Whereas a certain road leading from the corner of the homestead of Nathaniel Dominy, formerly known as Peter Murdock's corner, towards Three- Mile Harbor, has been used as a highway for twenty years, but has not been legally described and entered of record.
Now, Therefore, we, the commissioners of highways of said town of East-Hampton, all of said commis- - sioners having been duly notified to attend and de- liberate upon the subject of this order,
Do Order, that said road be ascertained, described and entered of record in the office of the Town Clerk according to a survey made under our direction, as follows, to wit: Beginning at a stake (A on the map) in the centre of a highway running northwesterly by

W. 2.03 ch. distant, shall run S. 46} deg. W. 3.60 ch. to stake (2 on map); then S. 15} deg. Do Order, That the western section of said road from the Hook highway to the highway leading across from Freetown, be ascertained, described and entered of record in the Town Clerk's office of said town, ac- cording to a survey which we have caused to be made under our direction, as follows: To wit: Beginning at a stake (A on the map) which bears from the east corner of the tenant house of Charles D. Hedges, N. 78 deg. E. dist. 1.70 ch., and from the north corner of the house of Stephen L. Hedges, N. 112 deg. E. dist. 3.683 ch., and running thence N. 55 deg. E. 12.48 ch. to a stake (B on the map), then N. 34 deg. E. 12.35 ch. to a stake (O on the map), then N. 272 deg. E. 9.30 ch. to a stake (D on the map), which stake D is opposite to the south line of the above mentioned highway leading across from Freetown.
And we do further order, that the line of said sur- vey (the red line on the map) be the centre of said road, and that said road be of the width of 4 rods at A and narrowing uniformly to 3 rods at B, and from B to D 3 rods wide. Excepting from said highway a triangular lot within the fence of Stephen L. Hedges, having a base line within his lot of 3.68 ch. in length, and a perpendicular on the east end of the triangle, at the old bar-way of 25 links, or one rod.

At the annual town meeting of the Town of East- Hampton, held at Clinton Academy, April 3rd, 1877, H. B. Tuthill, Esq., was called to the chair, and Joseph S. Osborne, Town Clerk, acted as clerk.
The Supervisor's report was called for, read and ac- cepted.
Resolved, That the Supervisor be authorized to bor- row the sum of two hundred and fifty dollars to pay the existing debt.
Resolved, That the sum of seven hundred and fifty dollars be raised for the use of the Supervisor, five hundred dollars for the contingent fund, and two hun- dred and fifty dollars to pay the existing debt.
The account of the Overseers of the Poor was then read and accepted.
Resolved, That the sum of sixteen hundred dollars be raised for the use of the Overseers of the Poor, for the support of the poor, and to pay the debt already incurred.
The report of the Commissioners of Highways was called for, read and accepted.
Resolved, That the sum of two hundred and fifty dollars be raised for the use of the Commissioners of Highways.
Resolved, That the Overseers of the Poor, be, and hereby are instructed to borrow upon the credit of the Town, the sum of two hundred and thirty-nine and

17-100 dollars, to pay deficiencies of account of Over- seers of the Poor for the past year.
On motion of D. H. Huntting, it was,
Resolved, That the Trustees' report receipts and disbursements, debts in favor of or against the Trus- tees, suits pending for or against the Trustees, or any individual Trustee, and the present state of each suit, in the order here stated.
The book account of the Trustees was then read by the Town Clerk, and S. M. Osborne, Clerk of the Trustees, made some statements in relation to the suits which were pending, and the meeting approved and adopted the report.
Nathaniel Dominy introduced the following pre- amble and resolutions, which were laid upon the table for a time, but were shortly taken up and discussed, when the meeting proceeded to ballot upon the reso- lutions.
Whereas, By the several Patents for the Town of East-Hampton, the said town is incorporated by the name of the Trustees of the Freeholders and Common- alty of the Town of East-Hampton, with perpetual succession, and the present Trustees of the Freehold- ers and Commonalty of the Town of East-Hampton are the successors of the original Patentees, named in said Patents, and as such they have and hold the legal title to all the common and unallotted and un- appropriated lands in the said Town of East-Hamp- ton (excepting Montauk) for the benefit of said Town of East-Hampton, and as such the present Trustees have, as their predecessors have had, power and au- thority to maintain and defend actions and suits to

