ATTACHMENTS-Will issue: 1st. Where defendant (debtor) has absconded, or is about to abscond, from the State. 2d. That he is concealed therein to the injury of his creditors, 3d. That he has assigned, disposed of or concealed, or is about to assign, dispose of or conceal, any of his property with intent to defraud his creditors. 4th. That he has removed, or is about to remove, any of his property out of the State, with intent to defraud his creditors. 5th. That he has fraudulently contracted the debt, or incurred the obligation respecting which the suit is brought. 6th. That he is not a resi- dent of the State, and has not resided therein for three months (one month in justice's court) immediately preceding the time of making the affidavit for the attachment. 7th. That the defendant is a foreign corporation. This last ground applies to courts of record, but not to justices' courts.
ARREST .- No arrest or imprisonment for debt, except for moneys collected in any professional employment, or for breach of promise to marry.
BILLS OF EXCHANGE AND NOTES .- Acceptance must be in writing on bill. On pro- tested bills of exchange (drawn or indorsed in this State), when payable without the United States, damages and rates of exchange are as follows: 1st. The current rate of exchange at time of demand. 2d. Damages at rate of five (5) per cent. 3d. With interest on contents from date of protest. On protested bills of exchange, drawn or indorsed in this State, payable ont of this State, but within the United States, the dam- ages and rates of exchange are: In addition to the contents, with interest and costs. from 3 to 10 per cent. All checks, bills of exchange, or drafts on banks or bankers. have no grace. Guaranty of payment of note is negotiable, and passes to the holder of the note, by assignment of the note. No written assignment, but merely indorsement of notes or bills, is necessary to pass title. Holder of guaranty of payment of note can sue in his own name on the note and guaranty. Three days grace is allowed ou all notes, bills of exchange, drafts and orders payable within this State, except when pay- able on demand. Assignee of note or bill may sne in his own name. Suit may be brought by the legal owner. Where consideration for note is a patent right, the words "Given for patent right " must be ou the face. Defense by purchaser same as original owner. It is a misdemeanor to deal with such notes not having said words on their face. There is no special form of note. Maker, indorser and guarantor of payment may be sued jointly. If last day of grace falls on Sunday, or any other legal holiday, the day previous is considered the last day of grace.
EXEMPTIONS .- A homestead, owned and actually occupied by the family, not exceeding forty acres, and the dwelling-house thereon, not inchided in any recorded town plat, or city or village, or instead thereof, at the option of the owner, one lot, within a recorded town plat, or city or village, not exceeding in the value of $1.500. This exemption also extends to the time it shall be occupied by the widow or minor children of a deceased person.
Ist. All spinning wheels, weaving looms, with apparatus, and stoves in a dwelling. house.
21. A seat, new or slip occupied in any house of public worship.
Cemeteries, tombs, rights of burial, while in use for repositories of the dead.
4th. All arms and accoutrements required by law to be kept; all wearing apparel of every person or family.

6th. To cach householder tes sheep and their fleeces, and the yarn or cloth maqu- factured from the same; two cows, five swine, and provisions and fuel for comfortable subsistence of such householder or family for six months.
7th. To each householder $250 worth of household effects.
8th. Two hundred and fifty dollars' worth of tools, implements, materials, appa- ratus, team and other things to enable any person to follow his trade, occupation or pro- fession.
9th. A sufficient quantity of hay, grain, feed and roots, whether growing or other- wise, for properly keeping animals for six months.
10th. One sewing-machine for each family.
Twenty-five dollars due and owing to a married man for personal labor, from garni- shee process.
All real and personal property is liable in execution for purchase price, though com- ing within the general exemptions, excepting mechanical tools and implements of husbandry.
EVIDENCE. -- Parties in interest competent to testify, except to matters, which, if true. must have been within the knowledge of a deceased person, when a suit or proceeding is prosecuted or defeuded by the representative of the deceased. The same rule applies in the case of a surviving partner or partners.
