Article 19, To see if the Town will vote to authorize and empower the Board of Selectmen to convey to the City of Worcester and without consideration that portion of Mulberry Street or Mulberry Road owned by the Town of Leicester and discontinued by a vote of the Town on December 26, 1961.
That portion of Mulberry Road or Mulberry Street that is to be conveyed to the City of Worcester is more particularly described as Parcel #3 containing 2.664 acres of land more or less, is shown on "Plan of Mulberry Road Relocation and Construction details; Area of Existing Mulberry Road in the Town of Leicester to be aban- doned," dated May 8, 1961, or take any action relative thereto.
And you are directed to serve this Warrant by posting an attested copy in at least one public place in each of the Precincts of the Town, and on the Bulletin Board in the Front entry of Town Hall, to the Town Clerk and to the Moderator not less than fourteen days before the 15th day of September 1964.

PROCEEDINGS OF SPECIAL TOWN MEETING
September 15, 1964
Meeting called to order at 8:10 P.M. by Moderator Robert N. Beck. Voters present 93.
Article 1, Reports of Committees
Benjamin Gryncewicz requested that the Planning and Zoning Board be present under Article 10.
Robert N. Beck requested that the Water Storage report be presented under Article 18.
Article 2, Arthur M. Williamson, Jr. moved that the Town vote to transfer from Free Cash the sum of $1,216.75 to pay two (2) judgements for land damages on Chapter 90, Route 56. VOTED.
Article 3. Gerald F. Guilfiyle moved that the Town vote to trans- fer from Free Cash the sum of $1,000.00 to take the State Census in accordance with State Laws. VOTED.
Article 4. Albert E. Berthiaume moved that the Town vote to transfer from Free Cash the sum of $2,800.00 to repair the bridge on Rawson Street. VOTED.
Article 5. Edward Duane moved that the parcel of Town owned land at the junction of Old and New Mill Streets and Stafford Street in Rochdale described as follows ;-
Beginning at an iron pipe driven in the ground on the Southerly line of Stafford St. at the North corner of the land described in Book "E" page 96 & 97 as laid out and accepted by the Town Meeting of November 10, 1951. Said pipe is also located S 47° 04'55" W. a distance of one hundred thirty and nine tenths (130.9) ft. of a W.C.H. bound as shown on a plan of Stafford Street Plan 1 on Sheet 4 of 5 sheets recorded in plan book 104 and on file at the

Worcester District Registry of Deeds dated June 21, 1938 which was laid out by the Worcester County Engineering Department in 1938. Said bound is located S. 42° 55'05" E. 24.95 feet of station 183 plus 10.48 as shown on said plan;
Then from the iron pipe first mentioned S. 40° 25'05" E. a distance of thirty-nine and twelve-hundredths (39.12) ft, by the Westerly line of Old Mill Street, to another iron pipe in the ground at an intersection of present Mill Street;
Thence N. 88° 55'05" W. a distance of fifty-six and thirty-four hundredths (56.34) feet by the Easterly line of the present Mill Street to a point on the Southerly line of Stafford Street;
Thence N. 47° 04'55" E. a distance of forty-two and three- tenths (42.3) feet by the Southerly line of Stafford Street to the pipe at the point of beginning;

lature allowing four (4) individuals whose names are now in the hands of the Board of Selectmen the right of late filing, beyond the Statute of Limitations for land damages in the 1962 land takings on Pleasant Street .. VOTED.
Article 9. Gerald F. Guilfoyle moved that the Town rescind Article 5, Section 2 of the Revised Zoning and Building By-Laws, and substitute in its place the following :-
Article 5-Inspector of Buildings and Wires and Gas Inspector. Section 1. The Board of Selectmen shall annually in March and subsequent to the Annual Town Meeting shall appoint;
A: Inspector of Buildings
B: Inspector of Wires
C: Gas Inspector
All these men to hold office for one year from the first of April following and until his successor is appointed and qualified.
Section. 2. The Inspector of Buildings and the Inspector of Wires shall make inspection of all buildings operations under their jurisdiction within the Town, and shall report to the Board of Selectmen all violations of this By-Law.
The duties of the Inspector of Gas Piping and gas appliances in all buildings known as the Gas Inspector, shall be to enforce the Rules and Regulations adopted by the Gas Regulartory Board established under Section 12 of Chapter 25 of the General Laws and later amended .. VOTED
Article 10. Report of Planning Board accepted and placed on file.
Benjamin Gryncewicz moved that the Town vote to accept the following zoning and By-Law changes and additions relative thereto as they affect the areas immediately adjoining the "New Route #56" from Stafford Street to Pleasant Street.

