day, not less than twenty nor more than thirty days after such assign- ment, for the creditors to meet at his office for the purpose of choosing an assignee.


The property is appraised and the assignee must give a bond in double the amount of appraisement.

Within six months after the assign- ment, the assignee shall appoint a day for the adjustment and allowance of claims, and shall give notice thereof to creditors by publication and also by letter if address is known. Such allowance shall continue three days unless continued for cause. Appeals can be taken from allowance by any creditor who is dissatisfied in the same manner as appeals from a Jus- tice's Court. Creditors who do not appear at such-time and present their claims, lose all right to participate in the trust fund. The assignor is re- leased to the amount actually paid.


Attachments .- Writ of attachment may issue for one of the following causes: 1. That the defendant is a foreign corporation or non-resident (but in this case only on demand aris- ing upon a contract, judgment or de- cree, unless the cause of action arose wholly within the limits of the state). 2. That he has absconded with intent to defraud creditors. 3. That he has left the county with intent to avoid service. 4. So conceals himself that summons cannot be served on him. 5. Is about to remove his property · from the jurisdiction of the court with intent to defraud. 6. It about to con- vert his property into money in order to place it beyond the reach of cred- itors. 7. Has property concealed.


8. Has assigned or disposed of, or is about to dispose of, property to de- fraud or delay his creditors. 9. That he fraudulently contracted the debt. 10. Where the damages sought to be recovered are for injuries resulting from the commission of a felony or misdemeanor, or the seduction of a female. Where the debtor failed to pay the price of any article delivered, when by the contract he was bound to pay for on delivery. . An affidavit must be filed stating the nature and amount of the claim, and that it is a just one, and also one of the above causes, and security must be given unless the defendant is a foreign cor-


poration or a non-resident. Where either the fifth, sixth, seventh or eighth of the above grounds exists the action may be brought and attachment made before the maturity of .the debt by special order of court. . Attachment may be dissolved by the defendant by giving bonds.


Chattel Mortgages. - Every chattel mortgage or conveyance intended to operate as such, which shall not be accompanied by an immediate deliv- ery, and followed by an actual and con- tinued change of possession of the thing mortgaged, shall be absolutely void as against the creditors of the mortgagor, and subsequent purchasers and mortgagees in good faith, unless the mortgage, or a true copy thereof, shall be forthwith filed in the office of Register Deeds of the county where the property is situated, or, if the mort- gagor be a resident of the State, then of the county of which he is a resident. And every such mortgage shall be void against creditors of the mortgagor, or subsequent purchasers or mortgagees in good faith, after the expiration of two years after the same is filed, un- less within thirty days next preceding the expiration of said term and each two years thereafter, the mortgagee, his agent, or attorney, shall make an affidavit exhibiting his interest in the property at that time and the amount yet due thereon, which affidavit shall be attached to and filed with such . mortgage. After condition broken, the mortgagee may proceed to sell the mortgaged property, or so much of it as may be necessary to satisfy the mortgage and costs of sale, by giving ten days' notice. If such an affidavit be made and filed before any purchase of such mortgaged property shall be made, or other mortgage deposited, or lien obtained thereon, in good faith, it shall be as valid to continue in effect such mortgage.as if the same had been made and filed within thirty days next preceding the expiration of the term of one year from the date of the filing of the original mortgage.


Deeds need not be executed before witnesses. Valid without acknowledg- ment, but must beacknowledged to be entitled to be recorded or to be intro- duced in evidence. Acknowledgment of wife need not be taken separate from husband. Until duly deposited for record, deeds and other instru-

Dower .- "The estates of dower and by courtesy are abolished."


Exemptions .- To unmarried person, tools and stock in trade, $400; or li- brary and implements of professional men. To head of family, household furniture, $500; also team, wagon, etc. Farming utensils, $300. Stock and tools of mechanics, $400. Libraries, etc., of professional men. Homestead, 160 acres farm land, or 1 acre in city, with improvements, without limit as to value.


Garnishment .- Earnings of resident debtor for personal services at any time .within three months next pre- ceding issuance of execution, attach- ment, or garnishment process, are ex- empt necessary to support =


of debtor's family, affidavit of debtor con- clusive as to necessity.


