REPORT OF THE BOARD OF SELECTMEN
January 13, 1954
To the Citizens of Norwell:
FINANCIAL
Norwell has completed another year in the familiar financial pattern common to South Shore towns.
Increasing residential construction, population and unit costs result inevitably in increased demands upon town government and increased budgets. The valuation of new property fails to yield sufficient income to meet increased expense without change of tax rate.
While the average tax rate for the 351 towns and cities of Massa- chusetts declined 17 cents in 1953, this desirable result was accomplished to a considerable degree by increased appropriations from reserve funds. We do not recommend that Norwell follow this course.
Uncertainty of economic conditions, additional school construction, unsolved water supply problems urge the preservation of strong finan- cial reserves. We recommend that appropriations from the Excess and Deficiency account be kept to the minimum.
The report of the state audit of accounts of the Town of Norwell appears on succeeding pages of this volume.
CUSHING MEMORIAL FUND
The late Florence M. Cushing provided in her will funds for the construction and maintenance of Cushing Memorial Town Hall, for the benefit of the inhabitants of the Town of Norwell.
The twenty-fifth accounting of the Trustees covering the period from August 21, 1952 to August 20, 1953 reports the principal amounts of $44,491.15 at the end of the period, and total gross income of $2,014.44 received during the period. The details are available to the inhabitants at the Town Hall.
Prudence has required the revaluation of the building and contents for fire insurance purposes. Careful estimates of replacement cost were obtained from a qualified contractor without cost to the fund or town, and adequate insurance coverage provided to protect against loss of this valuable heritage. The increased coverage and increased rates have re- sulted in a smaller balance of income available for general repair and maintenance. As this need increases with the age of the building greater demands upon the tax levy for the purpose are to be expected.
ROADS
Chapter 90 funds for the year were spent under supervision of the State and Town on the completion of Grove Street as laid out by the County Commissioners.

The layout for the reconstruction of Main Street, from Norwell Center to the Scituate line, as accepted by the Town, will be available for work in the spring. Owing to the size of this project and the esti- mated time of completion the Selectmen recommend the Town increase its appropriation for Chapter 90 from $3,000 to $4,000, in anticipation of a cerresponding increase from $9,000 to $12,000 from State and County funds. Tentative grant of $8,000, contingent upon this action by the town, has been received from the State.
We intend to petition for other layouts from the County for town acceptance, to obtain the benefit of future Chapter 90 funds.
The Selectmen are laying out and will recommend the acceptance of certain ways in the Washington Park, Brantwood Manor and Norwell Homes neighborhoods. Articles for acceptance will appear in the warrant.
The Selectmen and Highway Surveyor have inspected the ways pro- posed for acceptance. We believe the best interests of the resident tax- payers and the town as a whole will be served by favorable action upon these articles, providing certain legal obstacles are first removed to permit the action.
LEGAL
We have freely sought and obtained sound legal advice from Town Counsel in accordance with the American ideal of government of law rather than of men.
The Town is involved in three court actions. The principal one of these is. against the members of the Emergency Housing Commission and seeks to set aside a decision made by that commission which reversed a decision of the Board of Appeals of the Town of Norwell refusing to grant to Elizabeth Bean a variance from the minimum lot size standard of the Zoning By-Law. Elizabeth Bean sought the variance from the Board of Appeals in order to continue with the Brantwood Manor Devel- opment. At the present time there is in effect a temporary decree of the Court setting aside the decision of the Emergncy Housing Commission pending trial and a final determination of this case.
The second case is in regard to the petition of the First Parish of Norwell in the Land Court to register the title of the so-called school- house lot at the corner of River and West Streets in its name. This case will be tried in Boston on March 22, 1954.
The last of the three cases is against Mr. Clinton K. Porter et als and seeks to restrain him from the construction of a building within 25 feet of the way line of South Street in violation of the setback require- ments of the Zoning By-Law. Pending a trial of this case, the Court has issued a temporary order that the respondent is not to continue the erection of that building.
Attention is invited to the Report of the Planning Board which appears in this volume.

