RECORD OF THE ANNUAL TOWN MEETING, HELD MARCH 13, 1939, CALLED AT 7.30 P. M.
The meeting was called to order by the Moderator who read the call for the meeting and the Constable's return.
As there were but about 75 voters present on account of the severity of the weather, motion was made by Thomas M. Huse that the meeting be adjourned to next Monday evening, which was amended by Nelson B. Todd that the meeting be adjourned until next Monday evening at 7.30 P. M.
The motion as amended was carried by a unanimous vote.
RECORD OF ADJOURNED TOWN MEETING, HELD MONDAY, MARCH 20, 1939
The meeting was opened by the Moderator at 7.30 P. M. and by vote of the meeting the reading of the articles was dispensed with until taken up for action. Article 1 was read and taken up for action.
Article 1. To choose all town officers not required to be chosen by ballot, viz .: Three Field Drivers, one Pound Keeper and three Wood Measurers.
Voted, on motion by M. H. Doremus, that Everett S. Webster, Joseph F. Smith, and Daniel J. McCarthy be appointed as Field Drivers, Joseph

Art. 2. To act upon reports of town officers and special committees as published.
On motion by T. M. Huse, it was voted to accept the reports of town officers and special committees as published.
Art. 3. To see if the Town will vote to authorize the Town Treas- urer with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1940, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.
On motion by C. H. Russell, it was voted to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year begin- ning January 1, 1940, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year, in accordance with Section 17, Chapter 44, General Laws.
Art. 4. To see if the Town will vote to raise and appropriate a sum of money to cover the expenses of General Government of the Town, viz .: Town Officers' salaries and expenses, care of Municipal Buildings, and Elections and Registrations.
Motion was made by E. S. Webster, that $9,970 be raised and appro- priated to cover the cost of General Government of the Town, viz .: Town Officers' salaries and expenses, care of Municipal Buildings, and Elections and Registrations; that the following salaries be paid: Select- men, $550; Clerk, $100; Town Accountant, $600; Treasurer, $500; Town Clerk, $250; Tax Collector $500. T. M. Huse moved as an amendment that $9,500 be raised and appropriated for the expense of General Gov- ernment, that the Town Officers' salaries remain as last year, and the amendment was voted.
Art. 5. To see if the Town will vote to raise and appropriate a sum of money for the expense of the Police Department.
Motion was made by C A. Studley that $5,395 be raised and appro- priated for the expense of the Police Department. An amendment by H. A. Haskell, that the sum of $3895 be raised and appropriated for the expense of the Police Department was carried.
Art. 6. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of the Fire Department.

Art. 43. To see if the Town will vote to raise and appropriate the sum of $1,500.00 for the purchase of additional hose and the rehabili- tation of the fire alarm system, made necessary as a result of the September hurricane, or what action it will take thereon.
Motion was made by W. W. Moxham, that article 6 and 43 be taken up jointly and it was so voted. Mr. Moxham moved that $5000 be raised and appropriated for the maintenance of the Fire Department and the purchase of such equipment as he may deem necessary. M. H. Doremus moved as an amendment that the sum of $3800 be raised and appropriated for the expense of the Fire Department, and $500 for the purchase of hose and the amendment was lost. The original motion was then voted upon and was carried.
Art. 7. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of Hydrant Rental for fire protec- tion for the ensuing year.
M. H. Doremus moved that the sum of $1,175.00 be raised and appro- priated to cover the expense of Hydrant Rental for fire protection for the ensuing year and it was so voted.
Art. 8. To see if the Town will vote to raise and appropriate a sum of money to cover Other Protections of Persons and Property.
Motion made by T. M. Huse, that the Town vote to raise and appropriate the sum of $405.00 to cover Other Protections of Persons and Property was carried.
Art. 9. To see if the Town will vote to raise and appropriate a sum of money to cover the State Moth Assessment.
Voted on motion by C. A. Studley, that the Town raise and appro- priate the sum of $3,000.00 to cover the State Moth Assessment.
Art. 10. To see if the Town will vote to raise and appropriate a sum of money for Private Moth Work.
Voted, on motion by E. S. Webster, that the Town raise and appro- priate the sum of $500.00 for Private Moth Work.
Art. 11. To see if the Town will vote to raise and appropriate a sum of money to be used by the Tree Warden, for the trimming and caring for trees along the highways.
Voted, on motion by G. M. Roundy, that the Town raise and appropriate the sum of $500.00 to be used by the Tree Warden, for the trimming and caring for trees along the highways.
Art. 12. To see if the Town will vote to raise and appropriate a sum of money to be used for Health and Sanitation, including Board of Health, Inspection of Animals, Inspection of Milk.

