This Indenture made the tenth day of May 1733, between Jacob Schellinx of East- hampton &c., Yeoman, of the one part, and Lion Loper, Weaver, of the other part, Witnesseth that I the said Jacob Schellinx for and in consideration of the sum of five pounds and ten shillings to me in hand paid, have granted and sold unto the said Lion Loper and his heirs forever, one acre of commonage of all undivided land throughout this Town Westward of Meantauk, To have and to hold the same for- ever, and do warrant to defend, As witness my hand and

Book G, page 141 .- (Abstract) To all people to whom these presents shall come, Greeting, Know ye that I, Obadiah Osborne, of Easthampton &c., weaver, for divers good cause but especially for and in consideration of the sum of twenty pounds to me in hand paid by Josiah Osborne, of the same town, yeoman, has sold unto the said Josiah Osborne and to his heirs forever, my dwelling house and and all my land at Wainscot, given to me by my father Ephrain Osborn, be the same more or less. To have and to hold the same forever, and do warrant to defend.

Book E, page 11} .- The proprietors of Meantauk being warned and met together Febuary the 27th 1733-4 and did then agree by major vote that the committee have full power to agree with John Merry to keep the sheep flock at Mean- tauk for the term of five years from the date abovesaid ; And also agreed on by major vote to allow the said John Merry to clear and make use of twenty acres of land yearly and every year from the date abovesaid for the term and time of five years ; for and in consideration of the said John Merry his keeping the said sheep flock ; and to be ordered by the committee where the said John Merry shall clear and improve the land westward of the fort pond.
Book E, 92 .- The proprietors of Meantauk being warned and met together February the 27th 1733-4 and did then agree by major vote to leave the whole management of Meau- tauk for the term of one rear from the date above said to five men namely Capt. grazing on Meantauk for the time and term of one whole year from the date abovesaid not having right or not being duly listed or entered according to order of the committee abovesaid shall be and are liable to be impounded the owner or owners of all horse so impounded five shillings currant money for each horse kind so impounded.
On the day above said it was agreed on by major vote that it is and shall be lawfull to impound all neat cattle that shall be found grazing on Meantauk not having right for the time and term of one whole year from the date above said accord- ing as it shall be stinted ; the owners of all such cattle so im- pounded paying five shillings for each or every neat beast so impounded.
On the day above said it was so agreed on by major vote that it is and shall be lawfull to impound all swine that shall be found grazing on Meantauk for the the time and term of one year from the date above said the owners of all such swine so impounded paying three shillings current money for each swine so found and impounded.
On the day abovesaid said it was agreed by major vote that it is and shall be lawful to impound all sheep that shall be found grazing on Meantauk for the time and term of one whole year from the date above said not having right for the same according to the stint the owner or owners of all such sheep paying sixpence for each sheep so impounded or not being entered according to order of the committe abovesaid.
And the same penalties for impounding as above said each horse kind neat beast sheep or swine that shall be found graving in the fatting field or sheep pasture not having right for the same or without liberty from the committee abovesaid. And two shillings for impounding each weanedcalf out of the fatting field and the same penalty for impounding each neat beast or weaned calf not being duly entered according to the order of the committee above said.

Agreed on by majer vote on the day above said that the fence at the hither end of Meantauk to begin at common high water at the South Sea and so as to run across to the north side or round said fence to be three feet and ten inches high from the South Sea to the north side or Sound and to run into the North Sea or Sound until the water is three feet deep at the end of said fence shall be and is accounted a sufficient and lawful fence.
Agreed on by major vote that the fence that is near Clabord hill is to run from the cliff or bank on the south side to be 4 feet high from the said cliff across to the north sea or sound and to run into the said sea or sound until the water is two feet deep at the end of said fence shall be a lawful fence.
And also agreed on by major vote on the day aforesaid that the fatting field fence shall begin at common high water at the South Sea ond continue 4 feet high to the other end of the same until the water is 3 feet deep at the end of said fence the same to be a sufficient and lawful fence.
Also agreed on by major vote on ye day aforesaid that all small stone horses running or graziug on Meantauk having two winters over then are liable to be gelt after the twenty- fifth day of April after the date above said the owner or own- ers of such horses paying according to the act of assembly made for that intent.
Book E, page 10-Also it was agreed on by major vote on the day abovesaid that 4 weaned colors shall be equivalent to one neat beast in the common pasture on in the fatting field at Meantauk.

