Said 13th said Trustees did then order that a man or two do go to Mantake forthwith and forbid the Indians from cut- ting or selling any corn stalks except for their own cattle, and did also then order that a man be sent, or do go on the mor- row after and do warn the wife of Robert Harris to depart out of this Town, and did adjourn their meeting to the 20th instant at 4 of the clock in the afternoon.
And did then order by general consent that the charge of John Shawes tending the general pasture and all other neces- sary charge relating to said pasture be levied within the abovesaid rate, and did adjourn to the 4th day of October 4 of the clock in afternoon.

Page 93 .- Then ordered by the Trustees of the Freehold- ers and Commonalty of the Town of Easthampton, that Capt. Conkling do go on the morrow and procure of the Indians that the cattle be received into their field as soon as may be, and also that he do inform the Indians that they may supply Mr. Abram Schellinx with what they can spare. swer to Simon Hilliar's request do permit that he do put his cow in the Indian field. And did then order that notice be set up in public that persons do with all care avoid firing the common woods as they would avoid the penalty prescribed in the act of Assembly on that respect, and did adjourn their meeting to the 5th day instant, 5 of the clock in the after- noon.
Who did then order that all the cattle from beyond Napeag highland be put into the Indian field on Friday next and that 14 men be appointed to do that work, and did order that the woman at Simon Hilliars belles Widow be warned to depart out of this Town and did adjourn their meeting to the 10th day of this instant at 5 of the clock in the afternoon.
Who did then order that the fence at the hither end be re- paired forthwith and that the sheep flock be driven to Man- tak on this week or the beginning of the next and kept on the hither side of Fort pond till farther order and did adjourn their meeting to the 25th of October 5 of the clock in the afternoon.
Said meeting then adjourned to the first of November 1709 at 5 of the clock in the afternoon, then ordered that there be 6 men sent on Wednesday next to move the cattle into the fatting pasture, the same was performed on Friday after, and Cornelios Miller released, and did adjourn their meeting to the 15th day instant at 4 of the clock in the afternoon.
October the 6th day it was then ordered by Wiandance Sachem, that 10 shillings of the interest money concerning Mantake be paid to Theofilos Willman 0 10 00

According to adjournment said Trustees did meet the 15th instant and did agree & order that Cornelios Miller be paid 2s 3d per day he endeavoring to keep the cattle beyond the Fort pond and that John Shaw be sent too to keep up the fence at the hither end and be allowed reasonable for his trouble. Aud that the shepherds be ordered to keep and tend the sheep between the hither end and the ditch but not in the fatting field, and did adjourn their meeting to the 22d instant at 4 of the clock in the afternoon.
Said Miller began said keeping the 14th.
According to adjournment said Trustees did meet and did then adjourn their meeting to the 29th instant at 5 of the clock at night, who did order that notice be set in public that the tending cattle at Mantak do cease the next second day being the 5th of December, and did then order the shepherds to be spoken to to tend the flock one week or ten days longer and they should be paid and did adjourn their meeting to the thirteenth of December 1709.
Who did then order that a warrant be procured to the Con- stable to bring Kedee before Capt Hobart to give reason for his going with family to Mantak. And that notice be sent to the Shepherds to bring all their flock home from Mantak before this present week be out and did then order that the Town order bearing date 1696 made to prevent sheep rang- ing on the Common without a keeper should be published for the reviving of the same, and did adjourn their meeting to the 20th day instant at 5 of the clock in the afternoon, said flock taken up the 16th instant, said order published the 17th the said Kedee subpoenaed the 14th instant.
Said 20th day then ordered by said Trustees that the here after mentioned charges be levied on each person interested in the fatting pasture at Mantak as near as may be in propor- tion according to what right he hath there, Viz.

Thompsons petition was presented by Benj'm Osborn, desir- ing releaf in order nourishing her bastard child. Said Trustees did then order said Osborn that he in the name of said Trustees make application to the civil power that there- by ted father be procured to perform his duty on that respect and did adjourn their meeting to the 10th of January at 4 of the clock in afternoon.
Page 91 .- According to adjournment said Trustees did meet January the 10th 1709-10. Then the aforesaid John Field did ask ten shillings per week for entertaining of said ame man for the time past. Said Trustees offered 6s 9d per

week and so ended there : but on consideration said man's condition called for relief said Trustees did order that said crippled man be entertained for future from house to house by the week at a more reasonable rate and to begin at Capt. Conkling's first, and did adjourn their meeting to the 24th inst. at 4 of the clock in the afternoon.
Who did then adjourn to the 7th day of February ensuing at 4 of the clock in the afternoon.
Book 4, page 91 .- February the 7th 1709-10 it was then ordered by the Trustees of the freeholders and Commonalty of the Town of Easthampton, that, from and after the date and publication hereof, whatsoever sheep shall be found at any time of the year pasturing upon any part of Mantak and not by order permission from said Trustees for the time being it shall and may be lawful for any person or persons (he or they being proprietors to any part of said land of Mantak) to impound the same and they being so pounded, not to be dis- charged therefrom but by the payment of four pence half pen- ny per head, always provided that notice be given to the own- er or owners within twelve hours after impounding the same. But in case said owners are not known, then proclamation with the beat of the drum within twelve hours shall be (?) right, after such impounding shall be counted effectual notice. And it is farther ordered by said Trustees that whosoever shall presume to (portion of leaf gone in original) and shall rescue any sheep from before any such person driving the same towards the pound, or shall break the pound for their rescue shall forfeit as a further penalty for each and every such offence the sum of forty shillings said fine or pen- alty shall be improved the one half to the use of the proprie- tors of said Mantak, and the other half to the use of the per- son or persons so driving said sheep or putting them in said pound,

