It was resolved, that a committee of three be ap- pointed by the chair, with power to proceed to the erection, completion' and furnishing of a Lock-up, and to make all necessary arrangements therefor, and Messrs. Strong, Mulligan and Osborne were appoint- ed.

It was also resolved that the sum of Five hundred dollars be raised by tax for the use of the Town Trus- tees for the ensuing year, and that the same be in- serted in the next tax levy of this Town.


Resolved, That the sum of Five Hundred dollars be raised by tax this present year for the contingent fund account of the Supervisor.


Resolved, That the sum of One Hundred and eigh- teen dollars be raised by tax to pay the amount due upon the accounts of the Commissioners of Highways, as audited, and that the same be inserted in the next annual tax levy of this town, and that the said Com- missioners be and are hereby authorized to hire the same upon their note as such Commissioners.


The reports of the Overseers of the Poor and the Supervisors' contingent accounts were called for and read.


On motion it was resolved that when this meeting adjourn, it be to meet at Clinton Hall on the first Tuesday of April, 1895, at 12 o'clock M.

Whereas on the second day of December, 1893, we, the undersigned, John Sherry, Elisha O. Hedges and Henry A. Fordham, all of the Town of Southampton, County of Suffolk and State of New York, were an-

pointed by the County Court of Suffolk County, Com- missioners to determine upon the uselessness of a highway in the Town of East-Hampton, in said Coun- ty, proposed to be discontinued, which highway is in the order appointing described as follows:


" The highway at Wainscott in the said Town, run- ning from the highway leading from Sagaponack to East-Hampton to the highway running from the Main country road to East-Hampton; such highway is bounded on one side by land of School District No. 2, in said Town of East-Hampton, and on the other side by the cemetery or common lands of the Town of East-Hampton," and to assess the damages by reason of the discontinuance of such highway;


And whereas, before proceeding to act under the said order, we each took the constitutional oath of office and thereafter appointed the 10th day of April, 1894, at two o'clock in the afternoon, at the residence of Frank E. Hopping, at Wainscott, in the said Town of East-Hampton, as the time and place at which we would all meet for the purpose aforesaid, and to examine the said highway and to hear the Commis- sioners of Highways of the said Town of East-Hamp- ton and all others interested in the proceeding;


And whereas due notice of said meeting was given as required by law, at least eight days previous there- to, by posting such notice in three public places in the said Town of East-Hampton and by serving the same on the owners and occupants of the land through which the said road passes and on the Commissioners of Highways of the said Town of East-Hampton;


And whereas we all met at the time and place afore- said, and were attended by the applicant for the said

road, and by William A. Hedges, John S. Penny and Everett W. Babcock, Commissioners of Highways of the said Town, and we personally examined the said highway and heard the reasons offered for discontin- uing said highway and the testimony offered for the same (no reasons or testimony having been offered against the same), and reduced to writing all such evidence given before us, now we the said Commis- sioners, do decide and certify, that the said highway proposed to be discontinued is useless and we assess the damages to each of the following parties by rea- son of such discontinuance at nothing. namely, the Town of East-Hampton. the Trustees of the Freehold- ers and Commonalty of the Town of East-Hampton and School District No. 2 of the Town of East-Hamp- ton and the Wainscott Cemetery Association.

At a Special Town Meeting held pursuant to call of at least (25) twenty-five taxpayers upon petition, June 22nd, 1894, at Clinton Hall, in the Town of East- Hampton, there were present all members of the Town Board, and Thomas F. Bisgood, Esq., was called to the chair, and Joseph S. Osborne, Town Clerk, act- ed as Secretary of the meeting.


On motion the resolution, embodied in the petition, was voted on by ballot and the polls were kept open for two hours, at which time the box was opened and the ballots counted, and there was found to be one hundred and fifty-three against and thirty-six for the appropriation, which was therefore declared lost.


The meeting upon motion adjourned sine die.

