Upon the petition of Joseph Woodruff, of Woodbury in Litchfield county, shewing to this Assembly that he was indebted to Joel Stone of said Woodbury the sum of twenty-three pounds money, for security of which he conveyed a certain tract of land in said Woodbury to said Stone, of the value of eighty pounds, in nature of a mortgage, and was to have had a counter bond from said Stone for the reconveyance of said land upon the payment of said £23 0 0, but was providentially prevented, since which time said land has been seized for the use and benefit of this State ; praying for relief, as per petition on file : Resolved by this Assembly, that the petitioner be and he is hereby permitted to improve said land, he paying to the selectmen in and for the town of Woodbury for the time being the lawfull interest of the debt due from the petitioner to said Stone, for the use of this State, during the pleasure of this Assembly.
Upon the memorial of Jesse Terrill and Mary Terrill, administra- tors on the estate of Noah Terrill late of Woodbury deceas'd, shewing to this Assembly that the debts and charges due from said estate sur- mount the moveable part of said estate the sum of £44 5 7, lawfull money, and praying for liberty to make sale of so much of the real estate of said deceas'd as to make said sum, as per memorial on file : Resolved by this Assembly, that the said Jesse Terrill have liberty and he is hereby impowered, to make sale of so much of the real estate of the said deceas'd as to make said sum of £44 5 7, L. money, with the incident charges arising thereon; taking the direction of the court of probate for the district of Woodbury therein.

said Stratford deceas'd, shewing to this Assembly that the debts and charges against the estate of said deceas'd surmounting the moveable estate, upon application the General Assembly at their session in May, 1774, gave liberty to the memorialist and Ichabod Lewiss, Esq', the other administrator, to sell so much of the real estate of said deceas'd as should amount to the sum of £453 9 93, L. money, with incident charges, and that said Lewiss is since deceas'd and no sale has been made of said real estate; praying that some meet person may be appointed to assist in making sale of said real estate, as per memo- rial on file : Resolved by this Assembly, that Samuel Adams, Esq", of said Stratford with the memorialist be and they are hereby authorized and impowered, to make sale of so much of the real estate of said deceas'd as shall amount to said sum of £453 9 9}, L. money, with the incident charges of such sale; taking the advice of the court of probate in and for the district of Fairfield therein.
On the memorial of Lemuel Parish of Canterbury, shewing to this Assembly that his son marched in Capt. Benjamin Bacon's company in September last for New York, and while his said son was in said State he fell from a loft in a barn when asleep, by which fall he frac- tured and broke the bone of his arm, and that the memorialist brought his said son from Stamford to Canterbury, where he was for a long time siek, and he expended large sums of money in getting him to said Canterbury and also whilst he was there sick ; praying for relief &e., as per memorial on file : Resolved by this Assembly, that the Committee of Pay-Table adjust the accounts referred to in said memorial and draw an order on the Treasurer for what they shall find to be justly due.
On the memorial of John Thomas of Woodbury, shewing that on the 28th day of June last he inlisted into the service of this State for the northern department in Capt. Laey's company, Colo. Swift's regi- ment, began his march on the 18th of July, joined his regiment at Skeensborough on the 30th of said July, and served till the 5th of Sep- tember last, when he fell siek of the eamp distemper; that Capt. Lacey, the then commanding officer in that department advised him, if possible, to leave the camp and go into the country ; that with the assistance of a friend from Woodbury who was there present with a spare horse, on the 11th of September he returned from camp; that he was advised by several physicians which he met to continue riding if he would save his life: he accordingly continued his journey and arrived home on the 18th of said September, extremely debilitated with his disorder, and that his expences for his sickness were very considerable ; that he was unjustly, as he apprehends, returned as a deserter, by which he has been deprived of his wages and reimburse- ment of his expences ; that he left the camp with reluctance, deter- mined to return again if his health would permit, and that he is ever

willing to serve his country to the utmost of his power; and praying for relief, as per memorial on file: Resolved by this Assembly, that the Committee of Pay-Table be and they are hereby authorized and directed, on application of the memorialist, to receive, examine and adjust the accounts of his wages, expences for sickness and mileage untill he returned home, and draw on the Treasurer in his favour for what shall be found reasonably due and unpaid of the same accordingly.
Upon the memorial of Jonathan Bull of Hartford, shewing that one of his family has taken the small pox by means unknown, whereby his family have been exposed, and also widow Sarah Butler, and three of the family of Moses Butler, to take the infection ; praying for liberty to inoculate, as per memorial on file : Resolved by this Assembly, that the memorialist's family and said other persons have liberty and they are hereby permitted, to take the infection of the small pox by inoculation at such place and conforming himself to such regulations as the major part of the selectmen of Hartford shall direct.
On the memorial of Ednah Allyn, administratrix on the estate of Jacob Allyn late of Groton deceased, shewing to this Assembly that the debts due from said estate, together with the sum allowed the widow for bringing the children up, surmount the moveable estate of the said deceas'd the sum of £22 17 4, for the payment of which the said administratrix has not a sufficiency in her hands ; praying for liberty and authority that may be granted to some suitable person to sell so much of the real estate of the said deceased as to raise said sum of £22 17 4, as per memorial on file : Resolved by this Assembly, that liberty and authority is hereby granted to Stephen Hurlburt of said Groton, to sell so much of the real estate of the said Jacob Allyn deceas'd as to raise the sum of £22 17 4, money, with the incident charges arising on said sale ; taking the direction of the court of pro- bate for the district of Stonington therein.

