Motion was made by J. Ward, that action on Article 30 be indefi- nitely postponed and the motion was defeated.


Motion was made by G. W. Peavey, that Articles 30 and 31 be taken up jointly and it was so voted.


Art. 30. To see if the Town will vote to raise and appropriate a sum of money to cover the maintenance cost of two street lights on Clark Road, four on Lakeview Drive, three on the Edward Q. Moulton Boulevard, and two on Perry Avenue.


Art. 31. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of Street Lighting.


Motion was made by G. W. Peavey, that the Town raise and appro- priate the sum of $3,850.00 for the cost of Street Lighting, and instruct the Selectmen to install the following new street lights: two on Clark Road, four on Lakeview Drive, three on the new Route 128, and two on Perry Avenue, cost of maintenance of new lights to be paid for out of the general lighting appropriation, and it was so voted.


Art. 32. To see if the Town will vote to raise and appropriate a sum of money for the maintenance of highways, same to be used in co-operation with sum allotted by the Commonwealth of Massachusetts, under Chapter 90 Work.

Motion was made by M. H. Carter, that the Town vote to raise and appropriate the sum of $500.00 for the maintenance of highways, same to be used in co-operation with sum alloted by the Common- wealth of Massachusetts under Chapter 90 Work, and the motion was carried.


Art. 33. To see if the Town will vote to raise and appropriate a sum of money for Sidewalk Work.


Motion was made by E. P. Lane, that action on Article 33 be indefi- nitely postponed and it was so voted.


Art. 34. To see if the Town will vote to raise and appropriate a sum of money to be used by the Highway Department for the cutting of Brush along the Highways.


Motion was made by G. M. Roundy, that the Town vote to raise and appropriate the sum of $150.00 to be used by the Highway Depart- ment for the cutting of brush along the Highways.


Motion by E. P. Lane, to indefinitely postpone action on the article was defeated. An amendment offered by B. F. Griffin, that the sum raised and appropriated for said purpose be $300.00, was carried.


Art. 35. To see if the Town will vote to raise and appropriate a sum of money to continue the Town Survey.


Voted: On motion by E. M. Fletcher, to indefinitely postpone action on Article 35.


Voted: On motion by W. W. Moxham, to take up jointly Articles 36 and 43.


Art. 36. To see if the Town will vote to fix the salaries of the following Town Officers as follows: Accountant, $600; Treasurer, $500; Tax Collector, $500; Town Clerk, $250; and raise and appropriate the sum of $350 to provide for same.


Art. 43. To see what action the Town will take with reference to fixing the rate of salary for the Board of Assessors.


Motion was made by W. W. Moxham, to indefinitely postpone action on Articles 36 and 43 and it was so voted.


Art. 37. To see if the Town will vote to raise and appropriate a sum of money to be used by the School Department, for improving the J. B. Blood Playground.


Motion was made by E. M. Fletcher, that the Town vote to raise and appropriate the sum of $200.00 to be used by the School Depart- ment, for improving the J. B. Blood Playground, which was amended by W. W. Moxham that action be indefinitely postponed, which was defeated and the original motion was carried.

Art. 38. To see if the Town will vote to raise and appropriate a sum of money to cut back Oram's Corner at the junction of Main and Lowell Streets.


Motion was made by W. W. Moxham, that the Town vote to appro- priate the sum of $200.00 to cut back Oram's Corner at the junction of Main and Lowell Streets, said sum to be taken from the Highway appropriation, and it was so voted; an amendment by C. E. Pearson to indefinitely postpone action on the article having been defeated.


On motion by W. D. Harrington, it was voted to reconsider action taken on Article 4, and on motion by C. H. Russell, it was voted to raise and appropriate the sum of $9,500.00 for expense of General Govern- ment, that $900.00 be used to pay the Assessors' salaries.


Art. 39. To see if the Town will vote to appropriate the sum of Four Hundred Forty-five Dollars ($445.00) from the Sale of Lots and Graves Fund for the purpose of erecting a tool house in Willow Cemetery.


Voted: On motion by C. H. Russell, that the Town appropriate the sum of $445.00 for the purpose of erecting a tool house in Willow Ceme- tery, and that this amount be taken from the Sale of Cemetery Lots Fund.


Art. 40. To see if the Town will vote to indemnify the members of the Fire Department for loss by reason of any expenses or damages sustained by them while acting within the scope of their official duties or employment and appropriate the sum of $285.00 to pay a proper charge for effecting insurance providing indemnity to such members and each of them for loss by reason of any such expenses or damages, and that the necessary amount to provide such insurance shall be here- after included in the annual budget of the Fire Department, or take any action relative thereto.


Motion was made by L. E. Pearson, that the Town vote to raise and appropriate the sum of $285.00 for the purposes indicated in Article 40, and the motion was defeated.


Art. 41. To see if the Town will vote to accept Section 100a, Chapter 41, of the General Laws of Massachusetts, (Ter. Ed.) or what action it will take thereon.


