The meeting was then called to order by the Moderator, and prayer was offered by the Rev. Leonard K. Storrs.


Col. Thomas H. Talbot moved that the Second and Third Articles be taken up together ; to wit, -


Second. To see if the town will choose two women as Overseers of the Poor.


Third. To choose the usual town officers for the ensuing year.


Voted, That the Second and Third Articles be taken up together.

On motion of Col. Thomas H. Talbot, it was -


Voted, That the meeting now proceed to the election by ballot, on one ticket, of the following town officers for the ensuing year, and for such longer period as is hereinafter specified ; viz., -


A Town Clerk, who shall be Clerk of the Selectmen, Over- seers of the Poor, and Board of Health ; a Treasurer and Col- lector, five Selectmen, who shall be Surveyors of Highways and a Board of Health ; seven Overseers of the Poor, two of of whom shall be women ; three Assessors, three members of the School Committee for three years, one member of the School Committee for two years (to fill a vacancy ), four Trus- tees of the Public Library for three years, two Trustees of Walnut Hills Cemetery for three years, one Commissioner of the Sinking Fund for three years, one member of the Water Board for three years, twelve Constables, two Fence View- ers, three Auditors.


Voted, That the polls be opened and kept open until ten minutes past five of the clock in the afternoon.

Voted, That the Moderator be authorized to appoint two or more persons to assist in sorting and counting the votes.


The Moderator appointed the following gentlemen to assist in sorting and counting the votes ; viz., Col. Thomas H. Tal- bot, George Brooks, William B. Sears, and Joshua Crane.


The polls were then declared open for the reception of votes for the various officers before specified, and were kept open until ten minutes past five of the clock in the afternoon, when, after giving notice that they were about to be closed, so that any voters present who had not voted could have an op- portunity so to do if they desired, they were declared closed.


The Moderator and Town Clerk then proceeded to help sort and count the votes so given in, and the whole number so given in was six hundred and sixty-four, and the follow- ing persons, having a large plurality of the votes cast, were declared elected to the several offices ; to wit, -

To see what action the town will take in reference to uniting with Boston in making a new channel for Muddy river, so that the river may be kept free from sewage as far as possible.


Voted, That William Aspinwall, John W. Candler, Charles U. Cotting, Francis W. Lawrence, and Robert Amory be a committee with authority to negotiate with the city of Boston in reference to constructing a new channel for Muddy river from near Pond avenue to Charles river, so that the same may be kept free from sewage, such nego- tiation to be subject to ratification by the town.


Voted, To adjourn, to meet in this place on Monday, the first day of April next, at half-past seven of the clock in the evening.

Pursuant to adjournment, the inhabitants of the town of Brookline, qualified to vote in elections, met at the Town Hall in said town, on Monday, the first day of April in the year of our Lord one thousand eight hundred and seventy- eight, and were called to order at half-past seven of the clock in the evening by the Moderator, William Aspinwall.

On motion of Oliver Whyte, it was -


Voted, That the Water Board be authorized to expend a sum not exceeding eight hundred dollars in the grading and improving the grounds and roadways attached to the pump- ing station of the Brookline water works at West Roxbury,

and that sum, $800, be appropriated for the purpose and charged to the construction of water works.


Voted, That the Water Board be authorized to cause the stand-pipe of the Brookline water works, situated on the grounds of Atherton T. Brown, to be raised an additional height of six feet at an expense not exceeding one hundred. and eighty-five dollars, and that sum, $185, be appropriated for the purpose and charged to the construction of water works.


Voted, That the Water Board be authorized to purchase, for the use of the pumping station, a lathe and a steam-engine indicator, at an expense not exceeding two hundred and fifty dollars, and that the amount, $250, be appropriated for the purpose and charged to maintenance of water works.


Voted, That if any person shall turn on or turn off the water in any of the public water pipes or reservoirs without the license of the Water Board, he shall be liable to a penalty of not less than $3 nor more than $20, upon conviction there- of before a trial justice or court having jurisdiction of offences arising under town by-laws.

Voted, That the Selectmen are also authorized to select such other similar institution in addition to the State Prim- ary School at Munson as in their judgment may seem best.

To see what action the town will take in reference to the sale of intox- icating liquors, and whether it will advise the Selectmen to grant or with- hold licenses.


Voted, That the Selectmen be advised to enforce the exist- ing laws of this Commonwealth in relation to the sale of in- toxicating liquors, and as a part of that policy to grant licenses for such sale to suitable persons.


Voted, To take up the Seventh Article.


Seventh Article taken up :


To see what action the town will take in reference to laying down a sewer in Aspinwall avenue, to connect with the present sewers in School and Harvard streets ; such sewer to take none of the water from Aspin- wall brook, and to have no overflow into the same.