Upon the memorial of Lemuel Dorrance, of Voluntown in the county of Windham, administrator on the estate of Seth Pope late of said Voluntown deceas'd, shewing to this Assembly that since he obtained liberty of this Assembly to sell real estate of said deceas'd to pay what debts then was exhibited against said estate there has been ex- hibited to the court of probate for the district of Plainfield debts due from said estate to the amount of £39 14 2, L. money ; praying this Assembly for liberty to sell so much of the real estate of said deceas'd as to pay the said sum of £39 14 2, L. money : Resolved by this Assembly, that the said administrator have liberty and liberty hereby is granted for him to sell so much of said real estate of said deceas'd as to pay said sum of £39 14 2, L. money, with the necessary charges arising thereon ; taking the advice of the court of probate for the dis- trict of Plainfield therein.
Upon the memorial of Roger Veits of Symsbury, clerk, shewing to this Assembly that in January last he was sentenced to one years im- prisonment and to pay a fine of £20 0 0; praying to be enlarged, as per memorial on file : Resolved by this Assembly, that the memorial- ist be and he is hereby enlarged from his present confinement in prison, and is permitted to pass to and is hereby confined within said town of Symsbury for the same term for which he was sentenced to confine- ment by the honorable superior court, he paying cost of prosecution &c .: upon his giving bond with surety to the Treasurer of this State in the penal sum of one thousand pounds, lawfull money, conditioned that the memorialist shall not go out of the limits of said town of Symsbury, nor do or say anything against the United States of America or detrimental to their interest as such within the time for which he was sentenced to confinement as aforesaid.

Upon the memorial of William Skinner, of Woodstock in the county of Windham, executor to the last will and testament of Mr. Abraham Skinner late of Woodstock deceas'd, shewing to this Assem- bly that the debts arising against the estate of said deceas'd surmount the personal or moveable estate of said deceas'd the sum of £76 7 44, as appears from the files of the records of the court of probate for the district of Pomfret, and no provision made in the last will and testa- ment of the deceas'd to pay the same; praying this Assembly to im- power the memorialist or some other meet person to sell so much of the real estate of said deceas'd as will pay said sum of £76 7 4% with the incident charges arising thereon, taking the direction of the court of probate therein, as per memorial on file appears : Resolved by this Assembly, that Jedediah Morss, Esq", have liberty, and liberty and authority is hereby given him, to sell so much of the real estate of said deccas'd as to raise said sum of £76 7 44 with the incident charges arising thereon; taking the direction of the court of probate for the district of Pomfret therein.
Upon the memorial of Zebulon Waterman of Colchester and report of a committee thereon, shewing to this Assembly that Jonathan Beckwith, of Lyme in the county of New London, has recovered judg- ment of the county court in New London county by default on an action of book-debt and another of covenant-broken, for large sums against William Brown, Esq', of Salem, who is with the enemies of the United States of America, and that strict justice has not been done therein for want of tryals in said causes; that execution has been taken out on one of said judgments and is levied on a tract of land in Lyme belonging to said Brown, now improved by Benjamin and Jedidiah Beckwith of Lyme, taking from them a great part of said farm which they held and improved for the benefit of this State as the same with the other lands belonging to said Brown in the town of Lyme have been seized as belonging to an inimical person and as by judgment of said county court held and condemned for the purpose aforesaid : Resolved by this Assembly, that said two judgments recov- ered as aforesaid and the levy of said execution and all proceedings thereon be and the same are hereby set aside and declared to be null and void; and that the said Jonathan Beckwith is not hereby fore- closed from exhibiting his bill in equity, if he thinks proper, to the General Assembly of this State that justice and equity may be done between the parties concerned therein.
Upon the memorial of Daniel Tyler, jun', and others, inhabitants of the parish of Brookline and parts adjacent, representing to this Assembly the utility of their being formed and constituted a company of matrosses subject to a proper command, and that sundry spirited gen- tlemen have engaged to procure three or four light constructed field- pieces and equip them fit for service for the use of said company ;

