Resolved by this Assembly, That Doct' John Dickinson and Colo. Thomas Belding be a committee to receive of said managers the sums raised by said lottery into their hands and the same safely keep in their hands untill further order from this Assembly, and report make to the next session of this Assembly or to the General Assembly in May next.


On information of the state, circumstances and doings of the north military company or trainband in the first society in Waterbury,


Resolved by this Assembly, That said company or trainband be and the same is hereby dissolved, and that the company aforesaid be and they are hereby annexed to the several companies or trainbands hereafter named, in the following manner, that is to say: those liv- ing within the following lines near adjoining to Farmingbury society be annexed to the company under the command of Capt. Beacher in said society of Farmingbury, beginning at Mr. Ebenezer Warner's house, including said house, from thence northwestward to the house of Amos Terrell, including said house, then northward the west side of Hugh Grilleps into the road that leads northward the west side of Ard Warner's house, then continuing northward in said road till it comes into the road that leads from Bucks Hill northward into Farm- ingbury society, then northward in said road to Farmingbury line; and Capt. Abraham Hickox and those living on his farm be annexed to the company now under the command of Capt. Nathaniel Barns in the society of Northbury ; and Bela Brownson, Herman Munson, and Seba Bronson, and those living on their farms be annexed to the east company in the society of Westbury lately under the command of

Capt. Michael Dayton late of Waterbury, deceasd; and Seth Warner, Jacob Doud, and Daniel Brown, and those living on their farms be annexed to the west company in the society of said Westbury now under the command of Capt. Benjamin Richards ; and the remainder of the said north company be annexed to the second company in the 10th regiment in the first society in said Waterbury.


Whereas it has been recommended by this Assembly that all able- bodied men within this State who are not included in any military company would form themselves into military companies and to pro- ceed to choose their officers &e.


Resolved by this Assembly, That whenever a sufficient number of able-bodied men shall form themselves into such companies and shall choose their officers agreeable to said recommendation and make a suitable return thereof to his Honor the Governor, his Honor the Governor by advice of his Council of Safety is hereby authorized and desired to commission them accordingly.


Resolved by this Assembly, That it be recommended and it is hereby recommended to the civil authority and selectmen of the sev- eral towns situate on the sea-coast and sound immediately to set up a sufficient military watch and ward and to order sufficient centrys to be set in all proper places contiguous to the sea or elsewhere to make discovery of any attempt of the enemy to make a descent on any of said towns and to take especial care of all the watercraft belonging to any person or persons in their respective towns, which said craft shall be carefully inspected by said watch, especially in the night season, and that a copy of this resolve be forthwith sent to the sev- eral towns aforesaid.


This Assembly do appoint Increase Mosely, Esq', to be Judge of the County Court for the county of Westmoreland untill the first day of June next.


This Assembly do appoint Andrew Adams, Zebulon Butler, Nathan Denison and William Judd, Esq's, Justices of the Quorum of the county court for the county of Westmoreland untill the first day of June next.


This Assembly do appoint Zebulon Butler, Nathan Denison, Wil- liam Judd, John Jenkins, Uriah Chapman, to be Justices of the Peace for the county of Westmoreland untill the first day of June next : their power and authority as justices of the peace for the county of Litchfield in the meantime to cease.


Resolved by this Assembly, That the county court in the county of Hartford by law to be held on the first Tuesday of November the cur- rent year be adjourned and the same is hereby adjourned to the second

Whereas you are appointed by the General Assembly of said State to be of the regiment of foot in said State, reposing special trust and confidence in your fidelity, courage, care and good conduct, I do by virtue of the laws of this State constitute and appoint you to be of said regiment. You are therefore to take said regiment into your care and charge as their


and carefully and diligently to discharge that eare and trust in order- ing and exercising them, both officers and soldiers, in arms according to the rules and discipline of war, keeping them in good order and government and commanding them to obey you as their for the service of this State; and they are commanded to obey you accordingly. And you are to conduct and lead forth the said regi- ment or such part of them as you shall from time to time receive orders from me or from the Governor of this State for the time being, to encounter, repel, pursue and destroy by force of arms and by all fitting ways and means, all the enemies of this State who shall at any time hereafter in a hostile manner attempt or enterprize the invasion, detriment or annoyance of this State. And you are to observe and obey such orders and instructions as from time to time you shall re- ceive from me or other your superior officers pursuant the trust hereby reposed in you and the laws of this State.

