Vpon the complaynt of Samll Sheeres the bounde lines that concerne lotts of John Aldus John Farington. and that Lott which himselfe posesse by purchase. are not yet not certainly knowen whereby himselfe is hindered in fenceing and empuemt which is much to his damage: for the pruenting whereof. and the finall setling of the whole bound lines of all the aforesaid lotts Robert Ware Sergt Stearnes. and Sergt Ellice are deputed and em- powered. at the charge of the psons concerned. to repayer to Wollomonuppoag where the said Lotts lye. and being furnished with what records. are necessary for thier guideance in the case prmised and vpon the p"mises and in viewe. according to thier best vnderstanding and in corespondencie with thier re- spectiue grants. fully settle all those lynes. and cause them to be well marked out. by the asistance of the pties concerned. and all to be finished within the space of two monthes. except the said John Aldus John Farington and Samuell Sheeres shall be fore that time declare to the saide Comittee that they are agreed in the said. case

debate of an orderly pursueance thereof the consideration of the prsent state of the Towne in respect of publike charges. especially of that debt to Capt Pinchion it apeered doubtfull how the charge of such a building could now be defrayed. in case they should be engaged therein: but considering that ther is some remote Lands belonging to the Towne. not like to be vsefull to any man dwelling at home in the Towne or the prcincts there of. vizt. that Land that lye betwixt the sawe mill and Dorchester lyne. and so westward to the point betwixt that Line and the Ceader swampe: might by contract with any man of our Towne pcure and paye for the felling. crosse cutting hewe- ing saweing frameing and with conueanient help the rayseing of an house in the place afore said betwixt 40 and 50. foote longe. 18. or 20 foote wide. 13 foote betweene joynts. double floard. with windowes and all the building. suffcient for strength and conueaniencie as the case may be more at full be described. this semed at prsent worth the consideration. but not meet to con- clude without knoweing the minde of the Towne therein. and therefor its agreed that this pposition be ppounded to the Towne at the next meeting in march:
Chh Medow Ensign Fisher Sergt Fuller and John Gaye are deputed em- powered and desired to repayer to the meadow. called the Church meadow. neere Charles Riuer and take an aduised viewe thereof in respect of what measure of Fence is equally to be charged there vpon as allso what shruffe doe encumber the same and estemat what the cleereing of the meadow may amount vnto and value what yearely Rent may be equally demaunded for it. and to treat with Deacon Chickering about it tendering to him the first refusall thereof and to contract with him accord- ingly if he will giue as another man will doe. and to make a sure engagemt that the shruffe may be all cleered. vpon the account of the Rent of the meadow. and allso to dispose of all other pcels of meadowe belonging to the Church for the best advantage thereof

In consideration of the many complaynts of great waste of Timber in the Comon Lands of our Towne, which tends to prsent and future damage: for the puenting whereof it is by the Select men ordered and declared. that if any pson Inhabiting in this Towne or liueing out of Towne after the publica- tion heereof. without liberty first obteyned from the select men for the time being for any occasion to vse. or sell out of this Towne shall fell or cause to be felled. cutt empued. or carried away any oake Timber. being one foote or more. being vnder two foote at the stubbe wher it is felled shall forfiet five shillings. and for euery oake Timber piece. two foote or vpward at the stubbe. so felled. he shall forfiet eight shillings. the one halfe to the enformer and the other halfe to the select men. to be payed to them. or thier assignes for the vse of the Towne. the forfieturs to be leuied vpon the goods of the offender by the Constable. by warrant from the select men,

It being pposed to the Towne. whether they would part with that Tract of Lande that adjoyne to the Ceader swampe. and neere to the sawe mille or any other Lande. it was put to voate and the Voate was negatiue. in reference to the charge of building a house vpon the Church Lott;

3 Whether the select shall forbeare at prsent. and shall endeauour the next winter to puide workemen. and pmote the building with emproueing suiteable helpe of Inhabitants as farre as may be pfitable. and suiteable for the Towne, Voated in the affirmatiue,

Daniell Ponde coming to this meeteing declared that. before the pub- lication of the late order phibiting felling oake timber to sell or vse out of Towne he had felled about 8 Tunnes of Timber for building a house at Boston. but by reason of that order he doubted whether he might pceed to vse it as he intended. desired to purchase that Timber at equall price

Samuell Hinsdell of Hadley in the Countie of Hamphier haueing pur- chased some ppriety in Pocumptucke in the Land Granted and layed out to the Inhabitants of Dedham. and made empuemt by ploughing Lande there, came this daye to the select men. and gaue account of the reasons of his so doeing. and demaunded the layeing out of the Rights he had so purchased of one of the Inhabitants of Dedham. that he might settle himselfe vpon it and pceed in empuemt thereof for his owne supplye, or if it could not be yet layed out. that then some smale pcell of vpland might be granted and layed out to build an house vpon
To which we answer. that we see not cause to forbid him seing himselfe is content to beare the ventur of the place where he make empuemt. but it not being in our power to doe what he demaunde heerein. we thinke meet to doe what in vs lyes. to moue the ppriators to pmote. the layeing out each Inhabitants Right ther, and to that end that the Lotts may be prpared and drawen. that some better rule may be had for euery ppriator to knowe where about his owne Interrest lyes. and that in the first optunitie