1-By striking out in Section 11, entitled Definitions, of the zoning By-Laws, paragraph three (3), entitled Dwellings, and insert- ing in place thereof the following:
Dwelling-A building designed to be used and occupied for human habitation as a single family residence, two family residence or multi family residence on a site intended as the permanent location of such building.
2-In Section IV-G entitled Business-Industrial, amend by adding the word "Type A" to read Business-Industrial Type A.
3-Add new Section IV-G entitled Business-Industrial Type B, Permitted uses: (a)-Any use as permitted and as regulated in Business-Industrial Type A districts.
(b)-The construction and use of a multiple family dwelling provided that the lot meets in full the intensity requirements of the district as outlined in Section V of this By-Law and provided further that it can be demonstrated that no public health hazard is involved through inadequate provisions for water supply and sewerage disposal.
4-Zoning By-Laws SectionV entitled Intensity Regulations by amendingSections V-A, V-B, V-C and V-D so that Sections shall read as per sheet attached.
VI-A sub paragraph 7-
Any variance granted to construct a business or industry in any district must conform to the site plan regulations (Sec. IV-F,2) covering the Busines-Industrial Districts Type A and Business- Industrial Districts Type B.
5-The aformentioned By-Laws as they affect Business-Industrial Type B districts shall be applied to the areas as follows:
A business-Industrial Type B district shall extend on both sides of the "New Route #56" for a depth of four hundred (400) feet on

either side, starting at a point two hundred (200) feet northerly from Stafford Street to two hundred (200) feet from its junction at Pleasant Street, leaving a buffer zone two hundred (200) feet deep running parallel to Stafford and Pleasant Streets. These areas shall remain in their present zones. VOTED -Yes 69, No 5.
Motion to Pass Over, Protested that same is illegal as abuttors were not notified. DEFEATED.
Article 11. Arthur M. Williamson, Jr. moved that the Town vote to amend Chapter 9 of the Revised By-Laws by adding the following;

Article 12. Albert E. Berthiaume moved that the Town vote to transfer the sum of $7,667.75 from the Road Machinery Rental Account to the Road Machinery Maintenance Account. VOTED.
Article 13. Benjamin Gryncewicz moved that the Town vote to accept Folsom Street as per plan on file with the Planning Board. All bounds and markers are in, and the road has been accepted by the Street Superintendent. The roadway is forty (40) feet wide and two hundred and sixty (260) fect more or less in length. The deed has been received from the builder. DEFEATED.

Article 14. Albert E.Berthi aume moved that the Town vote to transfer from Free Cash the sum of $7,000.00 to the Veterans Service Account and that the Town vote to transfer from Free Cash the sum of $10,000.00 to the Welfare Department Medical Assistance Account. VOTED.

Beck moved that the Town vote to authorize the Board of Selectmen to file in behalf of the Town an application (in form and manner required by the United States and in conformity with P.L. 560, 83rd Congress) and do whatever else may be required for an interest-free loan or advance, in the amount of $7,500.00, to be made by the United States to the Town of Leicester to defray the cost of preliminary report and plan preparation for additional water supply facilities for the Town of Leicester; and further to authorize and empower the Board of Selectmen on behalf of the Town to secure the necessary engineering services for said report and plan preparation. Berthiaume moved that the Town vote to authorize and empower the Board of Selectmen to sign, seal, deliver and acknowledge a deed to the City of Worcester and without con- sideration of a portion of Mulberry Road or Mulberry Street abandon- ed by the Town of Leicester on December 26, 1961. The land to be conveyed to the City of Worcester is bounded and described as follows;

Greetings :-
In the name of the Commonwealth of Massachusetts you are hereby directed to notify and warn the inhabitants of the Town of Leicester, qualified to vote in Town Elections and in Town Affairs to meet at the Town Auditorium, Washburn Square on December 29th, 1964 at 8:00 o'clock in the evening, then and there to act on the following Articles, namely:

Article 8. To see if the Town will authorize the Planning Board to make necessary changes on the Zoning Map as they pertain to the new zone on the "New Route #56".
Article9. To see if the Town will vote to accept Mayflower Road and Mayflower Circle in the development of Mayflower Heights as per plan on file with the Planning Board, or take any action thereon.
Article 10. To see if the Town will vote to accept Daoust Avenue, Atwood Road and the remainder of Folsom Street as per plan on file with the Planning Board or take any action thereon.
And you are directed to serve this Warrant by posting an attested copy in at least one public place in each of the Precincts of the Town, and on the Bulletin Board in entry of Town Hall, to the Moderator and Town Clerk not less than fourteen days before the 29th of December 1964.

ANNUAL REPORT
SPECIAL TOWN MEETING
December 28th, 1964
Meeting called to order by Moderator Robert N. Beck at 8:03 P.M. 120 Voters in attendence.
Reading of the Articles was dispensed with as each person had a copy of the Warrant.
Article 1. Report of the Planning Board was held over until Article six was presented.
Report of Water Basin Storage Committee was accepted from Mr. Beck as progress.
Article 2. Motion by Gerald F. Guilfoyle that the sum of $3,660.00 be transferred from Road Machinery Rental Account to the Road Machinery Maintenance Account. VOTED.
Article 3. Motion by Wesley A. Proctor that the Following sums- of money by transferred from the School Department to the following. Departments. Moved that each transfer be voted on seperately.