LIMITATIONS .- 1st. Actions for libel, slander, assault, trespass upon land, false Imprisonment, within two years.
All actions of debt upon contraet or liability, not under seal, of assumpsit founded upon any contract or liability, express or implied, for waste, for replevin and trover. and all other actions, for taking, detaining or injuring goods or chattels, and for all other actions not otherwise mentioned, within six years.
Actions for the recovery of real estate. Where defendant claims title by or through some deed, made upon a sale thereof by an executor, administrator or guardian, or by a sheriff, or other proper ministerial officer, under the order, judgment or decree of : competent court, in this State, within five years. Where defendant claims title under s deed made by some officer of this State, or of the United States, authorized to make deeds upon sale of lands for taxes assessed and levied within this State, within ten years; in all other cases, within fifteen years.
All suits for the recovery of any lands by the State must be commenced withia twenty years.
Upon judgment, or decree in the United States Court, or any court of record, within ten years; justice's court judgment, within six years.
Claims against estate of deceased persons must be presented within such time as Probate Court shall direct-in the first instance, shall not exceed eighteen months, and not less than six months. The court may extend the time, but not to exceed two years from the time appointing commission to hear claims. In certain cases, Judge of Probate may revive commission for three months more. When death is cansed by wrongful act, neglect or default, a railroad company is liable, not exceeding $5,000, to personal repre- sentatives of the deceased, and such action must be commenced within two years of the death of such person. Debt debarred by statute of limitations can only be revived by a promise in writing.
CHATTEL MORTGAGES-Must be recorded, otherwise void as against existing credit- ors or subsequent purchasers. Must also be renewed each year, or otherwise void. No lien, by way of mortgage or otherwise, can be created on, or sale made of exempt prop- erty, except for tools, implements, etc., to carry on trade, profession, etc., without the consent of the wife, if he have one, to such sale, or by her signing of said mortgage.
REAL MORTGAGES-Are merely securities for debt or obligation. A widow takes no dower against mortgage before marriage. Mortgages should be recorded in county in which the land lies. If not recorded, void as against subsequent purchaser for valu- able consideration.
A deed or mortgage of homestead, without wife's signature, is absolutely void as to homestead interest.
MARRI O WOMEN-May own, hold and deal with their separate property as if sin- gle, and can deal with her husband. Husband is not liable for contracts of his wife as to her separate property. It seems that all common law disabilities of married women have been removed, except, probably, of becoming surety for her husband or third persons.
GARNISHEE PROCESS .- The statute provides for commencement of proceedings against garnishees in Justices' and Circuit Courts respectively, founded upon contract or upon judgment or deerce.

STAY OF FYECUTION .- Execution may he stayed only in Justices' Courts by party against whom judgment is rendered, for a space of four months, when amount shall not exceed $50 exclusive of costs; for six months, when amount exceeds $50 exclusive of costs. Time computed from commencement of suit.
REDEMPTION .- One year is given after sale of real estate upon execution. Same where land is sold to satisfy mechanics' lien. Foreclosure of mortgage by advertise- ment, one year is given to parties in real interest. When mortgage is foreclosed in chancery, and sale under decree, there is no redemption. In chancery foreclosure it takes one year to complete purchaser's title; in the other, fifteen months.
INTEREST .- The legal rate of interest is seven per cent, but parties may contract in writing for a higher rate, not exceeding ten per cent. Penalty for usurious interest is forfeiture of excess.
JURISDICTION. - Justices' courts have original jurisdiction in all civil actions wherein the debt or damages do not exceed $100, and concurrent jurisdiction in all civil actions upon contract, express or implied, wherein the debt or damages do not exceed $300. No Justice of the Peace has jurisdiction in real estate actions, actions for disturbance of right of way, or other easement action for libel or slander, or for malicious prosecu- tion and actions against executors or administrators, as such, unless specifically provided by law. Courts of record have original and concurrent jurisdiction in all civil actions for damages over $100.
