This Assembly do appoint John Watrous, Esq", to be Judge of Probate for the district of East Haddam untill the first day of June next, in the room of Daniel Brainard, Esq", deceased.


This Assembly do appoint Samuel Gordon Surveyor of Lands within and for the county of Westmoreland.


This Assembly do appoint Elihu Marvin to be Surveyor of Lands for the county of Hartford.


Whereas the exigencies of this State and the public require a con- siderable supply of the treasury,


It is therefore resolved by this Assembly, That a tax of four pence on the pound on the general list of polls and rateable estate of the inhabitants of this State brought into this Assembly in October, 1775, with the additions, be laid and collected as soon as possible, and paid into the treasury of this State at or before the tenth day of May next; and the Treasurer is ordered forthwith to send out his warrants accordingly, therein also directing the constables not to enforce the collection immediately on such as are not now of sufficient ability to discharge the same.


Whereas upon the memorial of Mathew Talcott, Esq", and others, preferred to this Assembly in May, 1772, praying that buoys and marks might be erected in Connecticut River pointing out the shoals and bars, so that the navigation in said river might be rendered more safe; and as it was resolved that the memorialists have liberty to set up and carry on a lottery or lotterys amounting to such a sum as by drawing at least ten per cent. out of each prize the whole might raise the sum of three hundred and thirty-seven pounds, and the managers to be liable for the payment of the prize tickets signed by them: the sum of three hundred pounds raised by said lottery to be paid into the hands of a committee or company that should thereafter be appointed for carrying said design into execution, and thirty-seven pounds thereof to Capt. Abner Parker; and Matthew Talcott, Esq", Richard Alsop and John Chenevard of Hartford, and Ebenezer Plum- mer of Glastonbury and Silas Dean of Weathersfield were appointed managers of said lottery : And whereas upon another memorial of the said Mathew Talcott, Esq", and others, at Hartford in May, 1773, shewing that the said sum of three hundred and thirty-seven pounds would be too small to attain the ends in said act proposed, this Assembly did resolve that the said memorialists should have liberty to set up and carry on a lottery or lotteries amounting to such sum as by drawing at least ten per cent. out of each prize or out of the whole may raise the sum of five hundred and thirty-seven pounds, and that the same persons named as managers in said former act be managers of this lottery, subject to the same restrictions, regulations and pro- visions in said former act contained and provided,

Resolved by this Assembly, That Doct" John Dickinson and Colo. Thomas Belding be a committee with full powers to receive of said managers the sums raised by said lottery into their hands and the same safely keep in their hands untill further orders from this Assembly, and also to receive, adjust and settle the accounts of said managers respecting said lottery, and make report to this or some future session of the General Assembly.


Upon the motion and representation of the inhabitants of the first society in the town of Glastonbury made to this Assembly in June last, shewing that a division of the military company in said town was necessary and would be of public conveniency and utility, and tend to promote peace among said inhabitants, whereupon a com- mittee was then appointed to repair to said society, view the cir- cumstances and situation of said military company and the limits thereof, and hear all parties concerned, and make report thereon &c .; and said committee having now reported it as their opinion that said military company ought to be divided by certain lines and limits &c. which report is accepted and approved &c.


Resolved by this Assembly, That said military company shall and the same is hereby divided into two distinct military companys by the following lines and limits, to wit: By a line to begin at the highway in Main street running through said society eastward in the line dividing between the late Capt. Jonathan Hale's, deceased, land and the land now in the possession of Gideon Hale to the bounds of the society of Eastbury, and to run westward from said highway or main street in the line dividing between Gideon Hale's and David Hale's land to Connecticut River; and all those living north of said line shall be and remain one separate distinct military company called and known by the name of the third military company in the sixth regi- ment of militia; and all those living on the south of said line shall be and remain one distinct separate military company and called and known by the name of the seventh military company in the sixth reg- iment of militia in this State. And whereas that part of said com- pany on the north of said line have already made choice of their officers, it is therefore resolved, that said choice be and the same is hereby approved, and the colonel of said regiment is hereby directed to cause proper warning to be given to lead that part of said company on the south of said line to the choice of commission officers, and make return thereof as soon as may be to this Assembly.


Whereas it appears to this Assembly upon information made by Samuel Abbott, lieutenant colonel of the 20th regiment of militia with- in this State, that Jacob Perkins, captain of the first military company in said regiment, and Samuel Wheat, captain of the second company of militia in said regiment, did altogether refuse to obey an order of his Honor the Governor and the subsequent order of their said colonel

requiring them respectively to muster and march their several compa- nies for the service and defence of this State,


It is therefore resolved by this Assembly, That the Secretary be and he is hereby authorized and directed to issue a warrant directed to some proper officer, requiring him forthwith to arrest the bodies of the aforesaid Jacob Perkins and Samuel Wheat and them have forth- with before this Assembly at their present or next sessions, to answer to the matters contained in said information and to be dealt with thereon as to law and justice appertains.


Whereas this Assembly since the foregoing resolve have received satisfactory information from Lieut. Colo. Abbott that the within named Jacob Perkins and Samuel Wheat have acknowledged their fault in disobeying or rather hesitating and delaying draughting the fourth part of the militia in their respective companies according to order to them given and have since complied with their orders, declar- ing themselves sorry for their fault and imprudence and that they are now ready on all occasions to defend their country with their lives and fortunes: Whereupon this Assembly, ready to forgive, have and do hereby revoke the aforesaid resolve, and order all proceedings against the said Perkins and Wheat to cease and be discontinued.