Also agreed on by major vote on the day above said that if any horse kind neat cattle sheep or swine be found grazing in the Indian field after the said field is shut up by the Indians until the fatting cattle be put into said field excepting the Indians own creatures not exceeding their liberty may be im- pounded the owners of all such horse kind or neat cattle paying five shillings for each horse kind or beast so impounded and three shillings for each swine and six pence for each sheep so impounded, such creatures shall be only excepted having liberty from the committee above said; And it was also agreed on by major vote on the day above said that the co.n- mitte may sue such as trespassers as have their creatures in or upon the said land as above said without right or liberty if not impounded.
Also agreed on by major vote on the day above said that if any horse kind legally impounded off of Meantauk at any time within the time of one year from above said and the owner or owners thereof cannot be found in forty-eight hours after being impounded according to said or no person will appear in that time and pay the poundage as above said that in such case all such horse kind so impounded may be sold at a public outcry and after the poundage and charge of sale be deducted the overplus to be returned to the owner if he can be found or if any person have notice given him or them of their horse or horse kind being impounded and will not appear and pay the poundage as above said in forty-eight hours after notice given him or them may be sold in manner as above said.
And it was agreed on by major vote on the day above said that what the major part of the committee above said shall do and act concerning Meantauk shall be deemed and esteemed as effectual as if the whole had done the same.

Also agreed on by major vote on the day above said that all horse kind that is found ranging or grazing in Meantauk after the twenty-fifth day of December next after the date above said until the tenth day of march next following shall be liable to be impounded the owners of all such horse kind pay- ing five shillings for each horse so impounded the stalions only excepted.
Also agreed on by major vote that eight sheep shall go on Meantauk in the room of one neat beast; and that 70 neat cattle to one whole share and one horse kind in the room of two neat cattle. Agreed on by major vote that the committee have full power (to agree with John Merry to keep the sheep at Montauk five years and to allow him the use of land for his so doing). The proprietors of Montauk being legally warned and met together February the 2Sth 1734-5 and did then agree by major vote to leave the whole managemeat of Meantauk for the term of one year from the date abovesaid to five men namely Elezer Miller John Davis Mr. Thomas Chatfield John Merry and Capt. Nathaniel Hunting or the major part of them.
Agreed on by Major vote on the day abovesaid that the committee above said or the major part of them have full power to part the fatting field at Meantauk and to eniarge the same as they see cause.
Agreed on by major vote that the community above said have full power to put a man at the hither end of Meantauk and a man at the fatting field for the time of one year from the date above said and no longer. On the day above said it was agreed on by major vote of the proprietors of Meantank that it is and shall be lawful to impound all neat cattle that shall be found grazing on Mean- tauk not having right; for the time of one whole year from the date abovesaid according as it is or shall be stinted the owner of all such cattle so impounded paying five shillings for every neat beast so impounted Indians cattle excepted they not exceeding their liberty in number.

Also ordered by major vote of the proprietors above said that the fence at the hither end of Meantauk to begin at common high water at the South Side or Sea and so to run across to the North Side or Sound said fence to be three feet and ten inches high from the South Sea to the North side or Sound and to run into the North Sea or Sound until the water is three feet deep at the end of said fence shall be and is accounted a sufficient and lawful fence.
Also agreed on by major vote of the proprietors above said that the fence that is near Clabord hill is to run from the clift or bank on the south side to be four feet high from the said clift across to the North Sea or Sound and to run into the sea or sound until the water is 2 feet deep at the end of said fence shall be a lawfull fence.
And also it was agreed on by major vote of the proprietors above said that the fatting field fence shall begin at high wat- er mark at the South Sea and continue four feet high at the other end of the same the same to be a sufficient and lawful fence.
And also it was agreed on by major vote of the proprietors of Meantauk February the 25th 1734-5 that all small stallions running or grazing on or at Meantauk having two winters passed over them are liable to be gelt by the 25th day of April after the date above said the owners of such horse or horses paying according to the act of Assembly made and provided for that intent.
Also it was agreed on by major vote of the proprietors above said that four weaned calves shall be equivalent to one neat

Also agreed on by major vote that the committee have full power or the major of them to hire a man to keep the sheep at Meantauk for the year ensuing.
And also that eight sheep shall go on Meantauk to pasture in the room of one neat, beast and also that seventy neat cattle shall be the number to pasture on one whole share on Meantauk ; and one horse kind in the room of two neat cattle. Agreed on by major vote that no sheep shall be put on Meantauk after the twentieth of August except put on horse right.
Agreed on by major vote that the committee have full pow- er to fence in a fatting field at Meantauk where they shall see cause.
Book E, page 9 .- At a town meeting held in Easthampton April the 2d 1734, were then chosen for trustees, constables and assessors, as followeth :
Daniel Osborne, Timothy Hudson, Daniel Miller, Joseph Conkling, Timothy Mulord, Thomas Mulford, Nathan Day- ton, Giddeon Hedges, John Hunting, Elisha Conkling, Ben- jamin Osborne.
Joseph Hix and Eliakim Conkling, was chosen constable
Mr. Thomas Chatfield and Capt. Matthias Burnet was chosen
assessors.
Samuel Dayton and John Hedges were chosen overseers of the poor.