Hedges, in said Town, all of the Commissioners having met and delib- erated upon the subject of this oder upon the appli- cation of Frank E. Hopping, a person liable to be

assessed for highway labor in said Town, and upon the certificate of Elisha O. Hedges, Henry A. Ford- ham and John Sherry, Commissioners duly appointed by the County Court of Suffolk County, made after duly hearing all persons who appeared before them at a duly advertized meeting to present reasons for and against the discontinuance of a certain portion of a highway in said Town of East-Hampton, which said certificate sets forth that such highway is use- less, the description of which highway appears in said certificate as.


" The highway at Wainscott, in the said Town, run- ning from the highway leading from Sagaponack to East-Hampton to the highway running from the Main country road to East-Hampton: such highway is bounded on one side by land of School District No. 2 in said Town of East-Hampton, and on the other side by the cemetery or common lands of the Town of East-Hampton, and which certificate was filed in the office of the Town Clerk of East-Hampton on the 20th day of April, 1894.


It is ordered and determined by the undersigned Commissioners that the highway as herein described be and the same is hereby discontinued.

Application to us, the Commissioners of Highways of the Town of East-Hampton in Suffolk County, for permission to plant or allow to remain, a line of shade trees upon the Main street of the Town of East-Hamp- ton, at a greater distance from the outside line of the highway than is usually laid down as proper and right, having been made, and we having been upon the ground and made an examination into the reason- ableness of the request, do hereby allow that in con- sideration of the shape of the ground in front of the premises of C. P. B. Jefferys, trees may be set and remain upon the outside of the bank adjoining Town Pond and near the edge of the bank, in conformity with a plot to be filed in the Town Clerk's office at the same time as this order, the trees to be upon the curve of the bank, at distances from the outside line of the highway varying from 354 feet to 54 feet, as shown on said plot or map.


We believe that by this order the beauty and use- fulness of the highway will be added to and the safe- ty of the traveling public enhanced.


Given under our hands at East-Hampton the 7th day of July, 1894.

At a meeting of the Commissioners of Highways of the Town of East-Hampton, in the County of Suf- folk and State of New York, on the 28th day of Sep- tember, 1894, for the purpose of deliberating on the propriety of altering a highway in said Town called Huntting Avenue or Lane, upon the application of Emma D. Woodhouse, a person liable to be assessed for highway labor in said town, and a release from the owner of the land through which the proposed alteration will pass, having been given, it is ordered and determined that a highway shall be and the same is hereby laid out and altered and the record thereof amended to conform to the following survey which we have caused to be made of the same, beginning at a point in the center of said Huntting Lane high- way upon the line which divides the property of Mary H. Parsons from the land of said Emma D. Wood- house, and running thence (magnetic meridian) S. 743 deg. E. about 435 feet to what is known as Station 3 of record of Huntting Avenue highway, dated Jan. 10, 1894.


This alteration will remove Station No. 2 of record 1722 feet nearer to Main street and will encroach up- on the land of Emma D. Woodhouse, which lies north of said highway, as follows: Beginning with noth- ing at the point opposite the place of starting and uniformily widening to 91 feet opposite station No. 2 of record, thence gradually and uniformily narrow- ing to nothing at a point opposite Station No. 3, said land having been formally released to the Town for highway.

shall be the center of said highway as altered and that the width shall be fifty feet, and that all portions of the highway as heretofore recorded, not included in the foregoing description be and the same are hereby discontinued.

At a meeting of the Commissioners of Highways of the Town of East-Hampton, in the County of Suffolk and State of New York. held at the house of William A. Hedges, in said Town, on the 18th day of March, 1895, all of said Commissioners having been notified to attend and deliberate upon the subject of this or- der for the laying out and alteration of a certain high- way in said Town, commonly known as the highway in the Hook.


It is hereby ordered, determined and certified that a public highway shall be and the same is hereby altered and the record thereof amended as follows:


Whereas, the Commissioners of Highways of this Town did on the 8th day of May, 1871, sign and exe- cute an order defining the highways in the Hook,

which order was duly recorded on the 31st day of July, 1871;


And whereas in said order the following described portion of the open or common land adjoining the north end of the cemetery was not included as high- way but was excepted therefrom, and by the map filed at this time was described as an addition to said cem- etery, said parcel of land being described on said map as beginning at the northwest corner of said cemetery and running N. 27 deg. E. 1.50 chains to 2; thence S. 654 deg. E. 2.03 chains to 3; thence S. 23} deg. W. 1.50 chains to the southeast corner of said cemetery, and thence following a line parallel with the course de- scribed as S. 654 deg. E. to the point or place of be- ginning, 203 chains more or less.