Voted: On motion by N. B. Todd, that action on Article 41 be indefi- nitely postponed.


Art. 42. To see if the Town will vote to raise and appropriate the sum of $241.00 to cover the cost of liability insurance for Fire Depart- ment drivers, said sum to be included in the Fire Department Budget each year hereafter.

Art. 44. To see if the Town will vote to raise and appropriate the sum of $200 from the Machinery Account to pay for a snow plow purchased during January.


Voted: On motion by C. H. Russell, that the Town appropriate the sum of $200.00 from the Road Machinery Account, to pay for a Snow Plow purchased during January.


Art. 45. To see if the Town will vote to adopt the following By-Law or take any action relative thereto:


"No contract for construction work or for the purchase of apparatus, supplies or materials, whether for repairs or original construction, the estimated cost of which amounts to Two Hundred Fifty Dollars ($250) or more, except in cases of special emergency involving the health or safety of the people or their property, shall be awarded unless pro- posals for the same have been invited by advertisements in at least one newspaper of general circulation in the town once a week for at least two consecutive weeks, the last publication to be at least one week before the time specified for the opening of said proposals. Such advertisements shall state the time and place where plans and specifi- cations of proposed work or supplies may be had and the time and place for opening the proposals in answer to said advertisements, and shall reserve to the town the right to reject any or all of such proposals. All such proposals shall be opened in public. No bill or contract shall be split or divided for the purpose of evading any provision of this By-Law."


Motion was made by W. W. Moxham, that the Town adopt the con- tents of Article 45. J. Ward offered an amendment to indefinitely post- pone action on the article and the amendment was carried.


Art. 46. To see if the Town will vote to change the hours of the opening and closing of the polls for voting at the Annual Election of Town Officers.


Motion was made by W. F. Emerson, that the polls at the Annual Election shall be opened at 9 o'clock A. M. and closed at 8 o'clock P. M. J. Ward offered an amendment that action on the article be indefinitely postponed which was defeated, and the original motion was carried.


Art. 47. To see what action the Town will take on the following: No person holding office, elective or appointive, receiving a salary of $300.00 or more, shall hold any other office.


Motion made by N. B. Todd, to indefinitely postpone action on Article 47, was carried.

Art. 48. To see if the Town will vote to instruct the Board of Selectmen to eliminate the WPA Co-ordinator.


Voted: On motion by G. M. Roundy, to indifinitely postpone action on Article 48.


Art. 49. To see if the Town will vote to have the Annual Election of Town Officers one week following the Annual Town Meeting.


Voted: On motion by J. Ward, to indefinitely postpone action on Article 49.


Art. 50. To see if the Town will vote to establish a quorum neces- sary to be present at a regular or special Town Meeting.

Art. 51. To see if the Town will vote to elect at the Annual Meet- ing, a Highway Surveyor to serve for a term of one year at a salary to be determined at the Town Meeting.

Art. 52. To see if the Town will vote to instruct the Selectmen that on and after this date special Articles for presentation at any Town Meeting be submitted to the Selectmen at least one week before Warrant for said meeting closes.

Art. 53. To see if the Town will vote to accept as a Public Way, Fairview Road, running from Salem Street to Rossmore Road, as laid out by the Board of Selectmen and shown on plan filed with the Town Clerk, Otis W. McIntosh, C. E., dated December 1937.

RECORD OF SPECIAL TOWN MEETING, HELD JUNE 10th, 1938, AT 8 O'CLOCK P. M.


The meeting was opened by the Moderator, who read the call for the meeting and the Constables return, it having been voted to dis- pense with the reading of the articles, and Article 1 was then taken up for consideration.


Article 1. To see if the Town will vote to raise and appropriate a sum of money to pay the court judgment against the town in the Ubbink accident case and for the necessary legal expenses incurred in connection therewith and determine whether the money shall be provided for by transfer from Surplus Revenue or otherwise.


It was voted on motion by W. D. Harrington, that the sum of $2,695.90 be raised and appropriated to pay the court judgment in the Ubbink accident case, and also the sum of $304.10 for legal expenses in connection with the above case, and to meet said appropriation of $3,000.00 there be transferred the sum of $3,000.00 from Surplus Reve- nue. The vote was unanimous.


Art. 2. To see if the Town will vote to authorize the Assessors to use a sum not exceeding $5,000.00 from available funds in the treas- ury for the reduction of the 1938 tax rate.


On motion by E. S. Webster, it was voted that the Assessors be and hereby are authorized to use a sum not exceeding $5,000.00 from avail- able funds in the treasury, for the reduction of the 1938 tax rate. The motion was carried by a unanimous vote.


Art. 3. To see if the Town will vote to raise and appropriate the sum of $200.00 to be used for the purpose of purchasing and installing a fireproof door in the south cell in the basement of the Town Hall, and for remodeling said cell for use as a storage vault.


Motion was made by W. D. Harrington, that the Town vote to raise and appropriate the sum of $200.00 to be used for the purpose of pur- chasing and installing a fireproof door in the south cell in the base- ment of the Town Hall and for remodeling said cell for use as a storage vault, for Town Records. The vote was unanimously in favor of the motion.


