WARRANT For Annual Town Meeting, Monday March 2, 1959 at seven-thirty o'clock in the afternoon At Cushing Memorial Hall and Saturday, March 7, 1959 at 12 Noon At the Center Elementary School For the Election of Town Officials

To either of the Constables of the Town of Norwell, in said County of Plymouth and Commonwealth of Massachusetts.
GREETINGS:
In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of the Town of Norwell, qualified to vote in elections and Town affairs to meet at the Cushing Memorial Town Hall in said Norwell, on Monday, the second day of March 1959 at 7:30 p.m., then and there to act upon the following articles, to wit:
Article 1. To see if the Town will accept the reports of its officers and committees as printed in the Town Report, or act on anything relative thereto.
Article 2. To see what sums the Town will raise and ap- propriate or appropriate from available funds to pay Town debts, expenses and charges including debt and interest for the ensuing year and to fix the salary and compensation of all elective officers of the Town, effective from January 1, 1959, as provided by Section 108 of Chapter 41 of the General Laws, as amended, and to provide for a reserve fund, and raise and appropriate the same for the following: Moderator, Selectmen's Department, Town Accountant, Treasurer, Tax Title Account, Town Collector, Assessors' Department, Town Counsel, Town Clerk, Out-Of-State Travel, Registration and Listing, Town Meetings and Elections, Board of Appeals, Planning Board. Town Hall and Annex, Police Department, Dog Officer, Forest Fire Patrol, Fire Department, Civil Defense, Sealer of Weights and Measures, Tree Warden and Moth Superintendent. Moth Department, Dutch Elm Disease, Elm Tree Beetle, Tent Caterpillar, Tree Maintenance, Squares and Triangles, Mowing Bushes, Board of Health, Inspector of Animals, School Nurse, School Dentist, Dental Hygienist, School

Physician, Town Dump, Mosquito Control, Highway Surveyor, Highways-Town Account, Chapter 81, Chapter 90, Signs and Road Markings, Snow Removal and Sanding, Street Lights, Wel- fare, Public Welfare, Old Age Assistance, Aid to Dependent Children, Disability Assistance, Veterans' Benefits, School De- partment, Out-Of-State Travel, Vocational Training, Practical Arts - Adults, Libraries, Water Department, Cemeteries, Ma- turing Debt and Interest, Anticipation of Revenue Loans, Aid to Agriculture, Workmen's Compensation, Plymouth County Re- tirement Fund, Reserve Fund, Town Reports and Budgets, Memorial Day, and Recreation Commission, or act on anything relative thereto.
Article 3. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1960, and to issue a note or notes therefor, payable within one year in accordance with General Laws, Chapter 44, Section 4, as amended, and to renew any note or notes as may be given for less than one year in accordance with General Laws 44, Section 17, as amended, or act on anything relative thereto.
Article 4. To see if the Town will vote to appropriate the sum of $13,750, or any other sum from available funds in anticipation of repayment by the Commonwealth of Massachu- setts for Chapter 81 work on the Highways, or act on anything relative thereto.
Article 5. To see if the Town will vote to appropriate the sum of $12,000, or any other sum, from available funds in antic- ipation of repayment by the Commonwealth of Massachusetts and the County of Plymouth, for Chapter 90 work on East Main Street, or act on anything relative thereto.
Article 6. To see if the Town will vote to appropriate the sum of $11,250, or any other sum, from available funds in anticipation of repayment by the Commonwealth of Massachu- setts and the County of Plymouth, for Chapter 90 work on West Main Street, or act on anything relative thereto.
Article 7. To see if the Town will vote to raise and ap- propriate the sum of $3,000 or any other sum for drainage in Washington Park, or act on anything relative thereto.

Article 8. To see if the Town will vote to raise and appropriate the sum of $2,000 for the purchase of a half-ton pickup truck, or act on anything relative thereto.