The said Trustees do farther order that whatsoever sheep shall be impounded as abovesaid and no owner do appear within twelve hours after such notice be given as abovesaid and discharge them from pound by the payment of four pence half penny as aforesaid. it shall and may be lawfull to put so many of them to public sale as will answer for (and discharge) the whole not being discharged by owners appearing for their discharge and pay both the charge of sale, drum and procla- mation and whatsoever else needful for the more perfectly ef- fecting the premises returning the over plus, if any shall be unfo such person or persons as shal: appear to be the lawful owner or owners of said sheep before sold, and do further or- der that the above written articles be and remain in full force and authority according to the true intent and meaning there- of for the full space of one whole year from and after the date and publication hereof. Page 90 .- The before mentioned 14 said Trustees did or- der three men be sent to fetch those sheep off that are pastur- ing on Mantak on Friday next except their owners bring them off before and did adjourn their meeting to the 21st inst 5 of the clock in the afternoon.
Then discoursed Nath'll Hayes about tending the fence and bars at the far end and did adjourn their meeting to the 24th inst. 5 of the clock at night.
Then ordered that Jonathan Baker be spoken to for to take a hand with him and go to Mantak and get and fit as many posts as they can in one day for the water fence and did ad-

journ their meeting to the 2Sth inst. at 5 o'clock in the after -. noon.
Who did then agree with Sam'll Hedges to get posts to set further into the water at Mantake and did adjourn their meeting to the 7th of March 1709-10 at 5 o'clock in the after- noon.
Then agreed to employ John Shaw to tend the general con- cerns at the hither end of Mantake and that if Sam'll Hedges were not gone to get said fence or posts said Shaw should be sent too to get the same and what other fencing needful for the closing the hither end fence and to get the same carted and to keep an account of what cattle should be brought to Mantake till further order, and that he come to Town as soon as he can and did adjourn their meeting to the 14th inst. at 5 o'clock in the afternoon.
Then ordered that Mr Hunting's grant for his home lot should be confirmed by the Trustees of the Freeholders and Commonalty of the Town of Easthampton, and did order that Stephen Leek and Recompence Sherry be asked to keep the sheep, and did adjourn their meeting to the 17th instant at 4 o'clock in the afternoon.
Then ordered that seventy and six neat cattle be the quota or proportion to go on one whole share of right at Mantak and no more, or one horse kind in lieu of two said cattle, bulls or calves fallen within this year not counted, and agreed with Robert Parsons to go the first suitable opportunity to set up and repair the fence at Mantake hither end, and ordered that Thomas Barnes be asked to come to Town to keep sheep and did adjourn their meeting to the 21st of this instant at 5 o'clock in the afternoon.
Then ordered to discourse John Carle and John Miller about keeping the sheep and did adjourn their meeting to the 24th inst. at 5 o'clock in the afternoon.

keeping but could not agree, and with John Shaw about tending Mantake bars and could not with him agree, and did adjourn their meeting to the 2Sth instant at 5 o'clock in the afternoon.
And did then agree with John Carle and John Miller to tend each of them one flock of sheep such as the Trustees for the time being should appoint and so long till taken up by the Trustees order at seventeen pound each, and did then de- sire Robert Parsons to speak with Nath'll Hayes and Recom- pence Sherrill about tending the hither end bars, and did ad- journ their meeting to the 31st instant at 6 o'clock at night.
And did then order that whereas the money for folding the last year did not fully pay the shepherds the arrears thereby should be allowed out of this years' market unto the last years' shepherds or to those who have supplied them on that account.

Between Recompence Barne of Easthampton upon the Island of Nassaw in the Colony of New York in America, Weaver, of the one part and Isaac Barnes of the same place, Weaver, of the other part, Witnesseth, that the said Recom- pence Barnes for and in consideration of the sum of four pounds to him in hand paid, hath granted and sold unto the said Isaac Barnes and his heirs forever, Three acres and a quarter of land near Ameganset closes, butting against the land of James Diamond Southwestward, which is Recom- pence's part of that piece of land laid out by the Town and parted amongst the brethren.

December the 4th 1709. Then reported by said Mr John Mul- ford that he and said Osborne had measured to said Baker one acre and sixty poles of land flanking on the side of his meadow at Accabonac Springs as men go to the Fireplace the same being staked and marked to him.
