An amendment to the amendment was moved and seconded that the following should be inserted between the word "town" and "not" in the amended article "except that an individual home owner may remove up to 5 cu. yd. for the purpose of landscaping his own property." Adjourned Town Meeting March 28, 1955


Meeting called to order at 8:15 by the Moderator. It became necessary to blow fire siren and contact voters by telephone to get a quorum. There were 210 present to open the meeting. (Quorum 200.) Non-voters were admitted to the left balcony. The Moderator appointed Donald C. Wilder, James Cavanagh, Frank W. Rounds, Jr., and Harry L. Chase, Jr., to act as tellers and swore them to the faithful performance of their duties.


Article 34. Motion made and seconded to amend the present Zoning By-Law by striking out the present Section III and insert- ing the following:


SECTION III Establishment of Districts


The Town is hereby divided into five classes of Districts:


*Residential District A, B, C Business District A, B


The Residential District A shall include all the land, except Business District A, east of a line starting at the Norwell-Hanover town line marker on Main Street at Jacobs Lake and running northerly to a point on Grove Street 1000 feet West of the westerly way line of Prospect Street, thence running northerly to a point on the Norwell-Hingham town line 1000 feet west of the westerly way line of Prospect Street.


Residential District B shall include all the land, except Resi- dential District C and Business District B, west of a line starting at the Norwell-Hanover town line marker on Main Street at Jacobs Lake and running northerly to a point on Grove Street 1000 feet west of the westerly way line of Prospect Street, thence running northerly to a point on the Norwell-Hingham town line 1000 feet west of the westerly way line of Prospect Street.


Residential District C shall include all the land as shown on plan of Jacobs Lake Shores, Ernest W. Branch, Inc. Civil Engineer, and dated March 11, 1939, and recorded in Plymouth Registry of Deeds, described as follows:


Starting at the northeasterly way line of Washington Street at the southeasterly way line of Jacobs Trail, thence running northerly by Jacobs Trail and land formerly of J. E. Anderson to lot No. 61 as shown on said plan, thence southeasterly by land of said Anderson 165.45 feet, more or less, to a corner, thence turn-

ing and running northeasterly by land of Thomas Leavitt to Jacobs Lake, thence turning and running by the shore line in a northwesterly direction to land of Henry Hayward as shown on said plan, thence turning southwesterly by said Hayward land to lot No. 134 as shown on said plan, thence turning northwesterly by said Hayward land to Douglas Avenue as shown on said plan, thence turning northeasterly still by Hayward land to the shore line of Jacobs' Lake, thence by an irregular line of the pond in a northwesterly direction to lot No. 193, as shown on said plan, thence running by lot No. 193 and Jacobs Lake in a northwesterly direction to land formerly of Hegan, thence turning southwesterly by said Hegan land to a point at junction of land formerly of Thomas Monk, thence turning southeasterly by said Monk land to Duncan Drive as shown on said plan, thence southerly by land of said Monk to intersection of land of Edward Farmer (at junction of Duncan Drive and Doris Avenue) thence easterly by said Farmer land to lot No. 20 as shown on said plan, thence southerly by said Farmer land to Washington Street; thence by Washington Street easterly and southeasterly to point of beginning.


Business District A


Business District A shall include all land within the follow- ing boundaries:


Beginning at the intersection of the easterly way line of River Street and the northwesterly way line of Dover Street, due east to a point 300 feet from the southeasterly way line of Dover Street, thence parallel to the southeasterly way line of Dover Street and 300 feet therefrom to a point due south of the inter- section of the northerly way line of Dover Street and the south- erly way line of Main Street; thence due north to a point 300 feet from the northerly way line of Main Street; thence westerly parallel to the northerly way line of Main Street and 300 feet therefrom to Central Street; thence southerly along the easterly way lines of Central and River Street to the point of beginning.


Business District B


The Business District B shall include all the land bounded and described as follows:


"starting on the Norwell-Hingham town line to a point 300 feet westerly of the westerly way line of Washington Street, thence southerly parallel to and 300 feet west of the westerly way line of Washington Street to the Norwell-Hanover town line, thence on said line easterly to a point 300 feet east of the easterly way line of Washington Street, thence northerly, parallel to and 300 feet east of the easterly way line of Washington Street to the Norwell-Hingham town line, thence on said line to the point of

beginning, except that portion of Residential District C as shall come within such lines."


To amend the present Section VII by striking out sub-sections A1 and A2 and inserting the following:


A. Residential Lot Sizes.


1. The minimum lot size on which a dwelling may be erected or placed or on which any other structure may be altered for dwelling purposes shall be:


a. Residential District A. One acre with a frontage of 150 feet or more on a Public Way, or on a Way approved by the Planning Board, or two acres without such frontage.


b. Residential District B. One-half acre with a frontage of 125 feet or more on a Public Way or on a Way approved by the Planning Board, or one acre without such frontage.


c. Residential District C. 8000 square feet with frontage of 100 feet or more on a Public Way or Private Way or, with respect to a lot described in a deed recorded in Plymouth Registry of Deeds prior to April 10, 1952, 4000 square feet with frontage of 50 feet or more on a Public or Private Way.


d. Business Districts A and B. One-half acre with a frontage of 125 feet or more on a Public Way or a Way approved by the Planning Board or one acre without such frontage.


provided the lot shall not be already occupied by a dwelling or other buildings except outbuildings commonly associated with dwellings.


