Thence running a distance of about 268.2 feet to the north side of Brook street, above laid out by us. The street


thus laid out being everywhere 40 feet in width, and taking from land owned by William Aspinwall, about 9,847 sq. ft.


The location of all three of said streets is in accordance with a plan and profile of the same, dated June, 1878, made by Aspinwall & Lincoln, civil engineers, approved by us, and such plan and profile are adopted by us as part of this record.


The Selectmen also take the right to support each and all of said streets by sloping the banks on each side thereof on the adjoining land owned by said parties respectively, and for a short distance on land owned by George E. Stedman; but this is not intended to affect or im- pair at all the right of any owner of such adjoining land to use such slopes for building or any other purpose or use whatsoever incident to the ownership of the fee in said slopes, that will not impair the security of the road-beds.


We have estimated the damage sustained by the owners of land, rights, and interests, including water rights, caused by the laying out and con- struction of these three streets in inanner aforesaid, whether by taking property, diverting water, or by injuring property in any manner what- soever ; and also estimate and determine the amounts to be paid to said parties, respectively, as follows : -


The Right Rev. John J. Williams, Benjamin Hurd, Archibald E. McDonald, and George E. Stedman have waived all claims to damages.


We take from owners unknown to us about 440 square feet, and we award to such owners the sum of $5.


We take from Mrs. Solomon Burt 380 square feet of land in front of her barn, which land forms part of the private way laid out by McDonald,

and we also take the right to support the road-bed as aforesaid. It will be necessary to raise the barn about 6 feet in order to bring it on the level of Brook street, and we award her as damages for the land and rights thus taken the sum of $200.


We take from Joseph Lovett, as the grantee of Charles H. Union, 1,517 square feet of land, which forms part of the private way laid out by McDonald, and also the right to support the road-bed as aforesaid, and we award him as damages for the land and rights thus taken the sum of $75.


We take from Daniel Doane 8,705 square feet of land, and also the right to support the road-bed as aforesaid; and we award him as damages for the land and rights thus taken the sum of $870.


We take from Thomas Howe 5,001 square feet of land, and also the right to support the road-bed as aforesaid; and we award him as dam- ages for the land and rights thus taken the sum of $750.


We take from William Aspinwall eight parcels of land, containing, re- spectively, -

We thus take from William Aspinwall a total of

46,112 sq. ft. and also the right to support the road-bed as aforesaid; and we award to him, and he has agreed to receive in full for all claims for damages for the land and rights thus taken, the sum of $2700.


We take from the estate lately owned by the Emigrant Savings Bank, but now owned by William Aspinwall, four parcels of land, containing, respectively, 3,230, 11,302, 4,806, and 4,276 square feet, making a total of 23,614 square feet ; and also the right to support the road-bed as afore- said. And we award to him, as legal purchaser of this estate of the bank, and he has agreed to receive in full for all claim by said bank or himself, for damages for the land and rights thus taken, the sum of $1705.60, being, as we believe, no more than the value of the gravel on the estate late of said bank which will fall within the line of the loca- tion of Brook street, reckoning such value at $3.20 a square.


As additional motives for inducing the town to accept these streets, Mr. Aspinwall offers to give the town, without expense, a right to con- struct and maintain a covered sewer, not exceeding four feet in diameter, from Aspinwall avenue through his land immediately adjoining, and easterly of land of George E. Stedman, to the sewer to be built under Brook street; or, in lieu thereof, to obtain, and without expense to the town, a right to construct and maintain a similar sewer through the land of said Stedman opposite Toxteth street, the choice between these lines to be with Mr. Aspinwall; but no man-holes or catch-basins, or other

openings are to be constructed in said sewer on the private lands of either said Aspinwall or Stedman.


Mr. Aspinwall also offers to accept the awards of $799, made to the heirs or grantees of Thomas Aspinwall, for damages occasioned by the laying out of the main sewer to Charles river, and to withdraw his appli- cation to the County Commissioners for a jury to assess his damages, without costs against the town, although he is. of opinion that the con- struction of such sewer has damaged his estate at least $4000.


Mr. Aspinwall also offers to release the town from all claims for injury done to his property by heretofore using Aspinwall brook for drainage or sewerage purposes illegally and to his injury, as he claims the town has done.