Voted, on motion by J. Ward, that the Town raise and appropri- ate the sum of $345.00 to be used for Health and Sanitation, including Board of Health, Inspection of Animals, Inspection of Milk.
Art. 13. To see if the Town will vote to raise and appropriate a sum of money to cover the General Expense of the Highway Department.
Motion was made by M. H. Carter, that the Town vote to raise and appropriate the sum of $10,000.00 to cover the General Expense of the Highway Department, and the motion was amended by T. M. Huse, that the sum of $9,000.00 be raised for said purpose and the amendment was lost. The original motion was then voted upon and was carried.
Art. 14. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of the Welfare Department.
Motion was made by E. S. Webster, that the Town vote to raise and appropriate the sum of $8,620.00 to cover the expense of the Welfare Department, which was amended by T. M. Huse, that the sum of $7,000.00 be raised and appropriated for said purpose and the amendment was carried.
Art. 15. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of Old Age Assistance.
Motion was made by E. S. Webster, that the sum of $11,050.00 be raised and appropriated to cover the expense of Old Age Assistance, and was amended by T. M. Huse, that the sum of $8,000.00 be raised and appropriated for said purpose and the motion as amended was carried.
Art. 16. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of Soldiers' Relief.
Voted: On motion by C. A. Studley, that the Town raise and appro- priate the sum of $1,200.00 to cover the expense of Soldiers' Relier.
Art. 17. To see if the Town will vote to raise and appropriate a sum of money for the General Expense of the School Department.
Motion was made by H. P. Peabody, that the sum of $46,700.00 be raised and appropriated for the General Expense of the School Depart- ment. T. M. Huse offered an amendment that the sum of $42,700.00 be raised and appropriated for the General Expense of the School Department, which was lost. The original motion was then voted upon and was carried.
Art. 18. To see if the Town will vote to raise and appropriate a sum of money for the general expense of the Public Libraries.
Voted: On motion by W. W. Grace, that the Town raise and appro- priate the sum of $800.00 for the General Expense of the Public Libraries.

Art. 19. To see what disposal the Town will make of the money refunded by the County from the Dog Licenses for the year 1938.
Voted: On motion by R. P. Schlenker, to appropriate the money refunded by the County from the Dog Licenses for the year 1938 for the support of the Public Libraries.
Art. 20. To see if the Town will vote to raise and appropriate a sum of money to cover the general expense of the Town Parks.
Voted: On motion by T. M. Huse, to raise and appropriate the sum of $450.00 to cover the General Expense of the Town Parks.
Art. 21. To see if the Town will vote to raise and appropriate a sum of money for the Observance of Memorial Day, and determine by whom it shall be expended.
Voted: On motion by C. H. Russell, to raise and appropriate the sum of $200.00 for the Observance of Memorial Day, same to be expended under the direction of a committee to be appointed by the American Legion Post No. 131, Incorporated.
Art. 22. To see if the Town will vote to raise and appropriate the sum of $1,573.87 to cover the Town's share of the expense incurred during the year 1938 in maintaining the Essex County Sanatorium under the provisions of Chapter 111 of the General Laws.

Art. 24. To see if the Town will vote to raise and appropriate a sum of money for the use of the Cemetery Commissioners for the care of the Town Cemeteries.
Voted: On motion by R. R. Pearson, that the Town raise and appropriate the sum of $650.00 for the use of the Cemetery Committee for the care of the Town Cemeteries.
Art. 25. To see if the Town will vote to raise and appropriate a sum of money to cover Payments of Notes maturing the current year.
Voted: On motion by C. H. Russell, that the Town raise and appro- priate the sum of $3,000.00 to cover Payments of Notes maturing the current year.

