Upon the memorial of Stephen Day of Tolland, administrator on the estate of Amos Fellows, late of Tolland in Hartford county, deceas'd, shewing to this Assembly that the debts and charges due from the estate of said deceas'd surmount the moveable inventoried part of said estate the sum of £406 13 11, L. money ; praying for liberty to sell so much of the real estate of said deceas'd as to raise the sum of £406 13 11, L. money, with incident charges arising on said sale, as per memorial on file : Resolved by this Assembly, that the memorialist have liberty, and liberty and authority is hereby granted to him, to sell so much of the real estate of said deceas'd as to raise said sum of £406 13 11, L. money, with incident charges arising on said sale ; taking the direction of the court of probate for the district of Stafford therein.


Upon the memorial of the selectmen of the town of New Haven, representing that by the mismanagement and bad husbandry of Joel Allen of said New Haven, he being thereby likely to be reduced to want, they took him into their care and was obliged to expend out of the town treasury for his support the sum of £44 3 11, and that he hath no moveable estate sufficient to pay the same ; praying for liberty to sell part of his real estate to pay said sum, as per memorial on file appears : Resolved by this Assembly, that the memorialists have liberty, and liberty and authority is hereby granted unto them, to sell so much of the real estate of said Allen as shall be sufficient to pay said sum of £44 3 11 with the incident charge of such sale, and the same pay into the treasury of said town.


Upon the memorial of John Morehouse, of Danbury in the county of Fairfield, showing to this Assembly that when the British troops marched to Danbury he, through inconsideration and surprise, joined to and went off with them, but being afterwards sensible of his crime took the first opportunity of leaving them and returned home, and voluntarily resigned himself up to justice and was committed to goal for tryal, where he now remains ; praying for pardon of his offence &c., as per memorial on file : Resolved by this Assembly, that the memorialist, upon his taking the oath of fidelity to this State and paying the costs of his prosecution and confinement, be and he is hereby pardoned of his crime, acquitted from any further prosecution on account thereof, and liberated from his confinement.

Resolved by this Assembly, That all petitions and memorials be- tween party and party depending before this Assembly be referred for further consideration to the General Assembly to be holden at Hartford the second Thursday of May next, and that all committees heretofore appointed on any of said petitions and memorials have powers and are directed to hear, examine and report to said sessions of Assembly in May next; and also, that all protections of persons and estates from attachment and imprisonment granted on any of said petitions and memorials shall continue and remain in full force till the rising of said Assembly in May next.


Upon the report of the committee appointed to examine into the complaint laid before this Assembly against Abel Pettibone, late a captain in Colo. Enos's regiment lately in service of this State, it ap- pearing that said Pettibone inlisted one Francis Northaway about the 25th day of November last but made up his pay-abstract as though said Northeway had inlisted on the 6th day of October, 1777, and procured an order for said Northeway's pay from said 6th of October till the end of the service of said battalion, as also for the bounty of said Northeway : Resolved therefore, that said Pettibone refund the bounty and pay which he has drawn for said Northeway from said 6th of October to the 25th of said November and pay the costs at- tending this prosecution, being £4 8 5 ; and the Secretary is directed to issue an execution for the same accordingly.


Ex" granted March 13th, 1778.


Upon the memorial of Doct" Jonathan Havens, Stephen Howell, and other refugees from Long Island now residing in this State, shew- ing that at the time when the British troops possessed themselves of Long Island, they fled into this State with their families for protec- tion ; that they left more or less of their effects in the hands of their friends to be secreted and disposed of as they could and the avails remitted them in order to the support of their families; that about three weeks since they by legal permit granted them for that purpose, went to said island to bring from thence some part of what their friends had saved from the enemy, or the avails thereof arising out of what they had sold of their stock and grain, and having received the same in small parcells of tea and cloath, linnen and woollen, and other things for the use of their families, which was all they could get for what had been sold as aforesaid, they brôt the same to Say- brook in a small boat to the house of one Harriss, when one White, a

