Article 2. Voted to substitute the sum of $18,000.00 for maturing debt instead of the $22,000.00 appropriated under Article 4 of the Annual Town Meeting of March 20, 1939. Unanimous vote.

Article 3. Voted unanimously that to meet the Emergency Storm Damage Loan of $4,000.00 due on October 24, 1939 and issued under authority of Clause 9, Section 8, Chapter 44, General Laws and a vote of the town at a meeting held October 11, 1938, there be raised in the tax levy of 1939 the sum of $2,000.00 and the Treasurer, with the approval of the Selectmen be and hereby is authorized to refund the sum of $2,000.00 and to issue bonds or notes of the Town therefor, said bonds or notes to bear on their face the words, Emergency Storm Damage Loan, Act of 1939, and to be payable in accordance with Section 19, Chapter 44, General Laws, and Chapter 63, Acts of 1939, so that the whole loan shall be paid in two years from the date of issue of the first bond or note.


Article 4. Voted to transfer the sum of $300.00 from the Overlay Reserve for the 1935 Overlay.


Article 5. Voted to authorize the Water Commissioners to sell surplus pipe and fittings belonging to the town and which they deem advisable to sell.


Article 6. Voted to authorize the Selectmen to sell the obsolete and scrap materials and partsbelonging to the town and also the old Republic truck formerly used by the Tree Warden Department.


Voted that the meeting be dissolved.

In the name of the Commonwealth you are directed to notify and warn the inhabitants of the Town of Medfield, qualified to vote in elections and in town affairs, to meet at the Town Hall, in said Medfield on Tuesday, the 18th day of July, A.D. 1939 at 7:30 P.M. then and there to act on the following articles:


Article 1. To see if the Town will vote to raise and appropriate a sum of money for the purchase of a sand spreader, determine whether the money shall be raised by taxation or by a transfer from available funds in the treasury, or take any action in relation thereto.


Article 2. To see if the Town will vote to raise and appropriate the sum of $2,000.00 for construction, reconstruction, maintenance and repair of local streets other than state highways, and surface drainage work and sidewalks, all located in the central portion of Medfield, or do or act anything in relation thereto.

To see if the Town will vote to raise and appropriate a sum of money to lay a six inch water main in South Street, Medfield, Massachusetts, from the present system now terminated at a point opposite the Loeffler Estate on South Street, Medfield, formerly the Kimball Estate, a distance of nine hundred and fifty (950) feet more or less, or take any action in relation thereto. And you are directed to serve this warrant by posting an attested copy thereof, in the usual place for posting warrants in said Medfield, seven days at least before the time of holding said meeting.

The meeting was called to order by the Moderator at 7:30 P.M. and the follow- ing action was taken on the articles in the warrant:


Article 1. Voted to transfer the sum of $300.00 from the Machinery Revenue account for the purchase of a Sand Spreader.


Article 2. Voted to raise and appropriate the sum of $2,000.00 for construction, reconstruction, maintenance and repair of local streets other than state highways, and surface drainage work and sidewalks, all located in the central portion of Medfield.

Article 3. Voted that the sum of $2,000.00 be raised and appropriated for the purpose of laying a water main of not less than 6 inches in diameter a distance of approximately one thousand feet southerly in South Street from the present terminus of the main, and to meet said appropriation the Treasurer with the approval of the Selectmen be and hereby is authorized to borrow the sum of $2,000.00 and to issue bonds or notes to be payable in accordance with the pro- visions of Chapter 44, of the General Laws so that the whole loan shall be paid in not more than 4 years from the date of issue of the first bond or note or at such earlier dates as the Selectmen and Treasurer may determine and that the work be left to the judgment of the Water Board. To see if the Town will vote to authorize the Selectmen to grant rights of way to the Shell Oil Co., Inc. through certain parcels of land owned by the town and known as the Public Dump, the N. Howard Peckham land and a certain triangular parcel located at the intersection of Bridge and Dale Streets, for the purpose of laying and maintaining a pipe line for the transportation of oil, gasoline, petroleum or any of its products, gas, water and other substances, and to receive consideration therefor, and to execute the necessary deeds therefor, or do or act anything in relation thereto.


Article 2. To see if the Town will vote to authorize the Selectmen to grant a permit to the Shell Oil Co., Inc. to construct a pipe line under the following streets: Granite, South, Causeway, Main, Bridge, Dale, Grove, Adams, West, West Mill, and Hospital Road, or do or act anything in relation thereto.

APPLICATION


APPLICATION OF SHELL OIL COMPANY, INCORPORATED, to the Board of Selectmen of the Town of Medfield, County of Norfolk, Commonwealth of Massachusetts.


To the Honorable, Board of Selectmen, of the Town of Medfield, County of Norfolk.


Your petitioner, SHELL OIL COMPANY, INCORPORATED of New York, N. Y., a Virginia Corporation, respectfully shows that it is duly authorized to do business in the Commonwealth of Massachusetts, and that it desires to construct a pipe line, a part of which is to lie in and across Town of Medfield, County of Norfolk.


