Article 30. To see if the Town will vote to authorize the establishment of, and to originally equip and operate, an emergency communications center at the Town Hall under the direction of the Emergency Communications Board, composed of the Civil Defense Director, Chairman; the Police Chief and the Fire Chief, and to raise and appropriate the sum of $5,000, or some other sum, for this purpose or act on anything relative thereto.

Article 31. To see if the Town will vote to amend Article III of the By-Laws of the Town of Norwell by adding thereto the following:

WARRANT - ANNUAL TOWN MEETING


Article 32. To see if the Town will vote to annul Section 2 of Article VI of the By-Laws of the Town of Norwell by revoking, rescinding and removing said Section 2 and substitut- ing therefor the following: or act on anything relative thereto.


Section 2.


The voters of the Town of Norwell shall elect by ballot at the annual election of 1960 an Advisory Board of nine citizens, no one of whom shall during their respective terms of office, hold any other office, elective or appointive, in the Town of Norwell, and shall serve without pay, three for one year, three for two years, and three for three years, and each year thereafter, three for three years.

Article 35. To see if the Town will vote to appropriate the 1958 Dog Tax Refund to the School Department Operation Ac- count, or act on anything relative thereto.

And you are further directed to notify all legal voters to assemble at the Center Elementary School, Main Street, on Saturday, March 7, 1959, during the polling hours, then and there to act upon the following article:


Article 37. To bring to the Election Officers, their votes, all on one ballot, for the following named officers to wit: One Selectman for three years; one Assessor for three years; one member of the Public Welfare for three years; Town Collector for three years; Town Treasurer, Highway Surveyor, Moderator, and Tree Warden for one year; one member of the Board of Health, two members of the School Committee, one member of the Board of Water Commissioners for three years; one Trustee of the William J. Leonard Memorial Library for three years; one member of the Planning Board for five years and one member of the Planning Board for one year.


Article 38. To vote on the following referendum questions which may be decided only by inclusion on the ballot of the Annual Town Election:


"Shall the Town vote to accept the pertinent provisions of General Laws (Ter. Ed.) Chapter 31, Section 48, as amended, relating to the classified Civil Service with reference to the office of Chief of Police?"

ANNUAL TOWN MEETING March 2, 1959


The Annual Town Meeting was called to order at 7:30 p.m. by the Moderator, Herbert A. Lincoln, with a quorum present.


The call for the meeting was read by the Town Clerk after which it was moved, seconded, and voted to omit reading the articles or the return of the Warrant.


Article 1. Mr. Cann, Chairman of the Board of Selectmen, made a motion to accept the reports of the elected and ap- pointed officers and committees, as printed in the Town Report, which was seconded. Mr. Cann made explanation of some errors in the reports and then spoke on the subject of the Police De- partment and Civil Service. Chief Bradeen also explained Civil Service for his Department, and Article 1 was voted by a voice vote.


Article 2. Mr. Devine, Chairman of the Advisory Board, moved that all items from No. 1 through No. 37 in the transcript of the Warrant be raised and appropriated as appears in the recommended column.


A motion was made and seconded, but lost by a voice vote, to amend No. 26, 26A and 27 to read so that the recommended figure read as printed in the requested column. The original motion was seconded and voted:

Article 4. Motion made, seconded and voted to appropriate the sum of $13,750 from available funds in anticipation of re- payment by the Commonwealth of Massachusetts for Chapter 81 work on the Highways.


Article 5. Motion made, seconded and voted to appropriate the sum of $12,000 from available funds in anticipation of re- payment by the Commonwealth of Massachusetts and the County of Plymouth, for Chapter 90 work on East Main Street.


Article 6. Motion made, seconded and voted to appropriate the sum of $11,250 from available funds in anticipation of re- payment by the Commonwealth of Massachusetts and the County of Plymouth, for Chapter 90 work on West Main Street.


Article 7. Motion made and seconded and voted to raise and appropriate the sum of $300 for drainage in Washington Park.


Article 8. Motion made, seconded, but failed to pass, to raise and appropriate the sum of $2,000 for the purchase of a half-ton pickup truck.


Article 9. "Move that the Town vote to amend its By-Laws by adding the following article: Article XIII Each employee, other than those employed by the School Committee or the Board of Public Welfare who has worked for the Town a minimum aggregate of 800 hours in the preceding twelve months shall be entitled to one week paid vacation, and each employee who has worked for the Town for 1600 hours in the preceding twelve months shall be entitled to two weeks paid vacation. Such vacations shall be granted by the heads of the respective departments at such times as, in their opinions, will cause the least interference with the performance of the regular work of the Town. Vacation pay for hourly employees shall be computed on the basis of a forty-hour week. Vacation pay for salaried employees shall be at the current weekly salary."


A substitute motion to Article 9 was made as follows by John J. Piotti:


"Sec. 1. Annual leave with pay shall be granted to hourly rate employees (except employees of the school committee) who have completed 2080 hours or 52 weeks at 40 hours per week in 12 consecutive calendar months.


Sec. 2. 8 hours of credit shall be given employees each day who are absent due to illness, injury, temporary lay off, personal reasons, Town, State or National holidays.


Sec. 3. Leave with pay shall be at the rate of one (1) hour for each 20 hours of service, but not to exceed 104 hours or 13 days excluding Sat., Sundays and Holidays.

Sec. 4. Heads of department shall grant leave when desired by the employee, provided that an emergency does not exist when application for leave is requested.


Sec. 5. Whenever employees are absent charged to annual leave, and where possible the work should be so ar- ranged that it can be carried without the employment of additional assistance.


Sec. 6. This act shall be effective on its passage."


Motion was made, seconded and voted to place Article 9 on the table.


