Article 22. Mr. Devine moved to add "to raise and" after "to" in first line of article as printed. Seconded and so voted. Motion made, seconded and so voted, "That the Town raise and appropriate the sum of $2,000, said sum to be added to the Developing Well or Well Fields Account and to be spent to conduct quantity tests on potential well or water source sites."


Article 23. Mrs. Virtue proposed to amend Article 23, by the following: "Appropriate from the Excess & Deficiency Account the sum of $1550 to provide new transportation for the Chief of Police." Amendment lost. Motion made, seconded and voted to substitute $1450 for $1550 in printed article. Voted to raise and appropriate $1450 to provide new transportation for Chief of Police.

Article 24. Motion made by Mr. Gaddis that each paragraph be acted on as printed under this article, namely, the areas designated as B1, B2, B3, B4, B5, B6, B7 and B8, be acted on by separate motion and vote. This motion was made, seconded and voted by a vote of 105 for, 74 against.


B1. Voted 114 yes, 11 no.


B2. Mr. Gaddis presented a substitute motion for B2, as follows: "B2 - Starting at a point in the southwesterly way line of Washington Street at the northwesterly lot line of the Washing- ton Street Cemetery, then southwesterly in the northwesterly lot line of the Washington Street Cemetery to a point 500 feet from the southwesterly way line of Washington Street measured at right angles therefrom, then northwesterly in a line 500 feet southwesterly from Washington Street and parallel thereto to a point 500 feet southwesterly from the southwesterly way line of Washington Street at Station 40 plus 55 measured at right angles therefrom, thence northeasterly to the southwesterly way line of Washington Street at Station 40 plus 55, thence southeasterly by the southwesterly way line of Washington Street to the point of beginning." John Carnes, proprietor of Washington Park Pharmacy, was given privilege of the floor and spoke on the motion, against it. Motion made, seconded and so voted to lay Article 24 on the table.

Section VII.


Area and Frontage, Setback and Off-Street Parking Regulations.


A. Lot Sizes for Dwellings


Definition: In subsection 1 and 2, except in "c" thereof, the word frontage shall mean frontage on a public way or on a way approved by the Planning Board.


1. The minimum lot size on which a dwelling may be erected or placed or on which any other structure may be altered for dwelling purposes shall be:


a. The Residential District A. - One acre with a frontage of 150 feet or more, or two acres with 40 feet or more frontage.

b. Residential District B. - One-half acre with a frontage of 125 feet or more, or one acre with 40 feet or more frontage.


c. Residential District C. - 8,000 square feet with a frontage of 100 feet or more on a public way or private way, or, with respect to a lot described in a deed recorded in Plymouth Registry of Deeds prior to April 10, 1952, 4,000 square feet with frontage of 50 feet or more on a public way or private way.


d. Business District A and B. - One-half acre with frontage of 125 feet or more, or one acre with 40 feet or more frontage.


PROVIDED the lot shall not be already occupied by a dwelling or other buildings except outbuildings com- monly associated with dwellings.


2. Nothing in the foregoing subsection, however, shall prohibit the erection or placement of additional dwell- ings, or the alteration of additional buildings for dwell- ing purposes, on a lot the size of which is sufficient to allow:


a. Residential District A. - One acre for each dwelling on a lot with a frontage of 150 feet or more, or two acres for each dwelling on a lot with 40 feet or more frontage.


b. Residential District B. - One-half acre for each dwelling on a lot with frontage of 125 feet or more, or one acre for each dwelling on a lot with 40 feet or more frontage.


c. Residential District C. - 8,000 square feet for each dwell- ing on a lot with a frontage of 100 feet or more on a public or private way, or, with respect to a lot described in a deed recorded in Plymouth Registry of Deeds prior to April 10, 1952, 4,000 square feet for each dwelling on a lot with frontage of 50 feet or more on a public or private way.


d. Business District A and B. - One-half acre for each dwell- ing on a lot with frontage of 125 feet or more, or one acre for each dwelling on a lot with 40 feet or more frontage.


