Whereas John Farington coming this daye and declared that there is a pcell of swampie Land lyeing adjoyneing to his Land in purgatory playne by estemation conteyneing about 2 or 3 acres which is enclosed by his fence at prsent which he desire may be granted to him vpon the account of his right in that Land intended by the Town to be layed out in pprietie neere Med- field or in case that Land shall not be so layed out in pprietie that then he will stand engaged to satisfie the Towne for that swampe according as it shall be adjudged equall by any two or three indifferent men whensoeuer the Towne shall call for it

[109] Whereas the way betwixt Cambridg and Dedham is not yet so set- tled. nor discouered as is [ ] and to that end it may be p"pard to be ppounded to the next Countie Court at Boston for [Legall] determination. Lieft Fisher Ensi. Fisher. Tymo: Dwight and Nathaneell Coaleburne & Richard [Ellice] or any three of them. are deputed and requested to make a further discouery of the most conueanient place for that waye to be layed out and to attend such Friends of Cambridg as shall attend and asist therein. and to prsent the result of thier agreemt to the next Countie Court for Legall settlement and fitting for passage


Lieft Fisher is deputed and empowered to order the repayeration of the pounde and pcureing it to be done at the Townes charge. so as. one length of rayles more be put into each side thereof and the pounde to be of the same demension that it now is. and make it sufficient for height and strength. and make a new gate thereto. and all to be accomplished in the first fitt optun [ ] he is allso desired to cutt oake planke fitt to make a new payer of stocks

Vpon consideration of the seuerall voates of the Towne and the returnes of the Comittee referring to the layeing out the lande neere Meadfield. It is ordered that the said Comittee in the first optunitie with the asistance of Lieft Fisher and some one man more whome the sayd Comittee may chuse and pcure shall take the circomference of that Tract next Meadfield. accord- ing to the Towne order in that case pvided. and make thier returne to the select men together with what they vpon view of that Land obserue that may be considerable for further direction in the layeing it out in pticullar deuision


[110] In order to the accomplishmt and settling the case concerning the grant of the 8000 acres due to the Towne: the care trust and power whereof was left to the selectmen in prsent being. it is this day agreed to tender to Lieft Fisher as artist in that worke and as one of the Comittee for effecting the Layeing out the said grante in the place pposed to be about 12. or 14 miles more or lesse from Hadley 150 acres of Land. and Tenn shillings in countrey payemt for euery daye he shall measure and to each of the other 3 psons being of the psons formerly named 150 acres. and liberty is giuen them to laye these thier grants together by some one side or end of that tract indifferently takeing vpland and meadowe in pportion to the pportion of each sort of such Land in the whole tract

Vpon further consideration of effecting the layeing out of the 8000 Acres aboue mentioned Lieft Fisher declaring his disaceptance of wt was aboue tendered him in satisfaction for his paynes therein as artist. and his pemptory demaund being 300 acres. it is consented vnto pvided he allso drawe for the Towne a true and sufficient platt of that tract and Edw: Richards Antho: Fisher Junior. and Tymo: Dwight, accept of the payemt formerly tendered viz 150 achers to each of them. all to be layed out as is aboue exp'ssed. or in case Tymo. Dwight shall be any way hindered that he cannot attend that seruice. then he pmise to furnish Sergt Richard Ellice wth a horse fitt for that occasion. who accept thereof and pmise to vndertake the worke in stead of the said Tymothie and they pmise to vndertake the Journey for this end the daye after Election daye at Boston next ensueing or the second daye of the weeke next followeing the daye aforesaid at furthest allwayes pvided and to be vnderstood that Lieft Fisher as measurer. and each of the other men that shall goe wth him doe all asist help and carry one this worke to effect in thier respectiue places and trusts according to thier best skill and abillatie so as
