WAGGONER, WAGNER, RAINEY, SNELL

Who was the Elizabeth Wag- goner (Wagner), 1796-1827, who married, as his 1st wife, in 1818, where? Isaac Rainey, 1792-1871, Felix J. Alisi, Surrogate of our and lived perhaps in Illinois? D. said County of Montgomery, at A. R. lineages, Nos. 91294, 91996, the Village of Fonda, N. Y., i

92643, 94453, 98936, are in error in stating that this Elizabeth was daughter of Joseph Waggoner or Wagner, 1759-1848, and Catharine Abeei (given as Abell in these D. A. R. lineages). This Joseph or Johan Jost 3 Waggoner (later Wagner), as proved by his Pen- sion Papers, published last spring in the Enterprise and News, died in Minden, Montgomery County. N. Y .: , August 15, 1848, and not in Illinois as stated in a number of these lineages.

As further proof of the error in the above D. A. R. lineages in stating that this Joseph Waggon- er's dau. Elizabeth married Isaac Rainey, I am submitting below a verbatim copy of this Joseph Waggoner or Wagners' will and probate which give his dau. Eliza- beth known as Betsey in the fam- ily and so designated in the will and probate as the wife of George I. Snell of Palatine, N. Y. The will and probate thus prove con- clusively that his daughter Eliza- beth did NOT marry Isaac Rainey. Whose daughter, then, was the Elizabeth Waggoner or Wagner who married Isaac Rainey ?

It should be noted that the wife Catharine mentioned in the will and probate was not the mother Catharine of Joseph's children. This Joseph was twice married, both times to women with given name Catharine. His 1st forth, wife of Peter C. Danforth Middleburgh, of Schoharie

the wife was Catharine 5 Abeel (Jo- Hof

hannes 4, Christoffel 3, Johannes County, his grandchildren - all of 2, Christopher Janse 1); She died full age - by means whereof, as your petitioners believe said Sur- rogate has sole power to take proof of said last will & testament - that said petitionens are desir- ious that said will be admitted to proof and that Letters testamen- bary be granted -

in Minden, N. Y., Mar. 30, 1829, and is buried in Fort Plain Ceme- tery; her husband was later bur- ted beside her; their gravestones are still standing and are legible Joseph's 2nd wife was Catharine Barse, widow of Archy Keeps, the mother of William E. Bleecker, and "Catharine Gibson" in Harvey Huyok's affidavit, June 3, 1853, made in connection with her appli- cation as widow of Joseph Wag- goner for pension on his Revolu- tionary War record, now on file in the Veteran's Administration, Washington, D. C. and published last spring in the Enterprise and News. Joseph Waggoner married his 2nd wife in Herkimer, N. Y., on Sept. 13, 1835. The maiden name of this muchly-married lady has not yet been located. Can any- one offer suggestions ?

It should also be noted that dur- ing the period of the 1830's and 1840's, Joseph signed his name variously as "Waggoner" and "Wagner", Waggoner in his ap- plioation for pension on Sept. 20, 1832 and in his marriage recond in 1835 to his 2nd wife; Wagner in at least three records between 1838 and 1848, one of these being hts will, which follows:

JOSEPH WAGNER'S WILL In the matter of proving

the last will & testament of Joseph Wagner deceased )

To the Surrogate of Montgom- ery, viz. Samuel Belding Esqr. The Petition of George I. Snell and Betsy his wife of Palatine & County aforegaid respectfully shows, that Joseph Wagner late of the Town of Minden & County aforesaid died a natural death on or about the 15th day of August uit. at Minden aforesaid leaving a last will & testament that the deceased devised and bequeathed to your Petitioner Betsy Snell, all his real & personal estate, except- ing as is therein excepted - that the deceased died leaving Cathar- ine Wagner his widow of Minden in the County of Montgomery &

Charles Wagner and John I. Wag- ner of Aurora, Illinois - Joseph Wagner & Peter J. Wagner of Minden aforesaid - Catharine Webster, wife of Joshua Webster, his children and heins at law of Minden aforesaid, and also Joseph Albert Lintner & Aurelia Dan-

Your Petitionens therefore pray that a Citation issuing out of and under the seal of this Honorable Count, requiring said widow, child- ren and grandchildren personally to be and appear when and where this Court may direot to oppose or support as they may see fit, the probate aforesaid - And they will ever pray in presence of S.