It being represented to this Assembly that Colo. Ethan Allen to gether with about eighteen other natives or inhabitants of this State* having been captivated in the service of this and the United States of America by a party of armed forces of the King of Great Britain, near Montreal in the Province of Quebeck on the 25th of September, 1775, have suffered great hardships during their captivity and are now confined in a suffering condition promiscuously in a common goal at Halifax, and Mr. Levi Allen of Salisbury is now about to at- tempt a visit to his brother the said Ethan, by whom a supply may be transmitted to said prisoners to whom considerable wages are due :


Whereupon it is resolved by this Assembly, That his Honor the Governor be desired to write on the subject to his Excellency General Washington, the Continental Congress, or to the commanding officer at Boston, or each of them, earnestly requesting such seasonable and friendly interposition as may be necessary in the premises and most likely to procure a speedy exchange of said prisoners ; and that the Pay-Table draw an order on the Treasurer of this State to pay out of the treasury to the said Levi Allen for the purpose aforesaid the sum of one hundred and twenty pounds, L. money, taking his re- ceipt for the same, to be advanced and paid to the aforesaid prisoners on account of their wages due from the United States of America, and his account thereof to render when requested.


The Gentlemen nominated by the Votes of the Freemen to stand for Election in May next as sent in to the General Assembly holden at New Haven on the second Thursday of October, A. D. 1776, are as follow, viz :

Upon the memorial of the civil authority and selectmen of the town of New Haven, shewing to this Assembly that sundry things are necessary for the defence of said town ; praying for relief, as per memorial on file,


Resolved by this Assembly, That the three twelve-pounders lately brought into said town remain there at the expence of this State, and that the charge of transporting the same be paid out of the treasury, liable to be removed by the Governor and Council of Safety, and that the company under Capt. Thomson remain where they are stationed, remain as a guard at Black Rock, and that the roof of the barrack now built be shingled and a chimney built, and that the militia of said town of New Haven hold themselves equipped and in constant readi- ness to defend said town and not be liable to be removed. And his Honor the Governor by the advice of his Council of Safety is impow- ered and directed to carry the aforesaid provisions into execution, and to make such further provision for the security of said town and the rest of the sea-coasts as they think proper and expedient.


Upon the memorial of Jacob Francis, administrator cum testa- mento annexo on the unadministered estate of Titus Tharp late of Wallingford, deceasd, representing that the debts and charges due from the estate of said deceasd surmount the moveable part of said estate the sum of £66. 17. 1; praying for liberty to sell so much of the real estate of said deceasd as shall be sufficient to pay said sum, as per memorial on file: Resolved by this Assembly, that the memorial- ist have liberty, and liberty and authority is hereby granted unto him to sell so much of the real estate of said deceasd as shall be suf- ficient to pay said sum of £66.17.1, together with the incident charge of such sale; taking the direction of the court of probate for the dis- triet of New Haven therein.


On the memorial of Elias Beckley, one of the administrators on the estate of John Beckley late of Weathersfield in the district of Hartford, deceasª, for liberty to sell so much of the real estate of John Beckley of said Weathersfield as will raise the sum of £147.6.23, to discharge the debts &c. due from said estate with necessary charges of sale &c. : Resolved by this Assembly, that the memorialist have liberty, and it is hereby granted, that he sell so much of said real estate as will procure said sum of £147.6.2}, L. money, to dis-

charge said debts together with incident charges of sale; taking the advice of the court of probate in the district of Hartford.


Upon the memorial of Levina Pettibone, executrix to the last will and testament of Ithiel Pettibone late of Symsbury, deceasd, shewing to this Assembly that the debts and charges allowed by the court of probate for the district of Symsbury against the estate of the said Ithiel Pettibone decd, with some small allowance made to the widow of said decd, surmounts the moveable part of said estate the sum of £32.10.4, L. money, as per memorial on file : Resolved by this As- sembly, that the memorialist have liberty, and she is hereby impow- ered, to make sale of so much of the real estate of the said deed as will raise said sum of £32.10.4, L. money, together with the incident charges arising on such sale; taking the direction of the court of pro- bate for the district of Symsbury therein.