The meeting was dissolved at 8.20 P. M.

and 2 of the Warrant for the Special Town Meeting duly called and held in the town hall Friday evening, June 10, 1938 at 8 o'clock, and action taken thereon:


Article 1. McNamara that the Town vote to raise and appropriate the sum of $2,000.00 to cover the expense of Govern- ment or Relief Projects in excess of money already appropriated for said purpose, and that same shall be provided for by transfer from Surplus Revenue and the motion was carried by a unanimous vote.


Art. 3. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of the Fire Department in excess of money already appropriated for said purpose, and to determine whether the same shall be provided for by transfer from Surplus Reve- nue or otherwise.

Art. 4. To see if the Town will vote to accept as a Public Way, a section of Vokes Terrace running northwesterly from the northwest- erly end of the State Highway layout of 1936, for a distance of 350 feet more or less, as laid out by the Board of Selectmen,, and shown on Plan filed with the Town Clerk, Edw. S. Averill, C. E., dated April 20, 1938.


Motion was made by C. A. Studley, that the Town vote to accept as a Public Way, a section of Vokes Terrace running northwesterly from the northwesterly end of the State Highway layout of 1936, for a distance of 350 feet more or less, as laid out by the Board of Select- men, and shown on Plan filed with the Town Clerk, Edw. S. Averill, C. E., dated April 20, 1938. The motion was carried by a unanimous vote.


Art. 5. To see if the Town will vote to raise and appropriate the sum of $102.75 to indemnify certain members of the fire department for damages received while acting as such members of the fire depart- ment, and to determine whether the same shall be provided for by transfer from Surplus Revenue or otherwise.


Motion was made by W. W. Moxham, that the Town vote to raise and appropriate the sum of $102.75 to indemnify certain members of the Fire Department, for damages received while acting as such mem- bers of the Fire Department, and to provide for same by transfer from Surplus Revenue and the motion was passed by a unanimous vote.

Motion was made by John Ward, that the Town vote to raise and appropriate the sum of $1,200.00 to cover the expense of Special Moth Work, and to provide for same by transfer from Surplus Revenue, which received a unanimous vote in the affirmative.

To either of the Constables of the Town of Lynnfield, in said Essex County, Greeting :


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of the Town of Lynnfield, qualified to vote in elections and town affairs, to meet in the Town Hall in said Lynnfield, on Monday evening, the nineteenth day of Decem- ber 1938 at 7.30 o'clock to consider and act upon the following articles:


Article 1. To see if the Town will vote to rezone and establish as a business district the following parcel of land now within a residential district and situated on the southerly side of Summer Street and the easterly side of Walnut Street, viz:


Beginning at a point on the easterly side of Walnut Street three hundred (300) feet northerly from land now or late of E. F. Gerry; thence running northwesterly on Walnut Street two hundred seventy- three and 98/100 (273.98) feet to the intersection of an arc having a radius of twenty-five (25) feet and a length of sixty-eight and 75/100 (68.75) feet more or less and which arc likewise intersects the street line of Summer Street; thence on the line of that arc in a northerly and easterly direction sixty-eight and 75/100 (68.75) feet more or less to the intersection of the arc and street line of Summer Street; thence running southeasterly on Summer Street one hundred forty-four and 47/100 (144.77) feet to an angle in the street; thence running again southeasterly but more easterly thirty-three and 60/100 (33.60) feet to land now or formerly of Smith; thence turning and running southerly by said land of Smith one hundred eleven (111) feet to an angle; thence turning and running southeasterly sixty-two and 48/100 feet; (62.48); thence turning and running southwesterly one hundred sixty and

Article 1, was read and on motion by G. E. Lambert, Jr. it was voted to use the check list.


Motion was made by H. A. Haskell, that action on Article 1 be indefinitely postponed. W. W. Moxham, J. Ward, W. W. Munroe and G. E. Lambert, Jr. were appointed as tellers. The motion to indefi- nitely postpone was lost, 17 voting in the affirmative and 44 in the negative.


L. B. Tuck, acting for the Planning Board read the report of said board, which stated that the decision of the board made at the hear- ing for a rejection of the change asked for, was unanimous.


Motion was made by C. D. Allen and seconded by R. L. Grace, that the Town vote to re-zone and establish as a business district the parcel of land now within a residential district, as indicated in Article 1.


The check list was again used and a total of 63 votes were cast, 39 being in the affirmative and 24 in the negative and as a two-thirds vote was required the motion was defeated.


Art. 2. Motion was made by E. S. Webster and duly seconded, that transfers be made from the Excess and Deficiency to be used as follows:


General Government $900.00, Police Department $100.00, Fire De- partment $800.00, Old Age Assistance $200.00, Hurricane Emergency $881.03 and the motion was carried by a unanimous vote.


All articles were acted upon and the meeting was dissolved at 8.40 P. M.
