T. M. Huse offered as an amendment that $8,500.00 be raised and appropriated to cover the expense of General Government of the Town and the salaries remain the same as last year.


F. W. Lichtenberg moved as an amendment to the amendment that $9,000.00 be raised for said purpose and the salaries remain the same as last year.


The amendment was defeated and the original motion was then voted on and was carried.

Voted: On motion by J. S. Caldwell that the town raise and appro- priate the sum of $1,275.00 to cover the expense of Hydrant Rental for Fire Protection for the ensuing year.


Art. 46. To see if the Town will vote to raise and appropriate a sum of money to pay for Hydrant Rental and the Centre Water District.


Voted: On motion by G. Peavey that the Town raise and appro- priate the sum of $271.00 to pay for Hydrant Rental in the Centre Water District.


Art. 8. To see if the Town will vote to raise and appropriate a sum of money to cover Other Protections of Persons and Property.

Art. 13. To see if the Town will vote to raise and appropriate a sum of money to be used for Health and Sanitation, including Board of Health, Inspection of Animals, and Inspector of Milk.


Voted: On motion by E. S. Webster that the Town raise and appro- priate the sum of $325.00 to be used for Health and Sanitation, including Board of Health, Inspection of Animals, and Inspector of Milk.

Motion was made by T. M. Huse that Articles 14, 15, and 16 be taken jointly.


F. W. Lichtenberg offered as an amendment that Articles 14, 15, and 16 be taken separately, and the amendment was carried.


Motion was made by M. Carter that the Town raise and appropriate the sum of $13,000.00 to cover the General Expense of the Highway Department and the sum of $850.00 transferred to the Machinery Account. T. M. Huse offered as an amendment that $10,000.00 be raised and appropriated for the purpose stated. The amendment was defeated and the original motion by M. Carter was voted on and carried.


Art. 15. To see if the Town will vote to raise and appropriate a sum of money to be used in co-operation with a sum allotted by the Commonwealth of Massachusetts, under Chapter 90, for the maintenance of Chapter 90 Roads.


Voted: On motion by M. Carter that the Town raise and appropriate the sum of $1,720.00 to be used in co-operation with a sum allotted by the Commonwealth of Massachusetts, under Chapter 90, for the main- tenance of Chapter 90 Roads.


Art. 16. To see if the Town will vote to raise and appropriate a sum of money for Sidewalk Work.


Voted: On motion by G. Trayers that the Town raise and appro- priate the sum of $2,000.00 to be used for Sidewalk Work.


Art. 17. To see if the Town will vote to raise and appropriate a sum of money to be used under the supervision of the Selectmen for cutting brush along the highways.


Voted: On motion by M. Carter that the Town raise and appropriate the sum of $300.00 to be used under the supervision of the Selectmen for cutting brush along the highways.


Motion was made by J. McDonough that Article 44 be taken up at this time. G. Peavey offered as an amendment that Article 44 be in- definitely postponed, and it was carried.


Art. 18. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of the Welfare Department.


Voted: On motion by C. A. Studley that the Town raise and appro- priate the sum of $6,120.00 to cover the expense of the Welfare Depart- ment.


Art. 19. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of Aid to Dependent Children.


Voted: On motion by E. S. Webster that the Town raise and appro- priate the sum of $500.00 to cover the expense of Aid to Dependent Children.

Motion made by T. M. Huse that the Town raise and appropriate the sum of $9,500.00 to cover the expense of Old Age Assistance, was amended by G. Peavey that the sum of $10,650.00 be raised and appro- priated to cover the expense of Old Age Assistance, and the motion as amended, was carried.


Art. 21. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of Soldiers' Relief.


Voted: On motion by C. A. Studley that the Town raise and appro- priate the sum of $1,500.00 to cover the expense of Soldiers' Relief.


On motion by J. D. McNamara, it was voted to take action on Article 6 at this time.


Art. 6. To see if the Town will vote to raise and appropriate a sum of money for the expense of the Fire Department.


Motion was made by F. W. Lichtenberg that the sum of $4,800.00 be raised and appropriated for the expense of the Fire Department, and was amended by J. Ward that the sum of $4,535.00 be raised for the purpose stated. The motion was carried as amended.


Art. 22. To see if the Town will vote to raise and appropriate a sum of money for the general expense of the School Department.


Voted: On motion by H. P. Peabody that the Town raise and appro- priate the sum of $48,500.00 for the general expense of the School Department.


Art. 23. To see if the Town will vote to raise and appropriate a sum of money to be used by the School Committee, to cover the cost of a new Heating Boiler and Oil Burner at the South School.


Motion was made by H. P. Peabody that the Town raise and appro- priate the sum of $1,100.00 to be used by the School Committee, to cover the cost of a new Heating Boiler and Oil Burner at the South School, was amended by T. M. Huse that action on Article 23 be in- definitely postponed. The amendment was lost. The original motion was then voted on, and was carried.


Art. 24. To see if the Town will vote to raise and appropriate a sum of money for the general expense of the Public Libraries.


