ADJOURNED ANNUAL MEETING, APRIL 30, 1877.


Pursuant to adjournment, the inhabitants of the town of Brookline, qualified to vote in elections, met at the Town Hall in said town, on Monday, the thirtieth day of April in the year of our Lord one thousand eight hundred and sev- enty-seven, and were called to order at seven of the clock in the evening by the Moderator, William I. Bowditch.


The Moderator called the attention of the meeting to the proceedings of the meeting held by the citizens of the town on the sixth day of February, 1877, to endorse the action of Congress in appointing a commission to count the electoral vote, presented the records of said meeting, and moved that they be spread upon the records of the town.


Voted, That the proceedings of the citizens' meeting held on the sixth day of February, 1877, endorsing the action of Congress in appointing a commission to count the electoral vote, be spread upon the records of the town.


Mr. William I. Bowditch, chairman of the Selectmen, to whom was referred the matter of selecting one or more lots of land suitable for a schoolhouse on Walnut street or vicin- ity, and ascertain the prices at which they can be obtained, and report to the town at the adjourned, or some future meet- ing, reported that they had attended to the duty assigned them, and presented the following statements in relation to the several lots which had been offered for that purpose ; to wit, -


First. A lot of land on High street, running through to - streets, and having a right of passage on and over said streets; said lot being a part of the John S. Wright estate, and containing twenty thousand square feet, at about fifty cents per foot.


Second. A lot of land on Walnut street belonging to Miss Mary Irv- ing, containing about five thousand five hundred square feet, with a dwel- ling house thereon, for the sum of six thousand and five hundred dollars.


Third. A lot of land on Walnut street was offered by Mr. Lewis Per- rin, containing about twenty thousand four hundred square feet, for forty-five cents per foot.


Fourth. A lot of land on Cypress street belonging to Mr. C. E. Hale, containing about sixty-five thousand square feet, with a large two-story stone house on the same, at fifteen thousand dollars for the estate.

Fifth. A lot of land on Walnut street, High street, and Village lane, belonging to Mr. Charles A. Morss, and containing eleven thousand eight hundred and fifty square feet, for sixty cents per foot.


The Selectmen recommended the lot offered by Mr. Morss as being the most suitable place for a schoolhouse, in their opinion, of any of the lots offered.


Voted, That the report be accepted and the committee dis- charged.


After considerable discussion in relation to the subject of purchasing land and building a schoolhouse in the vicinity designated, it was, on motion of Hon. William Aspinwall, -


Voted, That the whole subject of the necessity of greater school accommodations, and the proposed site of a school- house, be referred to a committee of five, of which the chair- men of the Selectmen and the chairman of the School Com- mittee shall be members, and the three others shall be neither School Committeemen nor Selectmen, with instructions to give a public hearing upon the subject, and to report fully in print at or before the next town meeting.


Voted, That the three other members of the committee be appointed by the Moderator.


The Moderator appointed the following gentlemen as the three other members of said committee; to wit, William Aspinwall, John D. Runkle, Thomas Parsons.


The committee on the necessity of greater school accommo- dations and the site for a new schoolhouse, are as follows ; to wit, William I. Bowditch, chairman of the Selectmen ; William H. Lincoln, chairman of the School Committee ; William Aspinwall, John D. Runkle, Thomas Parsons.


The committee to whom was referred the petition of Mr. A. W. Goddard, for an abatement of taxes on his real estate, reported, -


That after a careful inquiry into the subject, they found that the land on which an abatement is asked for, was sold by Mr. Goddard, on which he received a portion of the purchase money and took a mortgage back to secure the balance. The mortgagor failing to comply with the terms of the mortgage, Mr. Goddard was obliged to take possession of said estate, on which the taxes had not been paid by the mortgagor. That Mr. Goddard made no seasonable application for an abatement of said taxes, and that no method appears to the committee in which the town itself can reduce the valuation or refund from the treasury the money

which has been paid for taxes on said estate. Nor do the committee find any error in law or in fact in the action of the Assessors; nor do they find now open in law any mode of relief from any hardship arising in the case from subsequent causes.


