Pursuant to such notice, we met at the time and place appointed for the hearing; and all parties and interests which had appeared having been heard in relation thereto, and thence by adjournment to the 27th day of February, 1882, and the route of the street or way having been viewed and examined by us, after fully considering the subject, do ad- judge that it is necessary for the public convenience that a street or town way, called by us Sewall avenue, should be laid out and maintained by the town, as hereinafter described by its centre line; viz., -
Commencing at a point on the easterly side of St. Paul street, situated 319.48 feet northerly from the northerly side of Longwood avenue, and running N. 86º 59' 40" E. 392.00 feet.
Thence curving to the right with a radius of 1213.5 feet, 181.90 feet. Thence by a tangent S. 84º 24/ 20" E. 226.10 feet.
Thence curving to the left with a radius of 1315.60 feet, about 276.00 feet, to the westerly side of Kent street.
The above described line is the centre line of the avenue, the side lines of which are parallel with and twenty (20) feet distant from said centre line.
The location of said street or way is in accordance with a plan and profile of the same dated May 6, 1880, made by A. H. French, civil engi- neer, approved by us, and such plan and profile are adopted by us as a part of this record.
The Selectmen take the right to support said street or way by sloping the bank on the southerly side thereof on the adjoining lands of Charles A. Stearns and the heirs of Marshall Stearns; but this is not intended to affect or impair at all the right of any owner of such adjoining land to use such slope for building, or any other purpose or use whatsoever, inci- dent to the ownership of the fee in said slope, that will not impair the security of the roadbed.
We having estimated the damage sustained by the owners of land, rights, and interests caused by the laying out and construction of said street or way in manner aforesaid, whether by taking property, or by injuring property in any manner whatsoever; and do estimate and deter- mine the amount to be paid said parties as follows : -
We take from John K. Rogers 260 square feet of land on the southerly side of said street or way, and we award him as damages for the land thus taken the sum of one hundred and thirty ($130) dollars.
No other awards are made, all the other parties in interest, and the owners of the land abutting upon said street or way, and of the fee of

the land over which said street or way is laid out, in consideration of the town laying out the same, agreeing to waive all claims to land or grade damages.
There being no structures, buildings, trees, walls, fences, or hedges standing upon the land taken for said street or way, the same may be entered upon at once for the purpose of constructing the same, and the estimated cost of making said street or way is two hundred dollars.
And said street or way as so laid out, located, and described, is hereby reported to the town for acceptance, and when so accepted, allowed, and recorded, is to be known as a town way.
The said plan, profile, and this record have this day been filed by us in the Town Clerk's Office.

ter of the increase of the population of the town, and the demand upon it for more school room, and on his motion it was -
Voted, That the Boylston-street schoolhouse be enlarged by the addition of four school-rooms, and that the sum of twelve thousand dollars is hereby appropriated therefor.
Voted, That the Treasurer be authorized to borrow, under the direction of the Selectmen, one half the sum appropriated by the preceding vote in anticipation of the taxes of 1883, and the sum so borrowed is hereby made payable from said taxes.
Voted, That a building committee be appointed by the chair to carry out the vote for the enlargement of the Boyl- ston-street schoolhouse.
The Moderator appointed the following gentlemen to com- pose said committee ; to wit, Charles H. Drew, Cadwallader Curry, and William K. Melcher.
Voted, That the Selectmen and School Committee be a special committee to consider and report at a future meeting what provision it will be necessary or expedient for the town to make for additional school accommodations in consequence of appropriating the premises now occupied by the Ward school building to park purposes, and report in print.
On motion of Mr. Charles H. Drew, it was -
Voted, That the sum of ten thousand five hundred dollars ($10,500) be appropriated for the use of the Fire Department, and for purchasing a horse and chemical engine for Long- wood.
Mr. Charles H. Drew called the attention of the meeting to that portion of the report of the Overseers of the Poor in which they recommend the purchasing of land and the build- ing of an almshouse thereon.
On motion of Mr. Charles H. Drew, it was -
Voted, That the Overseers of the Poor be authorized to purchase a lot of land as a site for an almshouse, and to erect an almshouse thereon for the accommodation of the town's poor, and that the sum of ten thousand dollars be appropri- ated to purchase said land and erect said almshouse.