Voted: On motion by M. Eaton that the Town raise and appro- priate the sum of $850.00 for the general expense of the Public Libraries.


Art. 25. To see what disposal the Town will make of the money refunded by the County from the Dog Licenses for the year 1939.


Voted: On motion by R. P. Schlenker to appropriate the money refunded by the County from the Dog Licenses for the year 1939 for the support of the Public Libraries.

Art. 26. To see if the Town will vote to raise and appropriate a sum of money for the General Expense of the Park Department.


Voted: On motion by E. Fletcher that the Town raise and appro- priate the sum of $600.00 to cover the general expense of the Town Parks.


Art. 27. To see if the Town will vote to raise and appropriate a sum of money for the observance of Memorial Day and determine by whom it will be spent.


Voted: On motion by C. H. Russell, that the Town raise and appro- priate the sum of $200.00 for the observance of Memorial Day, same to be expended under the direction of the American Legion Post No. 131, Incorporated.


Art. 28. To see if the Town will vote to raise and appropriate a sum of money to cover the Town's share of the cost incurred during the year 1939 in maintaining the Essex County Sanatorium under the Pro- visions of Chapter 111 of the General Laws.


Voted: On motion by E. S. Webster that the Town raise and appro- priate the sum of $1,621.52 to cover the Town's share of the expenses incurred during the year 1939 in maintaining the Essex County Sana- torium under the Provisions of Chapter 111 of the General Laws.


Art. 29. To see if the Town will vote to raise and appropriate a sum of money to be used as the Reserve Fund.


Voted: On motion by J. Ward that the Town raise and appropriate the sum of $2,000.00 to be used as the Reserve Fund.


Art. 30. To see if the Town will vote to raise and appropriate a sum of money for use of the Cemetery Commissioners for the care of the Town Cemeteries.


Voted: On motion by R. Pearson that the Town raise and appro- priate the sum of $650.00, $200.00 to be a transfer from the Sale of Lots and Graves Fund, for the use of Cemetery Commissioners for care of the Town Cemeteries.


Art. 31. To see if the Town will vote to raise and appropriate a sum of money to cover the payment of notes maturing the current year.


Voted: On motion by C. A. Studley that the Town raise and appro- priate the sum of $3,000.00 to cover payment of notes maturing the current year.

Voted: On motion by E. S. Webster that the Town raise and appro- priate the sum of $3,000.00 to be used for Government and Relief Projects.


On motion by G. Peavey it was voted that Articles 35, 36, 37, 38, 39, and 40 be taken up for action jointly, before Article 34.


Art. 35. To see if the Town will vote to approve the installation of one (1) additional street light on Perry Avenue.


Art. 36. To see if the Town will vote to approve the installation of four (4) new street lights on Fairview Road.


Art. 37. To see if the Town will vote to approve the installation of two (2) new street lights on Douglas Road.


Art. 38. To see if the Town will vote to approve the installation of four (4) new street lights on Canterbury Road.


Art. 39. To see if the Town will vote to approve the installation of four (4) new street lights on Salem Street.


Art. 40. To see if the Town will vote to approve the installation of two (2) new street lights on Vokes Terrace.


Voted: On motion by G. Peavey that the Town approve the installa- tion of one (1) additional street light on Perry Avenue; four (4) new street lights on Fairview Road; two (2) new street lights on Douglas Road, four (4) new street lights on Salem Street; two (2) new street lights on Vokes Terrace.


Art. 34. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of Street Lighting.


Voted: On motion by G. Peavey that the Town raise and appro- priate the sum of $4,050.00 to cover the expense of Street Lighting.


Art. 41. To see if the Town will vote to raise and appropriate a sum of money, to be used by the Selectmen or by a Committee appointed by them to cover the cost of making surveys, plans and procuring esti- mates of the cost of restoring the Old Meeting House, and remodeling the Centre Library for a Fire Station.


Motion was made by J. S. Caldwell that the Town raise and appro- priate the sum of $400.00, to be used by the Selectmen or by a Committee appointed by them, to cover the cost of making surveys, plans, and procuring estimates of the cost of restoring the Old Meeting House and remodeling the Centre Library for a Fire Station.


An amendment was offered by W. Grace that the Town raise and appropriate the sum of $400.00, to be used by the Selectmen or a Com- mittee appointed by them, to cover the cost of making surveys, plans, and procuring estimates of the cost of restoring the Old Meeting House. The amendment was then voted upon and carried.

Article 42. To see if the Town will vote to appoint a Committee of Five, two from Precinct 1 and two from Precinct 2, they to choose the fifth member, to select a site for a High School and to report at a Special Town Meeting not later than May 15, 1940.


Motion was made by N. C. McKillop that the Town vote to appoint a Committee of Five, two from Precinct 1 and two from Precinct 2, they to choose the fifth member, the Committee to be selected by the Moderator, to select a site for a High School and to report at a Special Town Meeting, was amended by E. Billings that the Parent-Teacher Associations in Precincts 1 and 2, appoint a Committee of Five, two from Precinct 1 and two from Precinct 2, they to choose the fifth member.