Upon the memorial of Erastus Wolcott, Esq", colonel of the regi- ment of troops stationed at New London and the sea coast in the year 1776, praying that the Committee of Pay-Table be directed to make some allowance for paying of the companies in said regiment with twenty shillings premium to the soldiers that inlisted after the second of July, 1776, without any deduction from their wages &c., as per memorial on file : Resolved by this Assembly, that the Committee of Pay-Table be and they are hereby directed to allow twenty shillings premium to each man not being in the matross companies that inlisted after the 2ª day of July, 1776, into the companies of said regiment raised by order of the Governor and Council of Safety, and that said committee allow the wages in full to all the men in said regiment that did not supply themselves with arms, without deducting anything therefrom on that account.


Whereas the seventh military company in the sixth regiment in this State have refused to proceed to the choice of officers for said company agreeable to an order of this Assembly issued for that pur- pose : It is therefore resolved by this Assembly, that the Secretary do and he is hereby directed forthwith to issue a warrant directed to some proper officer to summon said military company and each of them to appear before this Assembly at their present or next sessions, to answer for their disobedience in the premises and to be further dealt with as shall appear fit and right thereon.

Upon the memorial of Jonathan Wells, Esq", of Glastonbury, shewing to this Assembly that he preferred his memorial to the Gen- eral Assembly in March, 1775, therein alledging that by reason of great losses and misfortunes he is greatly embarrassed in his person and estate, praying for relief &c., on which said Assembly by a resolve did exempt the person and estate of the memorialist from arrests un- till the rising of the Assembly in May then next, that he and his cred- itors might prefer their petition for a special act of insolvency ; that the state of public affairs hath been such ever since that no business of that nature hath since been transacted, and that the General Assembly in May last did revive and continue said protection untill the rising of the Assembly in October then next; and praying that the same may be renewed and continued untill the rising of the Assembly in May next: Resolved by this Assembly, that the person and estate of the said Jonathan Wells, Esqr, shall and the same is hereby protected from arrest and attachments untill the rising of this Assembly in May next, and his body during said time shall be exempted from imprison -- ment for any debt, and that he shall not in the meantime sell or dis- pose of any part of his estate either real or personal, and that he and his creditors have liberty to prefer their petition to said Assembly in May next, that what is right may be done in the premises.


Upon the memorial of Ezra Hawley and others, inhabitants of the town of Stratford, representing to this Assembly that they are exposed to the depredations of the enemy &c .; praying this Assembly to sta- tion a guard of twenty-five men at NewField Harbour in said Strat- ford, as per memorial dated January 14th, 1777: Resolved by this Assembly, that a guard of twenty-five men be stationed at said New- Field Harbour under the command of one lieutenant and two ser- jeants, and that they have an order to receive at the foundery at Salisbury two cannon, four-pounders, to be mounted on proper carriages, with a sufficient quantity of shot and also an order for a sufficient quantity of powder, and that Mr. Aaron Hawley be and he is appointed Lieutenant to command said party.

Upon the memorial of John Richardson of Lebanon, a soldier in Capt. Clark's company in Colo. Sage's regiment, shewing to this. Assembly that he was taken sick in New York whilst on service, and from thence removed by order of authority to recover his health, which is not yet accomplished; that he was returned as a deserter because not able to return to service before the term of inlistment was expired, whereby he is deprived of his wages and has lost the cost of his sickness &c., as per memorial on file: Resolved by this Assembly, that the Committee of Pay-Table be and they are hereby ordered to receive and adjust an account of the wages of the memorialist and allow him what is due thereon, taking care that he account for his arms &c., together with the reasonable expence of his sickness

and his marching money untill he returned home, and charge the same to the continent.


Upon the memorial of Benjamin Belding and Abraham Gillett, sol- diers in the company of Capt. Abraham Pettibone and Major Simeon Strong's regiment lately in the service of this State in the army at New York representing the necessity they were under of returning home by means of sickness, with the permission of their captain, only without a regular discharge, and of their continuing unfit for duty long after the discharge of said regiment; praying that their wages may be granted them from the time of their march till their return home, which hith- erto they have not received in whole or in part; as per memorial on file : Resolved by this Assembly, that the Committee of Pay-Table bc and they are hereby authorized and directed upon application of the memorialists to adjust the matters referred to in the memorial, and in favour of the memorialists to draw on the Treasurer for such sum or sums as shall be found justly due to each of them, respectively, for their wages and pay for the aforesaid term untill they severally returned home.


Upon the memorial of John McKey of Norwalk, shewing to this Assembly that before the superior court of this State held at Fairfield on the 25th day of June last he, the said memorialist, was adjudged guilty of being inimical to the united American States, and thereupon was sentenced by said superior court to be confined in the common goal in Litchfield for the space of one year; that in pursuance thereof was committed to said goal, where he still remains; that he was induced to commit the facts alledged against him from the artfull endeavors of sundry persons unfriendly to the liberties of the Ameri- can States, representing terror &c .; that said memorialist is sensible of his folly, has retracted, is now friendly to the liberties of these States and determined to behave and conduct himself accordingly ; praying for relief &c., as per memorial on file: Resolved by this Assembly, that said memorialist be and he is hereby ordered to be removed from the goal in which he is now confined to the town of East Haddam in this State, there [to] remain under the inspection, care and direction of the selectmen of said town of East Haddam untill the further order of this Assembly be given accordingly.
