Book 4, page 119 .- Then at our election meeting it was unanimously agreed on and voted by the proprietors of this Town, none opposing it, that no person or persons within this Township shall cut down or destroy any green tree or trees on the Commons of this Town for the term and time of one whole year from the date abovesaid for firewood, on the penalty of paying five shillings for every tree so cut down, excepting for tanner's bark or fencing stuff or building tim- ber; the persons so cutting for bark, fencing or building timber, shall neglect or refuse to cut up and cart home all the bodies and limbs of said trees excepting the small brush on the tops of said trees, the persons so cutting for firewood or neglecting to cut up and cart home within the time afore said, shall pay to the Trustees of this Town for the use of the proprietors the sum of five shillings current money of this Colony for each tree.

Also that no person as abovesaid shall cut down nor get any half tree pails on the Commons for the term abovesaid on the penalty aforesaid for each tree so cut down all the afore- said sums to be recovered as in other cases of debt, excepting cutting small brush for hedging without or beyond the stated Commons.

Between John Hopin of the Town of East-Hampton &c., Yeoman, of the one part and Nathan Miller of the same place, Weaver, of the other part, Witnesseth that the said John Hopin for and in consideration of the sum of eighteen pounds to him paid, hath granted and sold to said Nathan Miller and his heirs forever, a certain piece of land containing eighteen acres be the same more or less lying near a place called the Springs, bounded South and Westward by the Town Com- mons ; to the North by the land of Enock Fithian, and to the East by the land of William Hedges, To have and to hold the same forever, and doth warrant to defend.

Book A, page 25 .- Know all men by these presents that I David Fithian of Easthampton in the County of Suffolk in the Province of New-York do by these presents make over and sell from me, my heirs and assigns forever unto John Evans, his heirs and assigns, to say, all my right in the half acre division, it being three quarters of one acre and ten pole of land. And I the said David Fithian do acknowledge to have received full satisfaction, and do acknowledge myself to be fully paid for the same as witness my hand and seal in Easthampton this 24th day of June 1714.

Loose Leaf 7, page 7, (Vote of April 4, 1710.)-Daniel Miller August the 6, 1714, entereth one acre of land which he bought of Ananias Conkling Jr. at or on the West side of the Fire-place beach on the sedge by the water side.

Loose Leaf, page C .- William Edwards entereth two pieces of meadow on the account of his right in the half acre division at Napeag, against the further end of his own meadow. Said meadow being salt grass bounded by sand- hills on all sides, provided no person hath entered the same already.

Wheler and Benjamin Osborn at Napeag to John Evans, containing three acres and three quarters and thirty rods it being in the half acre division, which the said Evans hath purchased of several persons of this Town, bounded to the Eastward by a cedar tree, and Westerly by a pine tree right over against the afore said tree, and by the Beach Bank or two pine trees to Southward, the said meadow lying near the Fresh ponds in or near the pines. The abovesaid is bounded as it was given in to me by the layers out. August the 10th, 1714.

And whereas my honored and well-beloved husband Jere- miah Conkling of Easthampton did by his last will and Tes- tament bearing date November the eighth one thousand seven hundred and three, give all the aforesaid lands and privileges to his and my sons and to their heirs and assigns forever, namely, Jeremiah, Cornelius, David, Lewis and Ananias, for the preventing of any trouble or contention that may arise hereafter about the premises in the giving the same as above -.

said ; Now Know ye that I, Mary Conkling widow and rel- ict of the said Jeremiah Conkling, do now by these presents ratify and confirm whatsoever my said husband hath done in the giving of the said lands by his last will and testament or by any other instrument in writing under his haud and seal, together with all exchanges of land with any person or per- sons whatsoever to be and remain in full force and power forever, as fully and amply to all intents and purposes as if I myself had done the same; and furthermore I the said Mary Conkling do give all my aforesaid sons quiet possession of the aforesaid lands with all the buildings erected on the same to have and to hold to them and to each of them and to each and every of their heirs and assigns forever according to my said husbands last will and testament bearing date as above- said. John Wheler of Easthampton, being part of a small division of land to be taken up about meadows lying near the Northwest harbor, bounded Northwest by a piece of land belonging to Edward Bennit ; Southward by the road to the aforesaid harbour, and Eastward by a swamp. Also one acre allotment of Commonage throughout the bounds of the aforesaid Town, Meantauket only excepted with all privileges &c., To have and to hold the same forever, and doth warrant to defend.

Book A, page 1 .- Whereas there was a rate made in East- hampton bearing date April the 6th 1686, for the paying the charges that did then arise in the defending of our titles to our lands, wherein several persons become debtors, and some persons creditors in said rate. And also whereas there was a rate made in Easthampton bearing date April the 30th, 1706, for the equallizing of the Common pasturing of this Town wherein several persons became debtors in said rate

and some other persons creditors in said rate ; And also whereas there was a rate made in Easthampton bearing date January the 6th 1703-4 for defraying and paying the charges arising in the defending of our rights and titles to our lands wherein several persons became debtors in said rate and other persons creditors in said rate, the said rates made by the Trustees' order as per the Trustees orders may more plainly appear. Now for the reconciling and ending of all differences that are or may arise about any of the said rates abovesaid, we the proprietors of this Town with other per- sons concerned in said rates being legally convened together February the 7th 1714-15 do now agree by major vote of all persons concerned in said rates both debtors and creditors to leave the whole matter as concerning the legality of said rates to be finally concluded and ended by three persons, namely, Capt. Theophilus Howell, Mr. Robert Norris and Alexander Wilmot all of Bridgehampton, and do by virtue of said vote oblige ourselves to sit down satisfied with what the said per- sons or any two of them shall do concerning the premises.
Voted on the day abovesaid that Capt. Samuel Mulford and Cornelius Conkling shall go to the aforesaid men and in- form them concerning the rates abovesaid.

EASTHAMPTON April 5th, 1715.
Book 4, page 54 .- Then at a legal Town meeting it was. agreed on by major vote of the proprietors of this Town, that each and every person shall set up and maintain his propor- tion of fence as it is now laid out and staked for the space and time of seven years from the date abovesaid, in the bound line between Southampton and this Town. And also that Joseph Stretton and James Hand are chosen to view the said line and to make return of all defects in said line to the Trustees for the time being.
And also that John Conkling and Henry Persons is ap- pointed to be fence viewers in and about this Town bounds.
Book 4, page 55 .- At a legal Town meeting April the 5th 1715 it was agreed and voted by major vote of the proprie- tors then assembled together that a two rail fence or a log fence equivalent shall be accounted a sufficient fence on the North side or elsewhere about the meadows, it being three feet and six inches high.
Book 4, page 78 .- At a legal Town meeting April the 5th 1715, It was then agreed on by major vote of the proprietors then met together, that the whole concerns of Meantauk con- cerning fencing or pasturing or any other thing for the bene- fit of the proprietors shall be wholly left to the discretion of the Trustees for the space of one whole year from the date abovesaid.