Your petitioner further represents to this Honorable Board that it is necessary, in order to carry on its business, to lay and operate a pipe line or pipe lines in said County and to that end, your petitioner desires authority to lay, construct, re- construct, replace, renew, maintain, repair, and operate a pipe line or pipe lines and to change the size of and remove pipe and pipe lines for the transportation of oil, gasoline, petroleum or any of its products, gas, water, refined oil, and other substances, or any thereof, through, along, over, under and across the highways and public places of the Town of Medfield, County of Norfolk, together with the

right to lay adjacent to and parallel with the first pipe line or lines, other or ad- ditional pipe lines, together with the full right of ingress and egress to and from said pipe lines, or any of them, for the purpose of inspection, construction, repair- ing, renewing, changing the size of, or removing the same, together with the right of removal of the same at will, either in whole or in part.


Your petitioner further represents to the Honorable Board that said pipe line or lines will be laid along, under, through and across said township roads and highways in conformity with the rules and regulations prescribed by the Board and /or the Engineer, that said pipe line or lines shall be so constructed as not to interfere with the public use of said township roads and highways and shall not be constructed until permission and consent is secured from the owners of the properties abutting said township roads and highways at the point where such pipe line or lines cross or run along such roads and highways.


Your petitioner further represents to this Honorable Board that the proposed route or approximate location of said pipe line or lines across the aforesaid roads is shown on the blueprint attached hereto and numbered 9 for identification purposes.


WHEREFORE, your petitioner prays that this Honorable Board make and enter a proper order herein granting the permit and authority herein requested.

On this 19th day of December, 1939, came on to be heard the petition of SHELL OIL COMPANY, INCORPORATED (a corporation organized under the laws of the State of Virginia, but authorized to do and doing business under the laws of the Commonwealth of Massachusetts) before the Board of Selectmen, of the Town of Medfield, County of Norfolk, State of Massachusetts, in regular session duly assembled, for authority to lay, construct, reconstruct, replace, renew, operate, maintain, repair, change the size of and remove a pipe line or lines, for the transportation of oil, gasoline, petroleum or any of its products, gas, water, and other substances or any thereof, over, under, through, across and along certain highways and roads in the Town of Medfield, County of Norfolk, State of Massa- chusetts, as more fully described and referred to in application heretofore filed by the SHELL OIL COMPANY, INCORPORATED, and the said application

having been duly considered and it appearing that the same is reasonable and proper and that it should be granted:


Now, therefore, pursuant to authority granted by the following Resolution adopted by the Inhabitants of the Town of Medfield, at a special meeting held October 2, 1939:


Resolved :- Voted to authorize the Selectmen to grant a permit to the SHELL OIL COMPANY, INCORPORATED, to construct a pipe line under the following streets: Granite, South, Causeway, Main, Bridge, Dale, Grove, Adams, West, West Mill, and Hospital Road.


The Town shall receive the sum of $10.00 per street as an inspection fee, and an inspector appointed by the SHELL OIL COMPANY, INCORPORATED, is to be present at the crossing of each street to see that it is restored to its original condition.


It is ordered that the SHELL OIL COMPANY, INCORPORATED, its successors and assigns, be and they are hereby granted authority to use the high- ways and roads in the Town of Medfield, County of Norfolk, Massachusetts at and along the route of said proposed line or pipe lines, as described in its applica- tion on file with this Board, and to lay, construct, reconstruct, replace, renew, operate, maintain, repair, change the size of, and remove said pipe line or pipe lines, for the transportation of oil, gasoline, petroleum or any of its products, gas, water, and other substances, or any thereof, over, under, through, across and along the township highways and road in said Town of Medfield, County of Norfolk, Massachusetts.


It is made a condition hereof, that all pipe lines laid or constructed hereunder shall be so laid or constructed so as not to interfere with the use of said roads and hghways, and such crossings shall be constructed and maintained to the approval and satisfaction of the Board of Selectmen, and /or Engineer of Town of Medfield, County of Norfolk, Massachusetts, and in conformity with such rules and regula- tions as may be prescribed and promulgated by the Board of Town of Medfield, and /or Engineer of said County and Commonwealth last named.


It is further made a condition hereof, that said SHELL OIL COMPANY, INCORPORATED, its successors and assigns, shall repair any damage done to the surface of such roads and highways as it shall cross hereunder or through; and shall save the Town of Medfield, County of Norfolk, Commonwealth of Massa- chusetts, free and harmless from any and all loss, liability and responsibility growing out of the granting of this authority and the laying and construction of said pipe line or pipe lines by reason thereof.


