SPECIAL TOWN MEETING WARRANT


Worcester, ss.


To a Constable of the Town of Leicester:


Greetings :-


In the name of the Commonwealth of Massachusetts you are hereby directed to notify and warn the inhabitants of the Town of Leicester, qualified to vote in Town Elections and Town Affairs to meet at the Town Auditorium, Washburn Square on Monday, April 27th at Eight o'clock in the evening then and there to act on the following Articles, namely ;


Article 1. To hear the reports of any Committees and to take any action thereon.


Article 2. To see if the Town will vote to raise and appropri- ate or transfer from available funds, a sum of money to pay the in- terest on temporary loans of the Town of Leicester made by the Treasurer, with the approval of the Selectmen.


Artifficle 3. To see if the Town will vote to rescind its vote taken under Article 16 of the Annual Town Meeting of March 7, 1964, or take any action relative thereto.


Article 4. To see if the Town will vote to transfer a sum of money from the Road Machinery Rental Account to the Road Ma- chinery Maintenance Account, and to pay certain Road Machinery Maintenance bills of 1963 from this transfer, or take any action rela- tive thereto.


Article 5. To see if the Town will vote to rescind its vote taken under Article 7, of the Annual Town Meeting of March 7, 1964, or take any action relative thereto.


Article 6. To see if the Town will vote to raise and appropri- ate, or transfer from available funds, a sum of money to pay for repairs to the Rochdale Fire Siren.

Article 7. To see if the Town will vote to authorize the Board of Selectmen to enter into and execute on behalf of the Town a lease with Stanley Nicas under which the Town will lease from said Nicas that part of the Nicas land now being used as a bathing beach, to- gether with approaches to the bathing beach, if any are necessary; That the Town further authorize and empower the Selectmen to procure a policy of liability insurance covering the Town and said Nicas in the use of the property described in the lease; and that the Town raise and appropriate, or transfer from available funds, a sum of money to pay for the premises leased, or take any action 'thereon.


Article 8. To see if the Town shall determine which of its em- ployees shall be included in the coverage of Workmen's Compensa- tion insurance, and determination to be made in accordance with the provisions of Section 69 of Chapter 152 of the General Laws of the Commonwealth of Massachusetts, or take any action relative thereto.


And you are directed to serve this Warrant by posting an at- tested copy in at least one public place in each of the Precincts of the Town, and on the Bulletin Board in the front entry of Town Hall, to Town Clerk and to the Moderator not less than fourteen days before the 27th day of April 1964.


Given under our hands and seal of the Town, thirteenth day of April in the year of our Lord, one thousand, nine hundred and sixty four and the Independence of the United States the one hundred and eighty eight.

PROCEEDINGS OF SPECIAL TOWN MEETING


APRIL 27, 1964


Meeting called to order by Moderator Robert N. Beck at 8:45 P.M. as there were only 45 voters present (50 Voters is a Quorum) the Meeting was adjourned until Monday, May 4th at 8 P.M.


Adjourned Meetinf called to order at 8:05 P.M. by Moderator Robert N. Beck, 67 Voters present.


Article 1. No Committees reported.


Article 2. Motion by Albert E. Berthiaume that the Town vote to raise and appropriate the sum of $7,000.00 to pay interest on tem- porary loans of the Town of Leicester made by the Treasurer, with the Approval of the Board of Selectmen.


VOTED.


Article 3. Motion by Albert L. Nash that the Town vote to rescind its vote taken under Article 16 of the Annual Town Meeting of March 7, 1964, relative to a transfer of money from the Road Machinery Rental Account to the Road Machinery Maintenance Acct.


VOTED.


Article 4. Motion by Wesley A. Proctor that the Town vote to Transfer the sum of $10,197.15 from the Road Machinery Rental Account to the Road Machinery Maintenance Account, and to auth- orize and empower the Board of Selectmen to pay $4,494.50 in Road Machinery bills of 1963 from this transfer, said bills being now in the hands of the Selectmen.

Article 5. Motion by Albert L. Nash that the Town vote to rescind its vote taken under Article 7 of the Annual Town Meeting of March 7, 1964, relative to leasing land at so-called Nicas property on Main Street.

Article 6. Motion by Albert E. Berthiaume that the Town vote to raise and appropriate the sum of $189.48 to pay for the repairs to the Rochdale Fire Siren, made under the emergency powers of the Board of Selectmen.


Article 7. Motion by Albert E. Berthiaume that the Town vote to authorize the Board of Selectmen to enter into and execute on behalf of the Town, a lease with Stanley J. Nicas under which the Town will lease from said Nicas that part of the Nicas land now being used as a bathing beach, together with approaches to the bath- ing beach, if any are necessary; that the Town further authorize and empower the Selectmen to procure a policy of liability insurance cov- ering the Town and said Nicas in the use of the property described in the lease; and that the Town vote to raise and appropriate the sum of $275.00 to pay for premises leased.

