Book A, page 24 .- Be it known unto all men by these presents that I Thomas Edwards of East Hampton in the County of Suffolk of the Province of New York, Yeoman , having laid open and turned out to the Town Common, to say four acres of land being part of my house lot in said

Town, said four acres being bounded South by my yard and garden and North by my own land, East and West by the Town highways, and do by these presents for my self, my heirs, executors and administrators fully, freely and absolutly quit-claim unto and wholly resign up unto the Trustees of the Freeholders and Commonalty of the Town of East Hampton as they are in behalf of the proprietors of said Township and to their successors forever, to say all that my whole right, title or interest in and unto the said four acres of land, wholly renouncing and disclaiming any right, title or interest in and unto the same or any part thereof for ever by virtue of any conveyance, deed, grant or record whatsoever, as witness my hand and seal set to this 25 day of April 1711.

Book A, page 24 .-- For and in consideration of the above resignation of the abovesaid four acres of land and renuncia- tion of the same, the Trustees of the Freeholders and Com- monalty of the Town of Easthampton, do by these presents grant unto the said Thomas Edwards, to say, about five acres of land out of the Town Common near a place called Little- worth on the right hand of the cart path as leads down to Accobonoc as it is butted and bounded now by its fence on all parts, he the said Thomas Edwards to have, hold, possess enjoy and improve the said five acres of land unto himself and to his heires and assigns forever.

sideration of the good affection I do bear unto David Conk- ling and Lewis Conkling both of said Easthampton, do fully, firmly and absolutely give and grant unto the said David Conkling and Lewis Conkling to choose, and have surveyed and laid out to each of them the quantity of two acres and three quarters and eight poles of land in said division, they and each of them to have and to hold each of the said two acres and three quarters and eight poles of land, to their sev- eral uses and to the several uses of each of their heirs and assigns for ever, as witness my hand and seal this 26th day of April 1711.

Loose Leaf 7, (Town vote of April 4, 1710.)-April the 30th 1711. Then Joseph Stretton chose for his right in said divi- sion to be near or joining to his meadow at Wegwagonuck.


May the 5th. Capt. Wheeler chose for his part in said division joining to the North end of Capt. Conklings Ame- ganset new close and to Benj. Osbornes Ameganset lot and so toward Accobonuck path.


Mrs. Ann Hobert chose on behalf of her orphan sons as part of their right in this aforesaid division on the Northwest side of their Northwest plain farther close joining thereto to- wards the North end, May the 10th 1711.

Book A, page 216 .- At a meeting of the Trustees of the Freeholders and Commonalty of this Town of East Hampton, bearing date December the 1Sth, 1711, it was then voted that the fence in the Lane between Thomas Mulford and Benjamin Stretton shall be maintained by Commonage according to al- lotment, that is according to each man's right in Commonage, Therefore now we the Trustees of this Town do order that every man that hath his part measured and staked out to each allotment on Benjamin Stretton's side of the Lane, that they forthwith take care and set up their part of fence as soon as the weather will admit of doing of it, and whosoever shall neglect or refuse to do their part of that fence according to their right in Commonage they shall be liable to pay all dam- ages that shall accrue to the abovesaid Benjamin Stretton by their neglect, by order of the Trustees.

Book A, page 1782 .- Whereas Stephen Leeke of East- hampton on Long Island in the Colony of New York, Weaver, his heirs and assigns (as heir apparent to his brother Ebene- zer Leeke, deceased, who put himself obliged to John Miller late of said Easthampton for the making and maintaining a certain part of fence in the Lane called the Widow Baker's Lane, as on record, page 179 more fully doth appear) doth acknowledge himself and them firmly obliged to perform his