Homestead .- One hundred and sixty acres of farming land or one acre in an incorporated city, with all the im- provements thereon, while the same is occupied by the family of owner, can not be alienated except by joint con- sent of husband and wife. No exemp- tion is valid as against lien for pur- chase money or improvements erected ou homestead


Husband and Wife .-- Husband or wife under disability because of insan- ity or habitual drunkenness and having interests in real estate not in his or her own right, may by guardian jointly with the husband or wife of such party under disability convey or mortgage such real estate, except homestead, by approval of the Probate Court of the county where the land is situated.


Interest .- Legal rate, 6 per cent. By agreement in writing, 10 per cont. Usury: The party . forfeits double the sum in excess of 10 per cent.


Judgments .- Judgment is a lien on real estate in the county where it was rendered from the first day of term in which it was so rendered, and in other counties from the filing therein an attested copy of the judgment, and such lien continues for five years. Judgment by confession or those ren- dered at the term the action is con- menced are liens only from the date of entis. Unless execution is taken


out within five years from date of judgment, or five years from last exe- cution, the lien ceases as against the estate of the judgment debtor.


Justices' Jurisdiction .- For the re- covery of money when the amount claimed does not exceed $300. Jus- tices of the peace have jurisdiction of actions for the recovery of specific personal property, replevin, not ex- ceeding $300 in value. (See License.)


License .-- Commercial travelers are not required to procure a license.


Liens .- Any person furnishing labor or material, as contractor, sub-contrac- tor, artisan or day laborer, in the erec- tion of any improvements upon real es- tate, which are constructed under di- rection or by authority of the owner or his agent, shall have a lien therefor on the land so improved, which is pre- ferred to all other liens or incum- brances which may attach after the commencement of such improvements or the furnishings of such labor or ma- terials.


To secure such lien. the claimant must file a statement of his claim in the office of the clerk of the District Court of the county where the land is situated. If a contractor or material man, or laborer under a contractor, such statement must be filed within four months, and if a sub-contractor or a material man, or a laborer under a sub-contractor, within sixty days after the last material is furnished, or labor performed under such contract or sub- contract. Owner's liability cannot ex- ceed contract price.


Limitations .- Actions for recovery of land sold on execution, or by admin- istrators, etc., by order of court, five years; or for taxes, two years from the recording of the deed; other real actions, fifteen years; but persons un- der disabilities may bring action with- in two years after removal thereof. Contracts and agreements in writing, and actions on bonds of executors, etc., five years. Contracts not in writing, and statutory liabilities, other than penalties or forfeitures, three years. Trespass on real or personal property, replevin, relief from fraud and injuries to rights not herein enumerated, two years. Libel, slander, assault and bat- tery, malicious prosecution, false im- prisonment, penalties and forfeitures, one year. Time of debtor's absence

Fersons under disabilities may begin personal action within one year after removal thereof. Any person entitled to bring action for the recovery of real property who may be under a legal disability when the cause of ac- tion accrues may bring his action with- in two years after the disability is re- moved. After failure of an action for any cause not affecting the right of tion accrues may bring his action with- in one year. Acknowledgment of a debt barred must be in writing. As- signments and releases of mortgages recorded five years in the office of the Register of Deeds where the land is situated shall be deemed valid.


· Married Women .- Have same rights as nien concerning property and busi- ness.


Mortgages .- A mortgage of real es- tate, to be valid as against subsequent bona fide purchasers or mortgagees, must be duly acknowledged and re- corded in the office of the Register of Deeds of the county in which the land is situated. Mortgages are foreclosed by suit only. Attorney fee not col- lectable.


Proof of Claims. - Parties sending claims for collection should give full


name or names of parties to whom the same belongs. If the claims be- long to a firm, the full name of each member of the firm should be given, and whether a partnership or a corpo- ration, all claims should be verified, thus saving other proof, when no other defense is made.


Redemption.'-No redemption except of lands sold for taxes, then three years.


Stay of Execution. - In Justice's Court, on $20 to over $100, thirty to one hundred and twenty days.


Wills .- No man, while married, shall bequeath away from his wife more than one-half of his property, nor shall any woman, while married, bequeath away from her husband more than one- half of her property. But either may consent, in writing, executed in the presence of two witnesses, that the other may bequeath more than one- half of his or her property away from the one so consenting.


Witness .- Parties to the suit, and persons in interest not disqualified. Husband and wife cannot be witness for or against each other in civil ac- tion, except in cases where one acted as agent for the other, or where they are joint parties, and have a joint in- terest in the action.