3. With respect to lots not exempted from the application of the By-Laws by G. L. (Ter. Ed.) Ch, 40, Sec. 5A (added by Acts of 1958, Ch 492) the Board of Appeals shall permit the erection of a dwelling on a lot having a lesser area or frontage than required herein, provided

that said lot was described in a deed recorded prior to the Town Meeting vote adopting such requirement or requirements and was then held in ownership separate from that of adjoining land, and further providing that such erection shall not substantially change the character of the neighborhood.


4. No lot on which a dwelling is located shall be reduced in frontage or area so that it does not conform to the provisions of this By-Law, except in the case of a lot a portion of which is taken for public use.


B. Setbacks


1. From Public Ways in All Residential Districts. No building shall be erected or placed within 35 feet of the way line of any public way, except that no build- ing need be set back more than average setback of the buildings on the lots on either side, a vacant lot to be counted as if occupied by a dwelling set back 35 feet.


2. From Side or Back Lot Lines in Residential Districts.


a. Residential Districts A and B. - No building shall be erected or placed within 20 feet of a side or back line except that with respect to the buildings existing at the effective date of this provision, additions thereto may be erected or placed within 20 feet but not within 10 feet of a side line.


b. Residential District C. - No building shall be erected or placed within 10 feet of a side or back line.


3. In Business Districts no building shall be erected, placed or added to within 50 feet of the way line.


4. In Business Districts no building shall be erected, placed or added to, less than 20 feet from the side line or less than 40 feet from the back line.


C. Off-Street Parking in Business Districts.


No building shall be erected, placed on the lot, or added to for business purposes, unless one space is provided for parking for each 150 square feet of floor space in such building, or in such addition."


Article 26. Motion made, seconded and voted to amend Section X of the Zoning By-Laws "by numbering the existing sentence 1, and by adding the following:

2. Notice of Intention to Erect, Substantially Alter or Add to Any Building or Structure.


a. No person shall erect, substantially alter or add to any building or structure, and no person shall place any building or structure on any land unless he, or his agent, shall have filed with the Board of Selectmen a notice of intention to so erect, substantially alter, add or place.


b. Such notice of intention shall state the name and address of the person so erecting, substantially altering, adding or placing, the location where the work is to be done and a description of the work to be done. A sketch of the lot on which the work is to be done shall be furnished with such notice if requested by the Board of Selectmen.


c. No such erecting, substantially altering, adding or placing shall be commenced within forty-eight (48) hours of the filing of the notice of intention with the Selectmen, nor shall such erecting, substantially altering, adding or placing be commenced more than sixty (60) days after such filing.


d. Whoever violated the provisions of this by-law shall be fined not less than five ($5.00) dollars nor more than twenty ($20.00) dollars."


Article 27. It was voted unanimously "to discharge the By- Laws Committee appointed pursuant to Article 23 of the 1958 Annual Town Meeting and to direct the Selectmen to appoint a Committee of five members to study the Town By-Laws, ex- cluding the Zoning By-Laws, and to prepare Articles for the next annual meeting incorporating its recommendations, and to report thereon at said meeting, the Selectmen to call the first meeting of said committee not later than June 1, 1959, at which time a Chairman and Clerk shall be elected by said committee."


Article 28. It was voted unanimously "To discharge the present drainage committee and to establish a Permanent Drainage Committee of five members to be appointed by the Selectmen for the purpose of planning a long-term drainage program, after thorough consultation with the Selectmen and the Highway Surveyor, vacancies on the committee to be filled by a joint meeting of the Selectmen and the remaining members of the committee, the first meeting of the Committee to be called by the Selectmen not later than June 1, 1959, at which time said Committee shall elect a Chairman and a Clerk."

Article 30. Motion made and seconded to "Authorize the establishment of, and to originally equip and operate, an emergency communications center at the Town Hall under the direction of the Emergency Communications Board, composed of the Civil Defense Director, Chairman; the Police Chief and the Fire Chief, and to raise and appropriate the sum of $5,000, for this purpose."


Question of a quorum was raised and tellers polled those present. 175 present and it was voted to adjourn until Tuesday, March 10th, 1959, at 8:00 p.m. in same place.

ADJOURNED ANNUAL TOWN MEETING - March 10, 1959


The meeting was opened by the Moderator at 8:30 p.m. Motion made, seconded and voted to recess until 8:45 to get a quorum.