Voted, That the subject of the Seventh Article in the war- rant be referred to the Selectmen, with instructions to give a public hearing thereon, and upon any plan which may be laid before them for a sewer in or near Aspinwall avenue to connect with the intercepting sewer just built, and to carry the water of any sewer now built or hereafter to be built, or any brook, and to report thereon at any adjournment of this or at another town meeting.


Fourteenth Article taken up :


To raise and appropriate such sums of money as may be required to defray the expenses of the town during the ensuing year, and for any or all of the foregoing articles.

Pursuant to adjournment, the inhabitants of the town of Brookline, qualified to vote in elections, met at the Town Hall in said town, on Wednesday, the tenth day of April in the year of our Lord one thousand eight hundred and seventy-eight, and were called to order at half-past seven of the clock in the evening by the Moderator, William Aspin- wall.


The meeting then proceeded to fill the vacancies in the list of town officers chosen at the meeting held on the twenty- sixth of March last who had declined the office to which they had been chosen or neglected to qualify themselves for said office.


The persons who had been chosen Auditors having all de- clined to serve, it was -


Voted, To reconsider so much of the vote passed at the meeting held on the twenty-sixth day of March last whereby the town voted to choose Auditors by ballot, and that the meeting proceed to choose the Auditors for the ensuing year by nomination.


As the town voted, at the meeting held on the twenty- sixth day of March last, to choose by ballot twelve consta- bles, and as only ten were found to have been elected, it was -

Voted, That the sum of seventeen thousand and thirty- four ($17,034) dollars be appropriated for putting down sewers.


Voted, That prior to the adoption by the town of a rule for laying assessments for the right to use the main sewer, the Selectmen may, in their discretion, allow any abutter to enter and use the same, taking from each and every party so using the privilege an agreement to do all work in a manner satisfactory to the Selectmen, and to pay to the town, on demand, such assessments as shall be legally laid on such parties or their estates for the right to use the sewer in that or any other way.

Eleventh Article taken up :


To see what action the town will take in reference to Aaron D. Weld's. right of way across the northwest corner of the new cemetery.


Voted, That the subject matter of this article be referred. to the trustees of the new cemetery, with full power to effect, such a settlement of the claim of the town, either in money or other land, as they shall think expedient, and for the best interests of the cemetery. They are required to report such settlement made in either mode, or their inability to agree upon a settlement, as soon as may be.


Twelfth Article taken up :


To see whether the town will make an appropriation for lighting St. Paul street, from Longwood avenue to Francis street, and to place a. lamp near the corner of Morss avenue and Walnut street.


Voted, That the sum of three hundred dollars be appro- priated for lighting St. Paul street, between Longwood avenue and Francis street, and for a lamp near the corner of Morss avenue and Walnut street.


Fourteenth Article taken up :


To raise and appropriate such sums of money as may be required to defray the expenses of the town during the ensuing year, and for any or all of the foregoing articles.

Adjourned Annual Meeting, April 10, 1878.


Voted, That the Water Board be authorized to lay a 6- inch main in Babcock and Freeman streets, a distance of 3900 feet, at an estimated expense of $3700, and charge the sa ne to extension of water works.


Voted, That for the extension of water works, the town reappropriate the sum of $2608.08, being the amount left from the sale of water bonds, and also appropriate the sum of $5891.92, to be raised by taxation, making the whole amount $8500.


Voted, That the Water Board be authorized to pay Ken- rick Brothers $411.38, also Francis Maley $59.16, for 2- inch mains laid in Mountfort and St. Mary's streets and Sewall place, and that the same be charged to the extension of water works.


Voted, That the Water Board be authorized to lay a 6- inch main in Harvard street, from the point where the main now ends to a point near the Boston line, a distance of 1760 feet, at an estimated expense of $1600, and charge the same to the extension of water works.


Voted, That the Water Board be authorized to lay a 6- inch main in Cottage street, from the point where the main now ends to a point opposite the estate of James L. Little, Jr., a distance of 900 feet, at an estimated expense of $1200, upon Mr. Little agreeing to repay to the town $350, upon completion of the work, as part of the expense of laying the said main, the balance to be charged to extension of water works.


Voted, That $800 be appropriated to pay the salaries of the Town Clerk, clerk of the Selectmen, and clerk of the Overseers of the Poor.


Voted, That the sum of one hundred and fourteen dollars ($114) be raised and appropriated as the interest on the Edward Devotion School Fund, and placed in the hands of the School Committee for school purposes.


The meeting made the following appropriations ; viz., -


For construction of sewer $17,034 00


lighting St. Paul street, between Longwood avenue and


Francis street, and a lamp post on Morss avenue 300 00


highways
