Know ye, that I, Alfred Clark, of the Town of East- Hampton in the County of Suffolk, owner of two sail boats, one of which is called " The Bloomer " and the other having no name, for and in consideration of the

sum of seventy-five dollars, lawful money of the Unit- ed States of America, to me in hand paid before the sealing and delivery of these presents, by Samuel B. Gardiner of the same place, the receipt whereof is hereby acknowledged, have bargained and sold and by these presents do bargain and sell unto the said Samuel B. Gardiner, his executor, administrators, and assigns, the said two boats, together with the masts, sails, oars, anchors, cables, and all other fix- tures, necessaries and appurtenances, thereunto ap- pertaining and belonging. To have and to hold the said boats and appurtenances, unto him, the said Samuel B. Gardiner, his executors, administrators, and assigns, to his and their only sole and proper use, benefit and behoof forever.


And I, the said Alfred Clark, have and by these presents do covenant and agree for myself, my heirs, executors, and administrators, to and with the said Samuel B. Gardiner, his heirs, executors and adminis- trators to warrant and defend the said boats or ves- sels with the appurtenances against all and every per- son and persons whomsoever, of all and singular which said boats or vessels with the fixtures, neces- saries and appurtenances.


I, the said Alfred Clark, have put the said Samuel B. Gardiner in full possession, by delivering to him the said Samuel B. Gardiner, one oar at the sealing and delivery of these presents, in the name of the whole of said boats or vessels, with the appurtenances hereby bargained and sold, or mentioned or intended so to be, unto him, the said Samuel B. Gardiner, as aforesaid.

We, the Commissioners of Highways of the Town of East-Hampton, all of said Commissioners having been notified to attend and deliberate upon the subject of this order, having examined the prem- ises and having deliberated upon the facts and cir- cumstances of the case, Do Order, that a part of said highway be ascertained, described and entered of re- cord according to a survey which they have caused to be made of the same, as follows: The center of said highway beginning at a stake (marked A on the map),

which bears from the west corner of Charles R. Day- ton's lot, which he bought of Col. Samuel Miller-S 39 degress E. distant three chains and 89 links and running S. 362 degrees W. 8 chains 97 links to a stake (B on the map); then S. 262 degrees W. 8.51 chains to a stake (C on the map); then S. 72 degrees W. 4.91 chains to a stake (D on the map); then S. 15 degrees W. 5.06 chains to a stake (E on the map), opposite to the west corner of Josiah C. Dayton's land, which he bought of Henry P. Hedges, Esq., said line to be the center of the highway, and said highway to be five rods wide.

Conklin a tract of land, being at the west end of Wainscott, called common land, for the sum of ten dollars, bounded as follows, viz., north and east by common land, south by a highway, west by the land of the heirs of James Edwards, deceased; being five rods from east to west, by the highway, and eight hods from south to north, containing forty rods, by Quitclaim Deed.

Now, therefore, we, the Commissioners of Highways of said Town, all of said Commissioners having been notified to attend and deliberate upon the subject of this order, having examined into the facts and circumstances of the case and having become satisfied that said high- way is necessary for the public convenience.

Schellenger N. 691 degrees W., distance 1.76 chains (marked A on the map), and run- ning N. 24 degrees W. 8.05 chains to a stake (marked B on the map); then N. 32 degrees W. 7.08 chains to a stake at the bars between Great Close and Gardiner's woods (marked C on the map); then N. 43 degrees W. 10 chains to a stake nearly opposite to the bars of J. C. Schellinger (marked D on the map); then N. 44} de- grees W. 11.24 chains to a stake at the bars between Gardiner's woods and Gardiner's stubble (marked E on the map); then N. 492 degrees W. 11.91 chains to a stake at Town Lane (Marked F on the map), which stake is on the south side of said Town lane highway and distant from the corner between the land of Jacob and Jonathan E. Schellinger on north side of Town lane one chain and twenty-eight links and is the northern termination of this highway.

Resolved 1st, That the accounts of the Supervisor and Overseers of the Poor be approved and accepted by this meeting.


Resolved 2d, That the sum of two hundred dollars be raised for the contingent expenses of the Town for the year ensuing.


Resolved 3d, That the sum of twelve hundred dol- lars be raised for the support of the poor of the town for the year ensuing.


Resolved, To accept of vote 5th, 6th, 7th, 8th, 9th, 10th, as recorded last year.


Voted, to repeal vote 11th as it stands on the book.


Resolved, To accept of votes 12th and 13th as they stand recorded last year.


Resolved 14, That this meeting disapproves of the proceeding of the Commissioners of Highways of this town in narrowing and discontinuing highways mere- ly for the accommodation of individuals, by taking from the people and giving it to individuals without any compensation, charging the expenses to the town.