Article 9. To see if the Town will vote to amend its By- Laws by adding the following article:
Article XIII
Each employee, other than those employed by the School Committee who has worked for the Town a minimum aggregate of 800 hours in the preceding twelve months shall be entitled to one week paid vacation, and each employee who has worked for the Town for 1600 hours in the preceding twelve months shall be entitled to two weeks paid vacation. Such vacations shall be granted by the heads of the respective departments at such times as, in their opinions, will cause the least interference with the performance of the regular work of the Town.
Article 10. To see if the Town will vote to accept a portion of Brantwood Road as a Town way, as laid out by the Selectmen in accordance with the description and plan presented at a hear- ing in the Cushing Memorial Town Hall and now on file at the Town Clerk's office, or act on anything relative thereto.
Article 11. To see if the Town will vote to accept a portion of Myers Avenue as a Town way, as laid out by the Selectmen in accordance with the description and plan presented at a hear- ing in the Cushing Memorial Town Hall and now on file at the Town Clerk's office, or act on anything relative thereto.
Article 12. To see if the Town will vote to accept a portion of Walnut Road as a Town way, as laid out by the Selectmen in accordance with the description and plan presented at a hearing in the Cushing Memorial Town Hall and now on file at the Town Clerk's office and raise and appropriate the sum of $1,300 for resurfacing under the provisions of Chapter 80 of the General Laws, or act on anything relative thereto.
Article 13. To see if the Town will vote to raise and ap- propriate, or appropriate from available funds the sum of $60,000, or any other sum, to be expended under direction of the High School Planning and Building Committee, appointed pur- suant to Article Six of the Special Town Meeting of January 13, 1958, for the purpose of obtaining final plans and specifications for the construction of a senior high school building, or act on anything relative thereto.

Article 14. To see if the Town will vote to determine the site for the construction of a senior high school building, and to authorize the High School Planning and Building Committee, appointed pursuant to Article Six of the Special Town Meeting of January 13, 1958, to acquire, in the name of the Town of Norwell, for part of said site, the following parcels of land; said acquisition to be as to each of said parcels either by purchase or by taking by eminent domain in the discretion of said Com- mittee, viz :-
a. 4 acres known as the Murphy land
b. 9 acres known as the DeStefano land,
both parcels lying on and off the southerly side of Main Street, and abutting lands of the present high school site, and being fully shown on a surveyor's drawing on file with the Board of Selectmen; and to appropriate the sum of $14,000 or any other sum for said purposes and determine the extent to which said money shall be provided for by taxation or by appropriation from available funds in the Treasury, or act on anything relative thereto.
Article 15. To see if the Town will vote to authorize the Selectmen to sell at public or private sale, at their discretion, a parcel of land with the buildings thereon, on the east side of High Street, Norwell, as more fully described in a deed from Arthur H. and Grace A. Sprague, to the Town of Norwell, dated November 21, 1947, and recorded with the Plymouth Registry of Deeds, Book 1970, Page 600, and to execute any and all documents necessary to effectuate said sale, or act on anything relative thereto.
Article 16. To see if the Town will vote to raise and ap- propriate the sum of $800 or any other sum for the development of Hatch Pond for recreational purposes, or act on anything relative thereto.
Requested by the Recreation Commission.
Article 17. To see if the Town will vote to raise and appropriate the sum of $35,000 or some other sum to enable the Board of Assessors, by employing outside valuation consultants, to provide equitable valuation of real and personal property, and to cause to be installed an assessment system, and in the name of the Town to request the State Tax Commission to accept the system pursuant to the provisions of General Laws (Ter. Ed.), Chapter 58, Sections 7A and 7D, (added by Acts of 1955, Chapter 649), or act on anything relative thereto.

Article 18. To see if the Town will vote to raise and ap- propriate the sum of $10,000, or some other sum, for the purpose that the Board of Assessors shall provide the Town with adequate records which will be acceptable to the State authorities. under Chapter 58, Section 7A to 7E inclusive, and to provide equitable valuation of real and personal property or act on anything relative thereto.
Article 19. To see if the Town will vote, pursuant to the provisions of General Laws (Ter. Ed.) Chapter 58, Section 7A (added by Acts of 1955, Chapter 649) to petition the State Tax Commission for the installment of an assessment system, or act on anything relative thereto.
Article 20. To see if the Town will vote to appropriate the sum of $43,000 to install water mains of not less than six inches, but less than sixteen inches in diameter in River Street from a point at the end of the existing main near the junction of Green and River Streets to the junction of Tiffany Road and River Street, and to meet such appropriation by raising and appro- priating from the tax levy of 1959, or by appropriating from available funds in the Treasury, or act on anything relative thereto.
Article 21. To see if the Town will vote to appropriate the sum of $27,000 or any other sum, for the purpose of laying water mains of not less than six inches, but less than sixteen inches in diameter in River Street, from a point at the end of the existing main near the junction of Green and River Streets, to a point approximately one-half of the way to the junction of Tiffany Road and River Street, and to meet such appropriation by raising and appropriating from the tax levy of 1959 or by appropriating from available funds in the Treasury, or act on anything relative thereto.
Article 22. To see if the Town will vote to appropriate the sum of $2,000, said sum to be added to the Developing Well or Well Fields Account and to be spent to conduct quantity tests on potential well or water source sites, and to meet such appropria- tion by raising and appropriating from the tax levy of 1959 the sum of $2,000, or any other sum, or by appropriating from available funds in the Treasury, or act on anything relative thereto.
Article 23. To see if the Town will vote to raise and appropriate the sum of $1,550 or any other sum to provide new transportation for the Chief of Police, or act on anything relative thereto.