Voted, That the report be accepted and the committee dis- charged.


The committee to whom was referred so much of the Auditors' report as relates to the trust funds of the town, presented their report on that subject, which had been printed and distributed among the inhabitants.


Voted, That the report be accepted and the committee dis- charged.


The meeting then passed the following votes in relation to the matter of trust funds ; viz., -


Voted, That all trust funds of the town shall be invested in such securities as savings banks are by law allowed to in- vest in.


Voted, That the Warren Tree Fund shall be held by the Treasurer, the income from the same to be expended by the Selectmen, agreeably to terms of bequest.


Mr. Thomas Parsons made the following motion; to wit, -


That the Treasurer be authorized to issue the note of the town, signed by the Treasurer and countersigned by the Selectmen, for the sum of $2280.65, at five per cent. interest, payable annually ; said note to be held in the town treasury as security for the Edward Devotion School Fund, the interest to be raised annually by taxation, and to be appropriated towards defraying expenses of schools.


On motion of Rev. L. F. Beecher, it was -


Voted, That the subject of the Edward Devotion School Fund be referred to the committee on the new schoolhouse.


Mr. George Griggs offered the following motion; to wit, -


That the amount of the Edward Devotion School Fund, $2280.65, be raised by taxation the present year.


Voted, That the subject be referred to the committee on the new schoolhouse.


The following motion, offered by the committee, was then taken up; viz., -

That the income only of the funds held by the treasurer of the libra- ry trustees, shall be expended in the purchase of books and other articles for the benefit of the library, unless otherwise provided in the terms of the gift.


Voted, That the foregoing motion be laid on the table.


The report of the committee on so much of the Auditors' report as relates to the Fire Department, which had been printed and distributed among the inhabitants, was then pre- sented for the action of the meeting.


Voted, That the report be accepted.


The meeting then passed the following votes ; to wit, -


Voted, That the service of hose companies, and of hose attached to fire hydrants, be considered the main element of the fire service.


Voted, That the steam fire-engine be put out of commis- sion, but maintained in good order for service in an emer- gency.


Voted, That the engineer and driver be discharged from the special service for which they are now engaged, and that no special horses be kept for the special service of the steam fire- engine ; it being assumed that such arrangements can be made as will assure some of the horses belonging to the town being available to draw the engine to a fire when needed to sustain the hose companies ; such service as a reserve not calling for the very rapid work, either of men or horses, that is now as- sumed to be necessary.


Voted, That the Selectmen appoint one chief superintend- ent, who shall be qualified to operate the steam fire-engine, if it is needed, who shall give a large part or the whole of his time to attending to the hydrants, hose, telegraph, and other apparatus, and be responsible for all being kept in order ; such superintendent to be paid a reasonable compensation, to be fixed by the Selectmen.


Voted, That the Selectmen be authorized to appoint two or four assistant superintendents, and such hosemen, firemen, and hook-and-ladder men as in their judgment may be neces- sary, and fix their compensation at such rates as they may think warranted by the appropriation, keeping in view the need of having two or more men trained in the working of the

steam engine in an emergency, and selected with regard to their usual occupation, so as to be within easy call if that en- gine is needed.


Voted, That the committee be instructed to give such fur- ther consideration to the subject as in their judgment may be called for, and to submit to the town at a future meeting such further rules and regulations as may be required.


Voted, That the Selectmen be authorized to place a hose carriage at Longwood, if there is enough left of the appropri- ation for the Fire Department for that purpose.


The Committee on By-Laws requested further time, which was granted.


Voted, That the sum of three hundred dollars be appropri- ated for the purpose of trenching and grading the burial lot of Post 143, G.A.R., in Walnut Hills Cemetery.


Voted, That the Treasurer be authorized to borrow the sum of seventy-five thousand dollars, in anticipation of taxes, giving the note or notes of the town therefor, signed by the Treasurer, and countersigned by a majority at least of the Selectmen.


Voted, That the various appropriations made by the town, including those for making and repairing highways and town ways, less the amount in the treasury and the estimated re- ceipts for the current year, amounting to dollars, be assessed upon the polls and estates, real and personal, of the inhabitants, resident and non-resident, of the town, and collected as the town rates are usually charged and collected.


