By virtue of the within precept, I have notified and warned the legal voters of the town of Brookline to meet at the time and place within specified, by leaving an attested copy of this warrant at their last and usual places of abode.

In pursuance of the foregoing warrant, the inhabitants of the town of Brookline, qualified to vote in elections, met at the Town Hall in said town, on Thursday, the thirtieth day of December in the year of our Lord one thousand eight hun- dred and seventy-five, and were called to order at one of the clock in the afternoon by the Town Clerk, who read the war- rant calling said meeting, and the return thereon of the officer who served the notice on the inhabitants.
First Article taken up :
To choose a Moderator (who should be chosen by ballot).
The meeting then voted to choose a Moderator by ballot, and that the polls be kept open until three o'clock.
The polls were then opened for the reception of votes for Moderator, and were kept open until three o'clock, when they were declared closed.

given in for Moderator, and the whole number of votes so given in was three hundred and fifteen ; for Moderator, Wil- liam I. Bowditch had one hundred and eighty-eight votes, was declared elected, and took the chair.
Mr. Charles H. Drew had one hundred and twenty-seven votes.
In voting the check list was used, and no person was al- lowed to deposit his vote until his name was found on the . list and checked.
Second Article taken up :
To hear and act upon reports of town officers and committees.
Voted, That the Second Article be laid on the table.
Fourth Article taken up :
To see if the town will make an additional appropriation of fifteen hundred dollars for the support of the poor.
Voted, That the sum of fifteen hundred dollars be appro- priated for the support of the poor.
Voted, That the amount be taken from any money now in. the treasury not appropriated, or from any unexpended ap- propriation.
Fourteenth Article taken up :
To see if the town will vote to enter upon its records the resolutions- adopted at a meeting of the citizens of Brookline, held on the evening of November 24, 1875, to take action with reference to the death of the. Hon. John Wells.
Voted, unanimously, by rising vote, that the resolutions. in reference to the death of the Hon. John Wells, passed at a meeting of the citizens held on the evening of the twenty- fourth day of November, 1875, be entered upon the town records.
Fifth Article taken up :
To see if the town will lay water pipes on Pleasant street from Eg- mont street to Dummer street, and through Dummer street to St. Pauls street, and along said last-named street to the house occupied by George Dexter.

To see if the town will accept and allow a new town way known as Walter avenue, running from Washington street to Flora street, so called, as laid out and located by the Selectmen.
The Selectmen presented the following report on the lay- ing out of said avenue ; to wit, -
The Selectmen of the town of Brookline, after giving legal notice to all persons and interests known to them of their intention to lay out as a town way the private way called Walter avenue, did, in pursuance of said notice, meet at their office in the Town Hall, on Wednesday, the fourteenth day of October A.D. 1874, and thence by adjournment to Mon- day, the twelfth day of July A.D. 1875, and thence by adjournment to Monday, the nineteenth day of July A.D. 1875, and thence by adjournment to Monday, the twenty-sixth day of July A.D. 1875, and thence by adjourn- ment to Monday, the fifteenth day of November A.D. 1875; and all par- ties and interests which had appeared having been heard in relation thereto, and said route having been examined by the Selectmen, they proceeded to lay out said way as follows, describing it by its centre line : -
Commencing at a point on the southerly side of Washington street, 63.12 feet east from the point where the continuation of the westerly side of Brookline avenue would intersect the southerly line of Washington street, and running S. 30° 25' W., 344.66 feet, thence S. 31º 23' 40" W., 480.18 feet, to the northerly side of Flora street, taking a parallel width of twenty feet on each side of the above-described centre line.
The location of said way is in accordance with a plan and profile of the same as drawn by Alexis H. French, civil engineer, dated November 29, 1875, and examined and approved by the Selectmen, and filed in the office of the Town Clerk the same day.
And the owners of the land abutting on said way, and the fee of the land over which said way is laid out, in consideration of the town lay- ing out said way, agree to waive all claims to land or grade damages.
There being no structures, buildings, trees, walls, fences, or hedges standing upon the land taken for said way, the same may be entered upon at once for the purpose of constructing the same, and the estimated cost of making said way is about nine hundred and thirty dollars, exclusive of curbstones.
And said way as so laid out, located, and described, is hereby reported to the town for acceptance, and when so accepted, allowed, and recorded, is to be known as a public town way ; and they would recommend that said way be named and known as Walter avenue.

