The business of the meeting being accomplished, the re- turns were filled in, signed by the Selectmen and counter- signed by the Town Clerk, and sealed up in open town meet- ing as required by law, and were delivered to the Town Clerk, to be forwarded to their several places of destination.
The votes cast and the list of voters which had been used at the polls were then sealed up, endorsed by the Selectmen, and delivered into the custody of the Town Clerk, in con- formity with the laws in such cases made and provided.
The meeting was then declared dissolved by Charles H. Drew, Esq., chairman of the Board of Selectmen.

In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the inhabitants of the

town of Brookline, qualified to vote in elections, to meet at the Town Hall in said town, on Monday, the fourteenth day of January current, at seven and one half of the clock in the evening, for the following purposes ; to wit, -
First. To choose a Moderator.
Second. To hear and act upon the report of the Water Board, to whom was referred, with instructions to report in print at the next town meet- ing, the Sixth Article in the warrant for the town meeting held October 17, 1883, said Article being as follows : "Sixth. To see if the town will apply to the General Court for power to issue $100,000 of bonds for the construction of its water works, on the petition of George F. Fabyan and others."
Third. To hear and act upon the reports of any town officers or com- mittees.
Hereof fail not, and make due return of this warrant, with your doings thereon, to the Selectmen, four days at least be- fore the day of said meeting.

Voted, That the Selectmen be instructed to appear before the General Court on behalf of the town of Brookline, and ask that the town may be authorized to issue an addditional amount of water scrip of one hundred thousand dollars, to enable it to construct a high service so as to supply all its in- habitants and estates with water.

APPENDIX A.
REGULATIONS PROVIDING FOR THE MANAGEMENT OF THE BROOKLINE WATER WORKS.
1. Applications for the use of water must be made in writing at the office of the Water Board, and must state fully and truly the uses to which it is to be applied. Should any taker desire to use the water for any purpose not stated in his application, he must make request to the Water Board for permission to use it for such other purpose. No water shall be supplied by takers to persons not entitled to its use.
2. All persons taking water shall keep in order the service-pipe within their promises, and be liable for all damage resulting from their failure to do so.
3. They shall prevent all voluntary waste of water, and shall not allow water to run through their fixtures to prevent freezing. There shall be no concealment of the purposes for which it is used.
4. No alteration shall be made in any pipes or fixtures inserted by the town, except by persons authorized by the Water Board, who shall be allowed to enter the premises to examine the apparatus, the quantity of water used and manner of its use, and to ascertain whether there is any improper waste; provided, however, that no dwelling house shall be thus entered except on presentation of a special order, designating the house and its occupant, signed by the superintendent, authorizing such entry. Said order shall be left with the occupant.
5. The town reserves to itself the right, whenever it deems it necessary to repair the works, to shut off the water in whole or in part, and to stop the supply for other than domestic purposes in cases not requiring a complete stoppage.
6. Owners shall be so far responsible for tenants that new tenants shall not be entitled to a supply until all arrearages on the premises are paid. When water shall be supplied to more than one taker through a single service, the bill for the whole supply furnished through such ser- vice will be made either to the owner of the estate or to some one tenant who shall agree to be responsible therefor. In case of non-payment the water may be shut off, notwithstanding one or more takers may have paid their proportion to such owner or tenant.
AN ORDINANCE TO ESTABLISH THE BROOKLINE WATER BOARD.
SECT. 1. At the annual meeting in 1877, there shall be chosen by ballot three inhabitants of the town of Brookline, who shall be styled the Brookline Water Board, one of whom shall be chosen to hold office until the annual meeting in 1878, one to hold office until the annual meeting in 1879, and one to hold office until the annual meeting in 1880, and at every

annual meeting after 1877 one member of the board shall be chosen to hold offiee until the annual meeting in the third year after the meeting at which he shall have been chosen. In case of a vacancy by death, resignation, removal from town, or other cause, the vacancy shall be filled at the next town meeting after the occurrence of such vacaney.
SECT. 2. The Water Board shall, at the first meeting after their elec- tion in each year, choose from their number a Chairman. Two members shall be a quorum for the exercise of the powers and performance of the duties of the Water Board. The board may appoint and remove at their discretion a Clerk, who shall also be Water Registrar, and such servants or agents as may be necessary, and may prescribe their duties. They may fix the salaries of such Clerk and Registrar, and such servants and agents, subject to the instructions and control of the town. The board shall in no case make any contract or agreement beyond the appropria- tion for the purpose made by the town.
SECT. 3. The Water Board, thus constituted, shall have the exclusive and entire charge, superintendenee, and oversight of all lands, structures, works, and apparatus designed and provided for obtaining and supplying pure water for the uses of the town. They shall receive from the Water Commissioners any and all such works as may have been established. They shall have the exclusive control and management of the uses, repairs, and extensions of such works and structures, whether newly determined upon or otherwise, unless the town shall make other provision in extensions of the works.
SECT. 4. The Water Board shall have control and jurisdiction over all sources of supply possessed by the town, and of all lands appurtenant thereto, and owned or lawfully controlled by the town; and they may exercise all rights as to entry upon and passage over private premises which now are or may become vested in the town, belonging or relating to the management of the water works and supply of water.
SECT. 5. The Water Board shall use diligent care for the protection and security of all sources of water from which a supply is in any part obtained, so that the purity thereof may not be impaired.
SECT. 6. The Water Board shall, as often as once in each calendar month, meet and examine .all bills and claims incurred by them in the prosecution of their duty; and all elaims approved shall be certified by them and they shall draw warrants upon the Town Treasurer for the payment of the same. The Water Board shall keep a full record of their proceedings, and shall make quarterly reports to the Selectmen of their doings on or before the tenth day of each January, April, July, and October, which reports shall be printed in the same form as the annual reports to the town, and shall be in charge of the Town Clerk for dis- tribution to the inhabitants, and they shall at the annual town meeting make a report in detail to the town of their official acts and doings for the year preceding, with estimates of expenditures for the year sueceed- ing, and such suggestions and recommendations as may seem to them for the benefit of the town.
SECT. 7. The Water Board shall, in consultation with the Engineers of the Fire Department, make all proper arrangements for the sufficient

supply of water for use at fires, and for affording the same in the most effi- cient and suitable manner: They shall, in consultation with the Select- men, arrange for such supply of water as may be required for operating any public fountains and ornamental public water works, for flushing and cleansing public sewers and drains, for sprinkling streets, and for any other use clearly distinct from that of ordinary water takers.
SECT. 8. The Water Board shall have exclusive charge of the supply of water, may make all necessary arrangements therefor, and such regu- lations as may be judicious, not inconsistent with those established by the town.
SECT. 9. Bills for the use of water shall be payable at such times, and collected in such manner, as the Water Board may determine. All sums received by the Water Board for the use of water, or for the sale of any other matter or thing lawfully held by them, shall be paid weekly into the town treasury, and a receipt taken for the same.
SECT. 10. No member of the Water Board, and no person officially acting under their appointment, shall, directly or indirectly, be personally interested in any contract, bargain, or sale of property or material con- nected with the water supply, wherein either the Water Board or any committee thereof shall be a party. The members of the Water Board shall not receive any compensation for their services, and neither they nor any officer appointed under their authority, shall demand or receive any fee or reward for service to any person in connection with his duty.
