On the memorial of Heman Allyn and others against Capt. James Landon of the second company of militia in the town of Salisbury, complaining of his neglect of duty in his said office &c .: Resolved by this Assembly, that the Secretary be and he is hereby directed to issue a citation directed to a proper officer, to cite the said Capt. James Landon to appear forthwith as soon as may be before this Assembly to answer the complaint aforesaid and be dealt with as to justice shall be found to appertain. And the State's Attorney for the county of Litchfield is directed to prepare the evidence to support the facts in said memorial alledged, and lay the same before this Assembly.


Upon the complaint of Heman Allen of Salisbury and others, against James Landon jun" of said Salisbury, captain of the second military company in said Salisbury, representing to this Assembly that said Capt. Landon has been guilty of a general neglect of his duty and has discovered a very great unfriendliness to the American cause &c., on which complaint a committee have been appointed who have made their report to this Assembly, in which they have found the general facts set forth in said complaint to be true, and thereupon give it as their opinion that the said Capt. Landon ought to be cash- iered &c., as per memorial and report on file, which report is accepted : Whereupon it is resolved by this Assembly, that the said Captain James Landon jun' be and he is hereby cashiered and ordered to pay the cost arisen in the premises, allowed by this Assembly to be £11 16 0, and that the Secretary be directed to issue an execution for the same accordingly. Ex" granted Jan'y 29th, 1778.


Upon the complaint of Epaphras Sheldon, Esq', colonel of the 17th regiment of militia, against Solomon Marsh of Litchfield, captain of the tenth military [company] in said regiment, for being guilty of a general neglect of the duties of his office, arising from an unfriendli- ness to the grand American cause &c., on complaint a committee have been appointed, who have made their report to this Assembly, in which they find the facts set forth in said complaint to be true, and give it as their opinion that said Capt. Marsh ought to be dismissed, as per complaint and report on file, which report being accepted : Whereupon it is resolved by this Assembly, that the said Capt. Marsh be and he is hereby dismissed from his said office, and also ordered to pay the cost arisen in the premises, allowed by this Assembly to be £23 9 5, and that the Secretary be directed to issue execution for the same accordingly.


Upon the information of the State Attorney for the county of Litchfield against John Marsh the 3ª of Litchfield, who is cornet of a troop of horse under the command of Capt. Moses Seymour of said

Litchfield, for disobedience of orders, on which information a commit- tee have been appointed who have made their report in which they find the truth of said complaint, and also find that lately the said Marsh has taken the oath of fidelity to this State and declares his willingness to risque his life and fortune in defence of the rights of America &c. ; and upon the whole circumstances said committee give it as their opinion that, upon the said Marsh's paying all cost arisen in the premises, it would be advisable to dismiss said complaint, which report being accepted &c., as per complaint and report on file : Where- upon it is resolved by this Assembly, that the said Marsh pay the cost arisen in the premises, allowed by this Assembly to be £8 14 5, and that the Secretary be directed to issue execution for the same accord- ingly, and that thereupon said complaint be dismissed.


Upon the complaint of Epaphras Sheldon, Esq', colonel of the 17th regiment of militia in this State, against Mathew Grant of Torrington, lieutenant of the fifth company in said regiment, representing to this Assembly that the said Grant has been generally remiss and negli- gent in the duties of his office and has in some instances refused obe- dience to the orders of his superior officers &c., on which complaint a committee have been appointed who have made their report to this Assembly in which they find the facts stated in said complaint to be true, and thereupon gave it as their opinion that said Lieut. Grant ought to be dismissed from his said office, as per memorial on file, which report being accepted : Whereupon it is resolved by this Assem- bly, that the said Lieutenant Grant be and he is hereby dismissed from his said office and ordered to pay the cost arisen in the premises, allowed by this Assembly to be £12 5 0, and that the Secretary be directed to issue an execution for the same accordingly.


Ex" granted Jan" 29th, 1778.


Upon the complaint of John Lewiss jun', captain of a military company in the town of Waterbury, against Ira Beebe of said Water- bury, lieutenant of said company, for going off and leading off a num- ber of said company from Fishkill in October last &c., on which complaint a warrant has issued against the said Bebee and a full hear- ing of said cause has been had: Whereupon it is resolved by this Assembly, that the said Ira Bebee be dismissed upon his paying the cost that has arisen in the premises, which he has complied with.

Upon the memorial of Ralph Isaacs, preferred to this Assembly. shewing that he is executor of his father and brother's wills, that those estates as well as his own affairs suffer greatly by reason of his confinement, that he has taken the oath of fidelity to this State, has done much to promote the good of the United States and is desirous to continue his friendly endeavours for the safety of the country in a more extensive manner than he is able to in his present circumstances; praying to be set at liberty, as per memorial on file : Resolved, that said Ralph Isaacs be and he is hereby inlarged and set at liberty to pursue his business and concerns ; any former resolve of Assembly notwithstanding.


Upon the memorial of Timothy Beach, shewing to this Assembly that by a sentence of the superior court at Fairfield last February he was ordered to be confined in Windham county goal for the term of one year then next, and also to pay a fine of twenty pounds, money. to the Treasurer of this State, and cost of prosecution taxed at £16 16 3; in consequence whereof the memorialist has been confined to said goal ever since the 14th day of March last; that he is willing to take the oath of fidelity to the State and render his personal service in its defence &c., and that his circumstances are low and his family in want of his assistance for their support ; praying to be discharged from his said confinement and the said fine, as per memorial &c .: Resolved by this Assembly, that the memorialist be and he is hereby released and discharged from his said confinement and the fine afore- said, upon his giving his note to the sheriff of Windham county paya- ble to the Treasurer of this State for the costs aforesaid.