Mr. Aspinwall also offers to release the town from all claims for injury done to his land by the illegal use of the dam and tide gate erected some years since across Muddy river at the Brookline avenue bridge, as he claims the town has done.


We do not admit that Mr. Aspinwall has any just claim against the town for the use of Aspinwall brook by private parties for sewerage purposes. Nor do we admit that he has any just claim for damages growing out of the use of the dam and tide gate; but, nevertheless, we think it an advantage to the town to have these claims abandoned.


Mr. Aspinwall proposes to give to the town certain rights, and also 69,726 square feet of land, for the sum of $4405.60. On a portion of this this land is a bank of gravel, worth in the market not less than $1705.60. We should probably have to pay more than that sum to place on the line of the road that amount of gravel. So that the town really gets from Mr. Aspinwall 69,726 square feet of land and certain other rights for $2700. We therefore, on behalf of the town, assume the payment of any betterment hereafter to be assessed on his estates for the laying out of these streets.


We also assume, on behalf of the town, the payment of any betterment hereafter to be assessed on the estates of Archibald E. McDonald and George E. Stedman, but expressly reserve the right to assess the estates of all other parties, according to law.


And we have given the owners of the lands through which said streets are laid out thirty days from the date of the acceptance of this report by the town in which to remove structures, buildings, walls, fences, hedges, or trees standing on said land.


And said streets, as so laid out, located, and described, are hereby re- ported to the town for acceptance; and when so accepted, allowed, and recorded, are to be known as town ways.


The said plan, profile, and this record have been this day filed by us in the Town Clerk's office.


We can build all three streets for $9,500 00

Voted, That the three streets laid out by the Selectmen, July 10, 1878, as thus reported by them to the town, be and the same are hereby accepted and allowed as town ways, and ordered to be recorded as laid out by them.


Voted, That the town will build all three of said streets, and also a 7-feet sewer under Brook street, thus laid out and accepted substantially as such sewer is described in J. Her- bert Shedd's letter, dated February 22, 1878, the letter being printed in the Selectmen's report on the articles in the warrant for the last annual meeting.


Voted, That the sum of $6305.60 is hereby appropriated and placed at the disposal of the Selectmen with which they may, in their discretion, pay the damages awarded by them to the owners of lands to be taken for the construction of said three streets, said sum to be paid out of any unexpended or unappropriated balances in the treasury.


Third Article taken up :


To see if the town will make an appropriation to pay for engineering services about the lateral sewers reported at the last annual meeting, the drainage of the districts along Aspinwall brook, School street, Thayer place, White place, and the corner of Cypress street and Walnut street, and for making book of plans to show all the entrances into the sewer, and for surveys for the proposed street by the new station.


Voted, That the sum of $2500, or so mueh thereof as may be necessary, is hereby appropriated, and placed at the dis- posal of the Selectmen, with which to pay for engineering services referred to in this article, said sum to be paid out

of any unexpended or unappropriated balances in the treas- ury.


Voted, If the Selectmen shall find it to be either necessary or expedient, they are hereby authorized to borrow either or any of the sums of money appropriated at this meeting, in such sum or sums, and at such rate of interest not exceeding five per centum per annum, as they shall deem expedient ; and the Treasurer is hereby directed to sign all such notes in behalf of the town whenever the same shall have been so approved by the Selectmen ; but all sums so borrowed shall be in terms borrowed in anticipation of the taxes for next year, and all sums thus borrowed are hereby expressly de- clared to be made payable from the taxes to be assessed next year. The interest which shall accrue on such notes (if any) before the next annual meeting shall be paid out of any un- expended or unappropriated balances in the treasury.


Fourth Article taken up :


To see if the town will authorize the city of Boston to use our main sewer and the lateral sewer in Brookline avenue and Washington street, and define the terms.


Voted, That the Selectmen be and they hereby are author- ized to allow the city of Boston to use our main sewer and the lateral sewer in Brookline avenue and Washington street, upon such terms as may seem to them reasonable. But such agreement shall not be binding on the town unless actually reported to and approved by the town.


Voted, To adjourn.
