PREFACE.

This volume V includes the Town records from 1850 to 1900, tran- scribed under direction of committee appointed to re-produce the Rec- ords, by Town Meeting vote.
There has also been added a complete copy of the Church Record as far as one has been kept by the earlier Ministers, which covers all data concerning baptisms, marriages, deaths, and communicants, the mar- riage and death records being brought down to 1881, when the Town and State authorities began to make and preserve such records.
In copying the names from the old church record some were hardly decipherable, and though great care has been exercised, some slight in- accuracies may and do occur in the spelling of a name, or possibly of a date, but it is nearly correct and covers all data of this nature to be found in the original records of this town.
The whole is published at the expense of the Town and by its au- thority.

Book H, Tage 313 .- School District No. 5 bounds are this day altered and fixed as follows, viz:
Bounded easterly by Three Mile Harbor, southeast- erly beginning on Three Mile Harbor at the southeast- erly corner of the farm or lands of the late Benjamin Miller and following his southeast line, which is the line fence between said Miller's land and the heirs of Samuel Parsons, deceased, land to the highway that runs from town to Springy Bank highway; then northerly in said highway, the one from town to the line between the lands belonging to the heirs of the late Joseph Barnes and the land of Abraham Fithian; then following this line to the middle six rod highway; then crossing this highway and fol- lowing the southwesterly line of Jeremiah J. Mul- ford's wood lot to Hand's Creek highway; then fol- lowing the last named highway northerly until it comes to the highway leading across from this Hand's Creek highway at the southeast end of the Grassy Hollow lots to Old Northwest highway, fol- lowing this highway (the Grassy Hollow highway) to said Northwest highway; then southerly in the last named highway till you come to the northeast corner of Col. David Hedges' wood lot; then westerly on said Hedges' north line to the northwest corner of

last named wood lot; then keeping the same course to Bullpath; then following that path northerly un- til it comes to the southeast corner of Ralph Day- ton's wood lot, on said Bullpath; then westerly on said Dayton's southerly line to the road leading from Long Lane to Stephen Ranger's house, following last named road northerly to the southeast corner, on said last named road, of another wood-lot of the said Ralph Dayton; then westerly from this last named course on the southerly line of this (Dayton's lot) to Two Holes of Water path, road or highway, at or near the Two Holes of Water; then said Two Holes of Water path, or &c., northerly to Northwest high- way, the highway that leads from the Turnpike at the head of the Swamp to Northwest village; then follow last named highway westerly and northerly to the southeasterly corner of Thaddeus Russel's wood-lot; then follow said Russel's easterly line northerly to the said Russel's northeasterly corner of the same lot, and from there a straight line to the head of Northwest Creek; westerly by Northwest Creek and Sag-Harbor Bay, and northerly by Gar- diner's Bay.

raised for the support of the poor, and one hundred and eighty dollars for the contingent expenses of this town, for the year ensuing.
Voted-That the meadow grass and Jeremiah Loper Montank be hired out this day at auction, and the money arising from the hire of the grass be paid to the Supervisor, and the money for the Mon- taak to the Overseer of the Poor, on or before the 1st day of September next.
Voted-That any fence equal to two rails with posts, that is, equal to two rails with posts that is three feet, eight inches high in the clear, shall be considered a sufficient fence.
Voted-That all sheep found grazing or running at large on any of the streets, highways, common lands, or town commons, of this town, at any time during the year ensuing, shall be liable to be im- pounded. The owner or owners of such sheep to pay one dollar per head for every sheep so impound- ed, to be recovered with cost of suit in any court hav- ing cognizance thereof, by the person or persons im- pounding such sheep, who shall be entitled to the whole of the money when so recovered.
Voted-That all horses or neat cattle that shall be found running at large on the commons of this town from the eime they are brought from Montank in the fall until they go on again in the spring, shall be liable to be impounded. The owner or owners of all such horses or cattle to pay one dollar per head, to be recovered with cost of suit by the Supervisor. The one-half of the money to be paid to the com- plainant and the other half to the Overseers of the Poor, for the benefit of this town poor.

The owners of such horses or neat cattle to pay fifty cents per head for each horse or neat beast so im- pounded, the whole of the money to go to the person or persons impounding such horses or cattle.
Voted-That no person shall be entitled to sea- weed or drift in consequence of heaping it on any of the shores of this town.

or gather any cranberries on any of the lands or meadows belonging to this town at any time before the 2nd Monday of September next at sun rise, and that every person so offending shall forfeit the sum of ten dollars for every such offense, and the further sum of four dollars per bushel, or at that rate for a smaller quantity, for all cranberries so gathered, to be recovered with cost of suit before any court hav- ing cognizance thereof, which forfeiture when so re- covered to belong to the person who shall prosecute for the same, and the trustees of the town be particu- larly instructed to carry this motion into effect.
Voted-That no person or persons not inhabitants of this town shall be permitted to rake, pick or gather any cranberries or beach plums on any of the lands, beaches or meadows belonging to this town, and that every person so offending shall forfeit ten dollars for every such offense, and the further sum of four dollars per bushel, and at that rate for a less quantity of cranberries or beach plums so gathered, to be recovered with cost of suit before any court having cognizance thereof, which forfeiture when re- covered to belong to the person or persons who shall prosecute for the same.
Voted-That no person shall be allowed to turn out or allow any stone horse over one year old to run at large in this town at any time during the year ensuing, under penalty of ten dollars for every such offense.
Voted-That the trustees of the town be instruct- ed to collect all the money due the town and to pay it over to the Overseers of the Poor.

Resolved, That the Overseers of the Poor be in- structed to call upon the Trustees of the Freeholders and Commonalty of the Town of East-Hampton for all moneys by them collected belonging to the town under the vote passed at the annual town meeting April 2nd, 1850, and in case of the refusal of the said Trustees to pay said money, the said Overseers of the Poor are hereby instructed to proceed against them legally for the collection of the same, and to pay the expenses for the said prosecution out of any moneys that may come into their hands as Overseers of the Poor.
Voted that the above resolution be adopted.
Adjourned to the first Tuesday of April, 1852. at the Meeting House, at 12 o'clock noon.

Book H, Page 372-At the annual town meeting, held in the Town of East-Hampton on the 6th day of April, in the year 1852, the town officers were elected and the town laws and resolutions were pass- ed as follows:
Resolved, That the Trustees of the Freeholders and commonalty of the town of East-Hampton to be chosen at this meeting be elected by yeas and nays and that all the ballots cast for the said office of trus- tee at the present election be void and of no effect. Carried.
Resolved, That Baldwin C. Talmage, Sylvanus M. Osborne, Isaac B. Miller, Jonathan Osborne, Jr., Syl- vester Miller, Hezekiah Edwards, David D. Parsons, Talmage Lester, Stephen Ranger, David Talmage, David Barnes and James G. Leonard be and are here- by elected Trustees of the freeholders and common- alty of the town of East-Hampton for the year ensu- ing. Carried.
John C. Hedges was elected Supervisor.

Voted-That the sum of two thousand dollars be raised for the support of the poor, and one hundred and fifty dollars for the contingent expenses of this town for the year ensuing.
Voted-That the meadow grass and Jeremiah Loper, Montauk, be hired this day at auction and the money arising from the hire of the grass be paid to the Supervisors, and the money for the Montauk to the overseers of the poor, on or before the 1st day of September next.

Voted-That any fence equal to two rails, with posts thae is three feet eight inches high in the clear, shall be considered a sufficient fence.