During the year a press release has been prepared after regular meetings of the board, publishing matters believed to be of interest to the inhabitants.
The Board of Selectmen meet each Monday evening at 7:00 o'clock. One or more of its members may be seen at the Town Hall each day.

Special Town Meeting WARRANT
Plymouth, ss.
To either of the Constables of the Town of Norwell, in said County of Plymouth and Commonwealth of Massachusetts, greetings.
In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of the Town of Norwell, qual- ified to vote in elections and Town affairs to meet at the Cushing Memo- rial Town Hall in said Norwell, on Monday the Ninth Day of February, 1953 at 7:30 P.M. then and there to act on the following articles to wit:
Article 1. To see if the Town will vote to validate the action of the Town Accountant in closing to revenue 1951 the amount of $28,000.00 for laying water mains, raised by taxation in error in 1951, this amount having been provided for by issuance of notes of the town.
The Advisory Board recommends this action.
Article 2. To see if the Town will vote to authorize the Selectmen to sell at public or private sale at their discretion, a parcel of land with the buildings thereon, on the southerly side of Washington Street, Norwell, as more fully described in a deed from Howard J. Herchenroder to the 'Town of Norwell, dated February 6, 1952, and recorded with the Plym- outh County Registry of Deeds in Book 2193 at page 91, and to execute any and all documents necessary to effectuate said sale.
The Advisory Board recommends this action.
Article3. To see if the Town will vote to raise and appropriate a sum of money for the purpose of constructing an addition to the high school building and originally equipping and furnishing said building;

determine whether the money shall be provided for by appropriation from available funds in the treasury and/or by borrowing under authority of Chapter 645 of the Acts of 1948, as amended, or take any action relative thereto.

To see if the Town will vote to raise and appropriate a sum of money for the purpose of remodeling, reconstructing, or making extraordinary repairs to the existing high school building, as listed below, and determine whether the money shall be provided for by appropriation from available funds in the treasury, or by borrowing under authority of Chapter 275 of the Acts of 1948, or take any action relative thereto.

To see if the Town will vote to appropriate the sum of $42,000.00 or some other sum or sums of money for the purpose of laying a water main, not less than six (6) inches but less than sixteen (16) inches in diameter, from the present water mains in Washington Street at Assinippi, in Assinippi Avenue from Washington Street to Main Street, and in Main Street from Assinippi Avenue to a point approximately at the high school, for the purpose of connecting said water main to the already established mains in Washington Street, and for the purpose of laying pipes therefrom to the sides of Assinippi Avenue and Main Street as may be required by the residents thereon, and to authorize the Town Treasurer, with the approval of the Selectmen, to borrow a sum or sums

of money therefor, and to issue a note or notes on account thereof; or act on anything relative thereto.

To see if the Town will vote to appropriate the sum of $4,500.00 or some other sum or sums of money for the purpose of laying a water main eight (8) inches in diameter on Oak Street of Ridge Hill for a distance of approximately one-tenth mile between Washington and High Streets and for the purpose of laying pipes therefrom to the side- lines of Oak Street as may be required by the residents thereon, and to authorize the Town Treasurer, with the approval of the Selectmen, to borrow a sum or sums of money therefor and to issue a note or notes on account thereof.