The amendment was lost and the original motion was voted on and carried.


Art. 43. To see if the Town will vote to appoint a Committee of Three from Precinct 2, to select a site for a Grade School in Precinct 2, said Committee to report at a Special Town Meeting not later than May 15, 1940.


Voted: On motion by E. Averell that the Town vote to appoint a Committee of Three from Precinct 2, to select a site for a Grade School in Precinct 2, said Committee to be appointed by the Moderator, to report at a Special Town Meeting.


Art. 44. To see if the Town will vote to rezone and establish as a Business District the following parcel of land, now within a Residential District, commencing at a point in the easterly side of the Newburyport Turnpike at the Town Line between Lynnfield and Peabody; then running in a southwesterly direction by the easterly side of said Turnpike about 2,140 feet; then running by the arc of circle and the northerly side of Salem Street about 275 feet; then running north- easterly by various owners on a line parallel to and 200 feet easterly of the layout line of the Turnpike, about 2,000 feet to the Town Line, then turning and running by said Town Line 200 feet to the point of begin- ning. Excepting herefrom all land which has been laid out for the use of streets. All measurements are approximate and are shown on plan submitted to the Board of Selectmen.


Indefinitely postponed.


Art. 45. To see if the Town will vote to accept as a public way, Phillips Road, running from Main Street a distance of 840 feet, as laid out by the Board of Selectmen and shown on plan filed with the Town Clerk, Davis and Abbott, C. E., and recorded in Essex South District Registry of Deeds, Book 3059, Page 297.

RECORD OF SPECIAL TOWN MEETING HELD JUNE 3, 1940 CALLED AT 8.00 P.M.


The meeting was opened by the Moderator, at 8.10 P. M., who read the call for the meeting and the Constable's return. The reading of the Articles in the Warrant having been dispensed with until taken up for action, Article 1 was read by the Moderator and considered.


Article 1. To see if the Town will vote to amend the Zoning By-Law of the Town by striking out Paragraph (d) of Section 2 thereof, and substituting therefor the following new paragraph:


(d) No dwelling shall be erected or placed on a lot unless the lot has a street frontage of at least 80 feet upon the frontage street or way, public or private, and an area of at least 10,000 square feet; provided, that, in cases where substantial injury will not be done to surrounding property the Board of Appeals may, in accordance with the provisions of Section 30, Chapter 40, of the General Laws, permit the erection or placing of a dwelling on any lot heretofore laid out which does not at the time this paragraph is adopted comply with the foregoing minimum requirements. No lot with a building thereon shall be changed in size

so as to violate the provisions of this paragraph, and no lot area or frontage shall at any time be considered as the required area or frontage for more than one dwelling ..


A report of the hearing held by the Planning Board May 29, 1940, at the Town Hall, was read by Selectman Everett Webster.


Motion was made by Nelson B. Todd that the Town amend the Zoning By-Laws of the Town by striking out Paragraph (d) of Section 2 thereof and substituting therefor the following new paragraph:

Mr. Todd's motion was amended by Edward Averell to read 100 feet upon the frontage street or way, instead of 80 feet.


Selectman George Peavey moved the adoption of Article 1 with the change of 80 feet frontage to 100 feet frontage.


The Moderator appointed William Grace and Charles Jones as Tellers, and Mr. Peavey's motion was carried by vote of 68 in the affirmative and 7 in the negative.


During the discussion of Article 1, Moderator Joseph Smith, upon leaving the hall, appointed Gordon Millar to take his place as Moderator for the remainder of the evening.


Art. 2. To see if the Town will vote to raise and appropriate the sum of $2,000.00, said sum to be used with sums allotted by the County of Essex and the Commonwealth of Massachusetts in reconstructing Summer Street, in accordance with the provisions of Chapter (90) of the General Laws.


Voted: On motion by Minot Carter that the Town raise and appro- priate the sum of $2,000.00, said sum to be used with sums allotted by the County of Essex and Commonwealth of Massachusetts, in recon- structing Summer Street, in accordance with the provisions of Chapter (90) of the General Laws.


Art. 3. To see if the Town will vote to accept the report of the Committee appointed by the Board of Selectmen to revise the present building regulations of the Town.

Art. 4. To see if the Town will vote to accept as a public way a portion of Fairview Road from the end of the present accepted portion of Fairview Road to Lynnbrook Road, approximately three hundred and twenty-five feet.

Art. 5. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to sell at public or private sales, any property taken by the Town under Tax Title procedure upon which the Right of Redemption has been foreclosed, or what action the Town will take thereto.


Motion was made by William Grace that the Town authorize the Town Treasurer, with the approval of the Selectmen, to sell at public or private sales any property taken by the Town under Tax Title pro- cedure upon which the Right of Redemption has been foreclosed. Was amended by Nelson B. Todd, striking out the word "taken" and sub- stituting the word "acquired." The motion as amended was carried.


The meeting dissolved at 9.36 P.M.