Upon the memorial of Hezekiah Wadsworth of Farmington, pray- ing for the appointment of a committee vested with full power to dis- pose of a certain indian right of land situate in said Farmington and purchased with the avails of said East Haven Right of Land, so called, or at least so much thereof as shall be found to belong to John Adams, an indian native removed with his family from said Farming- ton into the Mohawks country, as per memorial on file : Resolved by this Assembly, that Colo. John Strong, Mr. Elnathan Gridley and Mr. Timothy Root; be and they are hereby appointed a committee with full power and authority by sale to dispose of any propriety or proprieties of said right of land upon application of the proprietor or proprietors giving said committee satisfaction of his or their determi- nation to leave this State, appropriating the avails of said land, so disposed of, to the sole use and benefit of him or them, and in his or their names to execute a deed or deeds to the purchaser or purchasers, and to do every other matter or thing necessary to render the con- veyance valid in the law.


Upon the memorial of Noble Hinman of New London, shewing to this Assembly that a house of entertainment is wanted in that part of the town where he lives, and that he is solicited to by many to open such an house ; praying for liberty, &c., as per memorial on file : Resolved by this Assembly, that the said Noble Hinman hath liberty and the same is hereby granted to him, to keep a tavern or house of entertainment in said New London untill the sitting of the county court in the county of New London in June next: he giving bond as the law directs to the treasurer of the county of New London, to ob- serve the law respecting tavern-keepers.


Upon the memorial of Thomas Bidwell, representing to this Assembly that in June last he agreed to supply this State with

sulphur, provided such iron-work as was necessary for that purpose should be procured by said State, which iron-work could not be ob- tained, whereby he hath lost his time and been upon expence ; pray- ing for two years from the time he may receive the utensils to perform said contract, and proper allowance for his loss of time and expence, as per memorial on file : Resolved by this Assembly, that the time of said contract be lengthened two years from this time, and that the Treasurer of this Colony pay to the memorialist the sum of thirty pounds three shillings for his loss of time and expence.


Upon the memorial of the inhabitants of the town of Stratford, shewing to this Assembly the exposed situation of said town from their enemies both foreign and domestick, that their distance from Long Island about twenty miles and that a large point of land lies between said town and the sound with a good shoar for landing, which gives the enemy great advantage to land a party and destroy the town &c., and that the fears of the people are greatly increased in their present alarming circumstances &c .; praying this Assembly to station a guard of twenty men in said town during the term of one month, under a proper officer &e., as appears per memorial on file, dated Novr 5th, 1776 : Resolved by this Assembly, that the inhabi- tants of said Stratford shall have the liberty and privilege of raising by voluntary inlistment twenty able-bodied effective men, exclusive of their officers, and to be well armed and equippd, with one lieuten- ant, two sergeants and two corporals, and that Lient. Ebenezer Coe of said town be appointed and directed immediately to inlist said soldiers and order and command them to their proper station and duty for the purpose aforesaid, not exceeding one month. And said officers and soldiers shall have their billett and pay while in said ser- vice as other officers and soldiers receive and be paid by this State.


Upon the memorial of the civil authority, selectmen and commit- tee of inspection of the town of Norwalk, shewing to this Assembly the exposed situation of said town and the necessity of having some of the militia stationed there and the great difficulty of billeting troops there on account of the number of sick soldiers that are already sent to that and the town of Stanford and Greenwich ; praying that the militia of said town of Norwalk may be stationed there for its de- fence &c., as per memorial on file : Resolved by this Assembly, that his Honor the Governor be desired and he is hereby desired, to give directions to Majr General Wooster to station a sufficient number of the militia under his command in the towns of Norwalk, Stanford and Greenwich, where he shall judge most needfull for the safety of those towns ; and that the Majr General so order and direct the mat- ter that the respective militias of said respective towns be respectively stationed in said several towns where they belong, so far as necessity and convenieney will admit.

Upon the memorial of Alexander Thomson of Litchfield, shewing to this Assembly that before the superior court holden at Litchfield, Feby. 1774, he was convicted of manslaughter; praying that in fu- ture he may be exempted from the consequence of said conviction, as per memorial on file : Resolved by this Assembly, that the said Alex" Thomson be and he is hereby restored to the privilege of giving evi- dence in court, said conviction notwithstanding.


Upon the memorial of Samuel Tyler and Elizabeth Tyler, admin- istrators on the estate of Lathrop Tyler late of Wallingford, decd, shewing that the debts now due from said estate surmount the per- sonal estate of said deceasd the sum of £367. 8. 7; praying for lib- erty to sell so much of the real estate of said deceasd as shall be suffi- cient to discharge said sum : Resolved by this Assembly, that the memorialists have and liberty is hereby granted to them, to make sale of so much of the real estate of said decd as shall be sufficient to dis- charge the aforesaid sum due with the incident charges of sale arising thereon ; taking the advice of the court of probate for the district of New Haven therein.


