The location of said way is in accordance with a plan and profile of the same as drawn by George Tyler, civil engineer, dated March 9, 1874,. and accepted and allowed by the Selectmen, and filed in the office of the Town Clerk the same day.
And the owners of the lands abutting on said way, and of the fee of the land over which said way is laid out, in consideration of the town laying out and making said way, agree to waive all claims for land and grade damages.
There being no structures, buildings, trees, walls, fences, or hedges standing upon the land taken for said way, the same can be entered upon at once by the town for the purpose of constructing the same, and the estimated cost of making said way with a curbstone and gravel sidewalk on one side will be $1930.00.
And said way so laid out, located, and described is hereby reported to the town for acceptance, and when so accepted, allowed, and recorded, is forever to be known as a public town way.
And we would recommend that said way be named and known as " Gorham avenue."

The Selectmen presented their report on laying out said way, which was considered, and after discussion it was -
Voted, To recommit the report on the laying out of said way to the Selectmen, to be printed and distributed among the inhabitants of the town.
Fifth Article taken up :
To see if the town will rescind the recent vote of the town instructing the Selectmen to pay two dollars per day for labor on the highways.
Voted, That the Fifth Article be indefinitely postponed.
Sixth Article taken up :
To see if the town will raise and appropriate money to pay claims or suits against the town, compromised or settled by the Selectmen, agree- ably to a vote of the town passed April twenty-seventh of the present year, and to pay fees of counsel employed by the town in such suits.
Voted, To lay the Sixth Article on the table.
Voted, To reconsider the vote passed under the Second Article, whereby it was voted that the sum of five thousand three hundred dollars be appropriated in addition to the sum already in the treasury, to pay the claims against the town authorized to be settled by the Selectmen.

Eighth Article taken up :
To see if the town will take action upon some plan to authorize the removal of sewage and other matter from vaults or cesspools, attached to or in connection with private residences and public buildings.

Voted, That the Selectmen be requested, as a Board of Health, to order the removal of the contents of any cesspool, vault, or privy within the town, whenever in their opinion the public health may require it.
Voted, That the Selectmen be authorized, as a Board of Health, to contract for the removal, as often as in their judg- ment may be necessary, of the contents of privies, vaults, and cesspools within the town; and that a place be desig- nated by the board at which citizens may give notice when their vaults, privies, or cesspools need cleaning, and that the expense of such cleaning be paid by the person making such application.
Ninth Article taken up :
To see if the town will authorize the Selectmen to purchase a lot of land on Clyde street for road material, not exceeding five acres, at a price not exceeding ten thousand dollars, and to raise and appropriate money therefor.
Voted, To indefinitely postpone the Ninth Article.
Tenth Article taken up :
To see if the town will authorize the Selectmen to sell the remainder of the schoolhouse lot on Brookline avenue.

Eleventh Article taken up :
To see if the town will act on the subject of grading Boylston street between Cypress street and land of E. S. Philbrick, and appropriate money therefor, upon petition of Isaac Taylor and others.

To see if the town will fix by vote or by-law the duties, qualifications, and compensation of any person or officer rendering service to the town, directly or indirectly, and receiving compensation therefor, on petition of John Conway and others.

