Vpon the Returne of the Comittee of: 6. 11: 70: being deputed and em- powered as in that deputation may apeere vpon consideration. and on satis- faction for a highway layed out by the said comittee thorough the Land of Peter Woodward Junr. being the same which was lately the house Lott of James Draper from the East Street to Nathaneell Whiteings mille. begining at the Corner of the said Lott next to Sergt Richard Ellice and so goeing along by that side past the orchyard thereby and then crosse that Lott Angular towards the mille aforesaid. this waye being layed out one halfe Rod in breadth to be free for the vse of the Towne for euer to be a foote way ppetually without interruption and for a horse waye the monthes of Decem- ber January and February. from time to time for euer, and if he shall Judge gates or barres needfull at any time. the said Peter his heyers and assignes are to make and mayntayne them. handsome and easie to open from time to time,

Gen meeting At a generall meeteing of the inhabitants. 3 of January [ In refference to the setting vp a Sawe Mille. it is left to [ men heereafter named. to agree. and conclude. on the Townes


In reference to


setting up a [ ] with such psons. as shall prsent themselues for the set- saw mill comttee ti [ ] a sawe mille. and to giue them such encouragmts. as the [ ] judge meete. these 3 men are chosen by the Towne. and if any of the three apeare to be pties. then the Elder is to be one of the three and the first three are: Sergt: Fisher: Nath: Coaleburne and Peter Woodward


Articles respecting the Sawe mille agreed. and concluded vpon. betwixt Proposals the Committee. deputed by Town order there vnto [ ] the agreed on in the one ptie and Lieft: Joshua Fisher. and Eleazer Lu [ ] who comttee prsented. to vndertake the building and manageing such a mille on the other ptie. as followeth. vizt


In prms: we the said Comitte. whose names are heere vnto subscribed in the name of the Towne of Dedham. and by the trust. and Article Ist power by T [ ] order to vs in this case giuen: giue. and grante Libertie vnto the said Eleazer. and Joshua. thier heyers. executors. Administrators and assignes joyntly. & seuerally. to builde. and erect a sawe mille vpon Naponcet Riuer or any pt thereof. wher they shall Judge most meete for the empve [ . ] the Timber. in the Ceader swampe allready granted. and to that end to take and make vse of. any Timber what so euer. as allso woode. stones or earth: as they shall haue occasion to make vse of. about building or [ ] or other wise. as shall apeare. necessary there vnto: all which they haue [ ] to take in any Comon Lande of the Towne. with the free vse of so much [ ] in all respects. about the said mille. as they shall occasionally vse for th [ ] worke and all these to haue. vse and enjoye. without disturbance or molestation. so long as them- selues. or thier heyers, or assignes shall maynt [ ] a sawe mille there. And further whereas. the charge of erecting the mille aforesd. is like to be greate. we the Comittee aforesd. doe for the encouragemt of the said vndertakers. and thier heyers. aforesd. grant all the timber. of all or any kinde. or sorte that shall be founde any where [ ] formerly granted. excepting allwayes. that Ceader timber. at the south [ ] of the great Ceader swampe. aforesd.
