A town which accepts this section, or has accepted corresponding provisions of earlier laws, by a two thirds vote at an Annual Meeting, may purchase or lease land, and erect, alter, enlarge, repair and improve buildings for public baths and wash houses, either with or without open drying grounds, and may make open bathing places, provide them with the requisite furniture, fittings and con- veniences and provide instructions in swimming. Such towns may establish rates for the use of such baths and wash houses, and appoint officers therefor, and may make by-laws for the government of such officers, and authorize them to be non-residents of said town.


Article 28. To see if the Town will vote to appoint a committee of three to inquire into the feasibility of establishing a bathing place within the Town limits, said committee to submit plans and estimate of cost at a future meeting.


Article 29. To see if the Town will vote to authorize and instruct the Select- men to order the Boston Edison Co. to discontinue the following street lights:

Article 30. To see if the Town will vote to transfer a sum of money from the Road Machinery Fund to the Highway Machinery Operating Account to defray expenses for operation and maintenance of Highway Machinery during the year 1938.


Article 31. To see if the Town will instruct the Water Board to amend Section 14 of the Rules and Regulations, Water Rates of the Water Department of the Town of Medfield to read "The minimum rate $16.00 per year." All other rates to remain unchanged.


Article 32. To see if the Town will instruct the Water Board to make a survey of our Water Department and recommend ways and means of placing the Water Department on a self supporting basis, and report at the next Annual Town Meeting.


And you are directed to serve this Warrant by posting an attested copy thereof, in the usual place for posting Warrants in said Medfield, seven days at least before the time of holding said meeting.

ANNUAL MEETING


March 7, 1938


Pursuant to a Warrant issued by the Selectmen, the inhabitants of the Town of Medfield, duly warned and notified in the manner prescribed by law, met at the Town Hall on the seventh day of March 1938 at six o'clock in the forenoon to elect their officers for the ensuing year.


Cards of Instructions and Speciman Ballots were posted as required by law.

The ballot box was examined and found in good working order and at the close of the polls agreed with the check lists in the number of ballots cast.


The following named persons appointed by the Selectmen and sworn by the Town Clerk were assigned to duty as follows:


Ann Young and Charles Bullard to distribute ballots; Coleman J. Hogan, Constable at the ballot box; Harriet Thayer, Alice Spear, Ruth Bryant, Robert Bowley as tellers; and Eugene Munson and Edward Sweeney to check at the Ballot box.


The ballots were counted in open meeting and the total vote cast was seven hundred sixty-six (766).

Article 4. Amendments:


(a) Election and Registration-Voted to have the Selectmen appoint a committee to investigate the compensation of the Registrars of Voters.


(b) Fire-Voted to have the Moderator appoint a committee of five (5) to study the advisability of centralizing purchasing with public bidding under the supervision of the Selectmen. Said committee to report at the next special town meeting.


Article 5. Voted that the Town authorize the Treasurer with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1938, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Chapter 44, Section 17, General Laws.


Article 6. Voted as recommended that the taxes shall be paid in two equal payments, July 1, 1938 and October 1, 1938 and that the Collector receive 1% of the 1938 taxes.


Article 7. Voted that the members of the Fire Department be paid a sum of $19.50 per year and $1.00 per hour while working at fires.


Article 8. Voted to authorize the Collector to use all means in the collection of taxes as the Treasurer might if elected to that office.


Article 9. Voted that the price per hour paid for labor on the Highways be left to the discretion of the Selectmen.


Article 10. Voted as recommended that the Town authorize the Water and Sewerage Board to appoint one of its members as Water Registrar.


Article 11. Voted that the sum of $50.00 be paid to the Water Registrar.


Article 12. Voted as recommended that the sum of $1,500.00 be appropriated for W.P.A. Projects.


Article 13. Voted that the report of the committee on Zoning By-Laws be accepted. Said committee to submit recommendations at the next special town meeting.


Article 14. Voted that the Town raise and appropriate the sum of $400.00 for consulting services, maps and printing in regard to the Zoning By-Laws.

Article 18. Voted that the following committee of five (5) be authorized to make arrangements and spend money appropriated under Article 4 for the ob- servance of Memorial Day: Julius A. Fitts, Louis Connors, Frank G. Haley, Dr. H. L. Park and Charles Jones.


Article 19. Voted that the Town raise and appropriate the sum of $1,000.00 provided the State and County reimburse the like amount for general main- tenance of Chapter 90, Roads.


Article 20. Voted that this article be dismissed.


Article 21. Voted that the Town raise and appropriate the sum of $50.00 for the purchase of a safe for the Collector's Department. Said safe to be kept in Collector's home.


Article 22. Voted that the report of the committee be accepted. The land formerly used by the Water Department as a source of water supply was ap- praised at $2,000.00.


Article 23. Voted as recommended that a new Police car be purchased for a sum not exceeding $600.00 and the allowance on the old car. The details of pur- chase and the application of the Town Seal on said car to be left to the Selectmen.


Article 24. Voted to raise and appropriate the sum of $396.25 for Public Liability Insurance covering motor vehicles owned by the Town.


Article 25. Voted that the Town raise and appropriate a sum of money for the payment of outstanding bills.


Article 26. Voted that the Town raise and appropriate the sum of $2,000.00 for the maintenance of Vine Lake Cemetery. Also to transfer the sum of $760.00 from the "Sale of Cemetery Lots Fund" for the purpose of developing the new part of the Cemetery.


Article 27. Voted that the Town accept the provisions of Chapter 40, Sec- tion 12 of the General Laws.