The recess was extended from time to time, until at 10 o'clock, a quorum was not reached. A motion to adjourn until Monday, March 16th was made, seconded and so voted.

REPORT - ANNUAL TOWN MEETING


ADJOURNED ANNUAL TOWN MEETING March 16, 1959


The meeting was opened at 8:05 with a quorum present. Permission was given for non-voters to enter the meeting, they to sit in back of balcony nearest the street.


Article 30. The Moderator read the motion as follows: "I move that the Town authorize the establishment of, and to originally equip and operate, an emergency communications center at the Town Hall under the direction of the Emergency Communications Board, composed of the Civil Defense Director, Chairman; the Police Chief and the Fire Chief, and to raise and appropriate the sum of $5,000. for this purpose." This motion was seconded and voted.


Article 31. Mr. Jackson made the following motion: “I move that the Town vote to amend Article III of the By-Laws of the Town of Norwell by adding thereto the following:


Section 8. Each proposed capital expenditure in excess of $15,000 shall be voted on by means of a written ballot to be collected and counted by the tellers at the Annual or Special Town Meeting at which the proposed expenditure is presented." The motion was seconded and debated, but failed to pass.


Article 32. Mr. Whittemore made the following motion: "I move that the Town annul Section 2 of Article VI of the By-Laws of the Town of Norwell by revoking, rescinding and removing said section 2 and substituting therefor the following:


Section 2. The voters of the Town of Norwell shall elect by ballot at the annual election of 1960 an Advisory Board of nine citizens, no one of whom shall, during their respective terms of office, hold any other office, elective or appointive, in the Town of Norwell; and they shall serve without pay, three for one year, three for two years, and three for three years. Each year thereafter the Town shall elect three for three years."


This motion was seconded, but failed to pass.


Article 33. Motion "that the Town vote to appropriate from the Washington Street Cemetery Fund the sum of $400 to be used for the purchase of a suitable lawn mower for the Ceme- tery," was made, seconded and unanimously voted.


Article 34. Ernest Haskins made the following motion: "I move that the Town vote to establish a Regional Vocational School District Planning Committee to consist of three members, including one from the School Committee, to be appointed by the Moderator and to raise and appropriate the sum of $500 for

the expenses, of this Committee. This motion was seconded and voted by voice vote.


Article 35. A motion was made, seconded and unanimously voted that "The Town appropriate the 1958 Dog Tax Refund to the School Department Operation Account."


Article 36. Instructions to Elected Town Officers. Mr. Whittemore proposed the following resolution, which failed to be voted: "Be it resolved that: (1) It is the sense of this Town Meeting that Articles in Town Warrants for change in the zoning By-Laws ought always to be accompanied by ex- planatory documents of such a nature that a layman of ordinary intelligence can understand from them the substance of what is proposed in said articles without the assistance of surveyors or lawyers, and without the need of attending hearings or meetings;


(2) And that such documents ought either to be distributed to all the voters of the town prior to the meeting at which such articles are to be acted on, or else should be available at the Town offices for distribution to all voters who ask for them;


(3) And further that it is desirable that the Town possess a large map or maps of the Town of Norwell of such size as to be clearly legible from the rear of the Town-meeting room when placed on the stage thereof, and that such maps should be of such a nature that temporary marks, legible from the rear of said room, can be made upon them for the purpose of facilitating discussion of articles in such warrants.


(4) And further, that the Selectmen should consider the advisability of including in some future Town-Meeting warrant an article providing for the raising and appropriating of a sum of money for the procurement of such maps, and the preparation of such documents as are referred to in this resolution."


Ralph Coleman made the following motion: "I move to in- struct the Selectmen to register the opposition of the Town of Norwell to any further subsidies for the Old Colony Branch of the New York, New Haven and Hartford Railroad, with the appropriate legislative representatives from this area." This motion was seconded and voted by voice vote.


SALE OF FISH RIGHTS


Two Fish Rights were auctioned by the Moderator. Fish Right No. 1 - sold to Richard Burbank for $4.00. Fish Right No. 2 - sold to James Barron for $4.00.


The business of the Warrant being finished, a motion to adjourn was made, seconded, and voted at 9:05 p.m.