SPECIAL TOWN MEETING February 9, 1953 . .
The meeting was called to order at 7:45 P.M. by the Moderator, Fred- erick A. Small. Before the reading of the Warrant, permission was granted to non-voters to sit in that section of the balcony which is nearest the street.
The Moderator appointed Donald C. Wilder and John Dickman tellers and swore in same.
The reading of the Warrant by the Clerk was called for. After reading that part calling the meeting, it was voted to postpone the reading of the articles until taken up for action; after which the charge to the Con- stable and his return were read.
It was voted to admit Town Counsel, Walter Kiernan, to the floor.
Article 1. Unanimously voted to validate the action of the Town Accountant in closing to revenue 1951 the amount of $28,000.00 for laying water mains, raised by taxation in error in 1951; this amount having been provided for by issuance of notes of the Town.
Article 2. Unanimously voted that the Selectmen be, and they hereby are, authorized to sell at public or private sale, at their discretion, a parcel of land with the buildings thereon, on the southerly side of Washington Street, Norwell, as more fully described in a deed from Howard J. Herchenroder to the Town of Norwell, dated February 6, 1952, and recorded with the Plymouth County Registry of Deeds in Book 2193 at page 91, at a price to be determined by the Selectmen, and to execute any and all documents necessary to effectuate such sale.
The Moderator announced that because he was to take part in the discussion under articles 3, 4, 5, he thereby was disqualified to serve as Moderator during that time, and asked that the meeting nominate and elect some person to serve in that capacity for that length of time.
Thomas T. Barstow nominated Herbert A. Lincoln and moved nomi- nations be closed. The motion was seconded and Herbert A. Lincoln was unanimously elected Moderator for the duration of articles 3, 4, 5.
Article 3. Mr. Small, Chairman of the School Building Committee, read the following article which was seconded and which Mr. Small moved to be adopted. "That the sum of $272,000.00 be raised and appropriated for the purpose of constructing an addition to the high school building

and for originally equipping and furnishing said addition and to meet said appropriation, that the sum of $2,000.00 be appropriated from avail- able funds in the treasury and that the treasurer with the approval of the Selectmen be and hereby is authorized to borrow the sum of $270,000.00 under authority of Chapter 645 of the Acts of 1948 as amended, and to issue bonds or notes of the Town therefor, payable in accordance with the provisions of Chapter 44 of the General Laws, so that the whole loan shall be paid in not more than twenty years from the date of issue of the first bond or note." This was followed by a step-by-step recital of the work of the Committee and the final decision of the plans submitted. Many questions pertinent to the issue were submitted and answered. Mr. MacFarlane received permission to read a report of an engineer relative to a plan of building an addition with a possible saving of several thou- sand dollars to the Town. Mr. Small asked permission for John W. Beal, the architect, to further enlarge on reasons for the plans submitted. Permission was granted and Mr. Beal went into details of the reasons and comparative costs of ways to accomplish what the Committee felt was needed at the least possible cost to the Town.
Other questions were asked relative to the time when an Elementary School would be needed, the effect of the cost of the addition on the tax rate and town debt and how all this compared with other towns.
The Moderator announced that a two-thirds vote was necessary on articles calling for a bond issue, therefore a standing vote would be taken.
It was voted 264 for, 16 against, that the sum of $272,000.00 be raised and appropriated for the purpose of constructing an addition to the high school building and for originally equipping and furnishing said addition and to meet said appropriation that the sum of $2,000.00 be appropriated from available funds in the treasury, and that the treasurer with the approval of the Selectmen be and hereby is authorized to borrow the sum of $270,000.00 under authority of Chapter 645 of the Acts of 1948, as amended, and to issue bonds or notes of the Town therefor, payable in accordance with the provisions of Chapter 44 of the General Laws, so that the whole loan shall be paid in not more than 20 years from the date of issue of the first bond or note.
Article 4. Mr. Small read the article which was seconded and unani- mously voted that the sum of $35,590.58 be raised and appropriated for the purpose of remodeling, reconstructing and making extraordinary repairs to the existing high school building and that to meet said appro- priation the sum of $35,590.58 be appropriated from available funds in the treasury.

Article 5. Mr. Small moved the adoption of Article 5, which was seconded and it was unanimously voted "that the School Building Com- mittee, appointed under Article 33, of the Warrant of the Town Meeting of March 10, 1952 be authorized to enter into all contracts and agree- ments necessary to remodel and reconstruct the existing high school building and furnish an addition to the high school building."