Now be it known unto all men by these presents that I, Benjamin Stretton of said Easthampton for divers good causes me thereunto moving but more espescially for and in consid- eration of the sum of Three pounds current of New-York to me in hand paid by the said Stephen Leeke at and before the sealing hereof, do for my self and my heirs, executors, admin- istrators and assigns, acquit and discharge the said Stephen Leeke, his heirs and assigns from any further performance or obligation to the making and maintaining said fence, but do by these presents oblige myself, my heirs, executors, admin- istrators and assigns to make and maintain the said fence to the full performance of said Ebenezer Leeke's engagement in all respects according to said record as in page 179 for ever. For the true performance of all and singular abovesaid I have hereunto set my hand and fixed my seal this 30th day of Jan- uary 1711-12.

the Freeholders and Commonalty of the Town of Easthamp- ton being legally met together, it was agreed by major vote of said Trustees that there shall be a fence kept up and main- tained across the hither end of Meantauk from sea to sea shail be accounted a sufficient fence as it now standeth, and also that whatsoever horse kind or neat cattle shall be found with- in or Eastward of said fence at Mantauk, the owners of said horse kind or neat cattle so found on Meantauk having no lawful right or propriety such cattle or horse kind so found on Meantauk shall and may be liable to be impounded by men appointed by said Trustees on the penalty of eight shil- lings for each horse so impounded as aforesaid and for every neat beast so impounded as above said the sum of six shillings and that if any person shall presume to drive or lead any horse kind or neat cattle to Meantauk not giving an account on whose right said horse or neat cattle goeth on, the owners of such horses or neat cattle shall pay to the trustees the sum of six shillings for each horse or neat beast as above said and if any person or persons going to Meantauk or coming from Meantauk shall presume to leave down the bars at the Hither end of Meantauk he or they shall pay to the Trustees of this Town the sum of five shillings also it is ordered by the Trus- tees abovesaid that no person that is a proprietor in Mean- tauk shall take out or off from Meantauk any neat cattle and put on horse kind after the last day of July on the penalty of paying the sum of six shillings for every horse so found as abovesaid.


Also it was ordered by said Trustees that no person or persons belonging to this Town or elsewhere shall improve any land at Meantauk by plowing or planting or sowing or mowing or pasturing on the penalty of paying to the Trus- tees the sum of twenty shillings for the least quantity so im- proved as abovesaid, and for each and every acre so improved as abovesaid the sum of Thirty shillings as abovesaid.

It is also ordered by said Trustees that all persons con- cerned in said Meantauk shall enter all their horse kind that is on Meantauk into Simon Hilyards horse list made for that purpose on or before the tenth day of April next on penalty of paying eight shillings to such persons as shall be appointed by said Trustees for pounders of all and every such horse kind, to say eight shillings for each horse not entered as abovesaid, by order of the Trustees.

The Trustees of the Freeholders and Commonalty of the Town of Easthampton being legally convened together March the 23d 1711 and taking into consideration the great damage done to the proprietors of Meantauk by reason of persons putting in horses and neat cattle into the Indian field at Mantauk, and also several persons under pretence of plowing for the Indians and also under a pretence of carting corn for said Indians in the fall of the year to the great damage of said proprietors and also to the Indians, and for the prevent- ing of said damage it is ordered and appointed by the author- ity of said Trustees that it shall and may be lawful to im-

Loose Leaf No. 7, (Vote of April 4, 1710.)-John Miller April the 14, 1712 hath chosen his part of said division be- longing to his own lot in Acabonik Neck the whole breadth of his own meadow and John Stretton's meadow.


EASTHAMPTON April the 22d 1712.


Book 4, page 78 .- Then at a meeting of the Trustees of the Freeholders and Commonalty of the Town of Easthamp- ton it was ordered by major vote of said Trustees that all persons concerned in the fence on each side the land com- monly known by the name of Thomas Mulford's Lane, do within fourteen days after the date abovesaid, set the two first letters of each and every of their names on each end of their fence as it is now laid out according to each man's right in the Town commons or allotment to say a twenty acre allotment for twenty acres, and a thirteen acre allotment for thirteen acres and so in proportion for all other denomina- tions in said Town commons, on the penalty of paying three shillings current money of this Colony to the Trustees for the time being, for the use of the proprietors of said Town for each and every defect and neglect in not marking said fence as abovesaid.