Article 10. Motion made, seconded and voted to accept a portion of Brantwood Road as a Town way, as laid out by the Selectmen in accordance with the description and plan presented at a hearing in the Cushing Memorial Town Hall and now on file at the Town Clerk's office.


Article 11. Motion made, seconded and voted to accept a portion of Myers Avenue as a Town way, as laid out by the Selectmen in accordance with the description and plan presented at a hearing in the Cushing Memorial Town Hall and now on file at the Town Clerk's office.


Article 12. Motion made, seconded and voted to accept a portion of Walnut Road as a Town way, as laid out by the Selectmen in accordance with the description and plan presented at a hearing in the Cushing Memorial Town Hall and now on file at the Town Clerk's office. Motion made, seconded and voted to raise and appropriate $900 under Chapter 80, and transfer $400 from Excess and Deficiency Fund.


Article 13. Moved, seconded and voted to indefinitely post- pone action on Article 13.


Article 14. Moved, seconded and voted to indefinitely post- pone action on Article 14.


Article 15. Motion made, seconded and voted to strike out words "or private" from article as printed. Motion made, second- ed and voted to authorize the Selectmen to sell at public sale, a parcel of land with the buildings thereon, on the east side of High Street, Norwell, as more fully described in a deed from Arthur H. and Grace A. Sprague, to the Town of Norwell, dated November 21, 1947, and recorded with the Plymouth Registry of Deeds, Book 1970, Page 600, and to execute any and all documents necessary to effectuate said sale.

ADJOURNED ANNUAL TOWN MEETING


March 9, 1959


Meeting opened at 7:50 p.m. by Moderator, Herbert A. Lincoln, with a quorum present. (275)


Article 17. The following motion was made by Clarke Atwater: "I move that the Town raise and appropriate the sum of $35,000 to enable the Board of Assessors, by employing outside valuation consultants to provide equitable valuation of real and personal property, and to cause to be installed an assessment system, and in the name of the Town to request the State Tax Commission to accept the system pursuant to the provisions of General Laws, Chapter 58, Sections 7A and 7D." He said the Assessors were not in favor. Mr. Allen spoke of need of re- assessment and stated the Assessors could do the job better for less money. Mr. Standish spoke in favor of outside appraisers to correct inequities - new properties get larger assessments - and offered amended article: "I move that the words "to expend from available funds" be substituted for the words "to raise and appropriate" in the first line of Article 17 as printed in the warrant." Mr. Barron asked for explanation from Assessors. Mr. Benner presented an amendment to take the place of the regular Article 17 as follows: "I move the following amendment be substituted for the main motion under Article 17. That a Committee of seven persons be appointed by the Selectmen for the following purposes:


To study the State laws regarding the assessment of real estate and personal property, and the requirements of the state in regard to Assessors maps, records and system of assessing; and to bring in a brief and concise written summary of the same, to be read at a town meeting.


To study the present assessing records, system, and maps of our town.

To study the procedures of such other towns as they deem necessary to properly evaluate our present methods of assess- ment and records of same.


To bring in a report and recommendations relative to the present and future needs of the town in these matters, and to present alternative programs that are acceptable to the State and practical for our Town.


That the Committee consist only of appointees who are willing and able to devote their time free of charge to the town for this service.


That the town raise and appropriate the sum of $500 for the use of this committee.


That the report and recommendations be brought before a future town meeting, but no later than the next Annual Town Meeting.


That the committee consist of at least:


1 lawyer, practicing locally, and acquainted with town problems;


1 member of the Board of Assessors,


2 engineers who are Registered Land Surveyors,


1 man engaged in the Real Estate business."


This amendment was seconded, but failed to pass.


Orville Devine made motion to amend Article 17 by striking out that part reading "And to cause to be installed, etc." to the end of the article, and substitute "with adequate records which will be acceptable to the State authorities under Chapter 58. Section 7A to 7E inclusive." That is, "Move that the town vote to raise and appropriate the sum of $35,000 to enable the Board of Assessors, by employing outside valuation consultants, to pro- vide equitable valuation of real and personal property with adequate records which will be acceptable to the State authori- ties under Chapter 58. Sections 7A to 7E, inclusive." This amend- ed motion was seconded and voted.


Article 9. Article 9 was removed from the table. Mr. Piotti reviewed his article presented at March 2nd. 1959 meeting. Moved, Seconded but lost, 77 yes, 81 no. Robert Kroeger offered the following substitute motion which was accepted, seconded and voted by voice vote: "Each employee other than those em- ployed by the School Committee and Board of Public Welfare,

who has worked for the town six months prior to June 1, of any calendar year shall be entitled to one week's paid vacation and each employee who has worked for the town 12 months or longer prior to June 1, of any calendar year shall be entitled to two weeks vacation with pay. The amount of vacation pay shall be equal to the average weekly earnings of the employee during the preceding 6 or 12 month period, whichever is effective in determining the vacation period. Such vacations to be taken during the period June 1 - Dec. 31 of the respective calendar year and in no instance shall vacation time be accumulative.


Article 18. Motion made, seconded and voted to indefinitely postpone action on Article 18.


Article 19. Motion made, seconded and voted to indefinitely postpone action on Article 19.


Article 20. Lee Turner made a substitute motion which it was voted to accept. Motion made, seconded and "vote to ap- propriate the sum of $43,000 to install water mains of not less than six inches, but less than sixteen inches in diameter in River Street from a point at the end of the existing main near the junction of Green and River Streets to the junction of Tiffany Road and River Street, and to meet such appropriation by raising and appropriating from the tax levy of 1959, the sum of $25,000 and by appropriating from available funds in the Treasury the sum of $18,000."


The question of a quorum was raised and the tellers directed to count the voters. They reported 249 present.