protect and defend the property and rights of the said Town of East-Hampton.
And Whereas, The Trustees of the Freeholders and Commonalty of the Town of East-Hampton, for the purpose of settling a controversy which has for a long time existed between the inhabitants of said Town and the occupants of the land now occupied by Josiah Kirk, have commenced an action for the recovery of the beach, between the bank, or cliff, and the bay, claiming that such beach was unallotted land, the legal title to which is in said corporation for the bene- fit of said Town; in which suit the Court of Appeals has recently rendered a judgment reversing the judg- ment heretofore rendered against the plaintiffs and directing a new trial.
And Whereas, Some costs have already been in- curred by the said Trustees and additional costs will necessarily be incurred for the further prosecution of said action.
And Whereas, The said Trustees, for the purpose of protecting the common fisheries of the said Town of East-Hampton for the benefit of all the inhabitants of said town, commenced actions in a Justice's Court against George W. Hallock, Bradley S. Horton and Michael McCail, respectively, to recover penalties for taking shell fish in the waters of said town, in the name of some of said Trustees, and recovered judg- ments therein, which were collected; but the defend- ants afterwards commenced actions against the said Trustees, or some of them, claiming that the Justices' Court had no jurisdiction.
And Whereas, The said Trustees have already in-

curred considerable expense in the defence of said ac- tions,
Resolved, That there be raised in said Town of East-Hampton, the sum of eight hundred dollars for prosecuting the said suit against Josiah Kirk.
Resolved, That there be raised in said Town of East- Hampton the sum of fifteen hundred dollars for de- fending the said suits against the said Trustees, or individual members thereof, brought by George W. Hallock, Bradley S. Horton and Michael McCail, re- spectively.
The polls of the election having been declared clos- ed and the ballots canvassed, there were found one hundred and ninety-four votes against, and one hun- dred and sixty-seven in favor of the appropriations, and one vote blank. The ballots for town officers be- ing next canvassed, the following named persons were declared duly elected officers of this town for the en- suing year:

Do Order, That the highway at the Springs in said town, beginning at the Fireplace highway nearly op- posite to the house late of Timothy Miller, deceased, and running southeasterly past the school house and over the bridge and head of the creek to the Springs branch of the Fireplace highway, and then onward, mainly between the lands of David D. Parsons and lands of Isaac Edwards, to a point near the house of Thomas Davis, be altered so as to conform to a sur- vey which we have caused to be made of the same, as follows, to wit: Beginning at a point on the Fire- place road, northerly of the school house, which stake bears from the north corner of the school house N. 32 deg. W. dis. 2.53 ch. (A on the map) and running thence S. 263 deg. E. 2.92 ch. to a stake nearly oppo- site to the public cemetery (C on the map), then S. 54 deg. E. 7.58 ch. to and over the bridge to a stake (D on the map), from which stake the S. E. corner of Julius D. Parsons' house bears N. 793 deg. E. dis. 2.04 ch. The said highway to be 4 rods wide at A on the Fire- place road, narrowing uniformly to 3 rods at C, op- posite the west corner of the cemetery, and continuing 3 rods wide to the point of meeting the north line of the highway as altered on the south side of the school house (3 on the map), thence merging uniformly into said last mentioned highway to the point D on the map, where it is wholly included in the 4 rods of the same. The undersigned, Commissioners of Highways of the Town of East- Hampton, in the County of Suffolk and State of New-York, having met at the house of David C. Barnes, in the village of Amagansett, in said town, to decide upon the alteration of a certain road leading from the west end of Amagansett Street or highway, nearly opposite to the house anciently of Jacob Schellinger, southerly to and through a valley