praying this Assembly that they may be constituted an independent company &c., as per memorial on file: Resolved by this Assembly,. that the memorialists have liberty, and liberty is hereby granted to. them, to form themselves and such others as shall join with them for the purpose of exercising three field-pieces, not exceeding twelve pri- vates to one field-piece, into a company of matrosses and apply to any one of the field officers of the 21st regiment of militia in this State to. lead them to the choice of the usual number of commission officers for- such company and certify such choice to his Honor the Governor and Council of Safety for acceptance, and if accepted shall be accordingly commissioned by his Honor, and when formed and the officers com- missioned as aforesaid shall belong to and be under the command of the chief officer of the twenty-first regiment: Provided that said field- pieces be procured and equipped and said choice certifyed by the first day of August next, and that none are included in said company that. are inlisted into or holden by draughts or otherwise for the continental. army.
Whereas the state of public affairs is such that this Assembly cannot attend to the hearing of private business between party and party : Resolved by this Assembly, that all petitions and memorials. between party and party depending before this Assembly be referred for further consideration to the General Assembly to be holden at. New Haven on the second Thursday of October next; and that all committees heretofore appointed on any of said petitions and memo- rials have power and are directed to hear, examine and report to said October Assembly ; and also, that all protections of persons and estates. from attachment, arrest and imprisonment, granted on any of said petitions and memorials, shall be continued and remain in full force- till the rising of said Assembly in October next.
This Assembly do appoint Colo. William Williams, Colo. John. Chester, Mr. Samnel Beach, Mr. Thomas Mumford, Mr. John Daven- port, Capt. Jabez Huntington, Mr. John Canfield and Mr. John Jen- kins, a committee to audit and adjust the state accounts with the Treasurer and make report of their doings in the premises to this. Assembly.
This Assembly do grant to his Excellency Governor Trumbull the sum of one hundred and fifty pounds, money, for the first half of his salary the current year.

Voted, That Mr. Shaw be directed to give orders to Capt. Niles to land those provisions on board the Spy with Messrs. Deshon and Ledyard as commissaries, taking their receipts, and that Mr. Shaw be directed to give order to Capt. Niles what goods to bring on board said schooner from Bed- ford in her next voyage there, which is hereby directed to be performed as soon as may be.
Orders were given to the commanding officer of the forts of N. London and Groton, to order the troops draughted from the northern companies in Stonington to go directly to the forts at Stonington to man that place for defence, and that those draughted from the southern companies in Stoning- ton return home and hold themselves in readiness to serve on the shortest notice for defence of those parts.
Orders were given to Capt. Palmer to remove the stores at Stonington back to some place of safety.
Gave orders to Mr. Andrew Huntington to cause the two guns now on ship carriages at Norwich Landing to be mounted on field carriages without delay.

Voted and Resolved, That Col. Samuel Mott be and he is hereby appointed Engineer, to oversee and direct the constructing and carrying on the fortifi- cations and works of defence begun and carrying on at New London and Groton, and to cause any proper redoubts or works to be erected on any neighbouring hills which might command Fort Trumbull, and which may be useful to annoy or resist the progress of the enemy ; to serve for such term as shall be judged necessary, not exceeding six months ; and that he be directed to repair to New London with all convenient speed and lose no time in giving necessary orders and directions in the premises ; and the com- manding officer on that station is to afford him all necessary assistance of men, materials &c., for the purpose aforesaid ; and the officers and soldiers are to yield all due obedience to the orders and directions of said engineer in this behalf.
Voted, That the commander in chief at the forts at N. London and Groton be and he is hereby directed to employ two whale-boats properly manned to ply in the harbour and sound near New London and the adjacent coasts, especially in the night season and thick weather, to observe the motions of the enemy in the Sound and on Long Island &c., as he shall judge necessary and convenient from time to time and at the present time, and to give notice of the same, to prevent a surprize at those posts.

Voted, To give orders to the overseers of the furnace at Salisbury and they are hereby ordered, to advance the £50 0 0, towards the building the bridge over Ousatunnuck River where wanted for the use of the furnace, on account of this State.
Voted, To direct the overseers of the furnace at Salisbury to mount two four or six-pounders on travelling carriages as field-pieces.
Voted, That Mr. Chauncey Whittelsey of Middletown be and he is hereby appointed and directed to procure a warrant and seize the wheat in the hands of John Birdsey and his sons in Middletown for the use of this State, leaving them enough for their own necessary consumption, and cause the same to be floured as soon as may be, and deliver fifty bushels of wheat to the selectmen of Saybrook for the use of the troops in the fort there, pay- ing said Birdsey and sons the lawful price for the same.
Gave orders to Mr. Benj. Henshaw to borrow one hundred bushels of salt of Capt. Jerh Wadsworth, for the use of the furnace.