Article 2. To see if the Town will vote to accpet, without con- sideration, from the Hillcrest Water District a conveyance of a par- cel of land, said parcel to be conveyed to the Town of Leicester by said Hillcrest Water District.


Said parcel is more particularly described in a plan on file with the Town Clerk's Office in the Town of Leicester; or take any action thereon.

Article 1, Motion by William A. Campbell that the Town authorize and empower the School Committee of the Town of Leicester to execute, acknowledge and deliver on behalf of the Town of Leicester, and without consideration, a deed of a parcel of land to Hillcrest Water District, provided that Hillcrest Water District convey to the Town of Leicester, and without consideration, a deed of another parcel of land.


The parcel of land to be conveyed by the Town of Leiceseter to the Hillcrest Water District is Described as follows:


A centain parcel of land situated in the Town of Leicester being more particularly described as follows:


Beginning at a point at the northeasterly corner of the herein described parcel, said point being S 13° 45'00" W 650.29 feet from an iron pin located on the easterly line of the Old Oxford Road, at. the northwesterly corner of land owned by the Town of Leicester.


Thence S. 77° 00'00" E. 95.00 feet to a point;


Thence: S. 13° 00'00" W. 188.81 feet to a point;


Thence S. 20° 00'00" W. 80.16 to a point;


Thence N. 70° 00'00" W. 95.00 feet to a point in the easterly sideline of the Old Oxford Road; the last four described courses are. by land of the Town of Leicester;


Thence: N. 20° 00'00" E. 74.35 feet by the easterly line of the Old Oxford Road to a point;


Thence N. 13° 00'00" E. 183.00 feet by the easterly of the Old Oxford Road to the point of beginning.

SPECIAL TOWN MEETING WARRANT


WORCESTER, ss


To a Constable of the Town of Leicester :-


Greetings :-


In the name of the Commonwealth of Massachusetts you are hereby directed to notify and warn the inhabitants of the Town of Leicester, qualified to vote in the Town of Leicester elections and Town affairs to meet at the Town Auditorium, Washburn Square on Tuesday, September 15th at eight o'clock in the evening then and there to act on the following articles, namely;


Article 1, To hear the reports of any Committee and to take any action thereon.


Article 2, To see if the Town will vote to transfer from available funds the sum of $1,216.75 to pay for two judgements for land damages on Chapter 90, Route 56 declared an emergency by the Board of Selectmen or take any action thereon.


Article3, To see if the Town will vote to transfer from available funds a sum of money to take the State Census in accordance with the General Laws Chapter 9 Section 6 and 7 as amended or take any action thereon.


Article 4, To see if the Town will vote to transfer from available funds a sum of money to repair the bridge on Rawson Street or take any action thereon.


Article 5, To see if the Town will vote to designate the parcel of Town owned land at the junction of Mill and Stafford Streets in Rochdale as the John A. Divis Square as per plan on file with the Town Clerk, or take any action thereon.


Article 6, To see if the Town will vote to transfer from available

funds, a sum of money for appraisal of land takings on new Route 56, or take any action thereto.


Article 7, To see if the Town will transfer from available funds, a sum of money to pay for land takings on new Route 56, or take any action relative thereto.


Article 8, To see if the Town will vote to empower the Board of Selectmen to file a bill in the State Legislature, pertaining to allowing certain individuals the right of late filing, beyond the statute of limitations, for land damages in the 1962 land takings on Pleasant Street, or take any action relative thereto.


Article 9, To see if the Town will vote to rescind Article V, of Section 2, of the revised Zoning and Buildings By-Laws, and Substi- ture in its place the following; ARTICLE V, INSPECTOR OF BUILDINGS AND WIRES AND GAS INSPECTOR.


Section 1, The Board of Selectmen annually in March and subsequent to the Annual Town Meetings, shall appoint;


a. Inspector of Buildings


b. Inspector of Wires


c. Gas Inspector


all these men to hold office for the term of one year from the first of April following and until his successor is appointed and qualified


Section 2, The Inspector of Buildings and the Inspector of Wires shall make inspection of all building operation under their jurisdiction within the Town, and shall report to the Board of Select- men all violations o fthis By-Law. The duties of the Inspector of Gas Piping and Gas Appliances in buildings, to be known as the Gas Inspector, shall be to enforce the Rules and Regulations adopted by the Gas Regulatory Board established under Section 12H of Chapter 25 of the General Laws, and as later amended. Or take any action thereto.