lieutenant of the continental frigate called the Trumbull, and one Combs, commanding a whale-boat, and others their associates, came and seized the memorialists' said effects and forceably took the same out of their hands and refuse to deliver or do what is just, to the great injury and distress of the suffering memorialists and their families ; praying for relief &c., as per memorial &c .: Resolved by this Assembly, that William Noyes, Samuel Field, and Ezra Selden, Esqrs, be and they are hereby appointed a committee with full power, as speedily as may be, to notify all parties concerned and enquire into the facts alledged in said memorial or that relate thereto, and report the same with their opinion thereon to the next General Assembly, or in the recess of the same to his Excellency the Governor and his Committee of Safety, who are hereby authorized and directed to give such order thereon as they shall think just and reasonable, and that in the mean time said committee appointed to hear and examine as aforesaid do forthwith take into their custody all of said articles and effects taken from the memorialists as aforesaid out of the hands of said White, Combs and others, and them safe keep untill further order may be had thereon.


Upon the remonstrance of Eliakim Hitchcock and others, living within the limits of the 15th company the 10th regiment, and other inhabitants of the parish of New Cheshire, shewing to this Assembly that Robert Martin hath been chosen Captain of said company and Reuben Rice jun' Lieutenant of said company, and that said Martin and Rice are unfriendly to the liberties of America and its independ- ence ; praying that said Martin and Rice may not be commissioned : Resolved, that General Wadsworth, Samuel Bishop jun", Esqrs, and General Ward be appointed a committee, to examine into the matter in said remonstrance mentioned and the circumstances and situation of said company, and report the facts that they shall find with their opinion thereon to this or the next Assembly.

Resolved and ordered by his Excellency the Governor and this Board, That Capt. John Cotten of Middletown be and he is hereby fully authorized, im- powered and directed, forthwith to endeavour by all proper and practible means in his power, to cause the said continental frigate to be remov'd and got over said bar and into the harbour of Newlondon, and for that end to employ such help and assistance of men and materials as he shall find and adjudge proper and necessary. And Dudley Saltonstall, Esq", commander of said ship, and all other officers and men belonging to said ship, are hereby requested, ordered and directed, to afford said Capt. Cotten every aid, help and assistance in their power, to effect this important and necessary object and which Congress have so much at heart. And said Capt. Cotten is to use his best prudence and discretion in prosecuting this important business to prevent said ship falling into the hands of the enemy. or any other misfor- tune ; and to make report as soon as may be to his Excellency the Governor of his doings in the premises together with the expence attending the execu- tion thereof, that the same may be defrayed and proper information imme- diately made to said Honble Congress.


Resolved by this Board, That Nathan Frink jun' be permitted to go into Newyork by flag, in order to transact some business. agreeable to his memorial.

JUpon the memorial of Jenne Rudement, now resident in Woodbury, shewing to this Board that she is a native of Scotland and has no estate to support her, and has a brother in New York by whose assistance she sup- poses she could get home to her parents and friends in Scotland; praying for liberty to go to Newyork, &c., as per memorial on file: Resolved by this Board, that the memorialist be permitted to go to Newyork for the purpose aforesaid; and his Excellency the Governor is requested to grant her a permit or flag for that purpose accordingly.


Whereas this Board are made acquainted by a private letter from the Honble Eliphalet Dyer, a Delegate [from] this State at Congress, to a mem- ber of this Board, that Congress have sent an express to Colo. Jeremiah Wadsworth of this State, requesting his immediate attendance on their body at York Town on business of much importance to the interest of the United States, and it appearing on inquiry that said Colo. Wadsworth has not re- ceiv'd the letter requesting his attendance as aforesaid; and this Board de- sirous to promote the publick service in every matter. do therefore earnestly recommend it to and advise said Wadsworth to repair as soon as possible to York Town, to wait on the Honbre Congress and attend to the business they may have to lay before him: his not having said letter notwithstanding.


