on the map, from thence bearing N. 772 degrees W. dist. 14.57 chains to a point marked G on the map, said point. G being the end of said survey, which is only a part of the way to Georgica. And we do furth. er order that the line of said survey be the center of said highway and that the width of said highway at A and from A to I be three rods wide dist. 26.02 chains at 2.34 links wide dist. 2.23 chains, at C 40 links wide dist. 1.05 chanis, at D and from D to G three rods wide dist. 47.06 chains, said highway to remain a highway forever.
And, whereas the Commissioners of Highways have received a petition in due form of law from twelve Freeholders as follows, to wit: "The petition of the undersigned Freeholders of the said Town of East Hampton, respectfully show that all that part of the common land in the said Town of East Hampton re- cently sold by the Trustees of the said Town of East Itampton to Ezekiel Miller and Isaac W. Miller, re- spectively, which was embraced within the bounds of the highway leading from town street to Georgica is unnecessary for the use of the public as a highway, and they ask that the said highway leading to Georgi- ca be so altered that the southerly boundery of the lands sold by the Trustees to the said Ezekiel Miller and Isaac W. Miller respectively, shall be the north- erly margin of the said highway, the same being the hne where the said Ezekiel Miller and Isaae W. Miller lately erected their respective fences and boundaries; and that all that part of the said highway or which may heretofore have been regarded as constituting a part of said highway, which was included within the said boundaries, be discontinued as a highway." Before the County Judge of Suffolk County, in the matter of the highway at Wainscott Hollow.
Thomas Osborne having appealed to the County Judge of Suffolk County from an order of the Con- missioners of Highways of the Town of East-Hamp- ton, dated June 27th; 1863, relative to the highway at Wainscott Hollow, a copy of which order and no- tice of appeal are hereunto annexed, and the County Judge having assigned the 19th day of August, 1863, on the said highway, as the time and place of hearing the same, and caused notice thereof to be given to the said Commissioners and other parties interested, and Laving attended at the time and place aforesaid, and been attended by said appellant and by said Commis- sioners and their counsel, and heard the allegations of the parties.
And it appearing to the County Judge that said or- der of said Commissioners so appealed from purports to be simply the ascertaining and describing a high- way heretofore laid out and that there is no appeal to the County Judge from such an order.
It is ordered that said appeal be and it is hereby dismissed and it is further ordered that said appel- lant, Thomas Osborne, do pay the County Judge's fees in this matter amounting to eight dollars and twelve cents.

Before the County Judge of Suffolk County, in the matter of the highway leading from the country road at the south end of East-Hampton village towards Georgica.
The Commissioners of Highways of the Town of East-Hampton, having made an order, dated July 15th, 1863, acertaining and describing and entering of record a portion of said highway and declaring it to be the highway and discontinuing all the remain- der of said highway.
And, Noah Barnes having appealed to the County Judge from said order, which notice of appeal is here- unto annexed. And the said Judge having assigned the 20th day of August, 1863, on the said highway, as the time and place of hearing the same, and caused notice thereof to be given to the said Commissioners and to all parties interested, and having attended at the time and place aforesaid, and been attended by said appellant and by said Commissioners and their counsel, and heard the proofs and allegations of the parties; and it appearing to the County Judge that the whole order taken together is in effect the reduc- ing of the width of a vacant piece of ground conceded to be a highway, and that the chief object In said re ducing and locating was to enable the Trustees of the town to give title to the piece of land discontinued as a highway.
And it further appearing that said reduction ren- ders the track reserved for a highway crooked, where- as the track generally heretofore used from time im- memorial was straight and that said described track is narrow and in other respects inconvenient for the

use of the persons travelling the said highway, and unsatisfactory to the neighboring residents.
It is therefore ordered that said order of the Com- missioners, and the whole thereof be and the same is hereby reversed; and it is further ordered that said Commissioners do pay the County Judge's fees on this hearing, amounting to eight dollars and twelve cents. August 24th, 1863.