Art. 26. To see if the Town will vote to raise and appropriate a sum of money to cover Payments of Interest on Debts and Loans becom- ing due the current year.
Voted: On motion by C. A. Studley, to raise and appropriate the sum of $850.00 to cover Payments of Interest on Debts and Loans be- coming due the current year.
Art. 27. To see if the Town will vote to raise and appropriate a sum of money to be used for Government or Relief Projects.
Motion was made by E. S. Webster, that the Town vote to raise and appropriate the sum of $2,000.00 to be used for Government or Relief Projects, was amended by J. D. McNamara that $2,500.00 be raised and appropriated for the purpose stated. The amendment was defeated and the original motion was voted upon and carried.
Art. 28. To see if the Town will vote to raise and appropriate the sum of $3,000.00, said sum to be used with sums allotted by the County of Essex and the Commonwealth of Massachusetts in reconstructing Summer Street, in accordance with the provisions of Chapter 90 of the General Laws.
Voted: On motion by M. H. Carter, to raise and appropriate the sum of $3,000.00, said sum to be used with sums allotted by the County of Essex and the Commonwealth of Massachusetts in reconstructing Summer Street, in accordance with the provisions of Chapter 90 of the General Laws.
Art. 29. To see if the Town will vote to amend the Zoning By-Law by adding a subdivision to Section 2 to be known as subdivision 9A and to read as follows:
9A. Tea Rooms, as regulated by Section 7A providing that no malt or spirituous liquors shall at any time be sold, or served.
And adding the following to be known as Section 7A :- Where special permits by the Board of Appeal are required under this section, the building inspector shall issue no permit until so directed in writing by the Board of Appeals. Upon application for such a permit, the Board shall give not less than seven (7) days' public notice by publication in a newspaper and by mail to the applicant and to the owners of all property deemed by the Board as affected by such a permit, and shall hold a hearing and render a decision. The applicant shall show to the satisfaction of the Board that the use of the premises for which appli- cation is made shall not constitute a nuisance because of noise, vibra- tions, smoke, gas, fumes, odor, dust, or other objectionable features, or be hazardous because of fire or explosion, and that such use shall not otherwise be injurious to the inhabitants, or their propery, or dan- gerous to the public health or safety. When not so satisfied the Board

shall refuse a permit. When, in the opinion of the Board, such a permit may be granted if accompanied by conditions especially designed to safeguard the district and the town, it shall impose such conditions and make them a part of the decision, and they shall be made a part of the permit issued by the building inspector. The Board may, after a hear- ing and proof of violation of such conditions, or any of the terms of the permit, withdraw the permit, after which the use shall be discontinued. -Louis B. After a discussion of the matter on suggestion by W. H. Harrington, it was decided to defer action to an adjourned meeting as the proposi- tion had not been advertised and a hearing held as required by law.
Art. 30. To see if the Town will vote to raise and appropriate the sum of $1,185.00 to cover the cost of equipment for the Highway Depart- ment as follows: Water Tank for Roller, Sewer Rods and Sphere, Truck, and Wings for Plow, same to be provided for by transfer from the Ma- chinery Account.
Voted: On motion by M. H. Carter, that the Town raise and appro- priate the sum of $1,185.00 to cover the cost of equipment for the High- way Department as follows: Water Tank for Roller, Sewer Rods and Sphere, and Wings for Plow, same to be provided for by transfer from the Machinery Account.
Art. 31. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of Street Lighting.
Voted: On motion by E. A. Smith, that the Town raise and appro- priate the sum of $3,858.00 to cover the expense of Street Lighting.
Art. 32. To see if the Town will vote to raise and appropriate a sum of money for the maintenance of highways, same to be used in co-operation with sum allotted by the Commonwealth of Massachusetts, under Chapter 90 Work.
Voted: On motion by M. H. Carter, that the Town raise and appro- priate the sum of $1,000.00 for the maintenance of highways, same to be used in co-operation with sum allotted by the Commonwealth of Massachusetts, under Chapter 90 Work.
Art. 33. To see if the Town' will vote to raise and appropriate a sum of money for sidewalk work.
On motion by M. H. Doremus, it was voted to indefinitely postpone action on article 33.
Art. 34. To see if the Town will vote to raise and appropriate a sum of money to be used by the Highway Department for the cutting of brush along the highways.

Motion was offered by E. L. Phillips as an amendment that the sum of $200.00 be raised and appropriated for said purpose and the motion as amended was carried.
Art. 35. To see if the Town will vote to accept as a Public Way, Canterbury Road, running from Salem Street, as laid out by the Select- men and shown on plan filed with the Town Clerk, Otis W. McIntosh, C. E., dated February, 1938.
Motion was made by H. A. Haskell, that the Town vote to accept as a Public Way Canterbury Road, running from Salem Street, as laid out by the Selectmen and shown on plan filed with the Town Clerk, Otis W. McIntosh, C. E., dated February, 1938. V. Nutile offered an amendment that articles 35, 36, 37 and 38 be taken up jointly. The Town Counsel stated that article 38 could not be acted upon at this meeting as it had not been laid out by the Selectmen. An amendment was made by F. W. Lichtenberg that each article be taken up sepa- rately beginning with article 35 and amendment was carried. The original motion made by Mr. Haskell was acted upon and was carried.
Art. 36. To see if the Town will vote to accept as a Public Way, Crescent Avenue, running from Highland Avenue for a distance of about 200 feet, as laid out by the Selectmen, and shown on plan filed with the Town Clerk, dated January 23, 1890, James A. Bancroft, surveyor.