The present measurements and descriptions with compass set for magnetic meridian are as follows:


Beginning at northwest corner of said cemetery and running N. 36 deg. E. 99 feet; thence S. 56 deg. 40 min. E. 1322 feet; thence S. 32 deg. 50 min. W. 99 feet to southeast corner of cemetery, and thence N. 57 deg. W. 139} feet to point or place of beginning.


Now, therefore, the said Commissioners, in consid- eration of the fact that said described plot of land has never been used for cemetery purposes, but has for the past twenty years and more been used for highway purposes, and it being, in our judgment, nec- essary that it continue to bt so used, and in pursu- ance of our powers as Commissioners, we do hereby order and direct that it be and remain a public high- way forever, and that a record thereof be made in

the Town Clerk's office of such alteration and addition as hereinbefore described.

The polls of the election were declared open at 12 o'clock, and it was announced that they would close at four P. M. by resolution.


A ballot vote was taken as advertized, to raise by tax the sum of Twelve hundred dollars for contingent expenses for the support of the poor during coming year, which was affirmed without dissent.


It was also voted that the sum of Forty dollars be raised by tax to pay an existing deficiency on bills against the Overseers of the Poor.


The sum of One hundred dollars now in Supervisor's hands from Dog Fund account, which has remained over from previous year, was voted to the use of the

It was also resolved, that the sum of Two Hundred dolars be and is hereby appropriated to be inserted in next annual tax levy, and when raised, to be paid by the Collector to the Commissioners of Highways to be applied as far as necessary to the clearing of the highway called Town Lane, in the woods, to pre- vent spread of forest fires from Railroad.


It was also voted to raise Fifty dollars by tax to be paid to Commissioners of Highways for the pur- pose of clearing and widening the Springs highway between Springs and East-Hampton.


It was also further voted that the sum of One hun- dred and forty-three 55-100 dollars be raised by tax to pay the amount due upon the accounts of the Com- missioners of Highways, as audited, and that the said Commissioners be and are hereby authorized to hire the same upon their note as such Commissioners.


It was also resolved to raise by tax this current year, the sum of Five hundred dollars for the Con- tingent Fund account of Supervisors.


Resolved, That the sum of Five hundred dollars be raised by tax for the use of the Town Trustees, and that the same be inserted in the next general tax levy.

Gardiner of said East-Hampton, do hereby consent that said David J. Gardiner may lay, construct and maintain a Railroad switch crossing over and across the highway known as Race Lane, in said Town, according to a plan to be drawn and approved by the construction engineer of the Montauk Extension Railroad Company, said switch crossing to be put in for the accommodation of the East-Hampton Lumber and Coal Company, and to be laid and maintained by said David J. Gardiner or his heirs or assigns, in such a manner as not to interfere with the public use of said Race Lane high- way and on condition that the necessary repairs and maintenance shall be at the expense of said D. J. Gar- diner or his heirs and assigns, and this privilege shall continue so long as said Gardiner shall so maintain

Hedges in said Town on the twelfth day of July, 1895, all of said commissioners having been notified to attend and deliberate upon the subject of this order for alteration of a certain highway in the Hook in said Town,


It is hereby ordered, determined and certified that a public highway shall be altered and the record there- of amended as follows:


Beginning at a stake upon the south line of the highway in the Hook, 128 feet from the north corner of house of Felix Dominy, from which stake the said house corner bears (magnetic meridian) S. 62} deg. E. and 30 1-5 feet from the corner of Pantago and Egypt Lanes as altered February 2, 1891, and run- ning thence S. 33 E. 147 feet to a point opposite to and on a line with the rear of said Dominy's kitchen and 364 feet distant from the west corner thereof; thence same course 361 feet more or less until said line intersects with the east line of Egypt Lane high- way; all that portion of the present highway lying east of said line running S. 33 deg.
