[141] Complaynt being made that by reason that in the first layeing out the Broade Meadowe the Riuer was accounted sufficient passage for haye from those pcels adjoyneing thereto. ther was no high way layed out thorough the Iland planting field nor haue hetherto yet beene layed out. by reason whereof passage is made thorough pprietie. it is therefore ordered that Lieft Fisher and Nathaneell Coleburne be and heereby are deputed to view the same and the Lands there about where a way may best be layed out or com- pound wth those ppriato's who are concerned in the land the way now passe thorough. and make returne to the select men. of what they doe heerein


Tho: Aldridg moue for liberty to enclose the high way wth two gates wch comes thorough the swampe betwixt thier dwelling house & thier barne. and engage to mayntayne that Cause way so long as they enjoy the way. in meane time to allowe comon vse for that for all passage the Town or. Inhab- itants shall need. this left to consideration


Granted vnto Elea: Lusher and to his heyers foreuer that tract of Land lyeing adjoyneing to the land lately layed out to Andrew Duein. which the said Andrew formerly purchased of Tymothie Dwight. as it lye adjoyneing to the east side thereof. to take so much land there as shall be judged fitt to laye out. this granted vpon account of his Naticke and 500 Acre deuident. for so farre as it extend towards the same and what this pcell shall be want- ing of the whole. is allso likewise granted. west of the second brooke beyond the sawe mill. to be layed out on the left hand of the way leading from the sawe Mill towards the great Ceader Swampe. the first grant is to be layed out by Lieft Fisher Joh. We whose names are heere vnder subscribed. being deputed by the select men to view and estimate one pcell of Land desired by John Pigge vpon the playne called the swampe playne. we accordingly haue viewed the

Land and doe judge that lande to be one Acre worth one Acre and an halfe of Natick deuident and we haue bounded as followeth it abutteth vpon the Land of the said John Pigge toward the south. vpon the high way towards the west and vpon the waste Lande East and North. onely we judge it neces- sary. that if this land be granted as we haue bounded it. that then the said John Pigg should be jnjoyned to make a sufficient waye next the north side of this his grante, leadeing from the high way into the woodes. which is on the East side of his ground

We being like wise deputed to view and estemate a pcell of Land desired by John Euered. the which accordingly we have done. and doe Judg that Land desired to be one Acre worth one Acre and halfe of Naticke deuident we haue bounded it as followeth. vpon the high way towards the west and vpon the way leading into the woods towards the south and vpon the waste Lande towards the East and North. but further we conceaue this pcell of Land will be a dammage to the Towne. because its a smale pcell. and yet will take neere 60 rodd of fence to enclose it


Granted to John Pigg and to his heyers foreuer. vpon the Account of Peter Woodwards Naticke deuident & by him purchased so much of that pcell bounded by the comittee as is aboue written. as is answerable to foure Acres. one third pt being discounted. pvided that John Pigg. make the carte way by them named sufficient. within 3 monthes after this pcell is measured and layed out to him by Lieft Fisher. Robt Fuller and Isaac Bullard. who are heereby deputed thereto. other wise this grante is nulle.

John Gaye. Robt Ware and Nathaneell Fisher being of the comittee apointed to take a further viewe of that place called Pawcompticke came this daye and made demande of payemt for that thier seruice, which is taken into consideration


Lieft Fisher Ensign Fisher Nathaneell Coaleburne and Sergt Fuller being allso of the same Comittee. and attended the same seruice. tender, that if they may be repayed that money they wer occasioned to expend in that seruice. they are willing to giue thier owne and thier horses laboure and time bestowed in that Journey aud seruice. pvided the rest of the said Comittee will doe the like

A bill is giuen to Daniell Ponde to receaue 26-158-for payemt for 4 wolues killed by John Magus. and 10$ for his worke done about Robert Onions Chimney and 58. Sergt Fuller was ouer rated in 66.

1 Whereas it is too aparent that great waste is made in the wood and timber in the Comon Lande of the Towne notwithstanding the known order to the contrary which is judged very prjudiciall at prsent but especially for the succeeding generations. which it concerne vs to consider


It is therfor put to the consideration of the Towne whether for the pruention they will thinke fitt to reuiue that order allready pvided for the prs- eruation of woode and Timber, and appoint and empower some men to put it in execution or laye out those woodelands neere the Towne that each man may p'serue his owne or else leaue all at liberty. and repeale that order that no transgression may be against it to occasion offence


2 That all psons that yet clayme land vpon the Account of the 500 Acre deuident or Naticke deuident: may be enjoyned to come to the select men now chosen within some conueanient prfixt time and make thier Right apeere that all such titles may be cleered and sattisfied. or that such as attend not that order shall forfiet thier rights. that so the Towne may bring those claymes to an end


[149] 3 That the Towne may consider that the time p"fixt by the Gen- erall Court for the planting a Towne at Pocompticke doe shorten: and it wer good to resolue what the Towne will doe in that respect and that if it be in- tended to empue it according to the grante. that then it might be put into some way conduceing therto

The select mens acts of the yeare past being reade nothing is objected


In consideration that the price of seuerall sorts of corne as now valued by the Generall Court is lower then in this Towne can be afforded to be payed vpon the account of sattisfieing Town debts vpon other occasions. It is ordered by generall consent that the Rates allready made shall be payed at the same prices of corne according to the prices set by the Court but all charges and debts that shall arise due from the Towne vpon any contract to be made after this daye shall be payed at those prizes that wer currant the last yeare for the Country Rate. and all Rates heereafter made shall be payed at the same prizes. any order or custom formerly to the contrary notwith- standing, voated in the negatiue


the question being put whether the order formerly made ordering all Town Rates to be payed at Countrey Rate price. should be repealed. it was voated in the negatiue

Daniell Ponde haue liberty granted to fell. and empue 8 or 9 Tunne of building timber for the vse of Lieft Cooke of Boston. puided he fell none within a mile of any house in the Towne


It is by voate agreed and ordered that the order entered entituled. fire- woode is heereby reviued and remayne in full force. and the men vnder written are deputed and empowered to se the full execution thereof, and it is further ordered that who so euer shall employe any psons that fell trees . disorderly shall be lyeable to paye the penaltie as fully as if it had beene done by thier own hands Robert Fuller Nathaneell Fisher Tho. Battely Joh. Farrington Joh Aldus Joh Bacon are chosen for the yeare ensueing


It is ordered that the 500 acre deuident shall be all layed out that is so much as is not allready layed out, all to be finished before the middle of may next. and it is further ordered that euery grantee to whome Land shall be so- layed out shall duely pay for the layeing out thier Lands vpon the pennaltie of forfieture of eighteen shillings to the vse of the Towne