Fantigo Lane Highway.
Twelve persons, liable to be assessed for highway labor in the Town of East-Hampton, in the County of Suffolk, having made application, verified by oath to the undersigned, Commissioners of Highway in said town, for an alteration in the road or highway. herein- after particularly described; and all of the said Com- missioners having met at the house of Edward Baker cn the 27th day of August in the year 1863, for the purpose of deliberating on the subject of this order, and of the said application. It is ordered and deter- mined by the said Commissioners that the said high- way be altered according to the following survey which the Commissioners have caused to be made thereof:
The center line of the alteration is to begin at a mere stone, placed in the center of the present high way, midway between a place known as Gile's corner, and a stone at the corner of a lot of ground of Stephen Hedges'; the highway to be ten rods in width at the

place of beginning and the center line running thence north eighty-six degrees east (N. 86 degrees E.), three chains and ninety-one links (3 chains 91 links) to a. stone placed in the center of the highway, which is there six and a half rods in width; thence north eighty degrees east (N. 80 degrees E.) fifteen chains and nine links (15 chains 9 links) to a stone placed in the center of the highway, which is continued of the same width of six and a half rods; thence north eighty-six and a half degrees, east (N. 86} degrees E.) eight chains and fifty-four links (8 chains 54 links), to a stone placed in the center of the highway, between the lands of the heirs of Edward M. Baker, deceased, and of the afore- said Edward Baker, to which last mentioned stone the highway is continued of the same width of six and a half rods.
In witness whereof the Commissioners of Highways of the Town of East-Hampton, in the County of Suf- folk, have hereunto subscribed their names this twen- ty-eighth day of September in the year one thousand eight hundred and sixty-three (1863).

At a meeting of the Commissioners of Highways of the Town of East-Hampton, County of Suffolk, aforesaid, held in said town at the house of Ezekiel Miller on the 16th day of November, 1863, all of the said Commissioners having met and deliberated on the subject of this order, it appearing to the said Com- missioners that the westerly and northerly parts of a certain road in said town running through Georgica to the country road from East Hampton to Bridge Hampton, has been used as a highway for forty years, but has not been recorded. It is ordered by the said Commissioners that the said parts and portions of the said road be ascertained, described and entered of record, and the said Commissioners do further order that the description, courses and distances thereof be according to a survey which they have caused to be made of the same, be as follows, viz:
Beginning at a point in a map or diagram of the easterly part of said Georgica highway, made by David H. And the said commissioners do further order that the description, courses and distances thereof be ac- cording to a survey which they have caused to be made of the same and which is hereunto annexed as follows, viz: Beginning at a point in a survey and plot of the easterly part of a highway from Georgica highway to Apaquogue, made by Jeremiah Miller, and bearing even date and filed same time herewith, marked by a X, distant 1.40 chains from the S. W. end of line Y on said map or plot, and running thence N. 26 degrees W. 4.42 chains to a stake marked on an- nexed map W., thence N. 55 degrees W. 7.53 chains to a stake in the center of Georgica highway marked on the said map by the letter V, and that the line of said survey be the center of said road, and that said road be of the width of three rods.

At a meeting of the commissioners of highways of the towns of East-Hampton and Southampton, in said county of Suffolk, held in the said town of Southamp- ton on this ninth day of November, 1863, it appearing that the highway upon the line between the two said towns leading from highwater mark on the shore of the Atlantic ocean to the main country road leading from Bridge-Hampton to East-Hampton and now used as a highway, was laid out but not sufficiently de- scribed on the 25th day of June, 1695, as will appear from a record made thereof in the "Liber A, No. 2," page 170, of Southampton town records and from a record made thereof in " Liber A, page 128," of East- Hampton town records, which said records are both in words and figures identical and are as follows: " It is also agreed upon by us above named in behalf of each town, that there shall be a highway from the stake at the beach to ye above said pine tree on the north side of the Island, and East-Hampton leaving out to the eastward of the above bounds or line one pole wide of land from ye said stake at the beach to ye above said pine tree, and Southampton to leave out one pole wide of land from ye stake to ye above said pine tree to the westward of the said bounds or line, and that to lye for a highway forever."
Now, therefore, we, the undersigned, commissioners of highways of said towns, do order that, that part of said road hereinbefore described as extending from the ocean to the main country road, be ascertained, described, and entered of record in the Town Clerk's offices of the said towns of East-Hampton and South-

