vpon serious consideration and enquirey into the case depending be- twixt Nath Whiteing and Ezra Morse respecting the Creeke where vpon both mills are set the case apeere so cleere to vs that we hope if Nath: Whiteing and his friends or Atturneyes wer rightly enformed ther would be no need of further trouble either by action or Refference and whereas we heare its pbable that those Roxbery men are like to be in Towne the next 2 daye. we conceaue it may be expedient to make them truely acquainted with the trueth thereof expecting they will be of the same minde wth vs but if they concurre not we may then aduise what shall then be judged meete to be done

The Towne being mett and after debate of the case moued by Roxbery men in the behalfe of Nathaneell Whiteing. concerning referring the case late depending betwixt the said Nathaneell. and Ezra Morse. doe find that Ezra Morse aforesaid. being principally concerned thinke it not meet or safe for him to yield to referre the said case to refference except the Towne will secure him from damage thereby. which the Towne see not cause to doe. and so its left to a due course of Lawe. if the plaintiff will pceed


The Inhabitants declare by voate that they leaue the select men intrusted to defend thier Right. wherein so euer it may be needfull in the tryall of the case aboue mentioned. that is in respect of the Creeke where vpon the Milles in Town are standing and expect the said select men for the time being should be carefull therein

[153] Whereas there have beene some reports that some Lotts in the ponde playne are larger now then they wer layed out. and that there apeere to be some Lande within that fence that is not in ppriety to any man. that yet is fitt for empuemt. which is desired by Edward Richards vpon the account of Naticke deuident. to which end it is agreed betwixt the select men in the behalfe of the Towne and Edward Richards in behalfe of himselfe to chuse Lieft Fisher and Tymothie Dwight who are chosen and deputed to repayer · to the said playne and by measure to enforme themselues. whether there be any considerable errour as aforesaid. and what they shall finde of that nature materiall to rectifie that the posessors may haue what they posesse. but vpon some other account of Land yet due to them and to measure the waste Lande desired by Edward Richards and make returne to the select men

Joh: Gaye and Joh: Newton. in or very neere the place where a way was there formerly drawne and further they re- solue that if wth a moderat charge it may be fenced in and be an open drift way that will be most conueanient. but if not. that a leadeing way kept en- closed at each end wth gates or barres may be of competent vse there


Vpon the request of James Thorpe is granted to the said James (vpon the account of layeing downe so much as is equall in his deuident neere Meadfield) one smale pcell of hilley Land in the swampe being by estema- tion about 20 poles, as it is adjoyneing to other swampe formerly Granted. 10: 2: 64. to be layed out at the discretion of Pet: Woodward Sent and Tho: Metcalfe. and whereas the said James owe 3 acres in that deuident before to the Towne, it is now agreed that what he shall sell that his Lott neere Mead- field for. he shall paye to the select men. or to thier order for the Townes vse so much as 3 acres and 20 poles come to in pportion with the rest


The motion prsented and desired by Ensigne Fisher and Nath: Fisher entered the 24. 12 67. is now granted


Whereas ther is yet Land due to Edw: Richards vpon the Account of Naticke deuident and that he desire that he may haue it layed out to him in birch playne. so farre as fitt land yet vngranted may be there founde and equall in quantitie to what is yet due to him. this is granted. and to be layed out at the discretion of Lieft Fisher. Ensigne Fisher and Sergt Fuller. or two of them who are allso deputed to laye out all those grants in birch playne. not formerly puided for in this case


Samuell Fisher haueing acquainted seuerall Indians at wollomonuppucke with a letter sent to them from the select men which was to forbid them to pceed in breakeing up and fenceing in our Land there. and makeing waste of woode and timber returne answer that some of those Indians declared themselues to purpose to pceed. and to plant land there notwithstanding · that warning giuen them to forbeare and depart the place


Vpon the request of Josep: Kingsbery Sent. liberty is granted him to fell and empue so much Fenceing timber at Wollomonuppoag as he shall need to enclose the land he haue broken vp there pvided he make no waste of timber

John Gaye grant to the vse of the Towne a Cart waye space to crosse the whole breadth of his house Lott in that place where it is allready drawen. to be for the vse of the Towne foreuer. after the end of the third month. Anno 1669 which he vndertake fence when he shall se occasion to haue it fenced and not to put any charge vpon the Towne thereby. the waye is to be 2 rodd broade