Article 24. To see if the Town will vote to amend Section III of the Zoning By-Laws by the following changes, or act on anything relative thereto.
By inserting before the description of Residential District A the following sentence: All districts are shown on "Zoning Map of Norwell-1959" which is filed in The Town Clerk's office and is made a part hereof; by striking out everything below the caption Business District B and substituting therefor the following:
Business District B shall include all the land shown as B1 - B2- B3- B4- B5- B6-B7-B8 - on map entitled "Zoning Map of Norwell - 1959" and described as follows:
B1 - Starting at the southwesterly way line of Washington Street at the Hanover-Norwell town line, thence northwesterly by the southwesterly way line of Washington Street to the southeasterly lot line of the Washington Street Cemetery, thence southwesterly in the southeasterly lot line of the Washington Street Cemetery and thence on the same course to the Hanover- Norwell town line, thence easterly by the Hanover-Norwell town line to the point of beginning.
B2 - Starting at a point in the southwesterly way line of Washington Street at *Station 69 + 45, thence southwesterly to a point 500 feet southwesterly from the southwesterly way line of Washington Street measured at a right angle therefrom, thence northwesterly in a line 500 feet southwesterly from the south- westerly way line of Washington Street and parallel thereto to a point 500 feet southwesterly from the southwesterly way line of Washington Street at *Station 40 + 55 measured at a right angle therefrom, thence northeasterly to the southwesterly way line of Washington Street at *Station 40 + 55, thence south- easterly by the southwesterly way line of Washington Street to the point of beginning.
B3 - Starting at the intersection of the northerly way line of Oak Street and the southwesterly way line of Washington Street, thence westerly by the northerly way line of Oak Street to a point 300 feet westerly from the southwesterly way line of Washington Street measured at right angles therefrom, thence northwesterly by a line 300 feet from the southwesterly way line of Washington Street and parallel thereto to the easterly way line of High Street, thence by the easterly way line of High Street to the southwesterly way line of Washington Street, thence by the southwesterly way line of Washington Street to the point of beginning.

Article 25. To see if the Town will vote to amend the Zoning-By-Law by striking out Section VII and substituting the following, or act on anything relative thereto.
Section VII
Area and Frontage, Setback, and Off-Street Parking Regu- lations.
A. Lot Sizes for Dwellings
Definition: In subsection 1 and 2, except in "c" thereof, the word frontage shall mean frontage on a public way or on a way approved by the Planning Board.
1. The minimum lot size on which a dwelling may be erected or placed or on which any other structure may be altered for dwelling purposes shall be:
a. Residential District A. - One acre with a frontage of 150 feet or more, or two acres with 40 feet or more frontage.
b. Residential District B. - One-half acre with a frontage of 125 feet or more, or one acre with 40 feet or more frontage.
c. Residential District C. - 8,000 square feet with a frontage of 100 feet or more on a public way or private way, or, with respect to a lot described in a deed recorded in Plym- outh Registry of Deeds prior to April 10, 1952, 4,000 square feet with frontage of 50 feet or more on a public way or private way.