And the owners of the land abutting upon said way, and of the fee of the land over which said way is laid out, in consideration of the town laying out said way, agree to waive all claims for land or grade dani- ages.

Commencing at the intersection of the continuation of the centre line of the part of St. Mary's street already accepted with the southerly line of Beacon street, and running on the same course as the aforesaid St. Mary's street, viz., S. 21º 35', E., 340 feet, to the extension of the south- erly side of Monmouth street, taking an equal parallel width of twenty feet on each side of the above-described centre line.
The location of said way is in accordance with a plan and profile of the same as drawn by Alexis H. French, civil engineer, dated November 29, 1875, and examined and approved by the Selectmen, and filed in the office of the Town Clerk the same day.

Mr. Thomas H. Talbot moved that the subject be referred to the next annual town meeting, pending which it was -

ADJOURNED SPECIAL MEETING, JANUARY 5, 1876.
Pursuant to adjournment, the inhabitants of the town of Brookline, qualified to vote in elections, met at the Town Hall in said town, on Wednesday, the fifth day of January in the year of our Lord one thousand eight hundred and seventy-six, and were called to order at three of the clock in the afternoon by the Moderator, William I. Bowditch.
The records of the last meeting were read and approved.
The Twelfth Article, which was under consideration at the close of the last meeting, coming up in order, it was -
Voted, That the Twelfth Article be laid on the table.
Twenty-fourth Article taken up :
To raise and appropriate such sums of money as may be required for any or all of the foregoing articles.
On motion of Thomas Parsons, Esq., it was -
Voted, To appropriate the sum of eight thousand and fifty dollars ; as follows ; to wit, -
Under the Fifteenth Article, nine hundred and fifty dollars ($950.00).
Under the Sixteenth Article, seventy-five dollars ($75.00).
Under the Seventeenth Article, four hundred and seventy-five dollars ($475.00).
Under the Eighteenth Article, one thousand three hundred and twenty dollars ($1320.00).
Under the Nineteenth Article, five thousand two hundred and fifty dollars ($5250.00).
Voted, That the amounts be taken from the unexpended balance appropriated for interest, and any other unappro- priated balance now in the treasury.
Thirteenth Article taken up :
To see if the town will authorize the Selectmen to give a confirmatory deed of a piece of land sold by the town to Thomas Seaverns, March, 1861.
There being an error in this article in making a wrong date as to the time when the deed was given, no action was taken under it.

Adjourned Special Meeting, January 5, 1876.
To hear the report of the Selectmen upon the establishment of a grade, and take such action upon the same as may be authorized by the pro- visions of Chapter thirty-eight of the Acts of the year 1873, entitled "An Act to establish a grade in the town of Brookline."
The motion of Mr. Thomas H. Talbot was then taken up and considered ; to wit, -
That the subject be referred to the next annual town meeting.
After a full and lengthy discussion of the matter, it was -
Voted, Not to refer the subject to the annual town meet- ing.
The report of the Selectmen upon the Twelfth Article, in relation to the establishing of a grade in the town of Brook- line, and which was laid on the table at the last meeting, was then taken up, and is as follows : -
"An Act to Establish a Grade in the Town of Brookline.
"Be it enacted, &c., as follows : -
" SECTION 1. The Selectmen of the town of Brookline, when author- ized by a vote of said town at a meeting called for the purpose, shall establish in said town a grade of not less than twelve feet above mean low water; and no person, after such grade is established, shall construct in said town any cellar or basement cellar of any building below such grade, or use or occupy any cellar or basement cellar so constructed ; provided, that the Selectmen may, by license, subject to revocation at any time by them, authorize cellars to be constructed in buildings used exclusively for storage or business purposes, so much below said grade as they shall designate in each license."
The Selectmen who were instructed by a vote of the town passed May 7, 1875, " To establish a grade agreeably to the provisions of Chapter 38 of the Acts of the year 1873," being "An Act to establish a grade in the town of Brookline," and that they shall report the grade established to the town for its approval; and also report what will be the effect of the grade proposed upon buildings already constructed, would respect- fully report as follows : That after a careful examination of the subject matter, they have established a grade of sixteen feet above mean low tide, and, in order to show what cellars and buildings already con- structed are below such grade, they present the following report of A. H. French, civil engineer, upon the heights of lands and buildings likely to be effected.
