This Assembly do appoint the Honble Jabez Huntington, Esq", to be one of the Council of Safety for the year ensuing.


Whereas Lieut. Colonel Selah Hart of Farmington hath preferred his memorial to this Assembly, for himself and about thirty-eight other continental officers captivated by the enemies of the United States of America and confined by them on Long Island, shewing to this Assembly that said officers and their families are reduced to great distress by means of said officers being held in captivity, the most of them ever since the 15th of September last, since which they have received no wages or allowances from the United States or either of them, and that they have spent all their money, are considerably in debt, and have no means of subsistence; that they are unable to procure hard money ; that paper money or bills will not pay them ; praying for relief &c., as per memorial and a list of said officers' names lodged in the files of this Assembly appears.


Resolved by this Assembly, That the Committee of the Pay-Table be and they are hereby directed to adjust and settle said officers' accounts, when produced to them, and to allow to them, the same wages since their captivity as was allowed to officers of their rank in the continental army at the time they were captured ; and that the com- mittee pay to them, or to said Selah Hart for their use, the ballance due to each of said officers or such part thereof as on consideration of their ease may appear necessary for their relief : Provided such evi- dence shall be produced as shall satisfy said committee that said officers have not received their wages already. And said committee are directed, if possible, to make said payment, or considerable part thereof, in hard money, and for that purpose to draw on the Treas- urer of this State for the same or bills of eredit to exchange for the same, and the Treasurer is directed to pay the same accordingly ; and said committee are to charge the sum so paid to the United States and transmit an account thereof to General Washington with the names and offices of the persons to whom or for whom the same is paid, and the battalion and company to which they belonged, as soon as they can ascertain the same, and request the General to give orders that said sum may be ordered and paid to the Treasurer of this State for the use of this State .*

Resolved by this Assembly, That a bounty or premium of one shilling per pound be paid out of the public treasury of this State for all saltpetre that shall be manufactured according to the laws already provided for manufacturing saltpetre and nitre, from the first day of June next and before the first day of January next.


This Assembly do appoint Messrs. John Chenevard and James Church to be of the Committee of Pay-Table.


Resolved by this Assembly, That the Committee of Pay-Table be and they are hereby impowered to appoint one or two clerks as they shall find necessary in said office.


Resolved by this Assembly, That the militia of this State, both officers and soldiers, when ordered into service for the future shall be entituled to the same pay, rations and other allowances, as is or shall be from time to time allowed by Congress to the continental troops of equal rank, and that the Committee of the Pay-Table be impowered and directed to examine and settle the pay-rolls accordingly: Provided that said militia be not allowed pay for more than a reasonable time after orders received before they march, not exceeding in any instance more than four days.

Table an account of the number of the arms purchased, and where those arms lodged or how disposed of ; which accounts the Committee of Pay-Table are as soon as may be [to] lay before the General Assembly, that a just and equal distribution thereof may be made to the several towns in this State.


Upon the representation of Messrs. Benjamin Henshaw and William Whiting, managers of the cannon foundery at Salisbury, shewing that the workmen employed in carrying on the business of said foundery are liable to be drafted for the army, and that a number of them have already been drafted, that the workmen discover great uneasiness at their being thus liable to draught and fines, think it reasonable they should be exempted therefrom so long as they are engaged in the busi- ness aforesaid, conceiving that their respective services will conduce more to forward the warlike operations of this State in that capacity than in any other, and suggesting it as their opinion that it is requisite a sufficient number of men to do the necessary business of said foundery be exempted from such draughts and fines as aforesaid ; and upon the report of the committee on said recommendation,


Resolved by this Assembly, That a number of the principal men necessarily employed in said business, not exceeding fifty in the whole, for the time they are so employed be exempted and discharged from all past or future draughts and fines for filling up the army, or for actual service in the militia during the time they continue in the ser- vice at said furnace, and that it be left at the discretion of said mana- gers to determine who shall then be exempted, which they are hereby directed immediately to do and give information thereof to the com- manding officers of the companies to which they respectively belong, if within this State.


On report of the committee appointed by this Assembly to take into consideration the subject matter of the memorial of Nath' Jones, Simon Tuttle, Joel Tuttle, Nathaniel Mathews, John Mathews, Riverius Carrington, Lemuel Carrington, Zerubbabel Jerom jun", Chauncey Jerom, Ezra Dormer, Nehemiah Royce, Abel Royce, George Beckwith, Abel Frisbee, Levi Frisbey, Jared Peck, and Abraham Waters, all of Farmington, shewing that they are imprisoned on suspicion of their being inimical to America; that they are ready and willing to join with their country and to do their utmost for its defence ; and pray- ing to be examined and set at liberty, as per said memorial on file, reporting that the said committee caused the authority &c. of Farm- ington to be duly notifyed, that they convened the memorialists before them at the house of Mr. David Bull on the 22ª of instant May and examined them separately touching their unfriendliness to the American States, and heard the evidences produced by the parties ; that they found said persons were committed for being highly inimi- cal to the United States, and for refusing to assist in the defence of