d. Business District A and B. - One-half acre with frontage of 125 feet, or more, or one acre with 40 feet or more frontage.
PROVIDED the lot shall not be already occupied by a dwelling or other buildings except outbuildings commonly associated with dwellings.
2. Nothing in the foregoing subsection, however, shall pro- hibit the erection or placement of additional dwellings, or the alteration of additional buildings for dwelling pur- poses, on a lot the size of which is sufficient to allow:
a. Residential District A. - One acre for each dwelling on a lot with a frontage of 150 feet or more, or two acres for each dwelling on a lot with 40 feet or more frontage.
b. Residential District B. - One-half acre for each dwelling on a lot with frontage of 125 feet or more, or one acre for each dwelling on a lot with 40 feet or more frontage.
c. Residential District C. - 8,000 square feet for each dwelling on a lot with a frontage of 100 feet or more on a public or private way, or, with respect to a lot described in a deed recorded in Plymouth Registry of Deeds prior to April 10, 1952, 4,000 square feet for each dwelling on a lot with frontage of 50 feet or more on a public or private way.
d. Business District A and B. - One-half acre for each dwell- ing on a lot with frontage of 125 feet or more, or one acre for each dwelling on a lot with 40 feet or more frontage.
3. With respect to lots not exempted from the application of the By-Law by G. L. (Ter. Ed. ) Ch. 40, Sec. 5A (added by Acts of 1958. Ch 492), the Board of Appeals shall per- mit the erection of a dwelling on a lot having a lesser area or frontage than required herein, provided that said lot was described in a deed recorded prior to the Town Meeting vote adopting such requirement or requirements and was then held in ownership separate from that of adjoining land, and further provide that such erection shall not substantially change the character of the neighborhood.
4. No lot on which a dwelling is located shall be reduced in frontage or area so that it does not conform to the provi- sions of this By-Law, except in the case of a lot a portion of which is taken for public use.

B. Setbacks
1. From Public Ways in All Residential Districts.
No building shall be erected or placed within 35 feet of the way line of any public way, except that no building need be set back more than average setback of the build- ings on the lots on either side, a vacant lot to be counted as if occupied by a dwelling set back 35 feet.
2. From Side or Back Lot Lines in Residential Districts.
a. Residential Districts A and B. - No building shall be erected or placed within 20 feet of a side or back line except that with respect to the buildings existing at the effective date of this provision, additions thereto may be erected or placed within 20 feet but not within 10 feet of a side line.
b. Residential District C. - No building shall be erected or placed within 10 feet of a side or back line.
3. In Business Districts no building shall be erected, placed or added to within 50 feet of the way line.
4. In Business Districts no building shall be erected, placed or added to, less than 20 feet from the side line or less than 40 feet from the back line.
C. Off-Street Parking in Business Districts.
No building shall be erected, placed on the lot, or added to for business purposes, unless one space is provided for parking for each 150 square feet of floor space in such building, or in such addition.
Article 26. To see if the Town will vote to amend Section X of the Zoning By-Law by numbering the existing sentence 1, and by adding the following, or act on anything relative thereto:
2. Notice of Intention to Erect, Substantially Alter or Add to any building or Structure.
a. No person shall erect, substantially alter or add to any building or structure, and no person shall place any build- ing or structure on any land unless he, or his agent, shall have filed with the Board of Selectmen a notice of intent- ion to so erect, substantially alter, add or place.
b. Such notice of intention shall state the name and ad- dress of the person so erecting, substantially altering, adding or placing, the location where the work is to be

done and a description of the work to be done. A sketch of the lot on which the work is to be done shall be furnished with such notice if requested by the the Board of Selectmen.
c. No such erecting, substantially altering, adding or placing shall be commenced within forty-eight (48) hours of the filing of the notice of intention with the Selectmen, nor shall such erecting, substantially altering, adding or plac- ing be commenced more than sixty (60) days after such filing.
d. Whoever violates the provisions of this by-law shall be fined not less than five ($5.00) dollars nor more than twenty ($20.00) dollars.
Article 27. To see if the Town will vote to discharge the By-Laws Committee appointed pursuant to Article 23 of the 1958 Annual Town Meeting and to direct the Selectmen to ap- point a Committee of five members to study the Town By-Laws, excluding the Zoning By-Laws, and to prepare Articles for the next annual meeting incorporating its recommendations, and to report thereon at said meeting, the Selectmen to call the first meeting of said committee not later than June 1, 1959, at which time a Chairman and Clerk shall be elected by said committee, or act on anything relative thereto.

Article 28. To see if the Town will vote to discharge the present drainage committee and to establish a Permanent Drainage Committee of five members to be appointed by the Selectmen for the purpose of planning a long-term drainage program, after thorough consultation with the Selectmen and the Highway Surveyor, vacancies on the committee to be filled bv a joint meeting of the Selectmen and the remaining members of the committee, the first meeting of the Committee to be called by the Selectmen not later than June 1, 1959, at which time said Committee shall elect a Chairman and a Clerk, or act on anything relative thereto.

Article 29. To see if the Town will vote to authorize the Town Accountant to close out the unexpended balances of the following appropriations, the purpose of which have been com- pleted, or act on anything relative thereto.