Adjourned Annual Meeting, March 20, 1882.
Voted, That the Treasurer be authorized to borrow the sum of ten thousand dollars for the purpose of purchasing a lot of land and erecting thereon an almshouse, giving the note or notes of the town therefor, signed by said Treas- urer and countersigned by the Selectmen, which note or notes shall be payable, one half from the taxes of the year 1882, and one half from the taxes of the year 1883, and the sum so borrowed is hereby made payable from said taxes.
Mr. Charles H. Drew presented the report of the Select- men on guide-posts and guide-boards, which was accepted.
Voted, That the sum of one thousand two hundred dollars be appropriated for purchasing three new watering carts.
Voted, That the Treasurer be authorized to borrow a sum not exceeding seventy-five thousand dollaas, in anticipation of taxes, at a rate not exceeding five per cent. per annum, giving the note or notes of the town therefor, signed by the Treasurer and countersigneed by the Selectmen, to be paid from the taxes to be raised the present year.
Voted, That the money appropriated by the town for the various purposes, including the appropriation for the purpose of making and repairing highways and town ways, be as- sessed, after deducting the balance in the treasury and the probable receipts for the ensuing year, amounting to dollars, upon the polls and estates, real and personal, of the inhabitants, resident and non-resident of the town, and col- lected as the town charges are usually assessed and collected.

BROOKLINE, Mass., April 3, 1882. IN BOARD OF SELECTMEN.
Upon the application of the American Rapid Telegraph Company, of Massachusetts, filed December 16, 1881, requesting the Selectmen to grant a location for the poles and wires of said company along the highways and public roads or streets of the town, and to specify where the poles and wires of said company shall be located and maintained, the kind and height of the poles, and the places where said poles and wires may be established :
Voted,' 'That the application of said company for a location of their telegraph poles and wires along the highways and public roads or streets' of the town, be granted as follows ; to wit, -
Beginning on Washington street, at the boundary line between Brook- line and Boston, formerly Brighton (and known as the Brighton District) ; thence southerly along said Washington street, to Beacon street ; thence across said Beacon street and along said Washington street, to a new way through the lands of the Aspinwall Land Company ; thence along said Washington street, to Cypress street ; thence diagonally across said Washington street, from the northeasterly corner of said Washington and Cypress streets to the southwesterly corner of said Washington street and School street, thirty-two poles; thence easterly along said School street, to Harvard street, six poles ; thence in the same direction, across said Harvard street, to the southwesterly corner of said Harvard street and Aspinwall avenue; thence along said avenue in the same di- rection, to the northwesterly corner of said Aspinwall avenue and Brook street, three poles ; thence turning and running in a southeasterly direc- tion along said Brook street, to a new town way called Kent street, twelve poles ; thence turning and running easterly along said Kent street, to Aspinwall avenue, two poles; thence turning and running southerly along said Aspinwall avenue, five poles; thence across said Aspinwall avenue, to the northerly side of Brookline avenue; thence along said Brookline avenue, to the boundary line between Brookline and Boston, in that part known as the Highlands (to their pole across the boundary line in Boston).
The said location to be in conformity with, and according to, a plan of the same as made by Messrs. Craft & Forbes, civil engineers, dated April 3, 1882, and deposited in the office of the Town Clerk of Brookline; and the locations of said poles are indicated on said plan by black and red dots.
All the poles are to be of chestnut, sound, straight, and not less than six inches in diameter at the upper or small end, and are to be kept paint- ed such color as the Selectmen may direct. The wires shall be placed on said poles not less than twenty-five feet from the ground, and to be guarded in such a manner that they shall not fall from the poles if they shall become detached from the insulator, at all places where they shall cross a street or way.
And said poles and wires shall be kept in good order and condition by said company, and to the approval and acceptance of the Surveyors of Highways through whose district said poles and wires shall be located ;

and that no trees be cut or trimmed by said company in the streets or ways through which said telegraph line may pass, except under the direc- tion of the Highway Surveyors in whose district said trees shall be ; also that said company shall agree not to remove the poles and wires as above located, without permission so to do by the Selectmen, and shall agree to remove said poles and wires, or any of them, whenever required so to do by the Board of Selectmen.
This license or specification is granted upon the condition that the agreement given to the town by the said American Rapid Telegraph Com- pany of Massachusetts, signed by J. W. Converse, president of said com- pany, dated April 3 A.D 1882, shall be faithfully kept and fulfilled by said company, and a failure or refusal of said company to keep their said agreement shall annul all authority herein granted or conceded to said company. GREETING :
In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the inhabitants of the town of Brookline, qualified to vote as the law directs, to meet at the Town Hall on Thursday, the twenty-second day of June current, at seven and one-half of the clock in the evening, for the following purposes ; to wit, -
First. To choose a Moderator.
Second. To see if the town will change the name of Second street to Williams street, on the petition of William 1. Bowditch and others.
Third. To see if the town library shall be opened on Sundays, on the petition of William I. Bowditch and others.
Fourth. To see if the town will allow the County of Norfolk to use the old Town Hall as a court room for the Brookline police court.
Fifth. To hear and act upon the reports of town officers and commit- tees.
Sixth. To see if the town will authorize the Selectmen to buy in be- half of the town from the heirs of John D. Cowan, deceased, for a gravel pit, the whole or part of a parcel of land, containing about 96,800 square feet, and adjoining the present gravel pit near Warren street.

Eighth. To see if the town will authorize the Water Board to lay a water main in a new street leading into the Cowan estate from Clyde street.

