RESULT OF RECOUNT OF VOTES CAST FOR SELECTMEN ON MARCH 7, 1938, HELD ON MARCH 16, 1938


A petition was filed by Elmer A. Smith, and others for a recount of the votes for Selectmen cast at the annual election held on March 7, 1938, in accordance with Chapter 54, Section 135 of the General Laws and a recount was held on Wednesday evening March 16, 1938, in the Town Hall at 7 o'clock.


The Board of Registrars assisted by Alexander G. Williams, an election officer, conducted the recount. All the candidates and their appointed representatives were present and witnessed the recount, the following changes resulting:


William F. Emerson lost 3 votes, Charles R. Jones lost 2, George W. Peavey lost 1, Elmer A. Smith lost 2, Clarence A. Studley lost 8 and Everett S. Webster gained 14.

RECORD OF TOWN MEETINGS


RECORD OF SPECIAL TOWN MEETING HELD JANUARY 14, 1938, AT 8 O'CLOCK P. M.


The meeting was opened by the Moderator at 8.10 P. M. who read the warrant and the return of the Constable, and the articles were then taken up for action.


Article 1. To see if the Town will vote to raise and appropriate a sum of money to cover expense of Old Age Assistance in the year 1937, in excess of money appropriated for said purpose.


Motion was made by John Ward that the Town vote to raise and appropriate the sum of $349.02 to cover the expense incurred during the year 1937 for Old Age Assistance, and the motion was carried by a unanimous vote.


Art. 2. To see if the Town will vote to raise and appropriate a sum of money for Gipsy Moth Work, that the unemployed may be given work.


Motion made by John Ward that the Town vote to raise and appro- priate the sum of $3,000.00 for Gipsy Moth Work, that the unemployed may be given work, and that the money be expended under the direc- tion of the Tree Warden; was amended by Carl H. Russell, that the men be paid at the rate of $4.00 per day, and the foremen be paid at the rate of $4.25 per day; and the motion as amended was carried by a unanimous vote.


All articles on the warrant having been acted upon the meeting was dissolved at 8.23 P. M.

The Meeting was opened by the Moderator at 7.40 P. M. who read the call for the meeting and the Constable's return.


It was voted to dispense with the reading of the articles on the warrant and Article 1 was taken up for action.


Article 1. To choose all town officers not required to be chosen by ballot, viz: Three Field Drivers, one Pound Keeper and three Wood Measurers.


Voted: On motion by J. Ward, that Joseph F. Smith, Daniel J. McCarthy, and Everett S. Webster be appointed as Field Drivers, Joseph F. Smith as Pound Keeper, and George M. Roundy, Daniel Kelleher and Albert G. Tedford as Wood Measurers.

Art. 2. To act upon reports of town officers and special com- mittees as published.


Voted: On motion by G. W. Peavey to accept the reports of Town Officers and special committees as published.


Art. 3. To see if the Town will vote to authorize the Town Treas- urer with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1939, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.


Voted: On motion by C. H. Russell, to authorize the Town Treas- urer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1939, and to issue a note or notes therefor, payable within one year and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.


Art. 4. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of General Government of the Town, viz: Town Officers' salaries and expenses, care of Municipal Buildings, and Elections and Registrations.


Voted: On motion by G. W. Peavey, to raise and appropriate the sum of $8,600.00 to cover the expense of General Government of the Town, viz: Town Officers' salaries and expenses, care of Municipal Buildings, and Elections and Registrations, subject to amounts appro- priated under Articles 36 and 43. This action was later reconsidered and it was voted that $9,500.00 be raised and appropriated for the pur- poses stated, that $900.00 be used for salaries of the assessors. The motion passed to reconsider was made by W. D. Harrington and the motion carried covering the appropriation was made by C. H. Russell.


Art. 5. To see if the Town will vote to raise and appropriate a sum of money for the expense of the Police Department.


Voted: On motion by E. P. Lane, that the sum of $3,800.00 be raised and appropriated for the expense of the Police Department.


Art. 6. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of the Fire Department.


Motion was made by E. P. Lane, that the Town vote to raise and appropriate the sum of $3,800.00 to cover the expense of the Fire De- partment, was amended by J. Ward that $4,000.00 be raised and appro- priated for said purpose and the amendment was carried.

Art. 7. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of Hydrant Rental for fire protection for the ensuing year.


Voted: On motion by W. W. Moxham to raise and appropriate the sum of $1,175.00 to cover the expense of Hydrant Rental for fire pro- tection for the ensuing year.


Art. 8. To see if the Town will vote to raise and appropriate a sum of money to cover Other Protections of Persons and Property.


Motion was made by G. W. Peavey, that the Town raise and ap- propriate the sum of $390.00 to cover Other Protections of Persons and Property and it was so voted.


Art. 9. To see if the Town will vote to raise and appropriate a sum of money to cover the State Moth Assessment.


Voted: On motion by G. M. Roundy, that the Town raise and appropriate the sum of $1,614.33 to cover the State Moth Assessment.


Art. 10. To see if the Town will vote to raise and appropriate a sum of money for Private Moth Work.


Voted: On motion by E. P. Lane, that the Town raise and appro- priate the sum of $540.00 for Private Moth Work.


Art. 11. To see if the Town will vote to raise and appropriate a sum of money to be used by the Tree Warden, for the trimming and caring for trees along the highway.


Motion was made by A. H. Riggs, that the Town vote to raise and appropriate the sum of $700.00 to be used by the Tree Warden for the trimming and caring for trees along the highway, and motion was amended by E. P. Lane that the sum of $360.00 be raised and appro- priated for said purpose, and the motion as amended was carried.


Art. 12. To see if the Town will vote to raise and appropriate a sum of money to be used for Health and Sanitation, including Board of Health, Inspection of Animals, Inspector of Milk.


