Town Hall, Boxford, Massachusetts, August 10th, 1901. A special meeting of the citizens of the Town of Boxford, for the purpose of hearing and acting nhon a petition of the Essex County Street Railway Co. was called to order by the le hanman of the Board of Selectmen, Mh. I. C. Day who read the petition of said Company.
Mr .. . Maxwell, representing the Essex Street he Brok Railway Go, spoke briefly in favor of the petition. Mr. F. E. Gillis then presented to the Meeting a set of Resolutions, which he handed to the E kanman of the Meeting who read them as follows :-
Whereas we believe that a Street Railway Co. when asking for a franchise from a town should be willing to under a just equivalent by complying with the reasonable wishes of a majority of said town as to the location of their tracks and the winning of cars so as to benefit the town therefore Resolved That weare willing that the Selectmen grant a franchise to any Company who will guarantee to build and equipo within a reasonable time a Street Railway from Georgetown to Topsfield and Danvers on the streets of Boxford through Boxford village as formerly asked and granted to the He .. & D. Street Railway Cv. and also over the street from the line of North Andover to Ipswich line hat the B.V. M. R.R. Station in Boxford if desired.
Resolved that we do not believe that the proposed route from Georgetown to Jopefield hast Hood hond would be of any practical benefit to the Town of Burford and protest againstany franchise being given for that route.
Their adoption was then movedand seconded and carried unanimously, so far as expressed.

1901 Dr. F.J. Stevens, E. L. Bradford, and Rer. A. B. Peabody. Mr. Bradford set forth in an emphatic manner the fact that the Town of Boxford did not refuse the Essex Street Railway Company the privilege of passing through her streets, but only refused, in the resolutions adopted, the particular location asked for on Haverhill Street, so called. That the Town was only exercising her undoubted right to locate this, orany other, street railway where it would be of the greatest benefit to her citizens. That the Town of Boxford was entirely ready to grant the Essex Street Railway Company a franchise provided the track passed through the village, going north to Georgetown and south to Topfield.
These remarks were assented to iz several citizens and the meeting adjourned.

G. GD- Street Railway.
Resolved, That we do not believe the proposed route from Georgetown to Topsfield hast Lord's Fond would be of any particular benefit to the Town of Boxford, and we protest against any franchise being given for that route."
Accordingly we renew our refusal of the route for which you petition.

Petition of the Essex County Sheet Railway Company for a location in the town of Boxford.
The petition is founded upon Section 14. Chapter 578, Acts of 1898, which authorizes this Board to grant a location for the tracks of a street railway in certain cases where such loca- tion has been refused by the local board. The petitioner, in proceedings duly brought before the Selecmen of Bluford, asked ford location through that town to connect its railway in adjoining towns. The Selectmen refused too grant a location, for the reason that in their judgment the route of the railway through Boxford ought to be a different one, in order to accommodate the larger number of towns people. The question is whether the action of the Selectmen should be overruled, and the location which they refereed given to the petitioner.
It seems that a route somewhat less direct than the one proposed by the railway company would afford a convenient service to residents in One of the village centres of Boriford. It is true that other towns which this railroad serves have a just interest in a direct and short route. We believe, however, that in view of the fact that the accommodation of local travers does not
involve unreasonable cyl ense to the company or disproportionate inconvenience to other have, the needs of those persons who live along the route through Boxford outweigh consideration for quick Express service between other towns. rendered from place to place along the highways over which it hasses, even though it may inter- Here with the making of rapid time for through travel. As we think that a different route from that proposed by the petitioners would be better adapted to the circumstances of the case, it is Ordered, that the petition for the offeroval of the location refused by the Selectmen bedis - missed.

1901. Street Railway Conditions.
The conditions ofvon which the Selectmerouf Boxford St. Ry. Co. will allow the Essex County Street Railway Company to locate and put the overhead system in the town of Boxford are as follows :-
Ordered, that permission is hereby granted to the Essex County Street Railway Company to establish, Construct, maintain and use the overhead single trolley system of motive flower. so called, in the operation of its cars in und upon the following streets in the town of Burford to wil; Beginning at the Topfield town line between the town of Bonford and Jobsfield on what is known as the Topsfield Road, thence through the Popsfield Road on the westerly side to the village of Boxford, thence through the . Georgetown Road on the westerly side to the Georgetown town line between the towns of Balord and Georgetown.
A d to construct, maintain and use holes, wines and electric Appliances necessary for that kinddiese won the following conditions and not othervouse.
The foregoing location to be eight feet wide. Whenever the location shall encroach on the travelled part of the street, the said Company shall grade and put in suitable condition for travel a corresponding width on opposite sides of the above named streets, under the direction of the Selectmen, in any event to leave at least sixteen feet for travel unobstructed.
All changes, repairs, alterations or extensions of bridges and drains to be made at the ppense of said Company under the direction of the Selectmen. Wherever in the judgment of the Selectmen the public requires it, the said Company shall rail the highway adjoining its location. Whenever it shall become nices- sary or whenever said Company shall enter

upon or cross private lands, the right to so enter upon or cross such land shall be secured by said Company at its expense and without any liability to the town; and in case any fence or wall on land adjoining the highway shall be removed, the Company shall at once relay or rebuild said walk or felice in a manner satis- factory to the Selectmen.
Whenever snow is plowed from the tracks or thrown or placed on the highway or sidewalk the said Company shall at its own expense at once remove said snow or level the same under the direction of the Highway Surveyor or Road Commissioner, and in case it is not so removed or levelled by said Company whon notice from the said Surveyor or Com. missioner as the case may be , it is agreed that said Officials may remove or level the snow at the expense of said Company. In case the State Highway Commission shall decide to build a portion of highway within this location, the said Company shall at its own expense, at once conformo its grades and tracks to such change. "
The said Company shall maintain in proper condition the street between the rails to the width of eighteen inches on the outside of each vail.
In case said Company shall fail to keep the space between it's rails and for eighteen inches on either side in good condition as aforesaid, the same shall be warned in the Selectionen or proper town Officials and the expense of such refais shall be hard by the sand Company.
And in case there shall be any defect in any streets through which this location that extend in consequence of said Company's failure to keep said shace ins haw is

aforesard, the Company shall be responsible to said town therefor, and shall reimburse said town for all loss or damage sustained by it on account of said defect, subject however, to the provisions of the laws of the Commonwealth.
The rails used under this grant and whow this location shall be Trails not less than fifty six hounds to the yard, laid in conformity to the surface of street.
The poles to be saved and painted except in such portions of the location as the Selectmen may determine otherwise, and in all portions to be satisfactory to the Selectmen.
All box care used on this location shall be vestibuled. So much of said location that lies in the middle of the road shall be construc- ted of such materials as is now used on said streets.

Whenever said streets or any portion thereof shall be repaired or dig up for any purpose whatever to the extent of changing the grade thereof or not, the said Company shall take up and relay its tracks to conform to the new grade of said streets at its own expense subject to the approval of the Board of Selectment.
The said town of Boxford to be held harm less from any liability from accident or dam - ages arising out of o resulting from the construction or equipment of said Road.
All driveways and walks shall be graded under the direction of the Selectmen and at the expense of said Company.
All trimming of trees deemed necessary in building or maintaining the Railway shall be done under the direction of the Selectmen In case of five the Selectmen or five engineers may ent wires or remove holes of said Company, without any liability on

their past and the expense of refraining the same shall be borne by said Company.
The services shall include trips once an hour between six A. M. and tero P.M.