Tenth. To see if the town will accept and allow Gardner road as laid out by the Selectmen.
Eleventh. To see what action the town will take in relation to con- structing the new street leading from Grove street in Brookline to Allan- dale street in Boston, as laid out by the County Commissioners.
Twelfth. To see if the town will authorize the Selectmen to provide entertainments for the children on the fourth of July, on the petition of Edward I. Thomas.
Thirteenth. To see if the town will make an additional appropriation of one thousand dollars for the erection of additional lamp posts, and for lighting the same.
Fourteenth. To see if the town will accept and allow a new street in continuation of Toxteth street, as laid out by the Selectmen.
Fifteenth. To see if the town will authorize the Selectmen to construct the lateral sewers asked for by Charles O. Foster and others in Marion and Harvard streets, and by John J. Henry and others in Kent, Francis, and Toxteth streets, and to make the necessary appropriations therefor.
Sixteenth. To see if the town will authorize the Selectmen to construct any lateral sewers that may be deemed to be necessary, and to pay for the construction of the same from the receipts for sewer assessments.
Seventeenth. To see if the town will authorize the Selectmen to make regulations for the care and protection of the sewers.
Eighteenth. To see if the town will appropriate six hundred dollars for repairs on the Town Hall, in addition to the amount appropriated at the annual meeting.
Nineteenth. To raise and appropriate such sums of money as may be necessary for all or any of the purposes mentioned in the foregoing articles.
Hereof fail not, and make due return of this warrant to the Selectmen, with your doings thereon, four days at least before the day of said meeting.
Given under our hands at Brookline aforesaid, this fourteenth day of June, eighteen hundred and eighty-two.

In pursuance of the within warrant, I have notified and warned the inhabitants of the town of Brookline, qualified to vote in elections, to meet at the time and place and for the purposes within named, by caus- ing a printed copy of the same to be left at their last and usual place of abode; also by posting the same in three or more public places, and published in the " Brookline Chronicle," a newspaper published in said town, four days at least before the day of said meeting.

In pursuance of the foregoing warrant, the inhabitants of the town of Brookline, qualified to vote in elections, met in the Town Hall in said town, on Thursday, the twenty-second day of June in the year of our Lord eighteen hundred and eight-two, and were called to order at half-past seven of the clock in the evening by the Town Clerk, who read the war- rant calling said meeting, and the return thereon of the officer who served the notice of the same upon the inhabi- tants.

Voted, That the vote whereby the enlargement of the Boylston school was to be enlarged by the addition of four rooms be reconsidered, and that the subject be referred to the special committee, consisting of the Selectmen and the School Committee, appointed to consider and report upon further accommodations of the Ward school.
On motion of Mr. Oliver Whyte, of the Water Board, it was -
Voted, That the Water Board be authorized to extend the six-inch main now laid in Goddard avenue a distance of 350 feet at an estimated cost of $1275, provided the abutters.will pay to the town the sum of $367.50, and also agree to pay yearly in advance 5 per cent. per annum for 5 years, less the amount received from water-takers on said extension, on the sum of $637.50, that being the estimated net cost of the work to the town.
Voted, That the sum of $637.50 be appropriated for the above work, and the same be paid from water receipts now in the treasury.
Sixth Article taken up :
To see if the town will authorize the Selectmen to buy in behalf of the town from the heirs of John D. Cowan, deceased, for a gravel pit, the whole or part of a parcel of land containing about 96,800 square feet, and adjoining the present gravel pit near Warren street.
Voted, That the Sixth Article be referred to the Select- men, to report thereon at a future meeting.

The Selectmen presented the following report on the fore- going article ; to wit, --
The undersigned, Selectmen of Brookline, having given printed and written notices to Desmond Fitzgerald, B. F. Baker, John N. Chapman, estate of Nathaniel Harris, H. E. Abbott, estate of Sidney Andrews, Ellen C. Keaney, Thomas Howe, Morrill Frost, Charles E. Miles, Nathan- iel Lyford, Hannah W. Wilder, Charles H. Stearns, and heirs of Mar- shall Stearns (being all the parties known to us to be interested in the subject matter of the street or town way to be laid out), of our intention to lay out as a town way the private street called Vernon street, running from Harvard street to Park street, such notices requiring such persons to appear before us at the Town Hall, on Monday, the seventeenth day of April, 1882, at four o'clock in the afternoon, and having caused such notices to be actually served, according to law, upon all such persons by a constable of this town, at least seven days before the day so appointed for the hearing, and having given notice to them and all other persons (if any) who may be interested in the subject matter of said way, whose . names are not known to us, by posting up a copy of the printed and written notice in three public places in town, at least seven days before " the time appointed for the hearing :

Thence running south 74° 0' 0" east, 486.31 feet to the westerly side of Harvard street, taking a parallel width of 17} feet on each side of the centre line, and curving the southeasterly corner of Vernon street and Park street with a radius of 9 feet.