Whereas by reason of the badness of the roads, the scarcity of forage, the want of oxen for fattening to supply the army with meat, it is become extreamly difficult to transport so large a quantity of salt as was ordered to the North River; and as a large quantity is now at said river or near the same: Voted, that Mr. Peter Colt, the deputy commissary-general of pur- chases, be advised, and he is hereby advised, to stop the further sending on the salt to the North River. if it may be done with safety to the United States.

COUNCIL OF SAFETY

Voted, That his Excellency the Governor be desired to write to Major Thomonson, commanding officer of Colo. Nixon's battalion station'd at Farmington, requesting him to march with all convenient speed, pursuant to Gen' Putnam's orders, to Greenwich, all of said battalion who are in cir- cumstances to do duty, leaving at said Farmington those who are unfit with a proper officer to bring them on when fit; and that Colo. Root be directed to repair to said Farmington and acquaint said Major Thomson therewith and inquire into the state of said battalion, inform himself therewith and what may be necessary to furnish the said battalion to enable them to march as aforesaid, and report to this Board.


Upon the application of James and Horace Hooker, shewing to this Board that they have been appointed by Isaac Foster, Esqr, D. director-gen- eral &c., to receive and store a large quantity of hospital-stores for the use of the United States, part of which have already arrived at Windsor and the rest dayly expected, and that they had orders from said Foster to apply to [his] Excellency for a guard &c .; praying for a proper guard &c .. as per application on file: Resolved by this Board, that Colo. Roger Newberry be and he is hereby directed to furnish and supply from the regiment under his command, in such manner as he shall judge most convenient, to the said James Hooker and Horace Hooker a proper guard of one sergeant and twelve men for the present; and in case he shall judge it necessary, that he increase said guard to the number of eighteen men to guard said stores till further order, and that proper pay-rolls be made up and presented to the Committee of Pay-Table for payment, who are hereby directed to liquidate the same and draw on the Treasurer for the sum that shall appear to be due thereon and charge the same to the account of the United States.


Upon the memorial of Colo. John Chester of Weathersfield, and others, shewing to this Board that in January last they purchased of this State a number of salt-pans &c. to the amount in value of £320 18s. 9d., money, which by reason of large holes in said pans &c. were rendered entirely use- less, and that they have been at great expence in transporting said pans &c. from the furnace in Salisbury &c .; praying that they may be excused from the payment of said purchase money and reimburs'd their expence &c., as per memorial on file: Resolved by this Board, that Major William Hilhouse be directed to receive said salt-pans &c. into his custody and dispose of the same to the best advantage of this State and render his account thereof; and that the said Colo. Chester and Company be and they are hereby released and discharged from the payment of said £320 18s. 9d., and that the matter of their expences be referr'd to the future consideration of this. Resolved by this Board, That the overseers of the furnace at Salisbury be directed to cast a trundle head for Mr. John Gillit of Windsor, provided the same does not impede the casting of cannon or mortars.


Resolved, That the overseers of the furnace at Salisbury be directed to hire suitable pastures for the use of said furnace.


Resolv'd, That Brig" Gen' Silliman be impowered and directed to give a passport or flag to Jennie Rudement to go into Newyork, agreeable to a former resolve of this Board.


Upon the memorial of Hannah Church of Danbury, wife of Asa Church late of said Danbury, shewing to this Board that her said husband has vol- untarily joined the British army and is now in Newyork, and that she hath not any estate to support herself &c .; praying for liberty to go to New York to her said husband &c., as per memorial on file: Resolved by this Board, that the memorialist be and she is hereby permitted to go to Newyork to her said husband with such necessary apparel &c. as the committee of in- spection in said town of Danbury shall think proper; and that Brig" Gen1 Silliman be impowered and directed to grant a flag or passport to her, the said Hannah, accordingly.
