The persons aboue named being the comity a bout woolomonupack & the Select men; considering of the motion a bout payment of Capt Willit that haue ben obstructed in regard of diuers queries conserning woolomonu- pack doe judge it mett that the case should speedily com to a resolution that so the ingagment to Capt Willitt may be performed; and our owne futer peace to be setled and continued
[65] where vpon we agreed to propose to thos fiue men betrusted to act in refference of the case dependinge betwen the Towne & woolomonupack as followeth
1 whether thos that haue proposed to goe & are exsepted by the comity to woolomonupak haue a greed with any of the propriators a bout there whole- rights at woolomonupack: if with any then haue many
2 whether the number agreed with all: be sufficient incoragement to goe on with the plantation & may be likely to lay a foundation of peacable pro- seeding there: and continuing of peace heere
3 whether thay doe pay the mony rate for any of the propriators that still continue here; & for howe many:
4 what care is takin for thos that haue not subscribed at first or Last: that thay may haue there just right
5 whether all things considered as they are nowe surcomstanced that thay resolue to goe on to make it a plantation or not that is such a planta- tion as the Towne intended
Thay takin thes queries into consideration returned there answer as- followeth
To the first we say If you intend only that Land granted a plantation. we answere in the affermitive
To the second part of the first querie we say to the number of ten
To the Second querie we Answer in the negative
To the therd If we had due incoragement to goe on we will pay the the- mony for them agreed with: & all others we cane agree with
To the fourth all though we haue aduentered to make propositions in reference to a greement yet we are not in a capasity to giue them there just. rights

The persons subcribeing to the Answers of the former questions further propound as followeth
1 though by consideration of seuerall difficulties that seenee to prsent in this case we are discouraged at prsent as the case nowe stand yet we are not free or desirous to leaue the worke altogether but in case the Towne be pleased to direct vs and enable vs to proseed in a safe way: we are willing & ready to proceed
2 we haue bene at charges there in makinge some emprouments there & we beinge not well able to beare the losse of that without being in some measure disabled to beare thos burthens heere which we seeme to be called to beare desire the Towne would provid some waye to free vs from that Damage
we Answer to thes propositions first we conceaue the p"mises considered that difficulties indeed seeme to be much in your way at prsent & we suppose that yet some other way may be thought of to further a plantation there viz by layeing out to each propriator in Towne heere: his part proportionably in that 600 Acres for a plantation at first intended & so leaue each man to bar- gaine for hims [ ] [66] as he please wherein possibly some of your selues may be supplyed
2ly we judge payement for your emprouments ther should be allowed: that is if the same parcells emproued fall not to your selues: then those men to whome they shall fall be enjoyned to make you reasonable sattisfaction: .or compound some other equal way except the Towne allowe your selues · those parcells without Lott
vpon our retorne of thes answers there appearinge seuerall Woollom. The Grounds of callinge the mettinge beinge declared & none ob- jecting when it was put to them: but there was just ground to call the propriators to gether it was considered the queries put by the comity & .select men & the answers made by thos that prsented to goe to woolomonu- puck it was proposed as followeth ;
Itt beinge proposed to the ppriators in refference of the answer made by thos intended to goe to woollonupack to make it a plantation vpon the queries proposed by the comity & the select men : whether they do judge it exspedient for them further to pseed to make it a plantation or not in the way thay are & haue ben in all things considered as thay are nowe .. sorcomstanced
The voat beinge put to the ppriators whether thay could aduise them to pseed to make it a plantation : there was not any voted for it the contrary beinge put the generallity voted for the negitiue
The questan beinge put whether such charges as the persons accepted by the comity orderly exspended vpon breaking vp Land att woolomonu- pack shall be reasonably & equally sattisfyed voted affirmitiue
The questan to be resolued by the ppriators is as followeth
Whether it be the mind of the ppriators that there shall be 600 Acres of Land layd out at woolomonupack for a generall Deuident that so euery . ppriator may haue his pportion therein accordinge to the generall rull of deuision of Lands & the 600 acres to be layd out with as much conuenantie as may be with refference to a plantation if gods prouidence shall make way ther vnto: viz that the 600 acres shall be such Land as is so layd out for house Lotts & all highwayes officers Lotts buryall place trayneng grownd & all other Lands necessary to be reserued & vsed for all publique vse with- in the Seat of the Towne shall be over & aboue the 600 acres before men- tioned: as also all manner of wast Land the surcomference of this 600 acres to be takin before the last of this mº by the descretion of thes men heere- after named: Timoth Dwight John Furington: Henry Wight Nath: Fisher Joshua Fisher: this is past in the affermitiue by the generall consent of ppri- ators: Antho Fisher desent the vot aboue writen

Ralph Freeman made a motion to haue his lott that was formerly sett out to him of 12 acres at woolomonupuck & so not to draw any lott: which was consented vnto by the ppriators:
Daniell Mecia requested the propriators to giue him 8 acres of Land for a sittuation to setle vpon: some where on the out sid of the Sorcomference of the 600 acres which was granted by the propriators
Sergt Sternes moued for a smale parcell of Land adjoyning to his Lott part of it being brokin vp intending it for an orchard & which was granted by the ppriators