Resolved 15, That the Commissioners of Highways of this town be and they hereby are instructed that whenever they shall lay out any highway which is on record in the Town Clerk's office of this town, cause the same to be laid out to the full width as it is re- corded. And that whenever they shall lay out any road or street which has heretofore been used as a highway and not recorded, they cause the same to be laid out to the full width, as it has heretofore been so used.

We, the said commissioners of highways think it necessary that a highway be laid out from the street of Amagansett to the said highway, which commences on a line with the rear of the Methodist Episcopal church lot, as will appear by an order of the commis- sioners of highways in the Town Clerk's office, dated March 10th, 1858,


Do order that a highway be laid out from the south- west end of Amagansett street to the southward of the land of Jonathan C. Schellinger, and eastward of the church lot of the Methodist Episcopal church, two rods wide, to meet the highway, three rods wide, laid out March 10th, 1858, in pursuance to the session law passed in the year 1858. According to a survey which they have caused to be made of the same as follows, to wit: Beginning at a point on the line of the street 122 links eastward of the said church lot and 37} links westward of the corner of Jonathan C. Schellinger's house lot (marked 1 on the map) to a stake on a line with the rear of the church lot, dis. 1.62 chains (marked A on the map), said stake being the center line of the three rod highway laid out March 10th, 1858, which stake bears from the east corner of the church due north dist. 1.37 chains, and from the west corner of the house of Jonathan C. Schellinger N. 694 degrees W. 1.76 chains, being the northern termination of this highway.

Whereas application has been made in due form of law to Isaac Schellenger, George W. Huntting and Sineas C. M. (Talmage, Commissioners of Highways, to wit:


" The petitioners, of the undersigned residents of said town and liable to be assessed for highway labor, respectfully showeth: That that part of the highway or common land in said town leading from the home- stead of Nathaniel Dominy towards Three-Mile Har- bor, to a point opposite to the east corner of the land of Nathaniel Baker, has been used as a public high- way but has not been sufficiently described and en- tered of record. That all that part of said highway or common land lying northwardly of a line drawn par- allel with the front fences of Isaac Edwards, Paul Fithian, Nathan Miller and Stephen Scherrill to a point nearly opposite, to the barn and yard of said

Stephen Scherill, and thence in a northwardly direc- tion as nearly as may be parallel with the westerly bounds of the land of Phebe Bower and others to a point opposite to the aforesaid east corner of Nathan- iel Baker's land and fifteen rods distant from said fences and bounds, has become useless and unneces- sary as a public highway and may be discontinued. Your petitioners therefore pray that you will cause the said highway to be ascertained, described and en- tered of record, so as to be of the width of fifteen rods from the aforesaid bounds, and that you will make an ' order discontinuing all of said highway lying either side of said fifteen rods in width, as above described, or so much thereof as you shall deem expedient.


" Your petitioners also respectfully set forth: That that part of the Fireplace highway beginning at the above mentioned part nearly opposite the barn of said Stephen Sherill, where it unites with the above high- way, and running between the land of said Stephen Sherill and land of said Phebe Bower and others to the cross highway in front of Shem Gardiner's house, has not been sufficiently described and entered of rec- ord.


" Your petitioners therefore pray that you will cause the said highway to be ascertaind, described and entered of record, so as to be not less than four rods in width in any place from the fences which en- closes the land of said Stephen Sherill."


Now, therefore, we, the undersigned, commissioners of highways of said town of East-Hampton, all of said commissioners have met and deliberated on the sub- ject of this order and examined the premises and facts in the case,

The center of said highway to Three-Mile Harbor beginning at a point (marked A on the map), said point A bears from east corner of Nathaniel Dominy's homestead N. 22} degrees W. dist. 2.37 chains, also said point A bears from south corner of Isaac B. Mil- ler's house S. 733 degrees E. dist. 5.04 chains, and run- ning N. 7₺ degrees E. dist. 3.28 chains to a stake (marked B on the map), then N. 10 degrees E. dist. 17.06 chains to a stake (marked ( on the map), then N. 2 degrees W. dist. 5.89 chains to a stake (marked D on the map), then N. 52 degrees W. dist. 6.97 chains to a stake (marked E on the map). Point E is the ter- mination of said highway uniting with and running into Three-Mile Harbor highway. (At the cross high- way running over Chatfield's hill 10 poles wide.)


And we do further order that the line of said survey be the center of said highway, and that the width of said highway at A be 4.31 chains wide, and at B and from B to C 4 chains and at E 3.60 chains wide. Also we do further order, that the said Fireplace highway commence at a point (marked F on the map), said point F bearing from north corner of Stephen Sher- rill's kitchen N. 114 degrees W. dist. 2.44 chains, said point F being the center of said highway and running N. 343 degrees E. dist. 3.06 chains to a stake (marked G on the map), then N. 6 degrees E. dist. 7.04 chains to a stake (marked H on the map), then N. 35 degrees E. dist. 4.07 chains to a stake (marked J on the map).