Upon the memorial of Jonathan Coe of Torrington, administrator on the estate of Oliver Coe, deceasd, shewing that the said Oliver was taken sick in the northern army last year and returned home and continued sick a long time whereof he died ; that he expended large sums in his said sickness, to the amount of £14. 6. 0, and left but very little estate and a numerous family ; praying for relief &c .: Re- solved by this Assembly, that the Committee of Pay-Table draw an order on the Treasurer in favour of the memorialist for said sum of £14. 6. 0, the amount of said expence.


Upon the memorial of Lois Maltrop of New Haven, administratrix upon the estate of Solomon Maltrop, deed, representing that the debts and charges due from the estate of said deceasd surmount the move- able part of said estate the sum of £40. 10. 0; praying for liberty to sell so much of the real estate of said deceasd as shall be sufficient to pay said sum ; as per memorial on file appears : Resolved by this As- sembly, that the memorialist have liberty, and liberty and authority is hereby granted unto her, to sell so much of the real estate of said deceasd as shall be sufficient to pay said sum of £40. 10. 0, together with the incident charge of such sale; taking the direction of the court of probate for the district of New Haven therein.

Upon the memorial of Jabez West of Norwich, shewing to this Assembly that he was a sutler in the army and supplied the sick with sundry articles for their relief, to the amount of £70. 13. 6 .: Re- solved by this Assembly, that said account be and the same is hereby referred to the Committee of Pay-Table, who are hereby directed to examine, adjust and liquidate said account and to draw an order for such sum as they shall find due to the memorialist on the Treasurer nd charge the same to the United States of America.


Upon the memorial of Hannah Deming, administratrix on the es- tate of Waitstill Deming late of Weathersfield in the district of Hart- ford, deceasd, shewing to this Assembly that the debts and charges, with a small allowance of necessary moveables set to the widow of said deceasd, surmount the moveable estate of said deceasd the sum of £35. 17. 2, L. money, as per memorial on file : Resolved by this As- sembly, that the memorialist with Mr. Aaron Porter have liberty, and liberty and authority is granted to the memorialist and the said Aaron Porter, to make sale of so much of the real estate of said de- ceasd as will raise said sum of £35. 17. 2, L. money, with incident charges arising on such sale; taking the direction of the court of probate in the district of Hartford therein.


Upon the memorial of James Thurber of Pomfrett, shewing to this Assembly that on the 8th day of December, 1773, he for the con- sideration of ninety pounds, L. money, paid, purchased of Benjamin Payne, then of said Pomfrett, a certain piece of land lying in said Pomfrett and recd a proper deed of release thereof from said Payne under his hand and seal of that date, which lands and part of build- ings thereon standing are described in said deed as follows, viz: being the same tract or parcell of land that was set over to be the right of Thomas Payne son of Noah Payne late of Pomfret decd; said tract of land contains about forty-eight acres with one-half of a dwelling- house and one-half of a barn thereon standing; and that said Ben- jamin soon after the giving said deed suddenly dyed not having acknowledged the same ; and praying to this Assembly that said deed may be receivd and recorded on the town records for deeds in said town of Pomfrett, and be received and allowed as evidence of a title to said land in him said memorialist as fully as if said deed had been

acknowledged by said decd in his lifetime &c., as per memorial on file : Resolved by this Assembly, that the said deed may be received and recorded on the town records for deeds in said town of Pomfrett and shall be received and allowed as evidence as fully as if said deed had been acknowledged by said deceased in his life time.


Upon the memorial of Stephen Gold, of Redding in the county of Fairfield, executor of the last will and testament of Daniel Gold late of said Redding, deceasd, shewing to this Assembly that the debts and charges allowed by the court of probate for the district of Fairfield against the estate of said deceasd surmount the moveable estate of said deceasd the sum of £225. 12. 4, L. money, for the payment of which no provision is made by the testator; praying for liberty to make sale of real estate &c .: Resolved by this Assembly, that the memorialist have liberty, and liberty and authority is hereby granted him, to make sale of so much of the real estate of said deceasd as shall be sufficient to raise said sum of £225. 12. 4 with the incident charges arising on such sale; taking the advice and direction of said court of probate for the district of Fairfield therein.