Voted, That the thanks of the town be given the Moderator for the excellent manner in which he has presided over the meeting.


Dissolved.

CITIZENS' MEETING, FEBRUARY 6, 1877.


PUBLIC MEETING OF THE CITIZENS OF BROOKLINE, MASS.,


IN RELATION TO THE APPOINTMENT BY CONGRESS OF THE COMMISSION TO COUNT THE ELECTORAL VOTE.


At the adjourned annual meeting of the inhabitants of the town of Brookline, held on Monday, the thirtieth day of April, 1877, it was -


Voted, That the proceedings of the citizens' meeting, held on the sixth day of February, 1877, endorsing the action of Congress in appointing a commission to count the electoral vote, be spread upon the records of the town. (See page 402).


The proceedings of said meeting were as follows ; to wit, -


" CALL.


" The undersigned, citizens of Brookline, believing that the passage of the bill for counting the electoral votes a signal proof of wisdom and fairness on the part of patriotic men of both parties in Congress, and that the patience with which the people of this country have endured these months of anxious suspense is a triumphant vindication of their capacity for self government, hereby invite all citizens of the town, without regard to their political preferences, to unite in cele- brating this glorious result of national wisdom, a fitting in- auguration of the second century of our independence ; and for that purpose to assemble in the upper Town Hall, at half- past seven o'clock on Tuesday evening, February 6, 1877."


In pursuance of the foregoing call, the citizens of the town of Brookline met at the Town Hall in said town, on Tuesday, the sixth day of February, 1877, and were called to order at eight of the clock in the evening by M. P. Kennard, Esq., who read the call for the meeting, and after a few well chosen remarks in relation thereto, announced the following gentle- men as officers for the meeting ; viz., -

The president, on taking the chair, expressed his thanks for the honor conferred upon him, and congratulated the citizens assembled upon the prospect of a peaceful and har- monious solution of the difficulties which had surrounded the recent election.


Col. Horace N. Fisher then presented the following resolu- tions, and moved their acceptance ; to wit, -


" Whereas, it is apparent that the framers of the Constitu- tion did not provide a specific remedy for complications growing out of a disputed election of presidential electors, but left it to the wisdom and experience of succeeding gen- erations to devise a suitable remedy when a need therefor should arise ; and -


" Whereas, certain general powers were delegated by the Constitution to Congress, namely, to make all laws which shall be necessary and proper for carrying into execution the fore- going powers and all other powers vested by this Constitu- tion in the government of the United States, or in any depart- ment or officer thereof ;


"Be it Resolved, as the conviction of the inhabitants of Brookline, in this public meeting assembled, without regard to their political preferences, that the plan adopted by Con- gress for counting the electoral vote is within the general powers thus delegated to that body, that its adoption by a two thirds vote of both houses is a signal proof of fairness and

wisdom on the part of their members ; we therefore rejoice that Congress has thus risen above party issues with a patri- otic spirit worthy of the emergency, and we hope that the result of this arbitration should be accepted as final, whatever that result may be.


" Resolved, that, recognizing the fact that an honest differ- ence of opinion does exist as to the constitutionality of this plan, we are convinced that as soon as may be after the inaug- uration of our next President, it would be eminently wise and proper for Congress to seriously consider this question as one which threatens the permanent prosperity and peace of the country, and to amend the Constitution so as to prevent the recurrence of a dangerous complication like the present.


" Resolved, that the president of this meeting be requested to transmit duly certified copies of these resolutions to the Representative of this Congressional District and to each of the Massachusetts Senators in Congress, and also to present these resolutions to the next town meeting, to the end that they may be entered upon the town records as the voice of the town."


The following gentlemen then addressed the meeting in support of the resolutions ; to wit, Hon. William Aspinwall, Col. Theodore Lyman, Gen. James S. Whitney, John W. Candler, Esq., Henry M. Whitney, Esq., and Col. Thomas H. Talbot.


The resolutions were then put upon their passage, and adopted by an unanimous vote.