called " Indian Well-Hollow " to a certain ancient highway which ran along the south ends of the "In- dian Well-Plain lots."
All the said Commissioners having been duly noti- fied to attend this meeting of the Commissioners, for the purpose of deliberating on the subject of this or- der, and the consent in writing of Charles Miller and all other owners of lands taken for such alteration having been first had and obtained,
Do hereby Order, That the line of the said road be, and the same is, hereby so altered as to run as fol- lows, to wit: The west line of the highway (the red line of the map) beginning at a certain stone (A on the map), which bears from a cedar tree standing in the east corner of the door-yard of Mary A. Schelling- er S. 53 deg. E. dis. 2.15 ch. and which also stands in a' line with the street fence of Benjamin Hedges, dis- tant one chain from the west corner of his lot as the fences now stand, and running thence S. 223 deg. E. 3.46 ch. to a stone (B on the map) at the said fence of Charles Miller, nearly opposite to the line fence be- tween Benjamin Hedges and Thomas M. Edwards, or heirs of Isaac Barnes; then S. 19} deg. E. partly through enclosed premises of Charles Miller and through a certain willow tree in front of his premises 5.82 ch. to another stone (C on the map) set opposite to angle in the highway line fence of Thomas M. Ed- wards and 75 links distant from said angle; then S. 25 deg. E. 32.04 ch. to a stone (D on the map) set op- posite to and on a line with the south fence of Joshua B. Edwards' land, and also opposite to a stone (5 on the map) which is three rods easterly of D, and marks the terminus of the east line of the highway. The in-

termediate distances of the last described line being ( 1 to stone at north angle of " Plain-Way " highway 5.41 ch., then 1, 2 to a point opposite to a stone placed at the southwest corner of the land of said Thomas M. Edwards and the supposed junction of an ancient highway, then 2 D three chains to the termius of this survey. The east line of the highway running straight from the street corner of Benjamin Hedges (3 on the map) to the angle in Thomas M. Edwards' fence (4 on the map); then straight on the line of fence as it now stands, and parallel with the west line of the high- way, to the stone at the terminus (5 on the map). And we do further order that the said highway be of the width of four rods at A, narrowing uniformly to three rods at B, and from B to D three rods wide. And it is further ordered that said parts of the present road as are not included in the above description, be and the same are hereby discontinued, and that this order and the survey of said road made under our direction be filed in the office of the Town Clerk of East-Hamp- ton, according to the statute in such case, made and provided.

Resolved, That the amount of eighty-seven dollars and forty cents, now remaining in the hands of the Supervisor from the Dog Fund, be appropriated to the contingent fund of the town, to be used in paying out- standing bills.
Resolved, That the Supervisor be authorized to bor- row on Supervisor's note, the amount of one hundred and seventy-five dollars, to pay existing indebtedness of the contingent account of the town.
Resolved, That the sum of six hundred dollars be raised for the use of the Supervisor for the contingent expenses of the town for the ensuing year.
The account of the Overseers of the Poor was called for, read and accepted.
Resolved, That the Overseers of the Poor be author- ized to hire upon note the sum of one hundred and ninety-seven 37-00 dollars, to pay the deficiency of their bills.
Resolved, That the sum of two thousand dollars be appropriated to pay the notes against the Overseers of the Poor, and for the relief of the poor for the year ensuing.
The report of the Commissioners of Highways was called for, read and accepted.
Resolved, That the sum of two hundred dollars be raised for the use of the Commissioners of Highways,

Resolved, That the sum of five hundred dollars be appropriated for the use of the Trustees.

Resolved, That it is not advisable under present cir- cumstances to erect a new jail for this county, and that the Supervisor of this town be and is hereby in- structed to vote against building a new jail.
Resolved, That the business of this meeting, save canvassing the ballots, do adjourn to the first Tues- day of April, 1879, at 12 o'clock M., and that the polls of the election close at four (4) o'clock P. M. of the same day.