It is further made a condition hereof that an inspector furnished by the Town of Medfield shall be paid by the SHELL OIL COMPANY, INCORPORATED, at the rate of one dollar ($1.00) per hour during backfilling operations, but in no event shall the amount to be paid exceed two dollars ($2.00 per road crossing). Inhabitants of the Town of Medfield, a Municipal corporation, duly organized under the laws of the Commonwealth of Massachusetts and situated in Norfolk County, Massachusetts (hereinafter referred to as "Grantor", whether one or more), for Five Hundred Dollars ($500.00), paid, grants to SHELL OIL COM- PANY, INCORPORATED, a Virginia corporation, having a usual place of business in Boston, Suffolk County, Massachusetts, with quit claim, a right of way over, under and through Grantor's lands in Town of Medfield, County of Norfolk and Commonwealth of Massachusetts, bounded and described as follows:


Parcel One.


A parcel known as the Peckham tract in the Southerly part of Medfield, con- taining 222 acres of land and bounded:


NORTHERLY by land formerly owned by William F. Guild and land formerly of Samuel Woods;


EASTERLY by land now or formerly of Jeremiah Hartshorn;


SOUTHERLY by land now or formerly of Oliver Allen and a wood road known as Rocky Lane;


WESTERLY by land now or formerly of William F. Guild.


For reference to title see tax deed for 1931 taxes assessed to H. Howard Peck- ham, dated September 30, 1933 and recorded with Norfolk Deeds, Book 2007, Page 561 and Certificate of Final Decree foreclosing said tax deed, dated March 3, 1938, No. 11707, Land Court, said certificate being recorded with Norfolk Deeds, Book 2175, Page 189.


As shown on Plan marked "A" to be recorded herewith:


The pipe line to enter the above described property /at a point on the Easterly boundary thereof approximately 200 feet South from the Northeast corner of said tract; and to run in a Northwesterly direction leaving said tract at a point on its Northerly boundary approximately 140 feet West of said Northeast corner. The parcel referred to herein being Lot No. 1279, Assessor's Map of Medfield.


Parcel Two.


A tract now used by the town as dumping property and situated on the East side of the road leading from the center of the town to the house of the last John Grant, deceased, and bounded:


EASTERLY by land now or formerly of Amos E. Mason;


SOUTHERLY by land owned now or formerly by the heirs of D. D. Curtis;


WESTERLY by the Town road, now called Grove Street, and


NORTHERLY by land now or formerly owned by George Fiske; Containing 42 acres, more or less.


Being the same premises conveyed to Grantor by Amos W. Shumway, by deed dated September 27, 1899 and recorded with Norfolk Deeds, Book 854, Page 262. As shown on Plan marked "B" to be recorded herewith:


The pipe line to enter the property last described herein at a point on the North- easterly side of Grove Street approximately 160 feet Northwesterly from the Southeast corner of said tract, and after turning to proceed thence in a straight line through said property to a point on its North boundary approximately 300 feet Easterly from the Northwesterly corner of said tract. The parcel referred to herein being Lot No. 851, Assessor's Map of Medfield.

With respect to last described property, Grantor shall not be liable to grantee for damage to pipe resulting from the burning of refuse, the caving in, or settling of the dump or from any cause whatsoever resulting from the use of said premises for dumping purposes.


It is understood that nothing herein shall entitle Grantee to construct any storage tanks or booster pumps within the Town of Medfield.


It is understood that this grant is made by the Board of Selectmen pursuant to the following Resolution adopted by the Inhabitants of the Town of Medfield, at a special meeting held October 2, 1939:


Resolved :- Voted to authorize the Selectmen to grant rights-of-way to the SHELL OIL COMPANY, INCORPORATED, through the parcels of land owned by the Town and known as the Public Dump and the H. Howard Peckham land, for the purpose of laying and maintaining a pipe line for the transportation of oil, gasoline, petroleum, and any other of its products, gas, water, and other substances.


The Town shall receive as consideration from the SHELL OIL COM- PANY, INCORPORATED, the sum of Five Hundred Dollars ($500.00), and execute the necessary deeds, therefore.


For the purpose of constructing from time to time and maintaining and operat- ing one or more lines of pipe for the transportation of oil, gas, petroleum products, water and other substances, with free ingress and egress to construct, operate, maintain and from time to time, inspect, alter, replace, repair and remove the same.


Grantor reserves the right fully to use and enjoy said premises, subject to the rights herein granted, and grantee hereby agrees to pay any damages which may directly and immediately arise to existing crops, timber, buildings or fences from the exercise of the rights herein granted.


Should more than one pipe line be laid under this grant, at any time, an ad- ditional consideration equal to the consideration hereinabove recited shall be paid for each line so laid after the first line, as well as damages, as above provided, arising from the construction thereof. All pipe lines laid under this grant shall be laid upon a route selected by grantee and be buried to a sufficient depth so as not to interfere with the ordinary cultivation of the soil, and any line laid after the first line shall be laid parallel with and adjacent to said first line.


* As to all rights hereby granted all rights of dower, curtesy, homestead and any other interests therein are hereby released to grantee.


It is hereby understood that the party securing this grant on behalf of grantee is without authority to make any covenant, agreement or representation not herein expressed.