Upon the memorial of Eunice Stocking, of Glastonbury in the State of Connecticut, shewing to this Assembly that on the 23d day of August last the powder-mill in said Glastonbury took fire and blew up; that her husband George Stocking and three of her sons, George Stocking jun", Hezekiah Stocking and Nathaniel Stocking, being at work in said house received in the explosion a fatal shock that in a few hours put a period to their lives ; that the listers of said town thought themselves obliged to put the heads of her said husband and three sons into the general list of said town for the year 1777, by which means she is liable to heavy taxation ; and praying for relief, as

per memorial on fire : Resolved by this Assembly, that the heads of the said George Stocking, George Stocking jun", Hezekiah Stocking and Nathaniel Stocking, deed, be abated and the same are hereby ordered to be abated out of the general list of said town.


Upon the memorial of Abiather Camp, of New Haven in the county of New Haven, shewing to this Assembly that he has long been confined by act of Assembly as a dangerous person, and that he has taken the oath of fidelity, and that the inhabitants of New Haven are willing he should return to his family : Resolved, that said Camp be permitted to return to New Haven, and that he be released from his confinement and all restraint by said act.


Upon the memorial of Samuel Mcclellan, of Woodstock in the county of Windham and State of Connecticut, shewing to this Assem- bly that he commanded a regiment from this State in the expedition against Rhode Island, and that no part of their wages, mileage or rations have yet been paid ; praying that the Committee of Pay-Table may be directed to adjust the accounts of said regiment and pay the same, as per memorial on file &c .: Resolved by this Assembly, that the Committee of the Pay-Table be and they are hereby authorized and impowered, to adjust the accounts of the said regiment and draw on the Treasurer for the sums as they shall find justly due to said . regiment for bounty, wages, mileage and rations, and charge the same to the United States of America. And the several captains in said regiment are hereby appointed pay-masters to their companys. And the Committee of the Pay-Table are directed to allow to said captains one and half per cent. commissions on all the moneys that they shall so receive and pay out to said companys.


Upon the memorial of Andrew Johonnot, Esq', of Boston in the State of Massachusets, commissary general of forage for the eastern department, shewing that on the 16th of October last he contracted with Absalom Williams of Weathersfield for fifty tons of screwed hay for the use of the United States, to be spent at Springfield, at the price of seven pound ten shillings per ton, said Williams to transport said hay to Ware House Point, to be paid eighteen shillings per ton for freight besides the charges of carting, as by said written agree- ment, and that said Williams neglects and refuses to perform his con- tract, to the great detriment of the States, as per memorial on file : Resolved, that said Absalom Williams cause said hay to be delivered at said Ware House Point or other place on the road as near and con- venient to Springfield as followeth, viz : Ten tons including what is already delivered in this month, the remainder of said fifty ton one half in February next, the other half in March next, and to be paid for transportation as specifyed in said contract, on pain of forfeiting and paying for the benefit of the United States the sum of three hun-

dred pounds, L. money, in case he fail of delivering said hay or any part as above ordered.


Upon the memorial of Ephraim Strong &c., praying that certain persons who worship with the second society in Milford may be annexed thereto and exempted from paying taxes to the first &c., as per memorial on file : Resolved by this Assembly, that all persons who have come to dwell in the limits of said first and second societies since the constituting said second society, who have never had an oppor- tunity to make their election, shall have liberty to make their election at any time before the first day of May next by enrolling their names with the town clerk of said town ; and that for the future all such who shall come to inhabit within said societies, or shall come of age or become widows, shall have liberty to make their election to which society they will belong at any time within one year next after their coming to dwell within the limits of said societies, or coming of age or becoming widows as aforesaid, by inrolling their names as aforesaid.


Upon the memorial of John Arlow, a native of Ireland, shewing to this Assembly that he transported himself and family consisting of a wife and one child to America in August, 1775, with a view to settle therein and prosecute the trade of making leather breeches, with which business alone he is acquainted, but that by reason of the war he is unable to procure leather or employment wherewith to subsist himself and family ; praying for liberty to transport himself and fam- ily and effects to Ireland by the way of New York or otherwise, as per memorial : Resolved by this Assembly, that the memorialist have liberty, and liberty is hereby granted to him, at his own expence to transport himself, his family and proper effects to Ireland, by the way of New York or other port ; any law of this State to the contrary not- withstanding.


Upon the memorial of Nathan Gates, of East Hadam in the county of Hartford, administrator on the estate of Daniel Gates late of said East Hadam, deceas'd, representing that the allowances to the widow and the debts and charges allowed by the court of probate for the dis- triet of East Hadam against the estate of said deceas'd surmount the moveable estate of said deceas'd the sum of £22 5 7, money ; praying for liberty to sell so much of the real estate of said deceas'd as to pay the same &c., as per memorial on file : Resolved by this Assembly, that said Nathan Gates be and he is hereby impowered to sell so much of the real estate of said deceas'd as will raise said sum of £22 5 7, money, and the incident charges of sale; taking the direction of the court of probate in the district of East Haddam therein.