2. Nothing in the foregoing paragraph, however, shall prohibit the erection or placement of additional dwellings, or the alter- ation of additional buildings for dwelling purposes on a lot the size of which is sufficient to allow:


a. Residential District A - One acre for each dwelling on a lot with a frontage of 150 feet or more on a Public Way, or on a Way approved by the Planning Board, or two acres for each dwelling on a lot without such frontage.


b. Residential District B - One-half acre for each dwelling on a lot with a frontage of 125 feet or more on a Public Way, or on a Way approved by the Planning Board, or one acre for each dwelling on a lot without such frontage.


c. Residential District C - 8000 square feet for each dwelling with frontage of 100 feet or more on a Public or Private Wav, or with respect to a lot described in a deed recorded in Plymouth Registry of Deeds prior to April 10, 1952, 4000 square feet for each dwelling with frontage of 50 feet or more on a Public or Private Way.

d. Business Districts A and B - One-half acre for each dwell- ing on a lot with a frontage of 125 feet or more on a Public Way, or on a Way approved by the Planning Board, or one acre for each dwelling on a lot without such frontage.


To further amend Section VII by striking out present sub- sections B-2, B-3 and B-4 and inserting the following:

2. From Side or Back Lot Lines in the Residential Districts


a. Residential Districts A and B - No building in the Resi- dential Districts A and B shall be erected or placed within 20 feet of a side or back line except that with respect to buildings existing at the effective date of this provision, additions thereto may be erected or placed within 20 feet but not within 10 feet of a side line.


b. Residential District C - No building in Residential District C shall be erected or placed within 10 feet of a side or back line.


3. From Side or Back Lot Lines in Business Districts No building used as a dwelling shall be erected or placed within 20 feet of a side or back line except additions to dwell- ings existing at the effective date of this provision, may be erected or placed within 20 feet but not within 10 feet of a side line.


All provisions of the present Zoning By-Law shall remain in effect until such time as the proposed changes are approved by the Attorney General, duly advertised and become effective.


Motion made and seconded that the motion be postponed indefinitely. Motion defeated.


Motion made and seconded that main motion be amended by striking out the following "or on a way approved by the Planning Board in 1a, 1b, 1d, 2a, 2b, 2d." Amendment failed to carry.


Question of a quorum raised. Voters counted, there were 215 present.


Main motion then voted, (see *) 140 for, 43 against.


Article 35. Motion made, seconded and voted to appropriate the 1954 Dog Tax Refund of $799.06 to the School Account.


Article 36. Motion made and seconded to raise and appro- priate the sum of $150.00 for expenses of the Regional School Dis- trict Planning Committee. This motion failed to pass.


Article 37. Motion made, seconded and unanimously voted "to thank the Union Athletic Association of Norwell Inc. for the gift of the land known as Ridge Hill Grove, and direct the Select- men to convey this vote of thanks to that Association."

Article 38. Motion made, seconded and voted to transfer the sum of $4,000 from Available Funds in the treasury to be spent under the direction of the School Committee, to install gutters, drains, and similar equipment on the old section of the High School building.


Article 39. Motion made, seconded and voted 143 for, 46 against, to raise and appropriate the sum of $400 for salaries and expenses of conducting Evening Practical Arts classes for Adults at the High School.


Article 40. A motion was made and seconded, but failed to carry, to transfer from Available Funds in the treasury, the sum of $4,000 for the hard surfacing and drainage of the High School parking lot and road leading to it from the street.


Article 41. Sale of Fish Rights.


The Moderator auctioned two fish rights. Edward J. Mahoney purchased Fish Right #1 for $3.50. Paul F. Bailey purchased Fish Right #2 for $5.10. The business of the Warrant being com- pleted, a Motion was made, seconded and unanimously voted to adjourn at 10:05 p.m.

Warrant for Special Town Meeting Monday, September 12, 1955 at seven thirty o'clock in the afternoon at Cushing Memorial Town Hall


Plymouth, ss.