Article 28. Voted that the Selectmen appoint a committee of three to inquire into the feasibility of establishng a bathing place within the Town limits. Said committee is to submit plans and estimate of cost at a future meeting.


Article 29. Voted to authorize and instruct the Selectmen to order the Boston Edison Co. to discontinue the Street Lights specified in this article.

In the name of the Commonwealth, you are directed to notify and warn the inhabitants of the Town of Medfield, qualified to vote in elections and Town affairs, to meet at the Town Hall, in said Medfield on Thursday, the 21st day of April, A.D. 1938 at 7:30 P.M. then and there to act on the following articles:


Article 1. To see if the Town will vote to raise and appropriate a sum of money for the purchase of a road grader, determine whether the money shall be raised by taxation or by transfer from available funds in the Treasury, or take any action in relation thereto.


Article 2. To see if the Town will vote to amend Article 7 of the Annual Town Meeting of March 1938 as follows: "That the members of the Fire Department. be paid a sum of $20.75 per year and $1.00 per hour while working at fires instead of $19.50 per year and $1.00 per hour while working at fires."


Article 3. To see if the Town will hear the report and recommendations of the Planning Board relative to the proposed Zoning By-Laws, or do or act anything in relation thereto.


Article 4. To see if the Town will vote to accept the proposed Zoning By-Law for the Town in accordance with Chapter 40, Section 25 of the General Laws, or do or act anything in relation thereto.


Article 5. To see if the Town will vote to authorize a committee consisting of the Board of Selectmen, the Chairman of the Board of Assessors and the Town Treasurer to sell and convey in behalf of the Town the property belonging to the Town and consisting of the following land and buildings: Lot No. 863 formerly known as the Hannah Blackington Estate consisting of 10,350 square feet of land and buildings thereon situated in the central part of Medfield and bounded as follows: northerly by the N. Y. N. H. & H. R. R. Co., easterly by land of Joseph and Annie Bravo: southerly by town highway known as Friary Street; westerly

by land of Antoinette Palumbo Estate. Lot No. 907 formerly known as the Chester W. Garfield property consisting of 3.7 acres of land and buildings thereon located in the northwesterly part of Medfield and bounded as follows: Northerly by the N. Y. N. H. & H. R. R. Co., westerly by the N. Y. N. H. & H. R. R. Co., southerly by land of Daniel Warren and easterly by Mill Street. Lot No. 913a, No. 913b and No. 913c formerly known as David C. Williams property situated on the south side of Mill Street. N. Howard Peckham-Lot No. 1279 consisting of 17.6 acres of land known as the Ellis Pasture; part of Lot No. 654 consisting of 12 acres of meadow land known as Draper on Causeway Street and Lot No. 664 consisting of 4.1 acres of meadow land situated near Harbor Island, or do or act anything in relation thereto.


Article 6. To see if the Town will vote to authorize the Board of Selectmen to appoint a committee of five for the purpose of investigating the immediate needs and arranging a long term program of adequate athletic facilities for the Medfield High School Student body and the citizens of the Town.


Article 7. To see if the Town will vote to authorize the Town Counsel to collect money due from various water takers for the sale of water pipe and ma- terials and to use all lawful means necessary to enforce collection thereof, a fee of 20% of the amount collected to be allowed the Town Counsel for compensation to be paid out of the Contingent Fund, or do or act anything in relation thereto.


Article 8. To hear and act on the report of the committee appointed under Article 4 of the Annual Meeting of March 1938 to investigate and report on the establishment of a Board for the centralization of all purchases of supplies and materials for the town in excess of $50.


Article 9. To see if the Town will vote to accept the following named sums as Perpetual Trust Funds for the care of lots in the Vine Lake Cemetery, the interest thereof or as may be necessary to be used for said care, viz:

SPECIAL MEETING


April 21, 1938


Pursuant to a Warrant issued by the Selectmen, the inhabitants of the Town of Medfield, duly warned and notified in the manner described by law, met at the Town Hall on the twenty-first day of April, 1938 at 7:30 P.M. and the follow- ing action was taken on the articles in the Warrant:


Article 1. Voted that the sum of $3,400.00 be raised and appropriated for the purchase of a Road Grader, said appropriation to be provided for as follows: From Machinery Fund $630.00 From Available funds in Treasury $2,770.00 The Selectmen are authorized to trade in the old Grader toward the purchase of the new one.


Article 2. Voted to amend Article 7 of the Annual Town Meeting of March, 1938 as follows: "That the members of the Fire Department be paid a sum of $20.75 per year and $1.00 per hour while working at fires instead of $19.50 per year and $1.00 per hour while working at fires."


Article 3. Voted that the report relative to the proposed Zoning By-Law as read by the Chairman of the Planning Board be accepted.


Article 4. Voted to accept the proposed Zoning By-Law for the Town in accordance with Chapter 40, Section 25 of the General Laws.

(1) Inasmuch as any change in method as proposed would involve a revision of the Town By-Law covering purchases which is now in effect that this matter be referred to a committee whose duty shall be to review the town by-laws now in force and propose any revision of these by-laws which they may see fit;


(2) That the Board of Selectmen be appointed as this committee with authority to appoint such additional members or sub-committees as they may think advisable and instructed to report at the next Annual Town Meeting.


Article 9. Voted that this article be accepted in the usual form. Voted that the meeting be dissolved.

I hereby certify that the Zoning By-Law and accompanying Zoning Map as accepted by the Town under Article 4 of the Special Town Meeting held April 21, 1938 were duly presented to the Attorney-General for approval.