Motion was made by E. S. Webster, that the Town vote to raise and appropriate the sum of $310.00 to be used for Health and Sanita- tion, including Board of Health, Inspection of Animals, Inspector of Milk, and the motion was carried.


Art. 13. To see if the Town will vote to raise and appropriate a sum of money to cover the General Expense of the Highway Department.


Motion made by M. H. Carter, that the Town vote to raise and appropriate the sum of $10,500 to cover the General Expense of the

Highway Department, was amended by E. P. Lane that $10,000.00 be raised and appropriated for said purpose and the amendment was carried.


Art. 14. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of the Welfare Department.


Motion was made by C. A. Studley, that $5,300.00 be raised and appropriated to cover the expense of the Welfare Department, and it was so voted.


Art. 15. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of Old Age Assistance.


Voted: On motion by E. S. Webster, to raise and appropriate the sum of $7,550.00 to cover the expense of Old Age Assistance.


Art. 16. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of Soldiers' Relief.


Voted: On motion by C. A. Studley, that the Town raise and appro- priate the sum of $1,200.00 to cover the expense of Soldiers' Relief.


Art. 17. To see if the Town will vote to raise and appropriate a sum of money for the General Expense of the School Department.


Motion was made by H. P. Peabody, that the Town vote to raise and appropriate the sum of $42,700.00 for the General Expense of the School Department; was amended by E. P. Lane that $42,000.00 be raised for said purpose. The amendment was defeated and the original motion was carried.


Art. 18. To see if the Town will vote to raise and appropriate a sum of money for the general expense of the Public Libraries.


Motion was made by W. W. Grace, that the Town vote to raise and appropriate the sum of $800.00 for the General Expense of the Public Libraries, and was amended by Mr. Green that Articles 18 and 19 be taken up jointly and the amendment was defeated. The original motion was then put and carried.


Art. 19. To see what disposal the Town will make of the money refunded by the County from the Dog Licenses for the year 1937.


Voted: On motion by R. P. Schlenker, that the Town appropriate the money refunded by the County from the Dog Licenses for the year 1937, for the support of the Public Libraries.


Art. 20. To see if the Town will vote to raise and appropriate a sum of money to cover the general expense of the Town Parks.


Motion made by E. P. Lane, that the Town vote to raise and appro- priate the sum of $450.00 to cover the General Expense of the Town

Parks, was amended by J. Ward that $500.00 be raised and appropri- ated for the purpose, and the amendment was carried.


Art. 21. To see if the Town will vote to raise and appropriate a sum of money for the Observance of Memorial Day, and determine by whom it shall be expended.


Voted: On motion by C. H. Russell, that the Town raise and appro- priate the sum of $200.00 for the Observance of Memorial Day, to be expended under the direction of a committee to be appointed by the American Legion Post No. 131, Incorporated.


Art. 22. To see if the Town will vote to raise and appropriate a sum of money to cover the Town's share of the expense incurred during the year 1937 in maintaining the Essex County Sanatorium under the provisions of Chapter 111 of the General Laws.


Voted: On motion by G. M. Roundy, that the Town raise and appro- priate the sum of $1,465.10 to cover the Town's share of the expense incurred during the year 1937 in maintaining the Essex County Sana- torium, under the provisions of Chapter 111 of the General Laws.


Art. 23. To see if the Town will vote to raise and appropriate a sum of money for the Reserve Fund.


Motion made by J. Ward, that the Town vote to raise and appro- priate the sum of $2,000.00 for the Reserve Fund, was amended by W. W. Moxham, that the sum be $1,500.00 and the amendment was carried.


Art. 24. To see if the Town will vote to raise and appropriate a sum of money for the use of the Cemetery Commissioners for the care of the Town Cemeteries ..


Voted: On motion by R. R. Pearson, that the Town raise and appro- priate the sum of $650.00 for the use of the Cemetery Commissioners for the care of the Town Cemeteries.


Art. 25. To see if the Town will vote to raise and appropriate a sum of money to cover Payments of Notes maturing the current year.


Motion was made by C. H. Russell, that the Town vote to raise and appropriate the sum of $5,500.00 to cover payment of notes matur- ing during the current year, and that the sum of $5,166.35 be assessed in the current tax levy, and the remainder of $333.65 be taken from the fund known as the Premium on Coupon Notes, and it was so voted.


Art. 26. To see if the Town will vote to raise and appropriate a sum of money to cover Payments of Interest on Debts and Loans be- coming due the current year.


Motion was made by C. H. Russell, that the Town vote to raise and appropriate the sum of $950.00 to cover Payments of Interest on Debts and Loans becoming due the current year, and it was so voted.

REPORT OF TOWN CLERK


Art. 27. To see if the Town will vote to raise and appropriate a sum of money to be used for Government or Relief Projects.


Motion made by E. S. Webster, that the Town vote to raise and appropriate the sum of $1,200.00 to be used for Government or Relief Projects, was carried.


Art. 28. To see if the Town will vote to raise and appropriate the sum of $3,000.00, said sum to be used with sums allotted by the County of Essex and the Commonwealth of Massachusetts in reconstructing Summer Street, in accordance with the provisions of Chapter 90 of the General Laws.


Motion was made by C. A. Studley, that the Town vote to raise and appropriate the sum of $3,000.00, said sum to be used with sums allotted by the County of Essex and the Commonwealth of Massachu- setts in the continuation of the reconstruction of Summer Street, in accordance with the provisions of Chapter 90 of the General Laws, and it was so voted.


Art. 29. To see if the Town will vote to raise and appropriate a sum of money to purchase and plant shade trees along the highways.


On motion by E. P. Lane, it was voted to indefinitely postpone action on Article 29.