By-law.
All boards, officers, or persons in the employ of the town, when en- gaging any person to render any service to the town, shall prefer persons who have the following qualifications to those who have not : -
First. To be a citizen of the United States.
Second. To have been a resident of Brookline and paid taxes therein for one year next preceding his employment.
Among persons having these qualifications, preference shall be given to citizens of long residence over citizens of recent residence ; to persons having large families to maintain over those who have small families or are unmarried.
Voted, That the provisions of the foregoing by-law be adopted for the regulation of all officers and persons named therein, until approved or disapproved by the Superior Court.
Thirteenth Article taken up :
To see if the town will instruct the Water Commissioners to lay water pipes in Warren street from Dudley street to Dudley street, and in Cot- tage street from Warren street to the town line, and raise and appro- priate therefor a sum not exceeding twelve thousand dollars, agreeably to provisions of Chapter 343 of Acts of 1872.
Voted, That the subject of the Thirteenth Article be re- ferred to the Water Commissioners, with instructions to report thereon at the next meeting, with a report of the streets in which they have ordered or intend to order the water pipes to be laid, and the length of pipes to be laid therein ; also the substance of all contracts which have been made, and all other matters of interest to the town concern- ing water supply.
Fourteenth Article taken up :
To see if the town will authorize the Selectmen to settle the claim of Mrs. Maloney for damages on Emerald street.
Voted, That the Selectmen be authorized to settle with Mrs. Maloney in an amount not exceeding two hundred and fifty dollars.
Twelfth article taken up, relating to vote or by-law fixing duties, qualifications, and compensation of persons rendering services to the town.
Voted, That the Moderator be appointed to present the by-law passed at this meeting to the Court for approval.

To raise and appropriate such sums as may be required for any or all of the foregoing articles.
Voted, That the Treasurer is hereby authorized to borrow the sum of sixty-one thousand six hundred and eighty dol- lars, giving the note or notes of the town therefor, counter- signed by the Selectmen, or so much thereof as may be necessary ; and that said sum is hereby appropriated for ex- penditures authorized under Articles Second, Third, Seventh, and Fourteenth, and for the purchase of land for a cemetery, and the improvements thereof, as follows ; to wit, -
Under Article Second, five thousand three hundred dollars.
Under Article Third, one thousand nine hundred thirty dollars.
Under Article Seventh, one thousand two hundred dollars. Under Article Fourteenth, two hundred and fifty dollars.

To either of the Constables of the Town of Brookline, GREETING :
In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the inhabitants of the town of Brookline, qualified to vote in elections, to meet at Town Hall in said town, on Tuesday, the thirtieth day of June current, at three of the clock in the afternoon, for the following purposes ; to wit, -
First. To choose a Moderator.
Second. To hear and act upon reports of town officers and commit- tees.
Third. To see if the town will accept and allow a new town way leading from Harvard street to Winchester street, as laid out and located by the Selectmen.
Fourth. To see if the town will raise and appropriate fifty thousand dollars to make Washington street, east from Park street, agreeably to the order of the County Commissioners.
Fifth. To see if the town will accept and allow a new town way lead- ing from Boylston street to Brighton street, as laid out and located by the Selectmen.
Sixth. To see if the town will authorize the Selectmen to purchase a quantity of land adjacent to the new reservoir, and lay out the same for public use.
Seventh. To see what action the town will take upon the subject of grading and improving the Brookline-avenue playgrounds, and enlarg- ing the same by buying land adjoining.
Eighth. To see if the town will discontinue the school heretofore maintained on Newton street, and known as the Newton-street school, upon request of the Board of School Committee, and if the town will establish a school in the new schoolhouse recently erected on Francis street.
Ninth. To see what action the town will take in reference to a notice from the County Commissioners of a petition from Moses Williams, Jr., and others, that a highway be laid out from Boylston street, near Reser- voir lane, to the boundary line between Brookline and Boston (late Newton).

Tenth. To see if the town will appropriate five thousand dollars to enable the Water Commissioners to lay service pipes from the street mains to the line of the streets.
Eleventh. To act upon the subject of laying water pipes in the streets. and instructing the Water Commissioners thereon, or upon any matter relating to the water supply, and appropriating any sum of money ex- ceeding one thousand dollars therefor.
Twelfth. To act upon the subject of locating anew and widening any highway in the town, and applying to the County Commissioners there- for.
Thirteenth.' To act upon by-laws, votes, or ordinances, already adopted, or to adopt any new by-law, vote, or ordinance which may be proposed.
Fourteenth. To give any instructions to any board, committee, officer, or servant of the town.
Fifteenth. To see what action the town will take in the suits of Charles L. Palmer and John Panter against the town.
Sixteenth. To raise and appropriate such sums of money as may be required for any or all of the foregoing articles.
Hereof fail not, and make due return of this warrant, with your doings thereon, to the Selectmen, four days at least be- fore the day of said meeting.

