SEC. 83. No person shall beat or shake any carpets within one hun- dred feet of any public way or place, or within one hundred feet of any dwelling-house not his own, or in any places so that the dust from such carpets shall injure any person in any dwelling-house or upon any public way or place.
SEC. 84. No person shall bring into town any decayed or damaged grain, rice, coffee, fruit, potatoes, or other vegetable product, or any tainted or damaged meat or fish, without a permit therefor, from and in such a manner only as directed by the Board of Health.
SEC. 85. The Board of Health shall have charge of any buildings which are or may be established within the town limits, for the admis- sion of patients having the smallpox or any other infectious disease ; and they shall make such rules and regulations for the management and government of the patients and employés as they may deem proper and necessary. And the board shall carefully guard against the introduction of any cases of infectious disease into any other buildings under their charge than those appropriated for that purpose by the town.
SEC. 86. All notices issued by the Board of Health shall be served personally upon the owner or occupant, or their authorized agent, by any police officer or person competent to serve a notice in a civil suit, or it may be left at the owner's, or occupant's, or agent's last and usual place of abode, if the same be known and be within the State.

Article XIII. - Miscellaneous Provisions.
SEC. 87. Whoever posts, affixes, or in any way attaches any poster, handbill, notice, advertisement, or placard, or paints, draws, or stamps any letter, notice, figure, advertisement, or marks upon or into, or other- wise defaces any wall, fence, post, tree, building or structure, not his own, within the town of Brookline, without the permission of the owner of such wall, fence, post, tree, building, or structure, shall forfeit and pay for each offence a fine of not less than five nor more than twenty dollars, to be paid into the treasury of said town; and if such posters, handbills, notice, placard, letter, figure, advertisement, or marks be obscene or indecent, the penalty shall not be less than twenty dollars for each offence.
SEC. 88. Whoever shall swim or bathe in any of the waters within or surrounding the town, so as to expose himself to the view of any passen- ger or other person in any public way, railroad, or house within the town, shall forfeit and pay not less than five dollars, and not more than twenty dollars.
SEC. 89. No person shall fire or discharge any gun, fowling-piece, or firearm on or within two hundred feet of any street in the town of Brookline, or on any private grounds, except with the consent of the owner thereof; provided, however, that this by-law shall not apply to the use of such weapons at any military exercise or review, or in the lawful defence of the person, family, or property of any citizen.
SEC. 90. The Board of Selectmen may make, from time to time, such rules and regulations for the government, disposition, and management of the police as they may deem expedient.
Article XIV. - Prosecutions and Penalties.
SEC. 91. Prosecutions for offences under these by-laws may be made by any constable or police officer of the town.
SEC. 92. Any person who shall violate any provision of these by-laws. or who shall refuse or neglect to obey any order of the Board of Health duly issued under these by-laws, and directed to him and properly served upon him, shall, in cases not otherwise provided for, forfeit and pay for each offence a fine not exceeding twenty dollars.
Article XV. - Accounts of the Town Treasurer.
SEC. 93. The books of the Treasurer shall be kept in such manner and form as shall be prescribed by the Auditors; and they shall report to the Selectmen any failure to comply with their instructions.
SEC. 94. The Treasurer shall, on the first day of each quarter, notify all officers, boards, committees, and agents of the town, authorized to expend money or incur indebtedness on account of the town, of the balances of the appropriations against which they are authorized to draw, to the end that no debt shall be contracted in excess of such appro- priations.
Article XVI. - Carriage Stands.
SEC. 95. No person shall use any portion of any public way in this

town as a carriage stand for the solicitation of passengers for hire, with- out a license from the Selectmen.
SEC. 96. The Selectmen may grant licenses to use a certain portion of any public way as a carriage stand, under such terms and conditions as they may prescribe.
Article XVII. - Dealers in Junk.
SEC. 97. No person shall deal in junk within this town, or go from house to house purchasing or endeavoring to purchase junk, bottles, bones, or grease, without a license from the Selectmen.
Article XVIII. - Repeal.
SEC. 98. Upon the approval of the foregoing by-laws by the Superior Court, all by-laws heretofore existing, except the by-laws relating to the Public Library, shall be annulled and repealed.

In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the inhabitants of the town of Brookline, qualified to vote in elections, to meet at the Town Hall in said town, on Thursday, the sixth day of October next, at seven and one half of the clock in the even- ing, for the following purposes ; to wit, -

Fifth. To hear and act upon the reports of town officers and commit- tees.
Sixth. To raise and appropriate such sums of money as may be re- quired for any or all of the foregoing articles.

In pursuance of the within warrant, I have notified and warned the inhabitants of the town of Brookline, qualified to vote in elections, to meet at the time and place and for the purposes within named, by causing a printed copy of the same to be left at their last and usual place of abode; also by posting copies of the same in three or more public places, and published in the "Brookline Chronicle," a newspaper published in said town, four days at least before the said day of meeting.

In pursuance of the foregoing warrant, the inhabitants of the town of Brookline, qualified to vote in elections, met at the Town Hall in said town, on Thursday, the sixth day of October in the year of our Lord one thousand eight hundred and eighty-one, and were called to order at half-past seven of the clock in the evening by the Town Clerk, who read the warrant calling said meeting, and the return thereon of the officer who served the notices of the same upon the inhabitants.

Second Article taken up :

Voted, That the Water Board be authorized to lay a water main in Ackers avenue, and any private ways which connect therewith, provided Moses Williams, Jr., shall sign an agree- ment to pay the town five per cent. per annum for five years on the estimated cost of laying the same, less such amount as may be chargeable to water rates on said avenue and private ways, said payment to be made yearly in advance ; and that the appropriation asked for this purpose be paid from the moneys received from water rates.
Third Article taken up :
To see what action the town will take relative to the erection or pur- chase of an almshouse.
Voted, That the subject matter of the Third Article be re- ferred to the Overseers of the Poor, to report thereon at the next annual meeting.
Fourth Article taken up :
To see if the town will make a further appropriation for the construc- tion of sidewalks.
Voted, That the sum of one thousand dollars be added to the appropriation for sidewalks, to be taken from any unex- pended balances in the treasury.
Fifth Article taken up :
To hear and act upon the reports of any town officers or committees. Laid on the table. Dissolved.