To either of the Constables of the Town of Norwell, in said County of Plymouth and Commonwealth of Massachusetts. GREETINGS:


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of the Town of Norwell, qualified to vote in elections and Town affairs, to meet at the Cushing Memorial Town Hall in said Norwell, on Monday, the twelfth day of September, 1955, at 7:30 p.m., then and there to act upon the following articles, to wit:


Article 1. To see if the Town of Norwell will vote to accept a legacy given it by one Fred B. Clapp, late of Somerville, Massa- chusetts, under the terms of his will (see Middlesex Probate Case No. 319896) which reads as follows:


"Sixth. To the Town of Norwell, Massachusetts, I give and bequeath the sum of One Thousand Dollars ($1,000.), the income to be paid over annually to the Trustees of the Pinehurst Ceme- tery at Church Hill to be used by them annually for the general care and upkeep of said cemetery."


and will further vote that its Treasurer, Margaret Crowell, accept on its behalf said sum of One Thousand Dollars ($1,000.) upon the terms as set forth in Fred B. Clapp's Will and release the executrix of his estate from all claims the Town might have against the estate of said Fred B. Clapp, or act on anything rela- tive thereto.


Article 2. To see if the Town will vote to authorize the Town Accountant to close out the unexpended balances of the following appropriations, the purposes of which have been com- pleted, or act on anything relative thereto.

Article 3. To see if the Town will vote to appropriate the sum of $450,000., or some other sum or sums of money for the purpose of constructing and originally equipping and furnishing an elementary school building on the site owned by the Town of Norwell known as Ridge Hill Grove; and to meet said appropri- ation by appropriating the sum of $100,000., or some other sum or sums of money, from available funds in the Treasury, by author- izing the Treasurer, with the approval of the Selectmen, to bor- row for and on behalf of the Town of Norwell the sum of $200,000., or some other sum or sums of money under the pro- visions of Chapter 44 of the General Laws and/or the sum of $150,000., or some other sum or sums of money, under the pro- visions of Chapter 645 of the acts of 1948, as amended, and to issue bonds or notes of the Town therefor payable in accordance with the provisions of Chapter 44 of the General Laws and/or Chapter 645 of the Acts of 1948, as amended, so that the entire amount borrowed shall be paid in not more than twenty years from the date of the issue of the first bond or note, or act on any- thing relative thereto.


Article 4. To see if the Town will vote that the School Building Committee appointed pursuant to the vote of the Town at the 1952 Annual Town Meeting be authorized to execute and deliver for and on behalf of the Town all contracts and agree- ments it shall consider necessary to construct, originally equip, and furnish an elementary school building at the site owned by the Town of Norwell and known as Ridge Hill Grove, or act on anything relative thereto.


Article 5. To see if the Town will vote to accept Section 97 of Chapter 41 of the General Laws, which authorizes the estab- lishment of a Police Department under the direction of the Selectmen, or act on anything relative thereto.


Article 6. To see if the Town will vote to appropriate from available funds, the sum of $1,000., or some other sum or sums of money, for three months salary of a full time Chief of Police and the sum of $3,500., or some other sum or sums of money, to provide transportation for the Chief of Police, or act on anything relative thereto.


Article 7. To see if the Town will vote to instruct the Select- men to appoint five (5) persons as members of a Recreation Com- mission, such Commission to fill vacancies which might occur in its membership and to serve until further vote of the Town, said Commission to exercise all the powers conferred by Chapter 45, General Laws, including the right to acquire land and buildings within the Town by gift, or purchase, by lease, or eminent

domain, for the purposes of a public playground or recreation center, to conduct and promote recreation, play, sport, and physi- cal education, or act on anything relative thereto.


Article 8. To see if the Town will vote to amend the descrip- tion of Residential District A contained in Section III of the Zoning By-Law of the Town of Norwell, as amended, by adding thereto the following:


"and east of extensions thereof northerly and southerly," so that the description of Residential District A therein as amended shall read as follows:


"The Residential District A shall include all the land, except Business District A, east of a line starting at the Norwell- Hanover town line marker on Main Street at Jacob's Lake and running northerly to a point on Grove Street 1000 feet west of the westerly way line of Prospect Street, thence running north- erly to a point on the Norwell-Hingham town line 1000 feet west of the westerly way line of Prospect Street, and east of exten- sions thereof northerly and southerly."


Article 9. To see if the Town will vote to appropriate from available funds in the Treasury the sum of $2,625, or some other sum or sums of money, for drainage on Tiffany Road, or act on anything relative thereto .- Requested by the Highway Surveyor.


Article 10. To see if the Town will vote to appropriate from available funds in the Treasury the sum of $2,500., or some other sum or sums of money for the improvement of Old Meeting House Lane, under the provisions of Chapter 80 of the General Laws (Betterments Act), or act on anything relative thereto.


Article 11. To see if the Town will vote to authorize the Board of Selectmen to purchase group life insurance for permanent employees of the Town, as provided by Chapter 40 of the General Laws; and to appropriate from available funds in the Treasury the sum of $240., or some other sum or sums of money, for fifty per cent (50%) of 1955 premiums on such group life insurance, or act on anything relative thereto.


Article 12. To see if the Town will instruct the Selectmen to appoint a Building Committee of five members to bring in pre- liminary plans and recommendations at the next Annual Town Meeting for a combined Fire and Police Station to be located on the Town Field in Norwell Center, or on some other suitable location and to appropriate for the use of that Committee, from available funds, the sum of $1,000., or some other sum or sums of money, or act on anything relative thereto.