the country ; that on examination it appeared they had been much under the influence of one Nichols,* a designing church clergyman who had instilled into them principles opposite to the good of the States ; that under the influence of such principles they had pursued a course of conduct tending to the ruin of the country and highly dis- pleasing to those who are friends to the freedom and independence of the United States ; that under various pretences they had refused to go in the expedition to Danbury ; that said Nathaniel Jones and Simon Tuttle have as they suppose each of them a son gone over to the enemy ; that there was, however, no particular positive fact that sufficiently appeared to have been committed by them of an atrocious nature against the States, and that they were indeed grossly ignorant of the true grounds of the present war with Great Britain ; that they appeared to be penitent of their former conduct, professed themselves convinced since the Danbury alarm that there was no such thing as remaining neuters; that the destruction made there by the tories was matter of conviction to them; that since their imprisonment upon serious reflexion they are convinced that the States are right in their claim, and that it is their duty to submit to their authority, and that they will to the utmost of their power defend the country against the British army; and that the said committee think it advisable that the said persons be liberated from their imprisonment on their taking an oath of fidelity to the United States : Resolved by this Assembly, that the said persons be liberated from their said imprisonment on their taking an oath of fidelity to this State and paying costs, taxed at £22 7 10; and the keeper of the goal in Hartford is hereby directed to liberate said persons accordingly.


Whereas this Assembly have received information that frequent incursions have been made by the enemy into the town of Greenwich and parts adjacent, and have taken cattle from the inhabitants in that quarter, and it is not in the power of this Assembly to give them im- mediate relief : Resolved by this Assembly, that his Honor the Gov- ernor be desired to request General Parsons to order four hundred of the continental troops raised in this State to be detained for the present in the town of Greenwich and parts adjacent, for the defence of said inhabitants.


Whereas there are several complaints exhibited to this Assembly against a number of military companies and military officers belong- ing to this State: Resolved by this Assembly, that Colo. Nathaniel Terry, Colo. Isaac Lee and Colo. John Chester be and they are hereby appointed a committee to examine into the conduct of the several military officers and military companies in the county of Hartford against whom complaints have been laid in to this Assembly, and report make of what they find and do to this or some future Assembly.

Whereas there are several complaints exhibited to this Assembly against a number of military companies and a number of military officers belonging to this State: Resolved by this Assembly, that Colo. Nehemiah Beardslee, Colo. Thomas Fitch and Majr Elijah Abel, be and they are hereby appointed a committee to examine into the conduct of the several military officers and military companies in the county of Fairfield against whom complaints have been laid in to this Assembly, and report make of what they find and do to this or some future Assembly.


Whereas it is represented to this Assembly that a number of per- sons have procured themselves to be inoculated with the small pox and are placed in the house of Capt. Stephen Thorp at the Mill River, so called, opposite to Saco Hill in Fairfield, near one of the guard houses, to the interruption of the guards and defence of that town : Resolved by this Assembly, that the civil authority and selectmen in Fairfield be and they are hereby directed and ordered forthwith to remove the said infected persons, or cause them to be removed, to some place of safety for said disorder and the more northern parts of said town, and that they cause said house to be cleansed of said infec- tion without delay, and that the expence thereof be borne by said in- fected persons, their parents, guardians &c.


This Assembly do appoint Mr. Hezekiah Wadsworth to be one of a committee heretofore appointed by this Assembly to make sale of the common and undivided land belonging to the Tunxis Tribe of Indians situate in Farmington, in the room of Colo. John Strong deceas'd.


Resolved by this Assembly, That the block-house lately burnt over Newgate Prison be with all convenient speed rebuilt on the foundation whereon said former block-house was erected, and that the same be made and constructed as near as may be like the said former block-house, and that in some suitable place near to said block-house there be built a dwelling-house thirty feet in length and eighteen feet in width, one story high, two rooms on the floor, and the chimney to be built on one side of said house in such manner as to diminish as

little of the rooms as may conveniently be, and that said house be a framed house and built with materials as usual for the accommoda- tion of the goaler and his family, and that the overseers of said prison be appointed to procure the said buildings to be erected, and that said overseers do as soon as may be prepare said prison for the reception of such persons as shall be ordered to be confined there.


This Assembly do appoint Amaziah Branch of Preston Surveyor of Lands for the county of New London.


This Assembly do appoint Ebenezer Crane to be Surveyor of Lands in and for the county of Litchfield.


Resolved by this Assembly, That the return made by Lieuten Elias Sanford Palmer, of the sixth military company of Stonington in the eighth regiment, respecting the choice of commission officers in said company, be set aside and the same is hereby set aside accordingly, and that said company be led to a new choice of commission officers under the superintendency of some one of the field officers of said regiment, and that a return thereof be made to this Assembly, or in the recess thereof to his Honor the Governor and his Council of Safety, who on return thereof are requested to commission them accordingly.


This Assembly do appoint the Honble Jabez Huntington, Esq", to be First Major General over the whole militia of this State, in the room of Major General Wooster deceas'd.

This Assembly do appoint Phineas Porter, Esq', to be Major of the tenth regiment of militia in this State, in the room of Majr Reuben Atwater resigned.