ampton according to a survey which has been made under our direction, as follows:
Commencing at a stake at highwater mark on the south beach (marked A on the map) and running across the beach and Wainscott plain on the line of an old ditch heretofore known as the line on a course N. 35 degrees 20 minutes W. 30 chains and 73 links to a stake near the house of Hermon Strong (marked 1 on the map); then on the same course 15 chains and 33 links to a stake in the center of the lane opposite the south end of Harvey Hedges' bars (marked B .on the map); thence on a course N. 29 degrees 45 minutes W. 44 chains 90 links to a stake in the lane (on a line with the front of James Strong's barn, distant from the east corner of said barn 98 links) (marked C on the map); thence N. 25 degrees 15 minutes W. 17 chains 55 links to a stake (marked D on the map); thence N. 30 degrees W. 16 chains 43 links to a stake opposite to the northwest end of the Wainscott hollow highway (marked E on the map); thence N. 32 degrees 15 min- utes W. 6 chains and 22 links to a stake (marked F on the map); thence N. 32 degrees W. 6 chains and 98 links to a stone said to occupy the former place of a white oak tree, which stone is one rod from the cor- ner of Levi Hedges' land and marks an angle in the boundaries of the towns of East-Hampton and South- ampton (marked G on the map), which said survey fol- lows the line between the two towns aforesaid.
And we do further order that the line of said sur- vey be the center of said road, and that the said road

Terbell in the vil- lage of Wainscott on the 30th day of March, 1864, all of said commissioners having been notified to attend and deliberate upon the subject of this order, having examined into the facts and circumstances of the case, it appearing to the said commissioners that a certain road or highway in the village of Wainscott in said town running from the highway which run- neth westward through Wainscott street, commen- cing at the north side of the school house running westwardly until it intersects the Wainscott hollow highway, has been used as a highway for forty years but has not been recorded. The center line of said highway to commence at a point marked A on the map (from said point A the east corner of the school house bears S. 56 degrees W. dist. 0.38 chains, also from said point A the N. corner of said school house bears N. 87 degrees W. dist. 45 links), running N. 49 degrees W. dist. 2.13 chains to a point marked B on the map, from thence running N. 43 degrees W. dist 14.73 chains to a point marked C on the map, said point C being the termination of said highway intersecting the center of Wainscott hollow highway.
The width of said highway to be three rods wide at A on the margin of Wainscott street highway between the school house and the burying ground, and to con- tinue three rods wide the whole length, excepting that part on which the north corner of the school house projects into said highway.

Resolved, That the collector, John H. Youngs, be ex- onerated from the payment of the sum of twelve dol- lars which said collector says is not collectable.
Resolved, That the Collector this day elected shall pay over every dollar to the Supervisor specified in his warrant.
Resolved, That the wife of Charles G. Bennett re- ceive the same monthly pay as the wives of volunteers who have gone to the war from this town, and that her pay commence at the time said Charles G. Ben, nett entered the service.
Resolved, That the sum of eight thousand dollars or so much thereof as may be necessary, be raised up- on the taxable property of this town for the purpose of procuring volunteers to fill the quota of the town, and for contingent expenses of procuring such volun- teers under the last call of the President for 200,000 men.
Resolved, That a committee be appointed to act in conjunction with the Supervisor to procure such vol- unteers, and be authorized to pay such sum to the vol- unteers procured and such sums for procuring them . as may in their judgment be necessary, provided that the sum so paid does not exceed $400 for each recruit or volunteer thus procured. Said committee are the Supervisor, David H. Huntting, Samuel P. Osborn, Jeremiah T. Parsons, Jr. and William H. Tooker.
Resolved, That the suit now pending in the law be- tween the commissioners of highways of said town of Fast-Hampton and the heirs of Nathaniel Huntting be withdrawn.

The following resolutions were introduced and adopted unanimously.
Resolved, That the Board of Town Auditors of the Town of East-Hampton are hereby authorized in ac- cordance with the provisions of the Act of the Legis- lature of the State of New York passed February 9th, 1864, known as the " Bounty Law," to issue bonds of the Town for the purpose of liquidating the indebted- ness of the Town incurred for paying bounties to vol- unteers into the Military or Naval service of the Unit- ed States, and credited to the quota of this Town un- der the calls of the President of the United States, dated February 1st, 1864, and March 14th, 1864, for

the paying the incidental expenses of such volunteer- ing, which bonds shall not be of a less denomination than one hundred dollars, nor payable at a longer period than ten years, and the said Board of Town Auditors are further authorized to determine, subject to the above limitations, what amount of bonds shall be paid in each year, and at what yearly rate of inter- est, not exceeding seven per cent. The Board of Su- pervisors of Suffolk County are hereby authorized and requested to levy a tax upon the taxable property of the Town of East-Hampton to meet the indebtedness of the Town upon such bonds as they shall from time to time become due.
