Resolved, That a committee of three persons be appointed to take such measures as will give author- ity to the Town of East-Hampton to purchase jointly with the Town of Southampton, such wharf, and the two towns to control its further use jointly.
Resolved, That such committee be instructed to solicit the co-operation of the Town of Southampton in the proposed measure, with the understanding that all to be paid for the property shall be assessed on the respective towns, upon the basis of population, or the assessed value of property, and to be held as a joint purchase to be controlled by the Supervisors and Assessors of the two towns in joint meeting, and all charges incurred to be imposed and collected like other town taxes, according to the ratio of the orig- inal purchase money.
Resolved, That the committee report at a special Town Meeting, the terms upon which the wharf prop- erty and franchise can be purchased, and also what- ever else they may have done by virtue of the fore- going resolutions.

At the annual Town Meeting for the election of Town officers of the Town of East-Hampton, held April 6th, 1875, Samuel B. Gardiner, Benjamin H. Terry and George L. Huntington were duly elected to the office of Commissioners of Excise.
Now, Therefore, we, the undersigned Board of Town officers of said Town, having met on the 12th day of April, 1875, at the office of the Town Clerk, as provided in Section 1, Chapter 444, of the Laws of the State of New-York, for the year 1874, for the pur- pose of deciding the term of office of each commis- sioner, do hereby certify that we have met and pro- ceeded in accordance with Chapter and Section afore- said, and that Samuel B. Gardiner serve for a term of one year, Benjamin H. Terry for two years, and George L. Huntington for three years.

At a special Town Meeting of the Town of East- Hampton, called pursuant to a petition signed by twelve or more resident freeholders of said Town and held at Clinton Academy, in the Village of East- Hampton, on Saturday the 24th day of April, 1875, at one o'clock P. M.
" For the purpose of raising money for the defence of suits," and for the purpose of deliberating in re- gard to the institution or defence and prosecution of a certain action now pending between the " Trustees of the Freeholders and Commonalty of the Town of East-Hampton " and " Josiah Kirk," and "also the propriety of opening the Polls at 9 o'clock at the next annual Town Meeting."
Justice H. B. Tuthill was called to the chair, and Joseph S. Osborne, Town Clerk, acted as Clerk.
After a lengthy discussion without voting upon the objects stated in the call, it was voted "That this meeting adjourn Sine Die."

On motion it was voted that the Board of Town Officers decide at once how long the Polls of this elec- tion shall remain open.

The minutes of the last annual Town Meeting were read.
The Supervisor's account was called for, read, and accepted.
The report of the Commissioners of Highways was read and accepted.
The account of the Overseers of the Poor was read and accepted.
The sum of two hundred dollars ($200.00) was voted to the use of the Supervisor.
It was voted to raise twelve hundred ($1,200) for the use of the Overseers of the Poor.
The sum of two hundred dollars $200.00) was voted to the use of the Commissioners of Highways.
It was voted that the Clerk of the Town Trustees make a report.
The following preamble and resolution was intro- duced by Wilson R. Cooper, and adopted:
Whereas, The Electors of the Town of East-Hamp- ton in the annual Town Meeting assembled, on the first Tuesday in April, 1875, did pass the following resolution, to wit:
Resolved, That the Trustees of the Town of East- Hampton be and they are hereby directed and re- quired to discontinue the action brought in the Su- preme Court for Suffolk Co. by the " Trustees of the Freeholders and Commonalty of the Town of East- Hampton " against "Josiah Kirk," and to stop all proceedings in the motion made for a new trial there- in, and it is further resolved, that the Trustees be required and directed to notify the attorneys for the

Plaintiffs in said action to discontinue such action, and said Trustees be directed and required to pay and settle with the said attorneys and counsel for their legal and proper charges in said action now re- maining unpaid, and
Whereas, The Trustees of the Town in defiance of the instructions of the people as expressed in said resolutions, have refused to discontinue the action against Josiah Kirk, have prosecuted and appealed the same, have been beaten on said appeal, have mulcted the Town in costs and lawyers' fees to an amount exceeding five hundred dollars, and have again appealed to the Court of last resort, thus plac- ing themselves above and beyond the people, there- fore,
Resolved, That we, the Electors of the Town of East-Hampton, reiterate the instructions and direc- tions contained in the foregoing resolution, and that we will steadfastly refuse to authorize the borrowing of any money to pay any costs or expenses in the action of the Trustees and Freeholders, &c., of East- Hampton, against Josiah Kirk, which have accrued since the passage of said resolution. And we repu- diate the action of the Trustees in the prosecution of said action since the last annual Town Meeting, and hold said Trustees individually responsible for all costs and expenses of said action since that time.
Resolved, That the sum of thirteen hundred and fifty dollars be appropriated to the Supervisor's fund for the purpose of defraying expenses incurred by the Board of Health.
Resolved, That the Trustees be and they are hereby directed to quit claim to the Trustees of School Dis-

trict No. 2 of this Town, the triangular lot of land lying between the Wainscott Street highway, the Wainscótt Hollow highway, and the highway running northerly and easterly of Wainscott school house, to be owned, used and occupied by said Trustees and their successors as a site for the District school house of said District.
Resolved, That the money now on hand from the Dog fund be appropriated to the use of the Overseers of the Poor.
Resolved, That the Trustees of the Freeholders and Commonalty of the Town of East-Hampton settle the suits now pending against the Town according to their judgment.

M., at Clinton Academy, for the purpose of deliberating and taking action in regard to the continuation, prose- cution or defence of suits, and the raising monies therefor," Henry B. Tuthill, Esq., was chosen Chair- man, and Joseph S. Osborne, Town Clerk, acted as Secretary.
The petition for the meeting was read by the Clerk.
It was moved that the Town Clerk read the journal of the Town Trustees.
A letter from Wm. Wickham, Esq., two from Miller and Tuthill, and the answer of Sylvanus M. Osborn, Clerk of the Trustees, also the resolution passed at the annual Town Meetings of 1874, 1875 and 1876, in relation to the Trustees, were read by the Town Clerk.
The following resolution was presented and voted on by ballot:
Resolved, That one thousand dollars be raised the ensuing year for the use of the Trustees of the Free- holders and Commonalty of the Town of East-Hamp- ton, and that the above resolution be voted on by bal- lot, the polls being closed.
It was voted that this meeting adjourn Sine Die.

Whereas a certain road leading from the Country road highway south of the "Sandhills " land, late of Noah Barnes, to the Old Sag-Harbor road (now the Turnpike), at " Buckskill," usually called the “ Buck- skill Road," has been heretofore laid out and has been used as an highway for twenty years, but has never been recorded.
Now, Therefore, we, the commissioners of highways of said town of East-Hampton, all of said commis- missioners having been duly notified to attend and deliberate upon the subject of this order,
Do Order, that said road be ascertained, described and entered of record in the Town Clerk's office ac- cording to a survey which has been made under our direction, as follows, to wit: Beginning at a stake (A on the map), which bears from a certain large white oak tree near the bars of the Barnes' lot S. 28} deg. W. dis. 71 links, and from the northern angle of the line fence of heirs of Timothy Hedges N. 192 deg. E. dis. 1 ch., and running thence N. 574 deg. W. 10.70 ch. to a stake (B on the map), from which stake the south corner of Ed. Tillinghast's Babcock land bears