The Selectmen presented the following
REPORT.
The Selectmen of the town of Brookline, after giving legal notice to all persons and interests known to them of their intention to lay out as a town way a new town way leading from Harvard street to Winchester street, did, in pursuance of said notice, meet at their office in the Town Hall on Friday, the eighth day of May A.D. 1874, and proceeded to hear all parties and interests present and desiring to be heard in relation thereto ; and the owners of the lands abutting on said way, and of the fee of the land over which said way is laid out, in consideration of the town laying out and making said way, agree to waive all claims for land or grade damages. There being no structures, buildings, trees, walls, fences, or hedges standing upon the land taken for said way, the same may be entered upon at once by the town for the purpose of constructing the same, and the estimated cost of making said way will be about twelve hundred dollars.
Said way having been previously examined, they proceeded to lay out said way as follows, describing it by its centre line; to wit, -
Commencing at a stone post on the northerly boundary line of Win- chester street and eight hundred and thirty-nine and one tenth (839 1-10) feet westerly from the northwest corner of Beacon and Winchester streets, and running N. 35º 16' E. 681 72-100 to a stone post on the south- erly boundary line of Harvard street, taking equal widths of twenty (20) feet on each side of the above-described line.
The location of said way is in accordance with a plan and profile of the same as drawn by George Tyler, civil engineer, dated May 8, 1874, accepted and allowed by the Selectmen, and filed in the office of the Town Clerk the same day ; and said way as so laid out and located and described is hereby reported to the town for acceptance, and when so accepted, allowed, and recorded, is to be known as a public town way ;

tion of John C. Abbott and others for the laying out a street from Boyl- ston street, by the new reservoir of the Brookline Water Works, to Brigh- ton street.
Said petition was received June 15, and with it was filed a waiver of notice and a release from all claim of land taken and from any grade damages, signed by Messrs. Horace N. and John H. Fisher, and by Mrs. Mary B. Pierce, they being the only parties whose lands are to be taken for said street.
On the 18th we proceeded to view the premises and heard statements of all parties interested.
And at a meeting of our board holden this 22d of June we decided that the public convenience and necessity required the location of the street as prayed for.
And we voted to lay out a street according to a plan thereof made by Amos R. Binney, surveys dated June 8, 1874, which plan we have this day approved and adopted, and filed in the office of the Town Clerk.
Said street shall be fifty-six (56) feet wide throughout, that is, twenty- eight (28) feet on each side of the central line thereof, which central line is located as follows; viz., -
Commencing on the northerly line of Boylston street at a point 137 2-10 feet westerly from a monument at the point of junction of the land of Messrs. H. N. and J. H. Fisher with that of Mr. Henry Lee :
From said point running N. 1º 7' W. 132. ft. Then by a curve to left, of 138 feet radius 99.86 ft. Then by a curve to right, of 419.07 do 203.58 ft. Then running N. 14º 45' W. 1651.20 ft.
Then running N. 22º 12/ W. .
. 461.60 ft.
Then running S. 72° 45/ W. .
559.80 ft.
To Brighton street at a point on the easterly line thereof, 295.8 feet southerly from line of land of Nichols.
Whole length
3108.04 ft.
Voted, That our action in this matter be reported to the town, so that when by the town accepted and allowed, said street so laid out shall be- come a public town way of the town of Brookline.
And we request that an appropriation of $5100.00 be made for the mak- ing and grading of said street.

Voted, That each and every proposition for extending the pipes for the distribution of water in the town, except the ex- tension of the pipes in Warren, Cottage, and Washington streets, involving an expenditure exceeding one thousand dollars, shall be submitted to the Water Commissioners, in writing, before it is brought before the town for action, and it shall be the duty of the Commissioners to inform the town upon the merits of each proposition and the estimated cost thereof.
Voted, That the Water Commissioners be instructed to lay water pipes in Warren street from Dudley street to Dudley street, and in Cottage street from Warren street to the ex- tent of six hundred feet.