April the 2d 1731. and also ordered by Major vote that Edward Jones, Jarnes Hand, Samuel Parsons Ju., Elias Mul- frod, Jeremih Mulford, Daniel Dayton, Henry Conkling, Elias Hand are impoured to put out the fire in our woods and to get men to assist them and be allowed reasonable wages for their time so spent.
And also agreed on by major vote on the day above said that a four rail fence three feet and six inches high in and about this town at all places within the stated commons shall be a sufficient fence, or a ditch or other fence as it shall be judged equivalent to the said four rail fence shall be also a good and sufficient fence and not otherwise and that Amaganset and Wainscot are included in the above said vote concerning fences.
Book A. 49} and 512-same-At a legal town meeting in Easthampton April the 2d 1734, it was then agreed on by major vote to exchange four acres and half of land with Na- thanial Dominy, the said land lying in Aylewife Brook Neck, he laying down the said land for the use of the proprietors of this town forever ; for and in consideration of the same the proprietors of this town did agree by major vote that the said Nathaniel Dominy shall take up the same quantity of of land joining to his land at three mile harbor, bounded eastwardly by the harbor and westwardly by common land, the said land was laid out by Nathaniel Baker Junior.

Commonalty of the Town of Easthampton being legally con- vened together December the 26th 1733, did then agree by major vote to exchange three acres of land with John Par- sons Junior, and on consideration of said Parsons laying down to the use of this Town commons forever, three acres of land lying at Acabonick path at a place called the long hollow.
The Trustees of this Town did on the 27th of said Decem- ber, laying out and stake three acres of land to the said Parsons, in Acabonick neck joining to his meadow, in consid- eration of his laying down and resigning up to and for the use of the proprietors of this Town the said three acres as abovesaid, forever. And whereas Beriah Dayton of this Town did at a general Town meeting April the 2d 1734, complain that the said Parsons taking up the said land would cause him to make and maintain a considerable quantity of fence more than he should have occasion to make if the said Parsons had not taken up the land as abovesaid; and for the ending of all differences between the said Dayton and Parsons in that mat- ter, they did both of them choose two men, namely, Capt. Matthias Burnet and Cornelius Conkling to go to the place and view the land with the conveniency and ill conveniency to each of them in respect of fencing, and the proprietors of this town did then agree and vote, none opposing it, that what the said Matthias Burnet and Cornelius Conkling shall do and act concerning the said land and fencing of the same, shall be good and effectual as if all the proprietors of the town had done the same, and on the 4th day of April last abovesaid Capt. Matthias Burnet and Cornelius Conkling went to the place abovesaid and did conclude and agree to leave out about three quarters of one acre of land that the Trustees had laid out to the said Parsons joining to the said Dayton's meadow across the bottom of the said neck, confirming the rest of the land joining to the said Parson's meadow and that land that was laid out to him by the Trustees, only on the

conditions that the said John Parsons his heirs and assigns do forever hereafter at all times set up and maintain two thirds parts of the fence in the partition line between the said Par- sons' and Dayton's land and meadow at that place, the said line of fence beginning at the place where the said Parsons' fence goeth across the said Dayton's hedge fence, and so down towards the meadow to a black oak tree by the fence, and from thence across the neck of land to the dividing line be- tween the said Parsons and Dayton's meadow and so to run in said line to John Conkling's fence or meadow, allowing the said Parsons to take up a narrow skirt of land by the path joining to his land in lieu of that land that was taken off from that land that was laid out to him at the bottom of the neck abovesaid.
The above written is a true record of what was done on that account and entered in this book by me.

The Trustees being met and convened together did agree by major vote for to hire out the Calf Pasture Lane and Little Plain Lane and Wenscot Lane or Beach Banks and on the 15th of April to the highest bidder at the Town House at 5 o'clock adjourned their meeting to the 15th of April, and did agree also at the same meeting that Nathaniel Baker should be the clerk for the Trustees.
