Whereas a petition, dated the fifteenth day of July A. D., 1904, by a majority of the directors of the Association for the formation of the Haverhill & Boford Street Railway Company, was filled with this Board on the 21 st day of July A. D., 1904, in substance praying that a location be granted said Railway Company lover certain streets and private lands in said Botford, for a double track street railway and authority to construct and operate a railway by electricity thereon; and


Whereas this Board ordered and directed that a public hearing be had on said petition on the 6th day of August, A. D., 1904, and it appearing that due notice to all interested parties was given in compliance with the provisions of law relating thereto, and especi- ally by the publication of a notice in the Haverhill Evening Gazette, a newspaper published in Haverhill, Massachusetts, on the 2 nd day of July A. D., 1904; and


Whereas in said appointed date of hearing the petitioners and others interested appeared before this Board, to wit on said 6 th day of August, A. D., 1904, at the time and place specified in said notice therefore and a hearing was there and there had on said petition; and Whereas after said hearing this Board voted that in their opinions public convenience and necessity required that in so far as set forth below said location should be granted nfrom the conditions, requirements and restrictions hereinafter set forth,


Therefore it is Ordered that a location, together with the right to operate a street railway system by the overhead thatly systemo so-called, whon said location and erect the necessary superstructure therefor, be and is hereby granted to the said Haverhill & Boxford Street Railway Company, its successors and assigns, subject to all obligations now imposed by law and also to the conditions, restrictions and obligations hereinafter set forth for a double track street railway, said location

line between Haverhill and Botford, to the last named point is six and 120 miles.


The word "Town" herein used shall be understood to refer to the town of Botford,"Company" to the Haverhill & Boyford Street Railway Company, and "Board" to Board of Selectmen of said Town &Botford.


The tracks of said railway shall be laid across said roads in the position indicated on a plan filed with the Town of Botford records, dated July 5th, 1904, drawn by G. M. Tompson, C. E., and at such grade at all street crossings as shall begiven by the Board when the construction of said tracks is commenced.


Said Company shall at its own expense work and grade the highways where said location passes across, so that when completed they shall be safe and convenient for travel hassing along said highways, and at such crossings suitable material such as the Board may approve of, shall be placed for a distance of eighteen inches outside of the outer rail of said tracks and between said rails and said tracks, and the street railway over said purate lands shall be constructed so that when completed it shall conform to the cross section shown on said plan.


Rails used shall be of the pattern known as Tee Rails, weighing not less than sixty pounds to the yard, and the roadbed of the railway is to be construe ted with at least eighteen inches of suitable ballast below base of rails.


Poles shall be of chestnut, and shall when set be of a height above ground of not less than thirty feet.


Ties to be of suitable timber not less than seven feet in length, six inches thick with six inch face, and spaced not more than two feet on centres."


The fare from the lines of said Company between any points in the Town of Boxford shall not exceed fire cents.


This grant shall be subject to all the rights of the Town of Boxford in the prosecution of any municipal work.

and to the building and operating an electric railway thereover, in, through, upon and over the private land above described, and the approval of said locations, over said private land is made by us because of the curves, grades and other natural, physical and engineering difficulties existing in the highway connecting the City of Haverhill and the southerly terminus of said railway in Botford, and to enable said curves, grades and physical difficulties to be overcome or avoided by using said private locations.


The location hereby granted may be revoked by the Board after ten days notice in writing delivered to any principal officer of the Company of the said Company shall not have its line within said Joun built by the first day of January 1906.

To The Board of Selectmen of the Town of Botford within the Commonwealth of Massachusetts.


Whereas Gom Honorable Board did by an order dated January 16, 1904, and amended byan order of your Brand dated December 21, 1904 grant to the Maplewood & Danvers Street Railway Company, a company in process oforganization under the provisions of Chapter 112 of the Revised Laws and all General Laws in addition thereto or amendment thereof a location for its tracks in certain public ways in said Town of Bofford with certain conditions and restrictions as contained therein and did approve the construction of the railway of said company upon ce tain private lands within said Town all as set forth in said order.


And Whereas the Board of Railroad Commission- ers of the Commonwealth of Massachusetts did upon the thirteenth day of February, 1905 certify that the location so granted to said company by said order of Your Honorable Board of January 16, 1704. only amended as a foresand is consistent with public interests, and did when the same day issue to said company authority to construct fils railway when the private lands described in said order of Your Board. Now Therefore the Maplewood + Danvers Street Railway Company toes hereby accept said locations subject to the conditions and restrictions set forth in said order as amended by your Honorable Board.

Voted: That the New England Telephone and Telegraph Company of Massachusetts It and it is herely authorized and permitted to erect and maintain poles and wins to be placed the war, together with such supporting and strengthening fixtures and wires as said Company may dem requisite, in the streets and highways of said town as hereinafter designated.


All construction under this permut shall be in accordance with the following specifications:
