Resolved by this Assembly, That the field officers of the voluntiers now proposed to be raised for the relief of General Washington's army shall be appointed out of the officers to be chosen by said com- panies of voluntiers, and also. a brigadier will be appointed by this Assembly if a sufficient number to form a brigade shall appear; and in the mean time Messrs. Jesse Root, John Canfield, Tapping Reaves, Lynd Lord, Hezekiah Sabin jun', Mark Leavenworth of New Haven, John Davenport, Thaddeus Burr, Daniel Everit jun', John Lewiss, Oliver Elsworth, Maj' Nathaniel Brown, Capt. David Landon of Guilford, Capt. Nathan Hecox, Justus Buck Esq", Mr. Eliakim Hall jun", Capt. Thomas Porter, Mr. Cyprian Collins, Colo. Seth Smith, Capt. Dan Towner, Mr. Dudley Pettibone and Mr. Ezra Starr, are appointed a committee severally to carry out into the several parts of this State west of the river the resolve now past respecting them and endeavour to rouse and animate the people to rise and exert themselves with the greatest expedition, and to cherish and propagate the spirit of zeal and ardor that appears to be rising on the present interesting occasion, and to set on foot and promote with all expedition such undertaking and inlistment in the various parts. And all friends of their country are earnestly exhorted to lend every aid in their power to said commit- tee or any of them to promote this great and good design. And said committee are to make report of what they find and do in as short a time as possible to this Assembly in their present session.


We the subscribers have and do voluntarily engage and undertake to march as soon as possible for the relief and succour of the contin-

ental army under the command of General Washington and under such officers as shall be chosen by the company to which we shall belong, and are not to be holden in said service more than two months unless the same ardor and love of our country which prompts our undertak- ing shall incline us to continue longer, and to be under the encourage- ment given by the General Assembly at Midletown in December 1776. This Assembly appoint Colo. Noadiah Hooker and Mr. Stephen Mix Mitchell and Mr. Elijah Hubbard jun", said Hubbard instead of Maj" Nath1 Brown resigned, to be of the committee to forward the raising of volunteers to go to the assistance of the continental army pursuant to an act passed in the present session of the Assembly.


Resolved by this Assembly, That Jesse Root, Esq", be appointed and he is hereby impowered and directed to apply for and draw the forty shillings to each non-commission officer and soldier to be advanced to the volunteers now ordered by this Assembly to be raised who shall inlist in any of said companies and march therewith, and the same to pay out for the purposes for which the same was granted and ordered, and render his account. And the Committee of Pay-Table are hereby directed to draw. on the Treasurer for such sums as shall be necessary for the purpose aforesaid. And the officers of said companies of volunteers are hereby directed to procure proper carriages for transporting of the baggage of their respective companies.


And it is further resolved, That his Honor the Governor be and he is hereby desired to take proper measures and give orders that said companies may be supplied not only with provision and hospital stores, but with tents and camp equipage.


An Act for establishing a Loan Office in this State.


Whereas the exigences of this State and the public require a con- siderable supply of the treasury for paying the additional bounty to our quota of the continental troops raised and raising in this State and for other important purposes for which it is apprehended adequate provision is not otherwise made,


Therefore be it enacted and resolved by the Governor, Council and Representatives, in General Court assembled, and by the authority of the same, That the Treasurer of this State be and he is hereby author- ized and directed in the name and on account of the credit of this State and for their use, to borrow and receive of any person or persons belonging to this State a sum of money or bills of credit emitted by order of the Continental Congress or this Assembly to the amount

and not exceeding eighty thousand pounds ; and said Treasurer is not to receive any sum in less quantity than ten pounds and to execute and deliver his promissory note and notes therefor payable at or before the end of three years from the date with an annual interest at the rate of four per centum per annum, according to the form and tenor hereafter in this act directed. And it shall be the duty of the possessor or receiver of such notes to exhibit the same to the Commit- tec of the Pay-Table that the same may be properly registered ; and the said committee are directed to take an account and register of the date of such note, the sum and name of the promisee therein mentioned ; and said committee or either of them shall endorse and sign the same as having been exhibited and duly registered, which endorsement shall authenticate such note and entitule the possessor or bearer to the sum therein promised and in manner as aforesaid. And the suin and amount of said notes so registered shall be annually exhibited to the auditors of the public accounts or according to the orders of this Assembly, and be entered to the debit of said Treasurer and be by him accounted for.


And it is further resolved, That the form and tenor of such notes, being numbered in order and expressing the place and date, the sum and person of whom received being filled up in the proper place, shall be as follows, viz :

The bearer hereof shall be entituled to receive out of the treasury of this State the sum of lawfull money, or bills of credit emitted by order of the Continental Congress or the General Assembly of this State, at or before the end of three years from the date, with interest at the rate of four per centum per annum to be paid annually if de- manded, having received said principal sum of A. B. for the use of said State. Witness my hand.


And it is further resolved, and directed, That said notes shall be written or printed on the leaves of a book properly bound and be thence cut out dentwise, the number of each note being first made and entered on the counterpart or opposite indenture from which the same shall be cut out as aforesaid.


And be it further enacted and resolved by the authority aforesaid, That if any person or persons shall forge, alter or counterfeit any of said Treasurer's notes, or shall be aiding or assisting therein, or shall utter, negociate or put off any such note knowing the same to be so altered, forged or counterfeited, and be thereof convicted before the superior court, such convict shall suffer the same pains, penalties and forfeitures as by law is provided against forging, altering or counter- feiting any of the bills of credit emitted by order of this Assembly.


And be it further resolved, That the Treasurer of this State shall pay out the sum or sums he shall borrow and receive as aforesaid according to law and the orders of this Assembly.


And whereas this Assembly are not disposed to make use of the

expedient and provision of this bill to supply the treasury but in case of necessity ; and whereas this Assembly have made provision for im- proving moneys received and expected to be received by the Conti- mental Loan Officer in this State, and have also made other provision for obtaining moneys for the uses aforesaid,


Therefore be it further resolved, That the said Treasurer be and he is directed not to open a loan office nor receive any moneys as directed by this act untill he shall receive further orders therefor from this Assembly or in their recess from his Honor the Governor and the Council of Safety. And the said Governor and Council of Safety are hereby authorized, desired and directed, carefully to en- quire into and from time to time find the state of said treasury and the demands upon the same and the supplys which are and can be seasonably had to satisfy the said demands agreeable to any provisions otherwise made by this Assembly ; and in case the safety and neces- sities of the public cannot by any other means as aforesaid be provided for, to give orders to said treasury to open such loan office and borrow and receive as speedily as may be the said sum of eighty thousand pounds or such part thereof only as the exigencies of this State and the public shall require, above what can be otherwise supplied in any of the ways as aforesaid. And said Treasurer is hereby directed forthwith to obey and comply with the orders and directions he may at any time receive as aforesaid.


This Assembly do establish Jesse Root to be Captain of a company of voluntiers raised in the town of Hartford in pursuance of an act of this Assembly in its present sessions.

Resolved by this Assembly, That the several companies of volun- tiers which have been raised or are raising by virtue of a recommenda- tion and encouragement given by this Assembly in their present ses- sions for the succour and relief of the continental army under the command of his Excellency General Washington be and they are hereby made and constituted a distinct regiment or battalion in and for the service aforesaid according to the tenor and term of their inlistment and to be under the immediate command of one colonel, one lieutenant colonel and one major, to be appointed by this Assem- bly. And this Assembly do appoint Noadiah Hooker, Esq", to be Colonel, Jesse Root, Esq', to be Lieutenant Colonel and Medad Hills, Esq", to be Major of said regiment.


Resolved by this Assembly, That Jeremiah Wadsworth, Esq", be and he is hereby appointed a Commissary of Supplies, to receive and deliver over for the use of the troops or militia raised or to be raised in this State all such articles of cloathing, refreshments and other necessaries that shall be purchased and delivered to him from time to time by order of this Assembly at such place or places as shall be thought most convenient for the supply of such troops agreeable to a resolution of this Assembly passed in October last, for which articles, goods and refreshments he shall render his reasonable account and

give bond to the Governor and Company of this State for the faithfull discharge of his trust and that he will render his said account to them when required, and of all such sums of money as he may receive from the public treasury for the purpose of executing said trust, which bond shall be taken by and lodged with the Committee of the Pay-Table, who are directed to draw orders upon the Treasurer for the purposes aforesaid and call upon and settle said account with said commissary ; and in case of death or refusal of such commissary the Governor and Council of Safety shall supply the same by appointing another person to such office.


And it is further resolved, That Mr. Chauncey Whittelsey of Middletown, Colo. Jonathan Fitch, Mr. Andrew Huntington, Mr. David Webb of Stamford, Doct' Joshua Elderkin and Mr. Abel Hine, be and they are hereby appointed to procure and purchase for the use of this State all such articles of refreshment and cloathing within this State for the purpose aforesaid as they or either of them shall be directed to do by his Honor the Governor and Council of Safety, who are hereby impowered to give order accordingly and to transport the same to the said commissary of supplies or his order from time to time and to such places as the Governor and Council shall direct for the best accommodation of said troops, and as they may happen to be particu- larly stationed or circumstanced; which said last mentioned persons appointed to procure and purchase as aforesaid shall give bond, receive orders and be accountable as aforesaid; and his Honor the Governor and Council of Safety are also impowered to appoint, if they judge it absolutely necessary and expedient for the ease and comfort of said troops, issuing commissaries to each regiment or battalion of said troops and to enjoin upon them such rules and obligations and give them such orders and directions as they may think most consist- ent with the interest of this State and the best good of the service.


And it is further resolved, That the pay and rations of said com- missary of supplies shall be the same as a captain in continental service.


Resolved by this Assembly, That for the defence and protection of the sea coasts of this State there be forthwith raised by voluntary inlistment to serve for the term of one year from and after the first day of January next unless sooner discharged the several companys and parties of troops and forces, and to be kept and stationed as fol- low, viz : One company to consist of seventy men including for officers one captain, one lieutenant and one ensign, three serjeants, three corporals, one drummer and one fifer ; and also one company to consist of fifty men including for officers one first lieutenant, one second lieu- tenant and one lieutenant fire-worker, two serjeants and two corpor- als, which said last company are to do the duty and service of artil- lery men or matrosses so much and so far as may be necessary in their station and as the circumstances of the case may be, and when

not incompatible with that service to do such other duty of soldiers as shall be reasonably required of them by their officers or the commander on the station; the two above companies to be stationed at New Lon- don. That there be also raised as aforesaid two other companys of the same number of officers and men of the same denominations and for the same purposes as the two above companys, and to be stationed and do duty as aforesaid at Groton. That there be also raised as aforesaid one company of thirty men including officers, one captain, one lieutenant and two serjeants, to be stationed at the fort at Ston- ington. That there be also raised as aforesaid one company of fifty men including one first lieutenant, one second lieutenant, and one lieutenant fire-worker, two serjeants and two corporals, to do the duty of artillery men or matrosses and such other dutys as shall be required of them as aforesaid, and said company to be stationed at New Haven.


And it is also resolved, That the cannon now at the fort or battery at a place called Black Rock in said New Haven be removed into said town and properly placed for the defence of the same. That there be also raised as aforesaid fifteen men under the command of one ensign and one serjeant to be stationed at Lyme, as was ordered the last year. That there be also raised as aforesaid twenty men to be stationed at Saybrook for the assistance of the inhabitants thereof according to an act of this Assembly in May last, under the command of one lieuten- ant and one serjeant. That there be also raised as aforesaid twenty men under the command of a lieutenant and one serjeant, to be sta- tioned at Milford. That there be also raised as aforesaid fifteen men under the command of one ensign and one serjeant, to be stationed at Stratford. That there be also raised as aforesaid twenty men under the command of a lieutenant and one serjeant, to be stationed at Fairfield.


And it is also resolved, That all the companys ordered by this act to be raised and stationed at New London, Groton and Stoningtown, shall be under the command of a major to be appointed for that pur- pose. And as an encouragement for able- bodied and effective men freely to engage in said service for the term and at either of the places aforementioned,


It is resolved and ordered, That the officers and soldiers shall be entituled to and have and receive the following pay, wages and allowances, viz : A major ten pounds, a captain eight pounds, a lieu- tenant £5.8.0, Ensign four pounds, serjeant £2.8.0, corporal £2.4.0, drummer and fifer £2.4.0, private £2.0.0 per calendar month. And as a further encouragement, each non-commission officer and soldier who shall furnish and provide himself a good and sufficient blanket shall have as a reward twelve shillings and retain the blanket at the end of the service, and such non-commission officer and soldier who shall provide himself a good fire-arm and bayonet, cartouch-box and accoutrements, to the acceptance of his chief officer, shall receive as a premium the sum of ten shillings and also six pence per diem for bil-
