Daniell Mackiah makes his motion. that whereas he haue purchased Thomas Jordans Right in the last deuident whose deuision being layed out at Naticke he desires the same may be layed out neere Medfield in a place he haue found out, wch is to be considered. it being ouer against Danll Morse his farme


this motion not consented vnto because the pcell desired is within the tract ordered by the Towne to be layd out in a Generall deuident


Deacon Henry Chickering likewise moue for supply of his deuident which was layed out at Naticke to be layed out neere his further pcell of meadow in Rocke meadowe to lye westerly from thence allso to haue allowe- ance in sattisfaction for some swampe he lost in that swampe taken by Cam- bridge

Deac : Nathan Aldus moues that whereas the Towne haue already taken for the supply of the Causie much grauell in his grounde to the prjudice of his orchyard he desires that a little pcell of swampie or course meadowe Land that lye adjoyneing to his sonns Lande nowe fenced in lyeing by the high waye east of the little Riuer may be granted to his sonne John Aldus.

the Select men being enformed that Joh Mackintosh haue felled timber to build him a barne on the Towne Comon wthout leaue did therevpon vnder thier hands forbid him and all other men to fetch the same away. vntill they had mett and taken further order therein. at this time he apeereing and con- fessed his offence therein. and aledged his ignorance of any Towne order forbiding such his takeing timber. and desireing liberty to vse that timber for the foresaid end. and to take some little quantitie more for that vse on the Towne Comon. that his request is granted

Serg' Nathaneell Stearnes maks his request that whereas he haueing purchased Land of mrs Stoughton which is not suitable to build vpon whereof he is willing to exchang 30 Acres wth the Towne. desires so much Land as shall be judged equall in value to that 30 acres. to be layed out and estemated by whome the Select men may depute there to. the land he desire is ad- joyneing to the Land mrs Stoughton did hold in Rent from the Towne the men deputed to value and set out this Land. and make returne to the Select- men are Pet. A request from Thomas Wight Senior of Medfield is prsented by Hen Wight his son to haue fencing timber for the Land purchased by him in this Towne. this to be considered


A bill is giuen to Eld' Hunting to receaue 18 6ª of the Constable for so much layed out by him for the purchase of a bell rope


Vpon notice receaued from the Select men of Roxbery appointing a time to runne the bounds betwixt thier Towne and ours. according to Lawe. are deputed to attend that worke the men heere vnder named Richard Euered, Sergt Willm Avery, Joh: Aldus


Vpon a request made formerly by Sergt Nathaneell Stearnes. that the Towne would exchange some Land wth him. he being willing to giue a con- siderable pt of the Land he bought of m" Stoughton for a lesse pcell of our Land fitt for him to builde a dwelling house vpon. Peter Woodward. Richard Euered and John Farington wer. 23 of March 63-4. deputed to viewe the Land mentioned and according to thier best discretion to act therein and make thier returne to the Select men. vpon whose returne being now prsented vnder thier hands we act as followeth


Granted to the sd Sergt Stearnes. and to his heyers for euer. one pcell of vpland conteyneing by esteemation Twelue Acres more or lesse as it lyeth Abutting vpon the Land formerly purchased of the Towne by mr Stoughton towards the southeast and vpon the Carte path leadeing from the south end of the East Streete towards that said Farme towards the southwest. and vpon the waste Land toward the north east. and northwest. and all this is granted as aboue is exprest. for. and in consideration of another Tract of Land. by the said Nathaneell fully and for euer granted to the Towne and to the onely vse and behoofe thereof conteyneing by esteemation Thirty Acres of vpland more or lesse as it lyeth betwene the Carte way afore said. and the Ragged playne being all the Land southwest of the the said waye that was some- times m' Stoughtons Land. comonly called the Range and reaching to the said Ragged playne. pvided that the grante and exchange of Land above written shall make no alteration. in refference to the due payemt of the Fourty shillings p ann due from m™ Stoughton to the Towne vpon former contract. which being payed. shall still discharge all Towne charges. for the aboue granted Twelue Acres.

In consideration of the prsent wante of a schoolemaster and of the weakly estate of or Br Joseph Ellice he being willing and we being hopefull. he may doe some good in teaching some children to read English. for prsent and vntill one more able may be attayned doe agree and order. that forth- with notice be giuen. that he shall begin to teach at the schoole house. the next 2 daye. and that he shall haue 68 p week. so long as he shall so teach. and that this shall be ppounded to the Towne the next Lectur daye that the minde of the Towne may be knowen therein

Wight of Meadfield Sen" had felled Fenceing Timber lately wthin that Tract of Land in our Towne wch was the last generall Towne meeteing granted to be layed out in pprietie and he haueing notice of this our prsent meeteing for the consideration thereof It is for the peaceable Settling of that case ordered and agreed be- twixt vs in the behalfe of the Towne and the ppriators. that may haue that Land in which the said Timber is felled That if the said Thomas Wight will engage and pmise in the behalfe of himselfe his heyers and assignes that whensoeuer that Land shall be layed out in pticular. that he will paye and sattisfie the ppriator of that pcell of Land when himselfe or his assignes haue felled timber as aforesaid for all damages occasioned by his or his assignes so felling Timber as aforesaid. and he vndertake for his sonne Samuell Wight as for himselfe in this case or in case this Land be not layed out in pticular. but shall be solde in the whole and vndeuided. that all damages ariseing from the. said felling Timber shall be duely sattisfied to whome so euer it shall apeere to be justly due. pvided. that in case the said Thomas. his heyers or assignes. and the said ppriator cannot then agree about the value of the damages aforesaide that then the price betwixt them shall be sett by such psons as shall then be indifferently and mutually chosen by the psons concerned. vnto all which aboue written agreemt The saide Thomas Wight declare his consent and engage accordingly. and therevpon he haue liberty to pceed to empue the Timber he haue allready felled for the fence as he exp'sse he intended


vpon a request made by James Thorpe for the grant of some swampe vpon exchange of other Lande Pet: Woodward and Richard Euered haueing beene deputed. to viewe the place by the said James desired. and to act ac- cording to thier discretions therein and to value wt quantitie of Land should be accounted equall sattisfaction to the Towne. the Comittee afore named now makeing thier returne vnder thier hands we act as followeth

Vpon a motion from in' James Mynot of Dorchester prsented by Pet: Woodward Senior. we doe Lett and assigne the vse of all that pcell of mead- owe belonging to the Towne of Dedham. lyeing by Dorchester mille vpon Naponcet Riuer vnto the said m' Mynot for this prsent yeare ensueing for the Rent of 28. 6d. and so from yeare to yeare vpon the same rent to be yearely payed in money to the Towne of Dedham. or thier assignes pvided the said m' Mynot carefully keepe the marks. bounds. and all pruelidges of waye to the meadowe aforesaid from losse or damage. vntill the select men of Dedham for that time being se cause otherwise to order

Whereas the grante made and layed out seuerall years since to Ensi: Francis Chickering vpon the playne called Swampe playne haue bene vpon the Townes occasion altered in its bounde Lines: it is therefore ordered that Lieft Fisher. with the asistance of Pet: Woodward Senior and Tymo. Dwight doe laye out the same againe so as the said grante be not prjudiced. at the charge of the Towne


Whereas ther was a grante of cutting grasse for the vse of the sawe mille made some years since. the men vndernamed are deputed to apointe
